HomeMy WebLinkAbout10-20-19711- • Record of Official Proceedings of the - Common ' Council of the City of Rochester, Minn., October 20, 1971 207 1 0 1 1 • 1 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on October 20, 1971.1 President Postier called the meeting to order at 12:00 o'clock noon, the following members being present: President Postier, Aldermen Kamper, Larson, Mayer, Powers, Strain. Absent: Alderman McNary. The call of the special meeting was read and President Postier ordered the same placed on file, the said meeting having been called for the purpose of considering resolutions re installation of watermains to the Universal Ford property and Pennington property and any other business the Common Council may deem proper. Resolution instructing the City Engineer to prepare a feasibility report and and recommendation on the water main extension along the east side of T. H. 52 from 41st Street N. W. to Pennington Business Park (City Project 7106-J8409), referring it -to the Public Works Committee for consideration and recommendation and ordering a public hearing on same for 7:30 o'clock P. M. on November 1, 1971. A motion was made by Mayer, second by Larson, that the resolution be adopted. The purpose of the watermain extension is to provide city water to the Universal Ford building which is expected to be in operation by December 20, 1971, Pennington properties and Universal Ford have also submitted a.petition for annexation of their properties and the Committee of the whole has informally agreed that the sprinkler requirements be waived on the Universal Ford building for five years as a condition for annexation; Universal Ford and Pennington properties have also requested that the assessments for the watermain extension be spread against their property over a period of ten years. Alderman Strain inquired about the 10 year assessment on this, he said that the City ordinarily requires the developer to put up the money to do a project and wondered if we were setting a new policy here or has it been done in the past. C. A. Armstrong, City Engineer, said the City has not.spread the assessments for 10 years for subdivisions where the property owner or proprietor is developing a number of lots and selling them off to individuals and in those cases they are required to provide the money but in cases where, such as this which is a little bigger than some of the others we have done, but in cases such as this where there are more than one owner it is not unusual for the City to spread the assessment to the property especially when the property owner is going to retain the property rather than sell off a number of lots; this is in general keeping with our policy but it would not be unusual if you wanted to make it a shorter time than 10 years as has been done for some in the past, he said he did not think it made any difference to the City if it were spread over a period of 10 years or 5 years and the matter of the City financing this project is not in violation of our policy. Alderman K�amper inquired if this will affect the availability of water in Northwest Rochester, by putting this water line does it take possible development from someone else that might already be in the City. Mr. Armstrong said it will not detract, 20 Record of Official Proceedings of the -Common Council of the City of Rochester, Minn., October 20, 1971 however, it does mean that this is the first step toward the City building -another water • tower in this area, there is plenty of water to take care of these two tracts but as the - entire Pennington acreage develops the City is going to have to put'in a new m ter tower and they will be assessed for that or their share at the time it is constructed. Alderman Strain also inquired what type of annexation this would be and wa's-told that it would be an immediate annexation, the only thing that -could hold it up would be if the Township objected and then it would have to go to the Municipal Commission. The City Attorney said if for some reason the annexation is not completed,,the City has statutory authority to set up a schedule of charges for the availability of water and use of water outside the City; there won't be any assessments because we can't assess land outside the City; we can finance projects such as -this by those charges and the developer is aware of the possibility, although it may be remote that annexation will not result in which case we will have to for•the first time determine a hookup charge and establish a schedule for charges outside the City. President Postier then called for a vote on the motion•to-adopt the resolution and all present voting in favor, the resolution was duly -passed and adopted.
