Minutes of a regular meeting of the Common Council of the City of Rochester,
(Minnesota, held in the Council Chambers in the City Hall, in said City, on March 20;1972.
President Postier called the meeting to order at 7:30 P.M., the following
members being present: President Postier, Aldermen Kamper, Larson, Mayer, McNary, Powers,
IStrain. Absent: None.
Upon motion by Kamper, second by Powers, and all voting in favor, the minutes
lof the meetings of March 6th and 15th, 1972 were approved.
Hearing for sidewalk replacement projects for 1972 on an area between No.
Broadway and 2nd Avenue N. W. and 3rd St. N. W. to 13th St. N. W. Mr. Cecil Long of
17 12th St. N. W. wished to be heard and stated that it.wouldn't do any good to replace
the sidewalk at this time because the street is much higher, and the water from the 12th
street car wash.is running down into.the street and if the street was.replaced, it would
not last because of the water hazard, and also if the street were to be town up to put in
curb and gutter, they would have to replace the street. Mr: Armstrong, City Engineer stated
that no plans have been made to put in the curb and gutter, but if the people from the
neighborhood could get a petition•requesting a curb and•gutter,*he was sure that the Council
ld approve this. Wishing to be heard was Bob Riege of 115 loth St. N. E. and asked what
the City policy was on removing trees. He stated that an elm tree on the boulevard of a
piece of property on E 40 of Lot 26, Block 26 was upheaving the sidewalk and should be re-

assistance in removing the tree. He also was concerned about the S half of Lot 3, Block 21,

stated that it was the sidewalk. Also wishing to be heard was Mr. Bill Vanderberg of 32 10th
St. N. W. he said that his sidewalk did not have to be replaced, that he had called the
sidewalk inspector and he would be out to look at it, in the meantime he received a letter
that the whole block would have to be replaced, and was wondering why. He was informed by
President Postier that he would look into the matter and have Harold DeVries call him.

Hearing for Sidewalk Replacement Project # 2 on the Area between 2nd Avenue

Ction, many of whom are operating businesses in this area, and stated that the loss of

the improvement of the street did not add that much improvement to their business.
Also wishing to be heard was M.L. Blee of 1933 Second St. S. W. stated that his house was
worth any more today than years ago, all that goes up is the taxes, President Postier
stated that no one present could answer him on the assessment principles. A motion was
made by Larson and second by Strain to proceed with the assessments, all voted in favor.
Hearing for deferred assessments for improvements on Meadow Park 7th and 8th
Subdivisions. No one present wished to be heard. A motion by Strain and second by. Mayer
of approval of resolution, all voting aye.
Hearing on approval to change the Zoning District from R-1 District to B-3
District. Wishing to be heard was Harold Robertson, 437 Northern Heights Dr., who pre-
sented plans for a Roller Rink to be located on the East 254 Ft. of Lot 18, Allendale
Subdivision. A motion,:to instruct the City Attorney to prepare the ordinance making
the zone change with the recommendation of the Planning Commission was made by Kamper
and second by Powers, all voting aye, Strain Abstaining. President Postier was asked by
the petitioners if the Council so desired a first reading, a second reading could be done
and a roll call vote taken.' This would speed up construction on this project. It was
decided to wait and take this up further at the April 3, 1972 meeting, with the first
reading. '
Hearing on a petition to vacate the West one-half of Phelps Avenue S.W.
( Third Avenue S. W.) adjoining Lot 5, Block 2, Golden Hill Addition. Wishing to be
heard was Russell Boraas of 1309 3rd Avenue S.W., Attorney representing Lowell Campbell
owner of Lot 5 abutting this property. Mr. Campbell is in agreement with the vacating of
this lot for proposed parking for the Ramada Inn. A motion by Strain, subject to City
retaining an easement, second'by Powers and the City Attorney to prepare a resolution
vacating the street that can be adopted.
Upon motion by Strain and second by Powers, and all voting approval, the City
Attorney was authorized to prepare an Ordinance for adoption of the Proposed Amendments
Subdivision Ordinance.
1. In Paragraph 41.201 (3) delete the words " One reproducible linen " from
this section.
2. In Paragraph 41.112 delete the words " and current " from this section.
Upon motion by Kamper and second by Mayer and all voting approval, the City
Attorney was authorized to prepare an Ordinance making the change that can be adopted
on the Planning Commission Initiated Zoning Districting on Property known as Parkside
Trailer Park from the R-1 District to the R-3 District and Parkside Shopping Center and
Adjacent Property to the West from the R-1 to the B-lb District.
Upon motion by Strain and second by Powers, and all voting approval, a res-
olution was adopted on the Final Plat of replat of Lots 6,7,8,& 9 Block Indian Heights
Third Subdivision was accepted with a discussion on the cable that the telephone company
has in the existing utility easement of the south side of Lot 4. If the cable mentioned
should need repairs or be torn up, this might.be costly to the property owners.

Hearing on Sewer and Service connection on 16th Street S. W. Present wishing to
be heard was Gordon Gjelton'of'62b 16th Street S. W. requested information on the costs
of the assessments on the watermain that is in, and the sanitary sewer and the storm sewer
that is proposed to be stubbed into this property. The assessments would be deferred until
such time as they are annexed into the City.

For Water Tower $650.00 per acre
For Trunk Line Sewer $300.00 per acre
The estimated assessments for the proposed sanitary sewer and service connection
(stub -ins in 16th Street are:
For Sanitary Sewermain $9.50 per front foot
For Service Connection Stub -In $320-$350 each
The estimated cost of the proposed Sanitary Sewer and stubbed -in Service Connection
project is:
For Construction $25,742.
For Engineering and Expenses 5,148.'
TOTAL 30,890.
lso wishing to be heard was Louis Weiland of 414 16th Street S. W. and clairfied that the
cost of a watermain over 8" in diameter would be borne by the City.
A motion by Strain and second by Powers with all voting aye to prepare the resolution
to proceed with the project.
A.motion by Larson and second by Kamperi all.voting aye, to enter into a cooperative
agreement with the County regarding payment for this work was approved.
Upon motion by Larson and second by Mayer all voting approval, after a hearing had
been held, the Sanitary Sewer in Northern Hills Drive from Northern Hills First Subdivision
to 27th St. N. E. project was abandoned.
Darryl Lee of 801 15th St. N. W. appeared on behalf of the RADAR program and
ichard Wintersteen of 825 6th Avenue S. W. wished to be heard on RADAR particular to
the activities of the Awareness House. A motion by Larson and second by Kamper all
ting approval a Resolution of Sponsorship of the RADAR Program be adopted, City Attorney
to prepare the necessary papers.
Del Fisher of 1409 82 Avenue S. E. wished to be heard,On February 5, 1972 a letter
was sent to the Common Council City of Rochester and City Planning Department. On
February 28, 1972 we appeared before the City Planning. Discussions were held with the
Planning Department and parking behind the station, repair and repaint the fence, and maintain
the station in a clean and orderly manner. Upon leaving the meeting was in complete under-
standing on these expectations. Mr. Fisher did not know that this project was defeated, and
would at this time like to resubmit for approval the storing and renting of trucks at the
station. It was moved by Larson that the matter be brought up for reconsideration of the original
motion to deny this projeci. Second by Mayer. A motion by Mayer and second by Powers, all voting
approval of the recommendation by the Planning and Zoning Commission to (I)the screen fence to
the west be repaired and maintained in good condition at all times, and it be extended north
to the south line of 5th Street N. W. and south to the north line of 42 Street N. W. and

(2) no vehicles be parked in the required front yard that must be maintained along 42
Street N. W. and (3) a limitation of three trucks parked at this station and the rent-
al trailers.
Petition foi Ext. of Sewer and Watermains on the east frontage road of TH
52 to Lot 18, Allendale Subd. with the City Engineer to prepare a feasibility report
on this extension was approved upon motion by Strain and second by Kamper with all
voting aye.
Upon motion by Larson and second by Kamper the request for a Dance Permit
by the Rochester Fire Department for the annual Firemen's Ball to be held at the Mayo
Civic Auditorium, April 7, 1972 was approved.
Upon motion by Powers and second by McNary, all voting approval, to Execute
a Contract Lease for 1.6 acres of land, site is used for Aircraft Surveilance Radar by
Federal Aviation Administration.
Upon motion by Larson and second by Powers, all voting approval, the Final
Payment, Paving High Speed Turn -Off, Project ADAP 8-27-0084-01, State Project 5501-28
was accepted.
Upon'motion by Larson to accept the'On Sale Liquor and Sunday Liquor Licenses
and -Dance Licenses subject to the three listed with unpaid Utility bills, No Auditor,,' -
Certificate, or Treasurer report, and that these be paid within the proper time
(April 1). Second by McNary, all voting approval. Due to the pending litigation
on the Ramada Inn property, the Council indicated that they would approve Ramada Inn's
application'when it was submitted.

Resolution ordering hearings on Special Assessment and ordering Assessment roll for
Job 6107-Part 6A-71 (J8364) "Watermain together with. -:necessary easements

total construction and expense of this project is $3,016.42 with a total of
$2,997.90 to be assessed with the remaining $18.52 to be City Share of Expense

A motion was made by Larson and second by Kamper, and passed unanimously that the
(semi-monthly bills in the amount of $136,652.78, list.attached, be approved.

Resolution for plans and specifications prepared by C.A. Armstrong, City
Engineer for the installation of sewer service to serve -Lots 1,2,3, and 11 Northwood Thi
Addition, Project Plan 6012-3-72 on file in the office of the City Clerk and approved the
Mayor and City Clerk to authorize and direct to execute a contract with Fraser Company,
Inc. and Jorge E. Maldonado and Carmen B. Maldonado for the construction of said -improve-
ments. Upon motion by Larson and second by McNary, all voting approval - Strain voted

Resolution determining the traffic engineering and safety study of the railro
grade crossings in the City of Rochester and Wehreas it has been determined from said s
that the following crossings (1) North Broadway and the North tracks of the Chicago and
North Western Railway Company because of sight restriction on the Southwast, Southwest anc
Northeast corners. (2) Second St. N. E. and the Chicago and North Western Railway Company
because of substandard advance warning sign and insufficient warning of the crossing.
(3) Second Street S. E. and the Chicago and Northwestern Railway Company because of the
lack of advance warning signs and sight restriction on the Southwestern corner. (4) Eout"t
Avenue N. W. and the Chicago and North Western Railway Company because of substandard
advance warning signs, insufficient vehicle warnings and sight restrictions on the..,
Northeast and northwest corners. A motion by Strain and second by Larson, all voting
approval, resolution adopted.
Resolution requesting that the Commissioner of Highways restudy the traffic
speeds on 16th Street S. E. between 3rd and llth Avenue S. E. Elton Hills Drive N. W.
between T.H. 52-63 and 12th St. S. E. in the vacinity of Horace Mann School. A motion by
Strain and second by Mayer all voting approval to table this resolution.
Resolution authorizing the Mayor and City Clerk to enter into a contract
entitled Data Processing Joint Computer Services Agreement between the City of Rochester,
Rochester Utilities Department and Rochester School District No. 535 and the County of
Olmsted. Upon motion by Kamper and second by McNary, resolution adopted.
Resolution granting a variance to owners of 426 2nd Avenue S. W. to vary the
requirements concerning minimum lot area, maximum lot coverage, floor area ratio
and minimum side yards to permit use of existing structure for apartment purposes. Motion
by Larson and second by Mayer and all voting approval, a resolution was adopted.

West Olmsted County Minnesota, described as follows: Beginning at a point on the South
line of the Northwest Quarter of the Southeast Quarter of said Section 32, 881.1 feet

An Ordinance amending Ordinance No. 1489 Relating to the Annexation
to the City of Rochester, Minnesota of Certain Unplatted Land in Section 26, Township
107 North, Range 14 West, Olmsted County Minnesota for a point of beginning.: .
Thence north along the west line of said quarter section a distance of 660.0 feet, thence
east along a line parallel to the south line of said quarter section a distance of 1386.0
feet, thence south along a line that is parallel to the west line of said quarter section

that the said ordinance be adopted as read and all voting in favor, President Postier
declared the said ordinance duly passed and adopted.
Ordinance relating to Permits for Plumbing, Heating, Ventilating, and Air -
Conditioning Work and Imposing Penalties for Proceeding without a Permit; Amending
Rochester Code of Ordinances, Sections 77.520 as amended by Ordinance No. 1545, and
85.460 as amended by Ordinance. No. 1607 was given its first reading. It was moved by
Strain to suspend rules and give this a second reading, second by Kamper a roll call
vote with all voting in favor. It was then moved by Larson and second by Strain for
Adoption of this Ordinance.
Ordinance Annexing.to the City of Rochester Minnesota Certain Land in the West
Half of Section 7, Township 106 North, Range 13 West, Olmsted County Minnesota, and
Establishing the Zoning Therefor described as "follows:
Commencing for a place of beginning at the northwest corner of the southwest
quarter of the northwest quarter of Section 7, Township 106 North, Range 13 West, thence e

(formerly Old Marion Road), thence southeasterly along said centerline to its intersection

A motion was made by Strain and second by Larson accepting the low bid of Halvorson, Inc.
in the amount of $8,869.00 to furnish a sidewalk snowplow for the Street and Alley Department. This
is known as a Bombadier snowplow.
Upon motion by Larson and second by Powers, and all voting in favor, the meeting was; adjourned
until 2:00 P.M. April 3, 1972..
