President Postier called the meeting to order at 5:00 o'clock P. M., the following members being present: President Postier, Aldermen Kamper, Larson, Mayer, McNary,.Powers, Strain. Absent: None. The call of the special meeting was read and Postier ordered the same placed on file; the said meeting having been called for the purpose of considering giving the proposed new Zoning Ordinance its first reading and any other business the said Common Council may deem proper. Recommendation of City Administrator (1) that Richard Krier, City Long Range Planner be temporarily assigned to the Rochester -Olmsted Council of Governments for the purpose of assisting in the preparation of plans as.required by federal agencies. This assignment will be.for a period of one year, at that time, the assignment could be.re9evaluated for possible extension of time; Mr. Krier would retain his status as a city employee and subject to the same conditions of employment, the City will be reimbursed for up to two-thirds�of his salary from 701 planning grant funds. Upon motion by McNary, second by Kamper and all voting in favor, the recommendation was accepted and the assignment approved. (2) The reassignment of the Long -Range Planner would preclude or substantially limit the initiation of any major long-range planning studies; the City presently employes a planning intern on an equivalent half-time basis, funds specifically provided for this posi will be nearly expended by September,.at which time the present intern will leave and return f to school. It is recommended that this position be authorized to extend beyond September and until such time as the long-range planning function becomes stabilized with the ROCOG. The authorization would be the equivalent of a half-time position. Funds to finance this posit through December 31 would be available in the existing budget because of the reimbursement affect of Mr. Krier's salary. Funds for 1973 would have to be determined at budget time. Alderman Strain said he felt this would just be giving additional manpower and -did not feel it was necessary. Upon motion by McNary, second by Kamper, and all voting in favor, ekcept Alderman Strain who voted."nay", the recommendation was approved. (3) It is recommended that the City Administrator be instructed to study the methods by which the City and County.Planning Departments would be merged.into a single agency, providing the County Board officially concurs in said study.. The study would be completed in approximately six months, if not before. The basis of this recommendation is from the informal discussions by the City Council and County Board over the past several months, and said discussions have indicated a favorable disposition toward some form of consolidation. Upon motj.9n: by.-MeNary; ,: second,sby�'Kamper, and all voting in favor, the recommendation was approved and the City Administrator instructed to proceed. The ,Committee of the Whole recommends that the City Administrator be designated as the employer's representative in negotiating employee requests for wages, salaries and 9 342 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., May 30, 1972 u benefits, and he may further designate the Personnel Director and such other department and t division heads to assist in the negotiation process in whatever manner he ddems appropriate. He would not act.as.the employer's representative in negotiating requests of employees under the jruisdiction of the Public Utilities Board. Upon motion by Larson, second by Mayer, and all voting in favor, the recommendation was approved. On May 15th the Council, at its regular meeting, denied the application of Cyril Ryan to transfer the 3.2 beer license from,Mr. Putnam (Tap Room) to himself .(Ryan's Brown Derby) at the same location. Mr.. George Delaney, Attorney representing Mr.. Ryan, requested that the Council reconsider their action. He said Mr. Ryan had purchased the bar from Mr. Dean Day and had spent considerable money for the license and also for the equipment; he said he had understood that there had been trouble at this location but did not.think Mr. Ryan should be blamed for this as he was not the owner at the time, he said he felt.Mr. Ryan should be given a chance to see what he could do. Mr. Cyril Ryan and Mr. Dean Day were also each present. (The Council took no action so the action taken by the Council on May 15th to deny the transfer still stands.) The application of Mr. Jerome Jensen, President of Buy Rite Realty, Inc. requesting an exception from,the requirement in the Building Code for the handicapped for two (2).toilets on the main floor level of his new building under construction and at that meeting the Council had denied his request. A letter.from H. Meyer, State Building Inspector in St. Paul, Minnesota stating that.in his opi-hion that. if one toilet was.provided on the main floor fully equipped for the handicapped and one toilet in the basement level, that this would comply with the requirements of the law with reference.to eliminating architectural barriers for the handicapped, he said they would approve a variance in this instance and would recommend that the City of Rochester allow proceeding. A motion was made by Mayer, second by Powers, that the request be approved and the building have one toilet on the main floor fully equipped for the handicapped and one toilet in the basement level; all voted in favor thereof except Alderman Larson who "abstained". Upon motion by Larson, second by Mayer, and all voting in favor, a resolution was adopted that the City Administrator be authorized to file application for Federal Aid Grants a for Southeast Interceptor Sewer. Upon motion.by Larson, second by Strain, and all voting in favor, a resolution was adopted authorizing the City ,:Administrator to file application for Federal Assistance in constructing sewer facilities in DeWitt Addition and.Sewer and Water facilities in Maplelane and Allendale Subdivisions. Recommendation of Planning and Zoning Commission that the application for a temporary Use Permit to allow a portion of Olmsted County Fairgraounds to be used as a Travel Trailer Parking Area on June 1, 1972 be approved. Upon motion by Kamper, second by Strain, and all voting in favor, the recommendation was accepted and the permit granted. Rochester, Minn., May 30, 1972 343 1 C7 1 • granting a license to conduct an auction sale at the Holiday Inn Downton on June 1, 1972 was removed from the table. Mr. Irvin D. Lewis was present and said that he lived in Forest Lake, Minnesota, that he had been an auctioneer since 1953 and had Minnesota State Auctioneers License No. 1910; he said he was representing Gbbe Trade Exchange Company, Inc. and they were direct importers of fine oriental rugs, antiques, art objects, etc. It was noted that the necessary bond in the amount of $1,000.00 had not as yet been provided. A motion was made by Strain, second by Kamper, that the license be granted subject to receiving the bond and that the Minnesota State License of Mr. Lewis be checked out; all voted in favor. Upon motion by Mayer, second by Powers, the appointment of Mrs. Joe R. (Sue) Rodarte, of 4025 7th Place N. W. as the 3rd Ward representative to the Committee on Urban Environment to fill the unexpired term of Mrs. Harry L. Baldwin, this term expires September, 1973, was approved; all voted in favor. An Ordinance establishing a new Zoning Code for the City of Rochester, Minnesota regulating the use and development of property, providing for the administration thereof, and imposing penalties for violations: Amending Rochester Code of Ordinance by adding Chapters 60 through 68; and repealing other ordinances relating thereto, was given its first reading. Mr. Gerald Swanson, City Attorney, Called attention to the change of some of the draft and was requested to send copies of these changes tothe Aldermen (1) a copy of Minnesota Statutes 462.354 (see subd. 2) and 462.357, subd. 6 concerning the granting of variances by a board of appeals (2) a comparison of the previous draft and revised draft of Sections 61.411 (Variances, Findings Required) and 61.412 (Administrative Standards and Procedures).in the proposed new zoning code (3) the present language in 62.213 concerning the parking of mobile homes and trailers and a suggested revision of that section to prohibit such parking in a front yard and permit parking in a side yard up to a maximum of three days at any one time. An Ordinance relating to Outdoor Signs, Sign Contractors, Licenses and Bonds; amend- ing Rochester Code of Ordinances Sections 84.100, 84.110, 84.200 and 84.220 and Repealing Rochester Code of Ordinances Sections 84.010, 84.120, 84.130, 84.210, 84.240 and 84.250 was given its first reading.
