HomeMy WebLinkAbout01-24-19734 DV Record of Official Proceedings of the Common Council of the City of Rochester, Minn., January 24, -1973 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota held in Room 4, City Hall at 4:30 o'clock P. M. on January 24, 1973. President Postier called the meeting to order at 4:30 o'clock P. M., the following members being present: President Postier, Aldermen Kamp&r, Larson, Mayer, Powers, Strain. Absent: Alderman McNary. Mr. Richard Gullickson, Attorney representing the Rochester Elks Lodge No. 1091, said they had originally requested an extension of one year but would accept very graciously the October deadline but would like to be flexible in their actions. Mrs. Beverly B'-andt, a representative of the Human Rights Commission, was present and said they had not been notified of the meeting two days ago to their group had not been able to meet and come up with any recommendation, she said she would not like to make any comments now but a recommendation from the Human Rights Commission would be forthcoming in a few days. Mr. Douglas Wilcox of 802 Zumbro Drive, Richard Fine of 2536 of 9th Avenue N. W., Wayne Hall of 531 21st Street N.E., Mrs. Genevieve Fine of 2536 9th Avenue N.W., Earl McGee of 904 18th Avenue N.E., George Gibbs of 2040 24th Street N. W. and Walter Macher of 979 11k Street S. W. were each again heard in opposition to granting an extension. After a lengthy discussion, President Postier declared a five minute recess at 5:35 P. M. The meeting was called to order again at 5:40 P. M. with all members being present except Alderman McNary. A motion was made by Mayer, second by Powers, to reconsider the motion taken by the Common Council at their meeting on Monday, January 22, 1973 which instructed the City Attorney to prepare an ordinance amending the liquor ordinance (Sec. 160.070) to change the date from March 1, 1973 to April 1, 1973; all present voted in favor of the motion to reconsider. A motion was then made by Strain, second by Larson, instructing the City Attorney to prepare an amendment to the liquor ordinance to change the date from March 1, 1973 to October 1, 1973, with automatic revocation of the liquor license if the "white only" clause has not been removed from their by laws at that time; all present voted in favor of the motion, except Alderman Kamper who voted "nay". An Ordinance relating to On -Sale Liquor Licenses for Clubs and extending the time for removing discriminatory membership clauses based on race, color, creed, religion or national origin; amending Rochester Code of Ordinances, Section 160.070, as amended by Ordinance No. 1653, to read as follows, was given its first reading: 160.70. On -Sale Licenses to Clubs. On=Sale licenses may be issued to clubs if such clubs are qualified as required in 160.010; provided, however, licenses issued to clubs in 1972 whose national charter restricts membership on the basis of race, color, creed, religion or national origin may continue in effect until expiration on April 1, 1973, if on or before October 1, 1972, a resolution of the local governing board petitioning the national organization to eliminate such provision is submitted to the common council; and provided further, however, that notwithstanding any provisions of 160.010 to the contrary any club having a valid on -sale liquor license on January 1,1973 whose national charter restricts membership on the basis of race, color, creed, religion or national origin, may be issued a similar license for the period commencing April 1, 1973, which license, however, shall be automatically revoked on October 1, 1973 unless prior thereto such provision governing membership in the local club is removed.
