Record of Official Proceedings of the Common Council
of the City of Rochester, Minn., March 14, -1973 •
Minutes of an adjourned. regular meeting of the Common Council of the City of
Rochester, Minnesota held in the Council Chambers in the. City Hall, in said City, on March 14,
1973.
President Postier called the meeting to order at 10:00 o'clock A. M. the
following members being present: President Postier, Alderman Larson, Mayer, McNary, Powers,
Strain. Absent: Alderman Kamper.
The Council met at 8:00 A. M. and proceeded to the various polling places and
checked the voting machines, the tabulations submitted by the Judges were .correct with the
exception of at Fourth Ward, First District, the "nay" cast for Amendment No. 1 should have
been 324 instead of 224.
Upon motion by Larson, second by Powers, and all present voting in favor, the
following resolution was adopted:
BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota
that the attached sheet, marked "Exhibit A" is a tabulated statement and
list of the number of votes cast for each person and each Charter Amendment
at the Charter Election held on March 13, 1973 in the City of Rochester,
Minnesota as -determined by said Common Council on the -canvass of the said
returns of said election made the 14th day of March, 1973. The said
statement is hereby declared to show the resilts of the said election.
Said tabulated list and statement is attached.
SO THEREFORE, Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That Alex P. Smekta is hereby declared to be elected to the office of
Mayor of the City of Rochester, at the Charter Election held March 13, 1973
to hold office for two years and until his successor is elected and qualified;
That Darrell G. Strain is hereby declared to be elected to the office of
Alderman of the First Ward of the City of Rochester, at the Charter Election
held March 13, 1973 to hold office for two years and until his successor is
elected and qualified;
That Paul J. Ludowese is hereby declared to be elected to the office of
Alderman of the Third Ward of the City of Rochester, at the Charter Election
held March 13, 1973 to hold office for two years and until his successor is
elected and qualified;
That Robert L. Larson is hereby declared to be elected to the office of
Alderman of the Fifth Ward of the City of Rochester, at the Charter Election
held March 13, 1973 to hold office for two years and until his successor is
elected and qualified.
Be it further resolved that the total number of votes cast at said election
on Amendment No. 1 to the Charter of the City of Rochester was 10,881 of which
3,528 were in favor of its adoption and 7,453 were against its adoption;. that
the votes cast in.favor of the amendment was less than the required 51% of the
total.votes cast thereon, and therefore the amendment was declared not
adopted.'
Be it further resolved that the total number of votes cast at said election
on Amendment No. 2 to the Charter of the City of Rochester was 10,91:9_of which
4,572 were in favor -of its adoption and 6,347 were against its adoption; that
the votes cast in favor of -the amendment was less than the required 51% of the
total votes cast thereon, and therefore the amendment was declared not
adopted.
Upon motion by Powers, seoond by Strain, and all present voting in favor, a
resolution was adopted -setting salaries for members of the Rochester Fire Department effective
January 1, 1973 (except the Chief and Asst. Chief).
Upon motion by Powers, second by McNary, and all present voting in favor, a
resolution was adopted authorizing the Mayor and City Clerk to sign the contract between the
International Association of Fire Fighters, Local 520 on the terms of a contract for 1973.

Mayor Day reported that he had met with the PCA on what they wanted done at the
landfill, it is going to cost some money but they want the cells sealed with 10 feet of soil
and then possibly if necessary at the end of each cell at the bottom it will drain into a
place they call leachate, and this. can drain down if there is any and there will be.a place
where it can be contained, it may have to be pumped from there back up onto the land or
something like that. He said he had told them they City would do what they wanted and work
it out with the PAC. He said the other thing is to seal all sink holes and this is to be
done -immediately and other than that it calls for a plan of grading, etc., we don;t have what
they call a Master Slope and Drainage Plan and they want one, they are worried about., -the
run off in the wrong spot, the clean water comes in and runs through the trash, so they want
to have a Master Plan of how the drainage is going to around. He said he had told them the
City would do what they wanted.
Upon motion by Larson, second by McNary, and all voting in favor, the meeting
was adjourned until 7:30 o'clock P. M. on March 19, 1973.
