Rochester, Minn., September 25, 1973 Minutes of a special meeting of the Common Council of the City of Rochester, Minnesota held in the Council Chambers in the City Hall, in said City, on.Tuesday, September 25, 1973. President Postier called the meeting to order at 7:00 o'clock P.M. , the follow- ing members being present: President Postier, Aldermen Kamper, Larson, Ludowese, McNary, Powers,' and Strain. Absent: None. The call of the. special meeting was read and President Postier ordered the same placed on file, the said meeting haveing been called for the purpose 'of considering an ordinance to amend land fill charges for tire disposal; and any other business the said Common Council may deem proper. Request from the'City Administrator for an Auctioneer's License ( Al's Auto Service Center ) to conduct an auction at A1'.s Auto Service Center, Monday; October 1, 1973. The auction will be conducted by Colonel'Joe Reisch of the Joe Reisch and Company Auctioneers; Box 850, Mason City; Iowa. The applicant ikasbiss:ued a State of Minnesota Auctioneer's. license in'Freeborn County on February'13,, 1973. Upon motion by 'Strain; second by "'I-'- _k­ r, and. the .license was approved subject to receipt of the required bonds.; An Ordinance Relating to Sanitary Landfills and Charges for the Disposal of Refuse therein;,Amending Rochester Code of ordinances, Section 31.031, as amended by Ordinance Nos. 1675 and 1717 to read as follows: 31.031. Disposal Fees. Any person disposing refuse at sanitary landfill sites. and dumping grounds operated by the City of Rochester shall pay a fee for such disposal as hereinafter prescribed. The superintendent of the dumping grounds and his assistants shall collect the following fees for each vehicle ( full or' -partial -load) and other fees, except that the fees in Items three through 13 shall be double for'the disposal of refuse which originates outside of Olmsted County. 1. Car or station wagon, $.50 2. Pickup truck, panel- truck, or two -wheel trailer, $1.00 3.- Two-axel truck or four-wheel trailer under 17 cubic yards, $3.00 4. Tandem -axle truck, $5.00 5. Semi -truck (3-axle truck), $10.00 6. Non -packer truck (17 cubic .yards",or over), $..30 per -cubic yard. 7:- Packer truck, $.40 per cubic yard. S. Each appliance unit,'$1.00. When in excess.of_the-vehicular 'charge, the charge for appliances in a -load shall beiin add- ition to the vehicular charge. 9. Each tire designed to fit a rim of 15 inches or less in diameter, $1.00, and each tire designed to fit a rim of more than 15 inches in diameter, $2.00. 10. Toxic or liquid waste, $6.00 per fifty gallons. 11. Special handling, $5.00 12. For each junked -car or vehicle, $10.00 Wishing to be heard was Roger Plumb Public Works Director and stated that he re- ceived a call from.an attorney representing the .Nelson Tire Company and he said they j might want to go into litigation on this. ''Mr. Plumb visited with a man from Nelson Tire and he said they had a huge stockpile of tires that were no good, the manager that had been there had -.not disposed of the times properly and that is why so many loads of tires were being brought to the landfill at this time. 'He has also stated that shipments of tires come from a West Coast firm . He said the manager from Nelson stated that once they get this stock down, they would only have a load a day, which was n 0 1 1 normal. He stated that this tire problem is a serious one. According to the Pollution Control Agency, tires would have to be buried 4 feet deep and 4 feet apart, and if this can't be done, we would jeprodize our rights at the land- fill site-.;! Wishing to be heard was Mr. Chuck Bliss of Southern California-; President of Nelson Tire and stated that they had an unusual problem, the manager did not take care of the waste tires and stocked them. He had to getrrid of the tires now, creating the overload at the landfill. He stated they get tires from California and they are pre -inspected and are recappable and they have very little waste with these tires, it is the stations, and other establishments where they take the waste along with the recappable tires that they get tires that are absolutely no,good. Mr. Bliss just got into town and asked that the Council give him more time to work out a solution to this problem. He also stated that they looked intb�a tire cutter, but it would take a couple of months to get authorization to buy this and also it would take 6 months to be installed. Mr. Mark Gray , Superintendent of Street and Alley stated that they are looking into buying a tire cutter, but would have to budget for this. Mr. Gray suggested Mr. Bliss take,.his tires to Spring Valley or Shokapde Minn. to dispose of them. Mr. Gray also stated=that--he might help Mr. Bliss find a place to store the tires until they can get a=cutter. Mr. Merle Walters and officer at Nelson Tire stated that they just wanted more time to work out this, problem, and it wasn't fair for the tire people. Alderman Larson left -8:00- The Ordinance :was =givai efts f> rs't �cead ng at this `time ," and upon motion by by Ludowese, second by ",Strain to suspend the rules with all voting in favor by roll call vote. The ordinance was then given its second reading, and a motion by Strain, second by Powers to adopt the Ordinance as read and, President Postier declared the said Ordinance duly passed and adopted.
