Minutes of an adjourned regular meeting of the Common Council of the City of
Rochester, Minnesota held this 17th day of December, 1973 in the Council Chambers
in the City Hall in said City.
President Postier called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Postier, Aldermen Kamper, Larson,
Ludowese, McNary, Powers, Strain. Absent: None.
Hearing on the application for Approval of the Planned Unit Development
( Revised Final Plan) to be known as Rochester Villas. There was no one present
wishing to be heard. President,Postier declared the hearing officially closed.
Upon motion by Strain, second by Powers and all voting in favor, adopting the -
resolution as prepared by the City Attorney.
Bids were opened by the Common Council -December 12, 1973 for furnishing
mobile and portable radio communications equipment for the police and sheriff commun-
ication system.
Bids were as follows: ,

General Electric $56,322.10 24,766.00
R.C.A. had submitted a bid for furnishing the portables, but this bid was returned
unopened at the request of-R.C.A. A telegram was received by the Mayor's office
on December 17, 1973 and requested that their bid be withdrawn, they stated that
R.C.A. had been allowed to withdraw their bid. The published specifications require
5 watt portable radios, however G.E. bid a portable of only 2 watts. Dr. John
DuBois, consultant in the purchase of mobile and portable radios recommended that
G.E. be awarded the contract. Dr. DuBois stated that even though the specifications
required a 5 watt radio, GE's radio , after testing, could pick up signals from a
far distance. Upon motion by Larson, second by McNary, with all present voting in
favor, the bid was awarded to G.E. and the prepared resolution was adopted.
Applications were received from the Yellow Cab Company to drive 31 taxi
cabs and from the Blue and White Cab Company ( ROCABCO, INC ) to drive 18 cabs.
Financial statements were furnished. Upon motion by Kamper, second by Strain,
with all present voting in favor, the licenses were granted.
Bids were received for ten trucks for various departments of the.City of
Rochester and the tabulations are as follows:

allocation of net bid price for award on all items on a percent basis. Three Dump'Boxes
for Street and Alley Department and Park Department Bids were received from Garwood
Twin Cities - $5,148.00; Charles Olson and Sons $5,282.40, and L.L. Dewey Company
$5,679.00.
A letter was received from the Public Utility Board listing the following reasons
for not awarding the trucks they requested from Selby:
1. Rarely have parts in stock - 90%/ have to be ordered.
2. Must.givb Service Department one week notice if truck is to be taken in
on warranty.
3. Parts are generally 507. higher then Ford, Chev. GMC or Dodge.
4. Do not have service manuals for 1973 truck bids. Have asked for them.
5. Local parts houses carry a very small amt. of International parts.
6. Sent one International k ton pickup out to Selby's 4 times before a
tail pipe extension was installed.
The Rochester Public Utilities recommended accepting Clement's Chevrolet for the

low bid. However, if the bid was accepted from el y Truck ales, this w 1 a
bid for all the bids as a whole, Mr. Selby was present for any questions, and had not
seen the above remarks by the Rochester Public Utility Board. However he did state that
parts were sometimes had to get due to strikes by the company and the fact parts have to
be ordered from far away as far as servicing and prices he stated he would have to go
back to his company and find out what the trouble was. A motion was made by McNary,
second by Kamper to award the over-all low bid to Selby Truck Sales on Item # 1, 4, and
6. and Interstate GMC on Item # 2, and Universal Ford on Item # 3. The total bid of

Selby is $36,534.20; Interstate GMC $5,193.00;cand Universal Ford $3,225.00. The award of
the three dump boxes was given to Garwood Twin Cities ats;a cost of $1,716.00 per unit, was
granted upon motion•by Powers, second by Strain, with all in favor voting"Aye". Bids were
advertised also for the year's supply of gasoline. No bids were received. Under the
current voluntary allocation program. American Oil Company will supply us. They have
sent a letter cutting our allotment to 107. of our 1972 usage plus 107. set aside for the
State reserve. This means a 19% reduction from 1972 usage. Application to the local
Civil Defense Director and Federal Office of Gas and Oil for an increased allocation
has been sent.
Recommendation by the Finance Department on accepting assignment of $500,000.00
substituted securities in lieu of depository bond from the Olmsted County Bank and Trust
Company of Rochester and the amount of $1,000,000.00 from the Rochester State Bank,

Rochester, Minnesota. Upon motion by Powerg, second by Strain, with all voting
in favor, the prepared resolution approving these assignments was adopted.
A motion was made by Powers, second by Ludowese, and passed unanimously that
the semi-monthly bills, list attached , in the amount of $883,218.02 be approved.
Recommendation from the Park and Recreation Department that a leave of absence
be granted for Mr. Ken Karau, Master Mechanic who suffered a heart attack in
October, 1973. Upon motion by McNary, second by Ludowese, with all voting in favor,
the leave of absence was granted.
Upon motion by Kamper, second by Powers, with all voting in favor, the
resolution setting salaries and wages for City employees other than those already
set'.by collective agreement and those in the Utility Department was adopted.
The increases for full-time employees are 67. above 1973 salaries and wages. Wages
for most of the part-time employees have not been increased.
Recommendation from the Personnel -,'Department for the following changes in the
employment policy:
1. Revise exempt employee list by deleting the Building and Safety Director
and the Assistant Poundmaster and adding to the list the Building Official and the
Data Processing -Supervisor.
2. Revise the vacation schedule
3. Provide for the City paying 90% of the hospitalization premium for
dependents.
4. Provide for the additional life insurance for exempt employees
5. Change the mileage allowance to 12�. and 14� per mile.
Upon motion by Strain, second by Kamper, the prepared resolution adopting
this change was granted.
Recommendation from the Planning Department on the Pdition to annex property
at 414 16th Street S. W. Upon motion by Strain, second by Powers, the City Attorney
is instructed to prepare an ordinance for subsequent adoption.
Recommendation from the Planning Department on the Petition to Annex Lot
59, North Sunny Slopes. Upon motion by Strain, second by Kamper, with all voting in
favor, the City Attorney was instructed to prepare an ordinance for subsequent adoppion.

Recommendation from the Planning Department on the`Petitionto.vacate 22nd
Street N. W. between 18k Avenue N. W. and the west frontage road of T.H. 52 North.
Upon motion by Ludowese,. second.by Powers, with all_voting.in.favoi,..the City.
Attorney was' nstructed to prepare a resolution vacating the street for adoption.
Recommendation by the Planning Department on the application for approval
of a planned unit development ( concept statement ) for Samaritan -Bethany Nursing
Home. Upon motion by Larson, second by Strain with all voting in favor, the
concept statement was approved.
Recommendation from the ftblic Works Department that a local improvement
• jl be initiated by Council Action without petition for the Trunk Line Sanitary Sewer

Extension along County Roads No. 4 and 151 , and Watermain Extension along -County
Road 151 to serve Pace -;Foods in SW'k Sec. 21, Cascade Township. Upon motion by
Ludowese, second by Powers, with all voting in favor, the prepared resolution
ordering a feasibility report was adopted.
Recommendation from the Public Works Department ( Traffic Division) ) to
install 12 minute meter Op"Booadway. This would replace the 60 minute meter in
place. Upon motion by Kamper, second by Ludowese, with all voting in favor, the
prepared resolution establishing a 12 minute metered zone under Section I,Zone
A (12 minute parking) to read as follows:
North Broadway on the west side of the street for 20 feet more or less
in front of the premises known as 15 North Broadway ( Welhaven Music Co. ).
Recommendation from the Public Works Department ( Traffic Division ) to
establish emergency parking near Methodist Hospital. The Hospital has requested
5 spaces on the south side of First St. N.W. between the alley and First Avenue.
to accomplish this it will require moving 5 chaplin spaces. Alderman McNary
asked the Traffic Director if the Methodist don't own a lot to the north, and it
wasAstated that they'do. It was stated that Mr. Dolan, Traffic Director , would
govand talk with the personnel of the Methodist Hospital and suggest they move
the Chaplins parking in to their own parking lot. Upon motion by Larson, second
by Powers to table this item until the January 7, 1974 Council Meeting. All voted
in favor.
Recommendation from.the City Administrator on a request to amend Bus Routes
( Rochester City Lines ). Upon motion by Kamper, second by Powers, with all voting
in'favor, the City Attorney was instructed to prepare a resolution making these
amendments for subsequent adoption.
Recommendation from the Y inance Department that the prepared resolution closing
completed local improvement projects and transferring;unexpended'balances in the met
amount of $154,028.92.•

Recommendation frod1he City Clerk's Department levying assessments for Snow
Removal, Noxious Weeds, and Dutch Elm Diseased Trees. Upon motion by Kamper,
second by Strain, with all voting in favor, the prepared resolutions were adopted.

Ordinance Relating to Municipal Planning ; Designating Land needed for future
public use; regulating the construction of buildings and structures thereon; and
adopting an official map was given its second reading. A motion was made by' Larson,
second by Strain, that the said ordinance be adopted as read and all voting in favor,
President Postier declared the said ordinance duly passed and adopted.
Ordinance relating to the Regulation of Refuse collection in the City of Rochester
and collection charges; amending Rochester Code of Ordinances Sections 130.560
and 130.600, as amended by Ordinance Nos. 1671 and 1725 was given its second
reading. A motion was made by Strain, second by Powers, that the said ordinance be
adopted as read and all voting in favor, President Postier declared the said"ordinance
duly,passed and adopted.
Ordinance annexing to the City of Rochester, Minnesota, certain platted lands in
Toogood's Subdivision of a part of the Southwest quarter Section 11, Township 106
North, Range 14 West, Olmsted County, Minnesota was given its second reading. A
motion was made by Kamper, second by Strain, that the said ordinance by adopted as
read and all voting in favor, President Postier declared the said ordinance duly
passed and adopted.
An Ordinance annexing to the City of Rochester, Minnesota, certain platted
land situated in North Sunny Slopes, Olmsted County, Minnesota wa"s given its first
reading.
An Ordinance annexing to the City of Rochester, Minnesota certain platted
lands in Golden Hill Addition, Olmsted County , Minnesota was given its first reading.
An Ordinance Annexing to the City of Rochester, Minnesota, certain unplatted
lands in part of the Southwest quarter Section 11, Township_ 106.North, Range 14 West,
Olmsted County, Minnesota was given its first reading.
An Ordinance annexing to the City of Rochester,Minnesota, certain unplatted
land not exceeding 200 acres in area, and certain platted land situated in Section
12, Township 106 North, Range 14 West, and Section 7, Township 106 North, Range 13
West, Olmsted County, Minnesota, and establishing the zoning of certain parcels
thereof, was given its first reading ( Grandview Memorial ).
An Ordinance annexing to the City of Rochester;'certain platted land in North
Sunny Slopes, Olmsted County, Minnesota ( William Gravett ) was given its first
reading.
An Ordinance rezoning certain property and amending Ordinance No. 1659
known as the zoning ordinance of the City of Rochester, Minnesota ( Redelings and
Herrick ) was given its first reading.
An Ordinance annexing to the City of Rochester, Minnesota , certain
platted land situated in North Sunny Slopes, Olmsted County, Minnesota, was given
its first reading.
Resolution approval of dedication of Land by the Town of Rochester for Park
and / Or Bird sanctuary purposes in Lot 44A, Sunny Slopes. ( Batchelder and Holland)

Upon motion by Ludowese, and second by Larson, with all voting in favor, the resolution
was adopted, instructing the City Clerk to record the same in the office of the Register
of Deeds.
Tabled Item - Decision of the Zoning Board of Appeals to Permit the Construction
of a new building to be located at 533 North Broadway that will be situated in the area
reserved for a future street by Official Street Map No,..3. A -motion was made by Strain,
second by Kamper to remove this item from the table. A motion.was made by Strain, second
by.Larson to instruct the proper agency -to preceed-with the negotiations or purchase
the Whiting Property at 533 North Broadway. All voted in favor, with -Alderman
Ludowese, and President Postier voting "nay".
Alderman Larson asked the Council if something could be done to.keep the
warming houses and schools open for athletic practice during the Christmas vacation.
It was stated that the, athletic.practice was going to be held at.the YMCA,. A•motion
was made by Larson, second -by Kamper, with all voting in favor to instruct the Assist-
ant City Administrator.to write a letter to the State.Director, of Education for per-
mission to keep the warming houses open at the various locations -so that the .children
would have a place to put their skates on and remove them when they are. through.
Sheriff Charles Von Wald presented a change order which he received from Tri-
State Erection, Inc. 18800 Lyndales Avenue South, Lakeville,.Minnesota 55044 concerning
the increased cost of extending guy anchors.and added footings, required at Olmsted
County. When the original figures were arrited at, this increase was not considered.
A motion was made by Strain, second by Powers with all present voting in favor•to
approve the change older of $1,822.85.
Upon motion by Larson, second by Powers, with all present voting in favor, the
meeting wasaadjourned until 2:00 P.M. January 7,,1974.
