February 4, 1974 - Reqular adiourned meeting # 33
President Postier called_ the meeting to order at 2:00 P.M. , the
following members being present: President Postier,- Aldermen Kamper,
Larson, Ludowese, McNary, Powers, Strain. Absent: None.
Larson moved, Strain seconded to approve the minutes of the .January 21
1974 meeting with the following correction: ' On Agenda Item E-14,
Alderman Powers abstained instead of Alderman Larson as stated.
Ayes (7),' Nays (0). Motion carried.
`Kamper moved, Ludowese seconded . to approve Resolution . No. 39 re-
ferring the following improvement to the City Engineer for a feasibility
report and recommendation: " Grading and Surfacing 19th Avenue N.W.
join with 41st'St. N.W., with the construction of curb and gutter along 11.
Ave. N. W. as extended." Ayes (7), Nays (0). Motion carried.
Ludowese moved, Kamper seconded 'instructing, the' City Attorney to prepai
an Ordinance licensing all sauna -massage parlors on a ,yearly basis. A
letter was presented by Mayor Smekta recommending Council action.
This Ordinance is to be introduced at the next regular Council meeting.

Strain moved, Larson seconded to approve Resolution. No. 40 dedicating
to Olmsted County the .Public Street Easement for the Ibth St. S.W.
extension across City Park property and instructing the City Attorney
to prepare the necessary documents. Ayes (7),Nays (0).Motion Carried.
Strain moved, 'Powers seconded -to grant a 3.2_ beer license to the PIK-
N-PAK Stores of Minnesota, Inc. for their store on 438 3rd Ave. S. E.
Ayes (7), Nays (0), Motion carried.
Kamper moved, Ludowese seconded to adopt Resolution No. 41 accepting
the low bid of Skyline Fence and Landscaping Co. of Bloomington, Mn.
to fumi"sh security fencing' at the Rochester Municipal Airport. The
accepted bid was $37,743.28. Ayes (7), Nays (0). .Motion carried.
Kamper moved, Strain seconded approving the application for a license
to sell cigarettes from PIK-N-PAK Stores, Inc. 438 3rd Ave. S. E.
Rochester, Minnesota. Ayes (7), Nays (0). Motion carried.
Strain Moved, Larson seconded approving a leave of absence for
Larry Krueger from, February 4, 1974 until such time as he is able to re'* -
turn to work. Ayes (7), Nays (0). Motion carried
Larson moved, Kamper seconded to lable action on the City Participation
in National Guard Armory Construction Costs until further information
is available on this procedure for payment of the' City's share of the
construction cost. Ayes (7), Nays (0). Motion carried.

Larson moved, Strain seconded approving the prepared' sanitary landfill=
rates and instructing .the City, Attorney to prepare the necessary ordinanc
The ordinance shall include a penalty provision for falsely identifing
refuse material at, the rate of, four times the: regular approved rate.

Powers moved, McNary seconded to approve Resolution No. 42 acceptin
the feasibility report for Watermain Extension in Northstar 2nd Sub.
in 31st St. N.E. and along T.H. 63 from 31st St. to 27th St. N. E.,
designating McGhie and* Betts as project engineers to prepare plans
and specifications, and ordering a public hearing to be held on March
4, 1974,. Ayes (7), Nays (0). Motion carried.
Ludowese moved, Powers seconded 'to approve Resolution' No. 43
accepting the.. feasibility report for Grading and Surfacing, curb and
gutter on 19th Avenue N.W. to.241 feet south of 41st St. N.W. and
ordering a public hearing to be held March 4, 1974. Ayes (7),
Nays (0). Motion carried.
Kamper moved, Strain seconded instructing the City Attorney to prepare
a resolution authorizing the Mayor and City Clerk to execute an agree -
merit between the City and Yaggy Associates, Inc. to perform engineer-
ing services in conjunction with Candlewood PUD. Ayes (7), Nays (0).
Motion carried.
Strain moved, Ludowese. seconded to approve Resolution .No's 45 and
46, referring._the .following improvements. to the City Engineer for a
feasibility report and recommendation:
a. Project No. 7401'-A(J8489) 12" Watermain in 18th Ave. N.W.
from 41st..St. to 572' North.
b. Project No. 7401-B(18490) Street. grading, .surfacing, and an
.8'. Watermain extension in 41st St. N.W. from the west line of Block
I, -Sunrise Estates 2nd Subd. to the. east- line of Candlewoo&RUD
Ayes (7), Nays, (0). Motion carried
Kamper moved, Ludowese seconded to adopt Resolution No. 47 awardi
the -.contrast for Traffic Signals and' Street ,Light System at the inter-
section of Third Ave. and 14th St. N.W. to Nietz Electric for the
amount of $42,740.00. Ayes (7), Nays (0). Motion Carried.
Powers moved, Ludowese seconded authorizing the expenditure of $1500
for the purchase of ' parki ng meters to be used at the Airport and
instructing the City Attorney to prepare the necessary ordinance
establishing a Taxi and Bus.Zone at the Airport. Ayes (7), Nays (0),
Motion carried.

Ludowese moved, Power's seconded` -ordering 'a public hearing 'to be
held on February. 19,1974 on an appeal of order to remove a driveway
approach to property at 1012 2nd' St. S. W-., described as the West 55
feet of the North 165-feet of Block 43* Head an_d McMahons Addition.

Kamper moved, Strain seconded approving an extension of time to file
an application for a housing registration certificate -from January 31,
1974 to March, 31, 1974 and.instructing the City Attorney to prepare
an ordinance_ making the change. Ayes .(7), Nays (0). Motion Carried.
Larson; -moved, Ludowese seconded that no action be taken on the request
t6~`tran-sfer the liquor license at Mr. T's to Bruiser's La Roes III prior
to the completion of the necessary investigation. This matter will be

Larson moved, 'Strain seconded adopting Resolution No. 48 amending
Phase I of Green meadows Village PUD. Ayes (7), Nays (0). Motion
carried.
Kamper moved, Ludowese seconded adopting Resolution No. 49 authoriz-
ing the Public Utility Board to enter into a purchase order contract with
Crescent Electric* -Supply* for fumishirig' 1000 feet of copper cable for
$9,275.00. Ayes (7), 'Nays (0). Motion carried.
Strain moved, Kamper seconded approving the pur chase by 'the Public
Utility Department of" 26.09 acres of land from Edgar E.• Jensen and
Gertrude C. Jensen for $68,698, authorizing and directing the Mayor
and -City Clerk to' execute' a contract for deed for such 'purpose, and
rescinding a Resolution'`passed on Septemb6r -17, 1973 regarding the purcl
ase of said property. Ayes (7); 'Nays (�0) Motion carried:
Kamper moved, Strain seconded adopting Resolution No. 51 approving
an agreement with Union Carbide Croporation -for.'a UNOX Mobile Pilot
Plant Demonstration Program at the Sewage Treatment Plant. Ayes(7),

Kamper. moved,, . Strain seconded vacating the Public Utility Easement
which lies in the East Half of Third Avenue S. V. ( Sometimes Known
as Second Avenue S. W. and Originally platted as Phelps Avenue) ,

McNary moved, Powers seconded to remove from the .table,an item.-,
of Request for carry-over of compensatory time for employees of the
City. This was held over from the January 21,.1974 meeting for further
review by the Committee of the Whole. Larson moved, Powers seconded
to approve this request. Ayes (7), Nays (0). Motion carried.
Ludowese . moved, Larson .seconded to adjourn the, meeting until 7:30
o'clock P.M. Ayes (7); Nays .(0). •. Motion carried. •
President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier, Aldermen Kamper,
Larson, ;Ludowese, McNary, Powers, Strain.. Absent: None.
Hearing on the Petition to change the Zoning .Districting on Lots 17-21
Block 23, Northern Addition from the • R-I. District to the R-3 District
( North Side of 8th Street N.W. between the. two north.south alleys).
Persons speaking in favor of the change were: Mr. Grant Mulholland,
19 8th St. N. • W..and Verna Anderson,. 812 .2nd Avenue N.. W.,
and. Philip Boyer, III 8th Street. N.. W. Ludowese moved,. Strain
seconded to accept the recommendation of the Planning and Zoning
Commission and deny the Zone Change. Ayes (7), Nays (0). Motion
carried.
Ludowese moved, McNary seconded the approval of the application
of a Planned -Unit Development ( Preliminary Plan ) for the Samaritan -
Bethany Nursing Home ( 25 7th St. N.W.) subject to the conditions
as referred to in the Planning Department report dated January 16,
.1974. Ayes (7),. Nays (0).. Motion carried.
Ludowese. moved, McNary .seconded:: approving the application for
a Planned Unit Development ( Con.cept Statement) to be located at
1502.1.2th St;. S. E. (Former National Food. Store). • Michael Kamin ,
representative of the Developer, was present and answered questions
of: the Council. _ Ayes •(6), Nays (0),.. Alderman Larson abstained,
Motion carried.
Powers moved, Ludowese seconded to approve the Application for the
Preliminary Plat of Green Meadows 3rd Subdivision,* subject to
the conditions as stated in the Request for. .Council Action dated
February 4, 1974. . Ayes (7), Nays (0)... Motion -carried.:
Ludowese moved, Kamper seconded the approval of retaining a Record
Management Study for the City Clerk's office and.instructing the
City Attorney to review the proposal and prepare necessary documents
to proceed with the study. Ayes (7), Nays (0). Motion carried.

Ludowese moved, Larson seconded approving for payment the semi-
monthly bills, in the amount of. $178;886.02 ( list :attached ), Ayes (7)

Powers moved, Ludowese seconded adopting Resolution No. 21 to reduce
the retainage on .Federal Aid Project at Second Avenue N. E. from
10% to 4%; retaining (.$I7,012.00)� as -a protection of the public inter-
est. Ayes (7), Nays (0). Motion carried
Powers moved., Ludowese seconded adopting. Resolution No. 53 approving
the; Final Plan of the, Planned Unit, Development to be known as the
Center . Court Apartments ( PUD-R-12 ) Planned Unit 'Development,
Residential. Ayes (7), Nays (0). Motion_ Carried.:
An Ordinance Rezoning Certain property, creating a Planned Unit Dev-
elopment District known as PUD-R-12 Planned Unit Development District
Residential ( --'VCenter Court Apartments ) and amending Ordinance No.
1659 known as the Zoning Ordinance of the City of Rochester, Minn.
was given its first reading.
An Ordinance relating to the impoundment of Unlawfully Parked veh-
icles and charges therefor; amending Rochester Code of Ordinances
Section 151.040 was .given its first reading. Larson moved, Powers
seconded to suspend the rules, and upon roll call vote, this ordinance
was given its second reading. Powers moved, Kamper seconded that
this ordinance be adopted as read. Ayes(7), Nays (0). .Motion carried.
An Ordinance relating to the Sanitary Landfills and Charges therein
amending Rochester Code of Ordinances, Section 31.031, as amended
by Ordinance No's. 1675, 1717 and 1729 was given its first reading.
President Postier stated that a price quote on two-way radios for the
Sanitary landfill to be operated by the Gatekeeper and the man
doing the covering so a check could be made on the people who
sneek materials into the Landfill. A motion was made by Powers
seconded by Larson to have Mr. David, Wemecke, Purchasing Agenat`>
Mr. Charles Armstrong, City Engineer and Mr. lames Andre,
City Administrator check on this. Ayes (7), Nays (0): Motion carried
Having no further business, Larson moved, Powers seconded that
the meeting be adjourned until 7::30 P.M., February 19, 1974.
