Absent: Alderman Kamper, attende he National League of Cities -An Texas. Strain moved, Larson seconded to approve the minutes of October 30, November 4, 12 and 18, 1974. Ayes (6), Nays (0). Motion carried. E-1 Larson moved, Strain seconded to adopt the prepared Resolutions No. 467 and 468 approving the annual budget of the City of Rochester, Minnesota for the fiscal year beginning January 1, 1975 and levying the sums of money listed below, collectible in 1975, upon taxable property in the City of Rochester. Five percent of the final estimate is to be withheld for one year. The request for final payment to McGhie and Betts, Consulting Engineer for work they completed on this same project in the amount of $442.43. FIve percent of the total is also withhell for a period of one year. Ayes (6), Nays (0). Motion carried. Larson moved, Powers seconded to grant the license to B & F properties at 300 Elton Hills Drive to sell cigarettes.at retail. Ayes (6), Nays (0). Motion carried. Strain moved, Powers seconded to approve the transfer of the Sauna and Massage. Parlor from E1 Cid at 301 1/2 North Broadway owner - Ronald Ga_ustad1-to a new name of Imperial Massage and Sauna with new owners of Michel LeRoy Livingston 618 1/2 St. South, St. Claud, Minn and Dale Robert Duresky 301 1/2 North Broadway, Rochester, Minnesota Ayes(6), Nays (0). Motion carried. Larson moved, Strain seconded to approve the semi-monthly bills, (list attached) in the amount of $242,781.29. Ayes (6), Nays(0). Motion carried. Strain moved, Powers seconded to authorize the City Attorney to initiate eminent domain proceedings for proposed -intersection improvements on 7th Street North and North Broadway - T.H. 63 - Parcel No. 9 - Lot 1, Block 22, Northern Addition fee owners Super America Stations, Inc. a coporation, Parcel No. 11, Lot 6, Block_ 31,.Northern Addition to the City of Rochester, fee owners J. Keefe and Doris P. Keefe, husband and wife, and adopt the. 'prepared Resolution No. 469. Ayes (6), Nays (0). Motion carried. Strain moved, Ludowese seconded.to adopt the prepared Resolution No. 470 receiving the preliminary report and ordering a public hearing and directing preparation of plans and specifications for Project No. 7201-0-75 J 8523 Sanitary Sewer and Watermain extensions to serve the Glatzmaier Enterprises Property at 1900 North Broadway. Ayes (6), Nays (0). Motion carried. Larson moved, Ludowese seconded to adopt Resolution No.471-accepting the public street easement granted by. Clarence W. and Grace B. Johnson fora payment of $1,627.00.- Ayes (6), Nays (0). Motion carried. Strain moved, Powers seconded to adopt Resolution No. 472 vacating Utility Easement in Replat of Folwell Subdivision as platted and granted along the easterly side of Lots 1,2,and 3 . Ayes (6), Nays (0). Motion carried. Ise RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA December-.2, 1974 - Regular Adjourned Meeting No. 25 Agenda Item F-1 Ludowese moved, Larson seconded to adopt Resolution No. 473 vacating the Utility easement as platted and granted along the west side of Lot 30, Block 5, Country Club Manor First Addition in the City of Rochester, Minnesota. Ayes (6), Nays (0). Motion carried. F-1 Larson moved, Ludowese seconded to adopt Resolution No. 474 establishing parking, truck loading, passenger loading, parking mete regulations and provisions, primary and one-way streets and alleys pursuant'to Ordinance No. 871 as amended and is hereby further amended as follows: (1)-Section C, Special'Parking Zones, paragraphs (2), (8), and (12) are deleted . (2) Section C, Special Parking Zones, paragraph (3) is amended to read: (3) First Street Southeast on the south side of the street from South Broadway to one-half block east of Broadway,,twelve minute (6 stalls ) parking Monday through -Saturday from 8:00 a.m. to 6:00 p.m. for postal patrons. (3) Section I., Parking Meters, Zone A (12 minute) is amended by adding paragraph (2.5) to read: (2.5) South Broadway on the east side of the (2 stalls) street from First Street Southeast to a point fifty-six (56) feet more or less south of First Street (Post Office). (4) Section I, Parking Meters, Zone D (90 Minutes), paragraphs (7) and (15.5) are amended to read: (7) First Street Southwest on the south side of the street from Second Avenue (4 stalls) Third Avenue and on the north side of the street from Third Avenue to Fourth Avenue. (15.5) Fourth Avenue Southwest on the east side of the street from Center Street to Second Street (4 stalls) and on the west side from First Street to Second Street. (5) Section I, Parking Meters, Zone A (12 minute) is amended by adding paragraph (4.2) to read as follows: (4.2) First Street Southeast on the south side of the street from South Broadway to one-half block east of South Broadway. (6) Section B, No Parking Zones, Streets , is amended by adding paragraph (240) to read as follows: (240) 31st Street Northeast on the south side.of the street -from North Broadway to East River Road Northeast. (7) Section J, Passenger and Commodity Loading Zones, is amended by adding paragraph (1.5) to read as follows: 0.5) First Avenue Southwest on the west side of the street from a point 38 feet more or less south of Fifth Street to a point 66 feet more or less south of Fifth Street (premises known as 503 First Avenue Southwest). F-1 An Ordinance relating to zoning and parking i.n yards and setback areas; amending Rochester Code of Ordinances, Section 63.205, as RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL 199 CITY OF ROCHESTER, MINNESOTA December 2, 1974 - Regular Adjourned Meeting No. 25 Agenda Item F-1 A-1 B-1 F-1 I enacted by Ordinance No.1659 was given its first reading. Having no further business, Powers moved, Larson seconded to adjourn the meeting until 7:30 P.M. Ayes (6), Nays (0). Motion - carried. President Postier called the meeting to order at 7:30 P.M., the following members being present: Aldermen Larson, Ludowese, McNary Powers and Strain. Absent: Alderman Kamper. A Hearing on the Proposed amendments to the Zoning Code , to establish the Common Council as an apellate body from decisions of the Zoning Board of Appeals, with the next recourse to District Court. Having no one present that wished to be heard, President Postier closed the hearing. Strain moved, Powers seconded to proceed with these amendments and instruct the City -Attorney to prepare and Ordinance making the changes that can be adopted. Ayes. (6), Nays (0). Motion carried. An Ordinance relating to Zoning, Appeals to the Common Council, and Supervised Living facilities: amending Rochester Code of Ordinances Sections 61.301, 61.302, 61.409, 66.300. ( Table 5), 66.309 and 66.310, as -enacted by Ordinance No. 1659, and adding Sections 60.4235, 60.4675, 61.4085, 66.319, and 66.320. was given its first reading.
