A-1 President Postier called the meeting to -order at 7:30 P.M., the
following members being present: President Postier, Aldermen Kamper,
Larson, Ludowese, McNary, Powers -and Strain. Absent: None.
Ludowese moved, Larson seconded to approve the minutes of March 3,
1975.- Ayes (7), Nays (0). Motion carried.

for the years he served the Council, and welcomed the new
man- Paul Allen. A standing coVation was given Alderman Ludowes(
B-1 Hearing on the Project J 8522 Sanitary Sewer Extension on 9th Avenue
S. E. from Sth Street S. E. to -a point 200 Feet South. Having no
one present that wished to be heard, President Postier closed the
hearing. Powers moved, Strain seconded to adopt the prepared Res-
olution No. 91-75 ordering the project to be made and authorize the
necessary -appropriation from the Contingency Account to cover the
necessary costs, in the event that Community Development -funds are
not used for this project. Ayes (7), Nays (0). Motion carried.

Hearing on the Deferred Assessments to Lot 2, Toogood Subdivision
on Project 6216-3-71 ( J 8372 ) Street Improvements in 16th Street
S. W. from T.H. 63 to West Line of Graham Addition-$1,165. '
Project 6706-1,11 and IIA J 8183,8184 and 8185, of Water Tower and
Trunkline , Southwest Service Area. $309.40,
Project 7101 J 8359 Sanitary Sewer and Watermain Extension to
Minnesota Bible College $ 992.80. Having no one present that wished
to be heard,President Postier closed the hearing. Strain moved,
McNary seconded to adopt the prepared Resolutions No. 92-75, 93-75
and 94-75 accepting the assessments. Ayes (7), Nays (0). Motion
carried.
B-3 Hearing on the J 8S27 Sanitary Sewer and Water Service for Lots
24 and 25 North Sunny Slopes ( Dr. Fontana ) Having no one in the
audience that wished to be heard, President Postier stated that Dr.
Fontana, who is the only owner involved could not be present at this
meeting. Powers moved, Strain seconded to table this hearing until.
the next meeting. Ayes (7) ;4ays; (0). Motion carried.
Hearing on the Proposed Assessments for Project 6206-2-74 ( J 8491 S
Street Improvements on 6th Street S. E. from 3rd Avenue S. E. to
4th Avenue S. E. Rick Colvin, Attorney in Rochester, was present
and represented the homeowners in the area. They are opposed to
this improvement'. they don't feel this has been a 15enefit, but
feel they suffer a deferment. They feel they shodld only pay for
the water assessments. Mr. Art Genz, 526 3rd Avenue S. E,, Corrine
Hovel 323 6th St. S. E., Walter Cassel, 322 6th Street S. E., Minnie
Olson 318 6th Street S.E. and Donald Meyer of 311 6th Street S. E.
were present and were all opposed to this assessment. Larson moved,
Kamper seconded to adop�i the prepared Resolution No. 95-75 accepting
these assessments. Ayes (7), Nays (0). Motion carried.

C-3 Larson moved, Strain seconded to instruct the City Attorney to draw
.ip an amendment to the City Ordinance No. 1476 Increasing the
nembership to the Housing Board of Appeals from five members to seven.
rhis is necessary because of lack of a quorum at meetings and the
'lecessity of having to postpone meetings. Ayes (7), Nays (0). Motion
carried.
D-1 Kamper moved, Strain seconded to adopt the prepared Resolution No.
96-75 referring the petition for installation of Concrete sidewalk on
both sides of Third Street N. W. from 3rd Place N. W. on the North an(
the park on the south, westerly through numbers 4126 and 4133.
A petitlon of the majority of the property owners-was'presented
against this improvement. Ayes.(6), Nays .(l), Alderman Ludowese
voting Nay. Motion carried.
E-1 Kamper moved, Powers*secondedto table the appropriation of $9,147
from the Contingency Account to the Library Fund until a Council
meeting on October 6, 1975. The Council will take an ov er-all look
at the budget of the Library at that time. Ayes (7), Nays (0).
Motion carried.
E-2 Larson moved, Strain seconded to instruct the City Attorney to
prepare an amendment to the present bicycle licensing ordinance
amending it to a system under which a permanent license ( sticker
type) would be issued to a bicycle with a rqquirement that it be
renewed every 4 years and that it would be possible for a retail
shop or schools to iss�.Ue licenses. The license fee would be $2.00
for new, renewal, or transfer. Ayes (7),Nays (0). Motion carried.
3 Powers moved, Strain seconded to approve the payments to the following
contractors for work completed to date on the Airport Terminal
Expansion: Floyd Larson Construction Company $41,162.60; Schammel
Electric Company $3,789.00; and J. McClure Kelly Co. $9,031.00.

97-75 statin.g that the traffic engineer is designated as.the engineer
for the Community College Demonstration Bideway. Project and is dire(ctE
to prepare the plans and specifications,for t�e making of the improve-
ments necessary for said project. Jennifer Resberg of 709 6th St. S.E.
Myron Beets of 1547 7th Avenue N. E., and.Carl Dentex of 2227 Lenwood
Court supports this project. Ayes (6), Nays (1). Alderman Ludowese
voted nay. Motion carried.
Ludowese moved, Powers seconded to approve.the award of bids for
13 intermediate sized Police cars for $47,521.00 and one compact -
sized sedan for the Fire Department to Adamson Motors -who submitted
the low bid; and to Clements Chevrolet to furnish one sub -compact,
two door sedan for the Public Services Department for $3,023.85 who
also submitted the low bid. and that the old cars would not be traded
in, but auctioned off at a' -later date. Ayes (7), Nays (0). Motion
Carried. ( Resolution No. 98-75
Powers moved,. Kamper seconded to approve the semi-monthly bills,
in the amount of $278,648.04 ( List attached Ayes (7), Nays (0).

Larson moved, Powers seconded to instruct the City Attorney to
take the necessary action to comply-wi.th the Public Services
Department requests to post a 4-ton 'limit on the 7th Street N. W.
bridge over Cascade Creek at the Arrow Marine Bui ' lding, and table the
request to close the 8th Avenue N. W. bridge over Cascade Street for
further study and notification. Ayes (7), Nays (0). Motion carried.

99-75 authorizing the City Clerk to advertise for bids on the
Project 6309-74 J 8522 Sanitary Sewer Extension on 9th Avenue S. E.
South of 5th St. S. E. 200 feet. Ayes (7), Nays (0). Motion carried.
E-12 Strain moved, Kamper seconded to instruct,the City Attorney to prepar(
a.resolution (Minnesota Highway Department Form 30731 will be furnish(
to the City Attorney ) requesting an d authorizing the Commissioner of
Highways to act as an agent for the City of Rochester on the above
referenced project. Ayes (7), Nays (0). Motion carried.
E-13 Powers moved, Kamper seconded to instruct the City Attorney to
prepare a resolution to establish the various regulations on
Loading Zones near the Milton Hotel on 4th Avenue N. W. and 3rd
Avenue N. W.Ayes (7), Nays (0). Motion carried.
E-14 Powers moved, Stra-in seconded to instruct the City Attorney to
prepare a resolution amending Ordinance No. 148.030 to establish 10-
hour metered parking in Parking Lot No. 5 ( East Center Street
Ayes (7), Nays (0). Motion carried.
E-15 McNary moved, Larson seconded -to adopt the prepared Resolution
No. 100-75 authorizing the Mayor to sign an agreement with ROCOG and
the City in order for the City to provide services for mass trans-
portation technical s'tudy. Ayes (7), Nays (0). Motion carried.
F-1 Larson moved, Kamper seconded to adopt the prepared Resolution No.
101-75 approving the Public Utilty Resolution dated March 11, 1975
establishin,g salaries and salary adjustments for the calendar years
of 1975-1976, and requesting approval,iof the labor agreement with
IBEW, Local Union No. 949 for the years 1975 and 1976 Ayes (7),
Nays (0). Motion carried.
F-1 Larson moved, Ludowese seconded to adopt Resolution No. 102-75
approving the contract amendment No. II to the Contract with Crescent
Electric Supply Co. for the installation of electric equipment by
$3,238.79 to a total amended contract price of $1,021,895.79 Ayes
(7), Nays (0). Motion carried.
F-1 Kamper moved, Powers seconded to adopt Resolution No. 103-75 amending
Ordin*ance No*. 871 as follows:
Sectton E, Passenger Loading Zones is amended by adding a new
paragraph (25) to read as follows:
(25) First Avenue S. W. on the West side of the Street for a distanCE
of 40 feet more or less in front of the premises known as 221 First
Avenue S. W., ( Lawler theatre ) from 8:00 a.m. to 5:00 P.M.
Monday thru Friday. Ayes (7), Nays (0). Motion carried.

Larson moved, Strain seconded to adopt Resolution No. 105-75 acceptin,
the easement (Utility ) to the City by Pendle-Hansen-Bagne Properties
Inc..across the east 5' of a portion of Outlot 25, Northern Addition.
Ayes (7), Nays (0). Motion carried. -
An Ordinance realting to the salaries for.the Offices of Mayor, Al-
derman -At -Large and Alderman of the City of Rochester,.Minnesota;
Repealing Ordinance No. 1756 as follows:
Mayor - $11,388. per year; Alderman - at - large $5,805. per year,
and each Alderman $4,785. per year. This will be in effect April
1, 1975. Larson moved, Powers seconded to suspend rules and give
this Ordinance a second reading, Upon roll call vote, All voted
Ayes (7), Nays (0). Motion carried. Strain moved, Kamper seconded
to adopt the Ordinance as read. Ayes (7), Nays (0). Motion carried.
Strain moved, Kamper seconded to remove the J 8519 Widening and Re-
paving 4th Street S. W. from 2nd Avenue S. W. to 4th Avenue S. W.
from the table. Ayes (7), Nays (0). Motion carried. Strain moved,
Larson seconded to table this indefinately. Ayes (7), Nays (0).
Motion carried.
Mr. Gerald Swanson read Judge Olson's order in the case of James
Vesey vs the Mayor and the Common Council - in his decision in effect
holds the Common Council has the right to revoke the license of Jim
and Joe's - that there was sufficient evidence, because of the minors
being present on the premises, that the Council does not have the
right in conjunction with revoc4tion to state a revocation and impose
other restrictions that are not applicable to other licensees. If thl
Council wants to procede to act on this, they should act by amending
their previous order to revoke the license without any conditions
attached. After discussion by the Council, McNary moved, Larson
seconded to revoke the license. After roll call vote, Aldermen
Kamper, Larson, Ludowese, McNary voted aye (Ayes (4)), Aldermen Power..
Strain, and President Postier voted nay (Nays (3)), Motion carried,
and the City Attorney was instructed to draw up the order.
Having no further business, McNary moved, Powers seconded to adjourn
the meeting until 2:00 P.M., April 7, 1975. Ayes (7), Nays (0).
