A-1 President Postier called the meeting to order at 7:30 P.M., the
following members being present: President Postier, Aldermen Kamper
Larson, McNary, Strain. Absent Aldermen Allen, Powers.
Kamper moved, McNary seconded to approve the minutes of May 5, 1975,
with the following correction. H-3 should read: Larson moved,
Kamper seconded to approve Resolution No. 162-75 re Legislation -
exempting the City from conducting City Elections in conjunction
with the State and Federal Elections held in November.- Ayes (5),
Nays (0). Motion carried.
B-2 Hearing on the Final Plat of Lots 1, 2, 3, & 4, Block 4, Elton
Hills East 5th Subdivision. No one wished to be heard, President
Postier closed the hearing. Larson moved, seconded by. Strain to
adopt the prepared Resolution No. 175-75 approving the plat.
Ayes (5), Nays (0). Motion carried.
B-3 Hearing on the proposed assessments for Watermain Extension in 7th
St. N.W. and in Arends Industrial Park First. Project #7402-1-74
J8492. Having no one wishing to be heard, President Postier
closed the hearing. McNary moved, Kamper seconded to adopt the
prepared Resolution No. 176-75 accepting the assessments. Ayes (5)
Nays (0). Motion carried.
Alderman Allen arrived at 7:40 P.M.
B-4 Hearing on the Petition to change the Zoning Districting on the
property located just North of the Former REA Building at 1700
North Broadway from the M-1 District to the B-lb District. Wishing
to be heard was Dave Hunt, Attorney for Jim and Joe Larson potential
buyers of this property. He stated that a Perkins Restaurant would
not be a detriment to the area, and there would be a fence along
the back of the property line. Also heard was Jim Larson of
Perkins. He stated that there would not be more traffic in this
area because of the restaurant, and also that there would be a
masonry wall 6 feet high in the back. Speaking in opposition to
the zone change was John H. Cachiaras of 1737 3rd Ave. N.E. and
Gene Reynolds of 1743 3rd Ave. N.E. Strain moved to deny the
zone change, seconded by McNary. Upon roll call vote, Aldermen
Larson, McNary, Strain, Postier voting Aye (4), Allen and Kamper
voting Nay (2). Motion carried, and the zone change denied.
D-1 McNary moved, Larson seconded to adopt the prepared Resolution
No. 177-75 requesting Sewer and Water Extensions to Hiawatha
Children'§ Home. Ayes (6), Nays (0). Motion Carried.
E-1 Larson moved, seconded by Strain to adopt the prepared Resolution
No. 178-75 formally adopting the 1975-1980 Capital Improvement
Program. Ayes (6), Nays (0). Motion carried.

Strain moved, McNary seconded to approve the following list of
licenses and bonds issued by the City Clerk:
Transfer "On and Off Sale" 3.2 Beer License from William
L.

at

Kamper moved, seconded by McNary to approve the semi-monthly bills
list attached, in the amount of $296,346.24. Ayes (6), Nays (0),
Motion carried.
Strain moved, Allen seconded to adopt the prepared Resolutions Nos.
179-75, 180-75, 181-75, and 182-75 authorizing the City Clerk to
advertise for bids for the season's supply of Road Oil and Cutback
Asphalt, Liquid Chlorine, Sand, Gravel & Crushed Rock, and Plant
mixed Bituminus. Ayes (6), Nays (0). Motion carried.
Larson moved, seconded by Kamper to instruct the City Attorney to
prepare a Resolution recommending approval of the --Zone changes for
Magnum Corp. - from_AG to-C--3 Section.l.0.,_ High Forest Township
.n the Willow Creek Sewer —District. _- Ayes (6), Nays (0)..Motion
carried.
Allen moved, Strain seconded to instruct the City Attorney to.�,
prepare a Resolution to change the Zone for Rochester Block and
Supply Co. from AG (Agricultural District) to R-1 (Residential
District), S.W. 1/4 Section 23, Rochester Township in;the Willow
Creek Sewer District. Ayes (6), Nays (0). Motion carried.
Strain moved,.McNary seconded to deny the request of Olympic
Village to asphalt Boulevard Area. Ayes (6), Nays (0). Motion
carried.

McNary moved, Larson seconded to adopt the prepared Resolution
No. 183-75 amending the following:
1. Section E, Passenger Loading Zones, amend Subsection (3) to
read:
(3) South Broadway, on the east.side of the street from.a
point 60 feet more or less North of third Street to -a point
130 feet more or less north of Third Street, five minutes
limit.
2. Section I, Zone A, 12 minute meters amend Subsection (1.5)
to read:
(1.5) South Broadway, on the east side of the street from a
point 130 feet more or less north of Third Street to a point
176 feet more or less North of Third Street (2 Stalls). Ayes
(6), Nays (0). Motion carried.
McNary moved, Kamper seconded to table the request to remove parking
on 4th Ave. S.W. in the 600 Block until the June 2, 1975 meeting.
This would give the Public Services Department time to notify
the residents. Ayes (6), Nays (0). Motion carried.
Strain moved, Kamper seconded to adopt the prepared Resolution No.
184-75 establishing Subsection (12.5) of Section D Truck Loading
Zones to read:
(12.5) First Avenue Southwest on the East side of the Street from
a point 66 feet more or less North of First Street to a point
94 feet more or less North of First Street.(1 stall). Ayes (6),
Nays (0). Motion carried.
Larson moved, Allen seconded to adopt the -prepared Resolution;No.
185-75 establishing a Commodity Loading Zone under Section J to
read:
(7) Fourth Avenue Northwest on the West side of the street from a
point 30 feet more or less north of West Center Street to a point
80 feet more or less north of West Center Street(2 stalls). Ayes
(6), Nays (0). Motion carried.
Strain moved, Kamper seconded to adopt the _prepared Resolution
No. 186-75 for the proposal of.enginee,ring services by Wallace
Holland Kastler and Schmitz for, Basic Construction on 21st Ave.
S.E. from T.H. No. 14 to 8 1/2 St. S.E. extended. Ayes (6),
Nays (0). Motion carried.
Kamper moved, Larson seconded to refer to the Committee of the
Whole on Tuesday, May 27, 1975, the Bid for sale of Dredge and
Dredging from Silver Lake. Ayes (6), Nays (0). Motion carried.
Allen moved, Larson seconded to instruct the City Attorney to prepa
a Resolution agreeing to participate in the cost of the Public
Transit Demonstration Project. Ayes (6), Nays (0). Motion carried.

Larson moved, Allen seconded to deny the,. -request to close 14th
Street S.E. at the entrance to Oak Terrace Estates. Ayes (5),
Alderman Strain voting Nay (1). Motion carried.
An Ordinance authorizing the use of residential business district
property for office purposes under the zoning ordinance of the
City of Rochester; amending Rochester Code of Ordinances, Section
65.600, as enacted by Ordinance No. 1659, as amended was given
its second reading. Larson moved, McNary seconded to adopt the
Ordinance as read. Ayes (4) Aldermen Allen and Strain voting
Nay (2), Motion carried.
An Ordinance amending Ordinance No. 1260 relating to the annexation
to the City of Rochester certain unplatted Land in the Northeast
Quarter of Section 34, Township 107 North, Range 14 West, Olmsted
County, Minnesota was given its second reading. Kamper moved,
McNary seconded to adopt the Ordinance as read. Ayes (6), Nays (0)
Motion carried.
Larson moved, Kamper seconded to adopt the prepared Resolution
No. 187-75 vacating a portion of 23rd St. N.W. in Hendrick's
Subdivision, and Utility Easement in Hendrick's Subdivision and
setting a public hearing for July 21, 1975 at 7:30 P.M. Ayes (6)
Nays (0). Motion carried.
Allen moved, Strain seconded to adopt the prepared Resolution No.
188-75 creating Downtown Development District Advisory Board.
Ayes (6), Nays (0). Motion carried.
An 'Ord .nance relating to the Building Code of the City of Rochester
and the adoption of certain amendments to the State Building Code
for the City of Rochester; amending Rochester Code of Ordinance,
Section 70.010 was given its first reading.
An --Ordinance Rezoning Certain Property and Amending Ordinance
No. 1659 known as the Zoning Ordinance of the City of Rochester,
Minnesota, was given its first reading.
Strain moved, Allen seconded'to have a 4-way stop sign installed on'
the corner of 6th Street S.E. and llth Avenue S.E. It now has a
2-way stop sign, and a petition was submitted requesting a 4-way
stop. Ayes (6), Nays (0). Motion carried.
Allen moved, Strain seconded to adjourn the meeting until 2:00 P.M.
on June 2, 1975. Ayes (6), Nays (0). Motion carried.
