Minutes of a Special Meeting of the Common Council of the City -of Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in said City, on
May 29th,1940.
President Lemmon called the meeting to order at 7: 30 o'clock P.M., the
following members being present: yemmon, Amundsen, Ahderson, Bowers, Moody,
Mrachek, Williams. Absent : None.
The call for the Special meeting was read, and President I,emmon ordered
that the same be placed on file; said meeting' having, been called for the
purpose of Canvassing the returns of the special election hald May 28th,1940,
and any other business the sand Common Council might deem proper.
The Common Council canvassed the returns from the special Election
held on Iltay 29th, 1940. -
Alderman Williams introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester:
That, the following is a tabulated statement and -list of the number of votes
cast for and against the amendment at the Special 'Election held on May 29,194o,
kn the City of Rochester, Minnesota, as determined by said Common Council on the
canvass of the returns of said special election made on the 29th day of May,1940,
and said statement is hereby declared to show the result of the said special
election; said tabulated list and statement being as follows:

Amendment.
Amend the last paragraph of Section 164,
of the Charter of the City of Rochester,
Minnesota, so that the same shall dread
as follows:
For the Part: Improvement Fund so
much as it may deem necessary for the
improvement of the Public parks and
parkways, in or near the City, not
exceeding four (4) mills on the dollar
of such assessed ValIxation.

Be it further resolved by the said Common Council: That the number of
persons present and voting at said Special Election on the above mentioned
proposed Amendment is as follows:
Amendment. Total 1903 "Yes" 1123 °1do" 777 Blanks 3
The number of voters voting in favor of the said proposed Amendment and
against said proposed Amendment are as shown on the above statement and that
said Amendment was not ratified by said voters as shown by the returns of said
election above stated.'
I Be it further resolved by said Common Council: That the whole number of
persons present and voting on the said Amendment at the said Special Election
iwas 1903 and that it required 1142- votes or 60 pe•r cent of those who voted at
'the said Special Election to ratify the said Amendment and that there were not
,more than three -fifths (3/5) of the total number of votes in favor of the
adoption and rati-f`,,cation of the said proposed amendment and that the said
amendment did not receive the necessary three -fifths (3/5) of the said total
votes and therefore was not ratified and adopted by the voters at the said
,Special Election and therefore did no.t carry and is not made a part 6f'the
IjCharter of the City of. Rochester, Minnesota.

Upon motion by Williams second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alder,map Amundsen introduced a resolution appropriating $4,735.00 from
the Interest Fund and ordering,payment made to the First National Bank, for
payment of the June 1st,194o giaturity of interest on City of Rochester
Improvement Bonds Nos.4+6 to 50,inclusive $112.50; on 41% Improvement Bonds
Nos. 73 to 190 inclusive $2,295.00, and on City of Rochester 47o Sewage
Disposal Plant Bonds Nos. 253 to 350 inclusive $2,327.509' . which was read.
Upon motion, by Amundsen second by Anderson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
T.he recommendation by the Police Committee and the Chief of Police, that
the proposal of the Universal Motors, Inc. for furnishing a specially
designed Police Sedan, 95 H.P.Mercury motor, for the net sum of $1L71.00, for
us,e of the Police Department of said City, was read and President Lemmon
ordered that the same be placed on file.
Alderman Amundsen introduced a resolution accepting the proposal of the
Universal Motors, Inc., for the furnishing to the Police, Department of said
City, a specially designed Police Sedan.with 95 H.P.1iercury Motor for the
net " sum of $?471.*00, which was read.
Upon motion by Amundsen second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Mootr second by Bowers the City Clerk was instructed to
return the certified checks of the unsuccessful bidders for furnishing a
new automobile for use of the Police Department.
Applications signed by George A.Moore, and Lew 11artinsen, for transfer of
on sale license No.342 and off sale license No.599, for selling non -intoxicating
malt liquors at 607 North Broadway, to Lew Martinsen, were read, and upon
motion by Williams second by Bowers the said application was not granted and
the City Clerk instructed to return the fee which accompanied said application.
A communication from Ida L.Jahnke, appealing from the decision of the
Building Inspector in refusing to is.sue a permit for the remodeling of 'her
house into a duplex, was read, and upon motion by Moody second by Williams
the said matter was referred t-o the Zoning Board.
A communication from Dr. T.B.M agath, to J.T.Lemmon, concerning a hearing
regarding the alleged pollution of the 11innesota River from Mankato to its
junction.with the Mississippi River,. at Fart Snelling, said hearing to be held
at 10:00 A.I%I-June 6th, in the Chamber of the House of Representatives at the

State Capitol, in St .Paul, was read, and upon motion by AT second by
Anderson any member of the Council who can go wareaaizthdrized to attend the
said hearing, at the expense of the City of Rochester.
A communication from the Commissioner of Highways of the State of
T4innesota, regarding.the removal of certain buildings located in the Street
on Broadway Street North, preparatory to the construction of a .new bridge.
by said Highway Department, was read.
Upon motion by Williams second by Amundsen, the City Attorney was
instructed to prepare the necessary legal papers to notify parties occupying
City owned property to vacate in legal time,- said papers to be prepared but not
served until after the meeting with the Highway Department Engineers which
is scheduled for May 31st, 1940.
Upon motion by Moody second by Mrache, the City Clerk was instructed to
prepare a resolution advertising the Witherstine property for sale.
Upon notion by Williams second by Anderson, the Common Council
adjourned.
