Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on June 14th, 194o. President Lemmon called the meeting to order at 7:30 o'clock P.Pt., the following members being present: Lemmon, Amundsen, Anderson, Bowers, -moody,- Mrachek,tvilliams. Absent: None. Upon motion by ?Moody second by Amundsen the minutes of the meeting of June 3rd, 1940, were approved. President Lemmon stated this as being the time and place set for a hearing on the construction of curb and gutter on S6:con;d Street Southeast from Thirteenth Avenue Southeast to Fifteenth Avenue Southeast. Pair. Gates, pepresent- in.- Lirs. Georgia Oates, presented a remonstance against the construction of said cprb and gutter, and President Lemmon 'referred the said remonstrance to t1he Street and Alley 'Committee, for report thereon at the meeting to be held June 24th, 1940, and further action on this improvement deferred until said date.. President Lemmon stated this as being the time and place set for receiving and opening bids for the cleaning and painting of the East Center Street bridge. The following bids were opened at this time: E. A. Dane rick, $934.00, Marcus H.Mattison $1075.00. President Lemmon referred the said bids to the Street and Alley Committee and the City Engineer for recommendation. President Lemmon stated this as being the time and place set for receiving and opening bids for the purchase of $62,000.00 City of Rochester, Minnesota, 2k% Surface Drainage -Sewer Bonds. The following bids were opened at this time: Wells Dickey Company: Par, accrued interest, and premiyim of $1609.00; Northwestern National Bank & Trust Company of Minneapolis, Minnesota: Par, accrued -interest and premium of $2175.00; First National Bank of St.Paul, First National Bank & Trust Company of Minneapolis, and the Bigelow Webb & Co., Inc.of Lfiinr_eapolis: Par, accrued interest and a premium of $1290.00; Piper, Jaffray & Hopwood: par, accrued interest and premium of $1377.02; Kalman & Company: Par accrued interest and premium of $1701.00; Halsey,Stuart & Co., Inc.: Par, accrued interest and premium of $1991.00; Paine,Webber & Co.,: Par, accrued interest and a premium of $1991.00 . President Lemmon referred the above bids to the -Finance Committee for recommendation. However, he is willing to make reasonable changes and improvements in the plant. Upon motion by Williams second=by Mrachek the above matter was referred to a Committee appointed by the President of the Common Council. President Lemmon appointed the following to said Committee: Chairman of the Board of Health and Welfare, Fire Warden, Building Inspector, Chairman of Fire Committee, Chairman of Street and Alley Committee, Chairman of the Public Grounds Committee, and the City Attorney. The request of the Shell Oil Company for a permit to remodel their service station facilities on Lot 1,Block 3, Flather's Addition, was read, and Upon motion by Moody second by Amundsen the matter was referred to the Board of Zoning for recommendation. A communication from the Department of Health, Division of Sanitation, regarding sewer extensions for the Rochester State Hospital, was read and President Lemmon referred the same to the Sewer Committee. Copies of requisitions by the Deputy Health Officer, upon Saint Mary's Hospital for the isolation of Helen Fritsch, diagnosed to be tuffering from suspected. Poliomyelitis, and of Balch Perkins diagnosed to be suffering from Chickenpox, were each read, and President Lemmon ordered that the same be placed on file. The appointment by the Mayor of Peter D. Claude as a Special Policeman for duty at the City Dumping Grounds, he to serve without pay and to hold office until the second Monday in April,1941, unless sooner removed, was read and President Lemmon ordered that the same be placed on file. il A.copy of a resolution passed and adopted by the Public Utility Board requesting authority to enter into contract with the Fullerton Lumber Company for the furnishing of poles, for a total bid of $1390.20, was read and President Lemmon ordered that the same be placed on file. The report of the Clerk of the Municipal Court for the week ending June 3, 1940, showing criminal fines and. costscollected $290.00, civil fees $14.00, conciliation court fees $1.85; and for the week ending June 10th,1940, showing criminal fines and costs colledted $591.90, civil fees received $7.05, Conciliation Court fees $1.00, were each read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The repixrts of the Building and Plumbing Inspector and the Electrical Inspector for the month of May,194o, showing building permits issued $170.00, Plumbing permits $144.00, and Electrical permits $56.50, were each read acid President Lemmon referred the same to the Finance Committee. 20 RECORD OF OFFICIAL, PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., June 14,19 40 The recommendation of the License Committee that the application of Clinton Hugh Wilson for a journeyman Electrician's license be granted, was read, and upon motion by Moody second by Amundsen, the said Committee report was accepted and the license granted to Cl-1nton Hugh Wilson. The recommendation of the License Committee that the application of M.J. Donahue for transfer of his liquor license from 20 Third Street Southwest to a location on South Broadway be not granted, was read, and upon motion by ;Amundsen second by Bowers the said recommendation was approved. The City Engineer's trial balance for the month of May, 1940, was read, and President Lemmon ordered that the same be placed on file. A petition asking that the eater main in Fifteenth Avenue Northeast be extended from Third Street Northeast to Fourth Street Northeast, was read., and President Lemmon referred the same to the City Engineer and the Sewer Committee. The application of Wm. Holland for a solicitors license was read, and upon motion by Williams second by Anderson the license was not granted. The application of C.R.Bowen for a permit to move a house from the Chicago North Ylestern Railway to Golden Hill, was read, and upon motion by Bowers second by Anderson the permit was granted, all voting in favor thereof except Alderman Moody who voted "No." The application of C.R.Bowen for a permit to move a house from the Mayo Farm to a point south of the City, was read, and upon motion by Mrachek second by Amundsen, permit was granted, all voting in favor thereof, except Alderman Moody who voted "No". The application of Lloyd Culver for two permits to place and maintain signs, were read, and upon motion by Mrachek second by Moody, permits were granted. The application of Archie M.Ackerman for a soft drink: dealers license, was read, and upon motion by Amundsen second by Anderson, license was granted. The applications of Traverse H.Schinke for on sale and off sale licenses to sell non -intoxicating malt liquors, were each read, and upon motion by Moody second by Amundsen, the said applications were referred to the License Committee for report on June 24th, 194o. The contract bond of Martin Paulson in the sum of $670.00 with the Fidelity & Casualty Company of New•York as surety, of Harry T.Earle in the sum of $790.00 with the Standard Surety & Casualty Company of New York as surety, and the bondsof the Roxanda nines, Inc. in the sum of $11,600.00, and $6,731.O4, with the Seaboard Surety Company as surety, were each read, and upon motion by ldrachek second by Amundsen the said bonds were approved, the sureties thereon accepted and it was ordered that the same be placed on file. Alderman Amundsen introduced a resolution accepting the bid of E.A.Danewick in the sum of $534.00, for gleaning and painting the Center Street East bridge lover the Zumbro River, Frhi ch was read. Upon motion by Amundsen second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the i (said resolution duly passed and adopted. The report of the Finance Committee recommendinT that the bid of the Northwestern National Bank and Trust Company of Minneapolis, Minnesota, be accepted, for the purchase of $62,000.00 City of Rochester, 21.% Surface Drainage Sevier Bonds at a premium of $2,175.00, was read_, and upon motion by Moody second by Amundsen said recommendation was accepted. Alderman Amundsen introduced a resolution accepting t'he bid and proposal of the Northwestern National Bank & Trust Company of Minneapolis, Minnesota, for the purchase of $62,000.00 City of Rochester, Minnesota, 22p Surface Drainage sexier bonds, at par, accrued interest and a premium of $2175.00, which was read. Upon motion by Moody second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating-$453.00 from the General Fund, and ordering payment made to Elmer W.Lyon for repairing ceilings in the Community Room and the Police Department, which was read. Upon motion by Williams second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $207.00 from the General Fund and ordering payment made to R.C.Cranston, for -an Allen gales r Adding machine for use in the City'Engineer's office, which was read. Upon motion by Mrachek second by Boyers that the said resolution be aXopt•ed las read, and all voting in favor thereof, President Lemmon declared the said Iresolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $349.57 from the General Fund and ordering payment made to the Standard Oil Company, for dne tank jcar UTLX 94591 of road oil., which was read. Alderman Mrachek introduced a resolution appropriating $494.95 from the General Fund and ordering payment made to George C.Peterson Company for tank car #SWLX 936 of gasoline, which was read. Upon motion by Amundsen second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a 'tesolution appropriating $425.00 from the General Fund and ordering payment made to G.Schwartz & Company, for installing curb and area vrays at the City Hall, which was read. Upon motion by Bowers second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $1117.25 from the General Fund and ordering payment made to the Street and Alley Fund, for use of equipment during P.4ay, 1940, which was read. Upon motion by Mrachek second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $21.60 from the General Fund, and $477 - 90 from the Street and Alley Fund, and ordering payment made to Morse Brothers, for sand, gravel and crushed rock furnished during part of April and May,1940, which was read. ♦ R Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $401.65 from the General Fund, $49.90 from the Permanent Improvement Revolving Fund and ordering payment made to the Rochester Post-Bulletingfor official publications and printing during May,1940,which was read. Upon motion by Williams second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $965.90 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund, for use of equipment during May,1940, which was read. Fund, for payroll for labor -during the last half of. May,1940,which was read. Upon motion by Amundsen second by Mrachek that the said resolution be except Alderman Williams, who voted 11IT0 if adopted as read, and all voting in favor thereof, /President Lemmon declared the said resolution, duly passed and adopted. Alderman Moody introduced a resolution appropriating $2019.50 from the kark Improvement Fund and ordering payment made to H.E..Swanson Company, for (structural steel for three bridges in Soldier Field, which was read. Upon motion by Mrachek second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said, resolution duly passed and adopted. Alderman Moody introduced a -resolution appropriating $629.65 from the Sewer Fund and ordering payment made to Yoeman's Brothers, for parts for the sewage disposal plant aerators, which was read. Upon motion by Pdrachek second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared I the said resolution duly passed and adopted. Alderman Bowers introduced a resolution granting public dance permit to IMrs. Dale Hess for the A.O.U.W.Hall June gth,1940, and fixing the fee at $3.00, which was read. Upon motion by Amundsen second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution granting public dance permit to the Central Labor Union for the Woodman Hall, June gth and 15th., 1940, and fixing the fee at $6.00, which was read. Upon motion by Anderson second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said. resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $719.47 from the General Fund and ordering payment made to Col -Tex Refining Company and Anderson - Prichard for tank car NATX 1397 of asphalt, which was read. Alderman Anderson introduced a resolution appropriating $501..10 from the General Fund and ordering payment made to the H. H. Alderman Amundsen introduced a resolution designating additional streets to be sprinkled and/or oiled during the`19l�0 season, and ordering a hearing on.the said sprinkling and/or oiling to be held at 2:00 o'clock P.A., on July 1st 1940, which was read. Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering a hearingon the levying of special assessments, said hearing to be held at 2:00 o'clock on July lst,1940, on the following improvements: the construction of a water main in Sixth Avenue Northwest from Tenth Street Northwest to Eleventh Street Northwest; the construction of a sanitary server and water main in Fifth Street Southeast from Twelfth Avenue Southeast to Thirteenth Avenue Southeast; the construction of a sanitary sewer,in 10-L Street Southeast from First Avenue Southeast to a point 260 feet east; the construction ofa sanitary sewer ILn Tenth Street Southeast from Eighth Avenue Southeast to a point 170 feet east,' which was read. Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution authorizing the Public Utility Board to enter into contract with the Fullerton Lumber Company, for the furnishing of 115,poles for a total sum of $1390.20, which was read. Upon motion by Amundsen second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared th6 said resolution duly passed and adopted. Stanley Gerlicher, Secretary of the Band and Music Commit tee, submitted a list of the personnel and recommended salaries for the Park Band during the 1940 season. Alderman Amundsen -introduced a resolution approving salaries and personnel of the Park Band for 1940, as recommended by the Band Committee, which was read. Upon motion by Moody second by Amundsen that the said resolution be adopted as read-, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. 25 RECORD OF OFFICIAL, PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF °ROCHESTER, MINN., June 14, 194o • • The following communication was read and President Lemmon ordered that the same be placed on file: 0 it State of Minnesota Department of Highways Rochester, Minnesota June 14 1940 City of Rochester Rochester, Minnesota Attent: Mr.A.C.Smith City Engineer Re: Br.No.5959 S.P.5510-02 (T.H. 63-59) Dear Sir: You will note that from the contents of the attached copy of memo which I received from 16r. E.J.,Miller,Bridge Engineer, your City will have to furnish all pipe required for your sewer syphon as well as the 4911 pipe connections. The quantities of required new pipe are as follows: 340 Lin. feet of 491 R.C.Pipe 520 Lin. feet of 2411 C.I.Pipe (including elbows) The installation of these 2411 and 49" lines as well as the con- struction of the large manholes at each end of the sewer syphon, will be performed by the State's Contractor at no cost to the city. As it is essential that this pipe be on the site of the proposed new bridge at the time that the &ontrac•tor beg.ans his operations, it is requested that you present this matter before your City Council immediat- ely and obtain their approval of a resolution agreeing to furnish to the State the above referred to quantities_ of pipe. Please have at least three (3) copies of said resolution or cooperative agreement executed at once, as the District Engineer, of the Federal Public Roads Administration, has authorized the State to proceed with the advertising of this project, subject to receipt immediately of,one copy of our agreement with your City of the reconstruction of the inverted sewer syphon. Alderman Amundsen introduced the following .resolution the following resolution, which was read: "WHEREAS, The State- of Minnesota have prepared plans for the construction of a neiv bridge over the Zumbro River in the City of Rochester, Minnesota, on Broadway Street North, known as Bridge No..5959, S.P.5510-02 (T.H.63_59) which plans include the construction of a new sewer syphon, and WHEREAS, The City of Rochester, Minnesota, has agreed to furnish the Sewer Pipe for said new sewer syphon, and WHEREAS, The City Engineer has submitted an estimate of the cost for • 34o lin. ft. of 4911 R.C.pipe $2210.00, and 520 lin. ft. of 241, C.I.pipe including elbows) $3744.00, total $5954.00; SO THEREFORE, Be it resolved by the Common Council of the 'City of Rochester, Minnesota: That the City of Rochester, Minnesota, furnish 340 lin. ft. of 'E911 R.C. pipe and 520 lin. it. of 241, C.I.pipe (including elbows) and that the said pipe be purchased for use of the State of Minnesota, in constructing the new sewer syphon in connection with Bridge No.5959, and -,Ad u RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF .ROCHESTER, MINN., June 14,1940. Be it further resolved by the said Common- Council: • -That th-e City Clerk- of said City be and he is hereby authorized and directed to advertise for sealed bids for the furnishing of said 49" R.C.pipe • and 24" C.I.Pipe (including elbows), in accordance with the State of -Minnesota plans and specifications for the construction of said Bridge No.5959,which sealed proposals w-il-1 be received -and opened at a meeting of the Common Council, which is to be held at 2:00 o'clock P.M., on July lst, 1940. " Upon motion by Moody second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced the following resolution which was read: "WHEREAS, The State of Minnesota, acting by and through its Commissioner of Highways, is about to erect or is in the process of erecting a bridge to be known and described as Bridge No.5959 which is on State Trunk Highway now known as No.63, within the- corporate limits of the City of Rochester, Minnesota, and WHEREAS, The Common Council of the City of Rochester, Minnesota, is desirous that such bridge be equipped with fixtures,and wiring for the proper lighting of same, and - • WHEREAS-, The Commissioner of Highways ,hos submitted to the City of Rochester, a proposed contract concerning such work, a copy of which is hereto attached, and forms a part of this resolution, - - - - NOW THE'REFOR:$, Be it resolved by the -Common Council of the -City of Rochester;) Minnesota, in meeting duly assembled, that the contract in the form submitted by the -Commissioner of Highways of the State of I-Iinnesota,-and which forms -a- part of this resolution, be and the same hereby is accepted and adopted, and that s-aid contract, when properly executed shall be in full force and effect and binding upon the City of Rochester, Minnesota, and the State of Minnesota, acting by and through its Comrpissi oner of Highways. - BE IT FURTHER RESOLVES; ThAt tHd Mayor- and the City Clerk, be- and- they hereby are expressly authorized and directed forthwith to execute said contract for and on behalf of the City of Rochester, -Minnesota." Upon motion by Mrac�hek- second by° Wi-lliams that the said resblution� be adopted as read, and all voting in favor thereof, :President Lemmon declared the said resolution duly passed and adopted. - - - _ • Alderman Amundsen introduced the following resolution, which was read: "WHEREAS, The State of Minnesota, acting by and through M.J.Ho•ffman, its Commissioner of Highways, have submitted to the City of Rochester, Minnesota, a cooperative agreement between th-e C-ity of Rochester, 1-1-inmesota, and the State of Minnesota, covering the W.P.A. construction of curb and gutter, sidewalk and drop inlets, and ornamental guard rail construction p-roject on Trunk Highway No.63 along that portion of South Broadway between Ninth Place Southeast and Sixth Street Southwest; the amount of the cost to be reimbursed- by- the City of Rochester, to the State of Minnesota, for said improvement, being estimated at $4044 00 in said cooperative a-greement; SO THEREFORE, Be it resolved by the Common Council of the City of Rochester, Minnesota: That the said cooperative agreement be and the same is hereby accepted by the Common Council for the City of Rochester, Minnesota, and the Mayor and City Clerk are hereby authorized and directed to execute the said agreement for said City of Ibchester, Minnesota."
