Minutes of an adjourned regular.meeting.of the Common Council of the City of
l Rochester, Minnesota, . held..in..the Council. Chambers, in the City Hall, in said
City, on June 24th.,.1940.
President Lemmon .called.the .me.eting. to order at. 7:30 o'clock P.M., the
following members being present.: Lemmon,. Amundsen,.Anderson, Bowers, Moody,
jMrachek, Williams., Absent: None.
Upon motion by Moody -second by Bowers the minutes of the meeting of June
114th,1940, were approved.
President Lemmon stated this as. being. the- timeand place set fop a hearing
on the widening of the pavement. on. Fourth Street Southeast, from Third Avenue
Southeast to Sixth Avenue Southeast,_ and asked if any one present wished to be
heard concerning this.impro.vement.:. No one present wished:to be heard.
President Lemmon. stated..this,,.as:..being the time and place set for receiving
bids for the widening. of. the pavement and construction of curb and gutter on
Fourth Street Southeast from Third Avenue Southeast to Sixth Avenue Southeast.
The. following bids were, received. and..- opened. at this time: H.T.Earle $6836.40,
L.M.Feller Company $6967'.52.. President.Lemmon referred the said bids to the
Street and Alle y Committee and -the City Engineer, for tabulation and recommenda-
tion.
President. Lemmon.. stated this, a.s being, the time and place set for receiving
and opening bids_ for. the purchase, of the North half of. Lqt 5, and all of Lots
6 ,and. 7',_ B_loek. 13, Original.. Plat, known as th-e Witherstine Property., 'The propos
of -.,the Mayo Properties Ass.o.ciation in th.e. sum of $11,844.64, was opened and read
at this time_. _
Alderman Moody introduced.a resolution accepting the bid and proposal of
the Mayo Properties Association to purchase the north half, of Lot 5,, and all of
Lots 6 and 7, Block 13, Original Plat, for the ,sum of $11,844.64„ whidh_was
read.
Upon motion by Amundsen second. by Williams that the sai.d..resolufd on be
adopted as read, and all voting. -in favor thereof, President Lemmon declared the
said resolution duly passed and. adopted.
The recommendation .of the. Street and.Alley Committee and the City Engineer
that. the bid of H.T.Earle in. the_ sum of $6, s36.40 for the widening of Fourth
Street Southeast from ..Third Avenue to Sixth Avenue Southeast -be accepted, was
read, and upon motion by Mrachek.second .by Amundsen the said Committee recommen
tion-was accepted.
A notice of appeal from.the de.cision...of the Building Inspector in refusing
Anna L.Lawler a building permit.for a.three room cottage on theback of her lot
at 119 Fifth Avenue Northwest,was 'read, and upon mot.iori by_. Mr.achek second by
Amundsen the said matter was -referred to the Zoning Board.

A remonstrance against -the widening of Second Avenue -Northwest from Center
Street to the Chicago -Great -We -stern Railway tracks was read, -and President Lemmon
ordered that the same beplaced on file.
The recommendation of -the Board of Zoning that the Shell Oil Company be
given a building permit for the improvement of•their oil station on Lot 1,Block
3, Flathers Addition, without any change in the zoning ordinance, was read and
upon motion by -Moody second by Bowers the said recommendation was approved and
the Building Inspector instructed toissue a building permit for said
improvements.
The report of the :Street- anal..Alley Committee and the City Engineer on
the construction of curb and gutter on Second.Stre-et Southeast from Thirteenth
Avenue -Southeast to Fifteenth Avenue Southeast was read, and upon motion by
Amundsen second by Williams said report..was approved:
The report of the Sewer Committee and the - City Engineer recommending that
the -water main in Fifteenth Avenue Northeast be extended from Third Street
Northeast to Fourths Street�,Northeast, was read, and.upon motion. -by Mrachek
second by- Bloody-, said report was accepted.
The recommendation of- the. Police Committee -and the Chief of Police that
the two motorcyc.les.in use in the Police Department be traded in for a new __
Harley -Davison motorcycle e-quippeA with -radio receiving set at a net additional
cost to the City of $145.00, was read, and upon motion by'Williams second by
l Bowers said recommendation -was approved.
The reports of the Clerk of the Municipal Court for the week ending
June 17th,1940, showing criminal.fines and costs collected $260.00, civil fees
received $13.20, conciiiation. court fees receiv.ed-$1.00, -ancl. for the week
ending June 22nd,1940, showing criminal fines and costs collected'$367.20, civil
fees received $6.45; and conciliation court fees received $3.00, were each read,
and having been previously .app.roved by'the City Attorney, President Lemmon
ordered- that the. same...be placed on-. file.
The request of the City Engineer that $1,000.00 be appropriated from the
Sewer Fund, for use of the Street and Alley Committee, was read and President
Lemmon ordered that, the same be placed on file.
A. communication signed by .several, property owners on the. south side of
Twelfth Street Southeast :fxom.Vhird.Avenue to 9P4venue-.Southeast objecting to
the making of any assessments for the proposedLcurb and gutter and sidewalk
was read, and several persons appeared before the Council voicing similar
objections to any assessment's being made for the costs of said improvements, but
stating that they were not against the improvements; among those who spoke.before

the Council were Mr. Gray, Mr. Zuehlke, and Jack Batdorff• Alderman Anderson
stated that 100 per cent on the south side were objecting. Alderman Moody stated

stated that this was an: o:p.po.rt.un.i.tyfor the City of •Eoches.ter to get a much
needed improvement on said street through the proposed -State Highway Department's
1W.P.A.Project, at not over one. third of ... the usual cost of such -work to the
1property owners.
Upon motion by Moody -second -by Ander.s.on.action.on the -above matter was
deferred until July 1st, 1940..
The application of the -Motor Sales & Service Company for a permit to place
land maintain a sign at 412.Pirs.t Avenue.Southwest, was read, and upon.motion by
Mo o,dy se con d by. Amunds.en, p.e rmit was.. grant d.
The application of Glenn. Blook fox a. soft drink dealers license was read,
land upon motion by Amundsen second. :by Moody Liden•ce was granted.
A statement. signed .by _22...pe.opleas. favoring, and nine as not objecting to
the operat-ion. of an eat.ing....place. ..w.i.t.h. 3.2 beer at 119 Sixth Street Southwest
by Traverse. Schinke•., wasread,.- an.d_..P.r.e.sident . Lemmon ordered that the same be

Upon motion by Mracheksecond by Moody the-applicationsof Traverse Schinke
for -on -sale. and off -sale .licenses to sell non -.intoxicating malt liquors at
119 Sixth Street- Southwest, were granted, all voting in favor thereof except
lAlderman Bowers who voted "No."
A communication from Don Emerson stating..that he.had transferred to G.H.
Glinke all his right, title and equity i n th:e.liquor business at No.12 Second
Street ' Southeast, _and. requesting,that On -Sale liquor license No.102_be
transferred to G.H.Glinke, and..the name of Don Emerson removed from said license,
was read, and upon motion -by Amundsen -second by Mrachek the.transfer was.granted.
The ,application of :M.J..Donahue. for transfer -of his on -sale liquor license
from 20 Third. Street Southwest to 307 Broadway Street South, was read, together
with a copy of a notice served -by. Jos.. Devlin to -Charles Gleason Secretary of
the Musicians Club that their lease .to the -west half of.,the second floor of
the building -Located at No..307 South.-. Broadway would not be renewed or extended
at its expiration on. iugus.t 15th.,.1940 .
A motion by Bowers second by Amundsen to defer action on the above applica-
tion of M.J.Donahue until the upstairs Tenant at 307 South Broadway had vacated
lost by the following vote: Ayes: Bowers,Amundsen and Moody. Nays: Mrachek
Williams, Anderson, and Lemmon. ,
• (� A motion by Mrachek second by Moody,.that the application of M.J.Donahue
for transfer of his on -sale liquor license to 307 South Broadway, be granted,
provided that the on -sale gon-intoxicating malt liquaw- license at said location
will be transferred or revoked on or before August 15th, 1940, carried by the
following vote: Ayes: Anderson, Moody, Mrachek; Williams. Nays,: Bowers and
Amuund,sen.

The contract bond of W.S.Nott Company in the sum of.$250.00 with the
National Surety Company as surety, the -contract bond.of the Universal Motor Co.
in the sum of $500.00 with the Weste.rn.Surety Company as surety, and the
contract bond of E.A.Danewick in the.sum of $834.00 with the Standard Accident
& Insurance Company as. surety., were each read, and upon motion by Williams
second by Mrachek, th.e said bonds were approved, the,sureties thereon accepted
and it -was ordered that the same, -be -placed on file.
Alderman Anderson intro.duc.e.d. a .resolution accepting the bid and proposal

Alderman Anderson introduced a resolution ordering a hearing on the
construction of a water main in Fifteenth Avenue Northeast from Third Street
Northeast to Fourth Street Northeast;. said hearing to be held at 2:00 o'clock
IP.M., on July 1st,1940, which..was..read.
Upon motion by Moody second.by Bawers.that the.said resolution be adopted
ias read, and all voting in favor .thereof, President Lemmon declared the said
resolution duly -passed and adopted.
Alderman Amundsen introduced a resolution ordering a hearing on the
the east sideof
widening of the pavement on/Third Avenue Southwest, �-Lfrom;,. Firgt , Street Southwest
Ito Center Street West, and on.First.Street Southwest from Sixth Avenue Southwest
Ito Seventh Avenue Southwest, said hearing-t.o be -held at,2:00 o'clock P.M., on
July 1st,1940, which- was.. read.
Upon motion by Amundse-n-se.cond.-by.Mrachek .that the said resolution be
adopted as read, and all votingin favor thereof, President Lemmon declared the
said resolution duly passed and. adopted.
Alderman Anderso-n introduced a resolution ordering plans for the
construction of curb and gutter on Second Street Southeast from Thirteenth
Avenue Southeast to Fifteenth Aven uenSoutheast, which was read.
Upon motion By Mrachek second by Williams that the said resolution be
ja dopted as read, and -all voting in.favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution adopting the plans, and specif.i
cations for the construction of curb and gutter on -Second Street Southeast from
Thirteenth Avenue Southeast to Fifteenth. Avenue Southeast, ordering a hearing

-Alderman Bowers introduced .a -resolution appropriating $499.90 ($80.40 from
the General Fund, and $41g.50 from the Street & Alley Fund) and -ordering payment
made to Morse Brothers, for sand and gravel furnished -during the "period Junelst,
to June 8th, 1940,. which was read.
Upon motion by Mrachek second by Anders"on that the said resolution be
adopted as read, and all. voting in favor thereof, President Lemmon declared the
said resolution, duly passed and adopted.
Alderman. Moody int-roduced a , resolut ion appropriating $442.29 from the
General Fund.and ordering..paymen.t made to the Standard Oil Company, for one
tank. car of road oil, which was read.
Upon motion by Amundsen second by Moody that the said resolution be
adopted as -read., and -'all. voting. in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mo-ody introduced a: resolution.appropriating $6,162.50 from
the Interest Fund, and ordering payment made. to.the First National Bank of Roches.

Alderman Moody introduc.ed.a resolution appropriating $1,645.00 from the
Permanent Improvement Revolving Fund and ordering payment made to the First
National Bank of Rochester, Minnesota, for. the July 1st, 1940, maturity of
City pf Rochester P.I.R.Fund Bond No.111,and for the July 1st,1940,maturity of
interest on.. P.J.R. Fund. Bonds.,whi.ch. was read.
Upon motion by Amundsen second by Moody that the said resolution -be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
res.oluti.on 'duly passed and- .adopt.ed.
Alderman. Mrachekint.roduce.d a .resolution granting public dance. permit. to
the Cbnbral Labor Union for the Woodman.Hall.on June 22nd,1940,and fixing the
fee at $3.00, which was read.

adopted as -reads and allvoting. in favor thereof, President Lemmon declared the

Alderman Mrachek introduced a resolution granting public dance -permit to
Dale Hess for the A.O.U.W.Hall, on June 15th,1940, and fixing the fee at $3.00,

Upon motion by -Anderson -second by Bowers that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $369.41 from the
Street and Alley Fund and ordering payment made to the•A-W.Company,Inc., for
lbroom wire and -parts for street sweeper, which was read.
Upon motion by Bowers se-cond.by Williams that the said resolution be adopted
las read, . and all. voting in favor thereof, President Lemmon _ declared the said
Ire_solution duly passed and adopted.
Alderman Amundsenintroduced a resolution appropriating $471.00 from the
General Fund and -ordering. payment made:.to the Universal Motors for a 1940 Ford
Sedan.. f.or use. in the... Police Department, per contract, which was read.
Upon motion- by Mrachek_second.by Amundsen that the said resolution be
jadopted as read, and all voting in.favor thereof, President Lemmon declared the
said resolution duly passed and. adopted.
The City Engineer submitted -specifications and an estimate of cost for
the furnishing of a two ton truck for use -in the 8ity Engineer's Department.
Alderman Doody introduced a.reso.lution adopting the City Engineer's
specifications for a two ton truck for use in the City Engineer's Department, and
ordering advertisement for bids to be received and opened at 7:30 o'clock P.M.,
on July gth, 1940, for the furnishing of said truck, which was read*'
Upon motion by Williams. second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution 'duly pas-sed and adopted.
Alderman Amundsen introduced an ordinance entitled,"An ordinance creating
a Sinking Fund and -levying .taxes for the payment of principal and interest on
$62,000,00 Surface Drainage'Sewe.r Bonds of the City of Rochester, Minnesota, datei
June .-1st, 1940, issued.. under provisions of Chapter 169,Laws of 1.92.7.." which was
given its first reading.
Upon motion by Moody second by Amundsen, and all voting in favor thereof,
the rules were suspended and the said ordinance given its -second reading.

Mr. R.H.McDonnell present-ad.the report on Municipal Gas Utility at
Rochester,Minnesota, as prepared by Burns.& McDonnell Engineering Company at the
request of the Common Council.
Upon motion by Bowers .second by Moody it was ordered that -the said report
be placed on file in the office of the.City Clerk, and that further action in
this matter be ,deferred until- 7:30 o'clock P.M., on June 26th,1940.
At the reggest of Alderman Bowers. the matter of the purchase of a new
typewriter for the BuildingInspecto..r's.office was referred to the Purchasing
Committee.
The request of Alderman .Mo.ody that::the :City have an extra unit for the
jS:top..and Go signals to be used duringthetime that repairs are necessary was
referred to the Police Committee.
Upon motion by Amundsen -second by Williams -the Common.Council adjourned
until 7:30 o-'clock. P.M.,. on June- 26th,19140.
