Minutes of a regular meeting of the Common:. .Council of the City bf Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in said City, on
July lst, 1940.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams. Absent: None.
Upon motion by Moody second by Anderson, the minutes of the meeting .of
June 26th,1940, were approved.
President Lemmon stated this as being the time and place set for receiving
and opening bids for furnishing 340 lineal feet of reinforced concrete pipe,
and 520 lineal feet of cast iron pipe. The following bids were received and
opened at this tire: United States Pipe and Foundry Company; 24" Class 150
Super-deLavaud Centrifugal U.S.Mechanical Joint pipe $6.75 per foot, 2210 U.S.
Mechanical, joint .bends $75.00 each; Wm. C. F.ras.er & Son, 241, Cast iron pipe
$7.00+per lineal. foot, 222° bends $72.50 each, �+S" '$einforced concrete pipe
4911 Reinforced Concrete pipe $5.00 per
lineal foot; Elk River Concrete Products Company, 49" reinforced concrete pipe

the said bids to the Sewer Committee and the -City-Engineer for -recommendation*
President Lemmon stated this asbeing the time set for a hearing on the
widening of the pavement and the construction of curb and gutter on Third Avenue
Southwest from Center Street West to First Street Southwest and -on First Street
Southwest from Sixth Avenue Southwest to Seventh Avenue -Southwest, and asked if
any one present wished to be heard concerning the said improvements., No one
present wished to be heard.
President Lemmon stated this as being the time and place set for a hearing
on the construction of a water main in Fifteenth Avenue Northeast from Third
Street Northeast to Fourth Street Northeast, and asked if any one present wished
to be heard concerning the said water main. No one present wished to be heard,

The construction of a water main in Sixth Avenue Northwest from Tenth
Street Northwest to Eleventh. Street Northwest;
The construction -of a sanitary sewer .and water -main -in Fifth Street South-
east from Twelfth Avenue Southeast to Thirteenth Avenue Southeast; . , ..
Theconstruction of a sanitary sewer in 10- Street Southeast from First
Avenue .Southeast to. a.point 260 feet east; and
The construction of a sanitary sewer in Tenth Street Southeast from Eighth
Avenue. Southeast to a -point 170 feet.east.
President .Lemmon asked .if any one present wished to be heard concerning
the levying of sp.ecial..assessments.-for the cost and expense of either or any of -
the above described improvements, No one present wished to be heard.
Dr. T.B.Magath, Health Officer, requested that four fifths of the sale
price of the Witherstine property be -returned to the Hog Farm; stating that
the money will be used for pe.rmanent.improvem'.nts on.the Hog Farm. Alderman
Moody called the attention of the. Council.to the fact that some years ago+ s'
temporary transfers were made to the Hog Farm which.have not been returned.
President Lemmon-referred the matter to the .Finance Committee and the Publi@
Grounds Committee.
H.O.Christensen, Attorney, representing residents in the vicinity of125
Sixth_Street Southwest, presented a remonstrance against the sale of 3.2 beer .
in that area. Mrs. Rommel,-Mrs..Fitzgerald and Mr. Evans -also voiced objections
to. the. sale of 3.2 beer in that area.
Archie- Be.rgan. appeared before the Council in the interests of the Olmsted
County Fair Board, and asked that light -and power be furnished gratis during
the -five .days of the fair. President Lemmon.referred the matter to the Lighting
Committee.
A petitionthat a curb and gutter be constructed on -East Center Street
from Eleventh Avenue to Fifteenth Avenue Northeast and Southeast, was read,
and. President .Lemmon ordered that the same be placed on file.
A petition that a curb and gutter be constructed on Seventh Street Soukhwest
from Fourteenth. Avenue Southeast to Lot 106 Belmont Addition, was read, and
President Lemmon ordered that the same be placed on file.
A petition asking that black -top surfacing be placed on Seventh Street
Southwest parkway between Tenth Avenue- Southwest and Fourteenth Avenue
Southwest, was read, and- president Lemmon ordered that the same be placed on
file.
A petition asking that a sidewalk..be constructed on the south side of
9� Streat Southeast from. Third Avenue ..Southeast to First Avenue Southeast, inhere
needed to obtain mail service, was read and President Lemmon ordered that the
same be placed on file.

Notices of appeals ..from the -decision of the Building Inspector in refusing
to issue building permits to W.H Penny and H.J.Underwood, were each read, and
upon motion by Moody second by Williams th-e said notices were referred to the
Board of Zoning. .f.or..recommendation.
The appointment by the Mayor of Paul F.Schmidt as a Special Policeman for
duty at the School and Public Play Grounds, he to serve without pay and to hold
office until the second Monday in April 1941, unless sooner removed, was read,
and President Lemmon ordered that the same be placed on file.
The report of the City Engineer for the month of June,1940, showing expen-
ditures for labor from the General Fund $992.29, Stgeet & Alley Fund $1693.74,
Sewer Fund $639.55, and from the Bridge Fund $2.3.4, was read and President Lemmon
ordered that the same be placed on file.
Copiee of resolutions passed and adopted by the Commissioners of the Sinking
Fund,.appropriating $19,000.00 from the Sinking Fund and ordering payment
made to the First National Bank of Rochester, for the July 1st,1940,maturity of
City of Rochester, Light Bonds $13,000.00, Water Bonds $5,000.00; appropriating
$5, 000.00 from the / Sinking Fund to the Sinking Fund to the Sinking Fund, for
transfer of uninvested funds to make same available for the payment of the
July lst.1940 maturity of City of Rochester Light.Bonds $2,000.00, Water Bonds
$3,000.00; appropriating. $4,999.79 from the Stinking Fund, and ordering payment
made to the. Interest Fund, for transfer of funds to make same available for
payment of the July lst, 1940, maturity of interest on City of Rochester, Light
bonds $4,657.93, and Water Bonds $331#85; and appropriating $237.50 from the
.
Sinking Fund and ordering payment made to the Sinking Fund for adjustment of
interest received on Sinking Fund Investments, which were each read, and upon
motion by Moody second by Amundsen, the actions set forth therein were approved
and it was ordered that the same, be placed on file.
The application of Gustaf E.Nelson for a license to sell soft drinks, was -
read, and upon motion by Bowers second by Amundsen, license was granted.
The application of Wm.E.Hocking for an off -sale license to sell non-intoxicai
ing malt liquors, was read, and upon motion by Amundsen second by Mrachek,
license was granted.
The application of Richman Bootery for a permit to place and maintain a
sign, at 227 South Broadway, was read, and upon motion by Moody second by Bowers
permit was granted.
A communication from the Secretary of the Olmsted County Public Safety
Council, together with a copy of the minutes of a meeting of said Safety Council
held June 26th, were- each read, and President Lemmon ordered that the same be
placed on file.

The report of the Clerk of the Municipal Court for the week ending July 1st,
11940, zhowing criminal. fines. .and .costs collected $451.15, civil fees received
$6.65, conciliation court fees $9.00, was read and having been previously
approved by the City Attorney, President Lemmon ordered that the same be placed

Eight property owners on Twelfth Street Southeast appeared before the
,Council in regard to proposed improvements by the Highway Department on said
IStre.et. The Mayor stated that Mr. Cadwell expects to go over the improvement
(with. the. owners and .the City Council. President Lemmon referred the matter to
Ithe Mayor, Street & Alley Committee, and Aldermen Anderson and Amundsen.
Upon motion by Moody. second .by Amundsen the City Engineer was instructed
Ito give notice to property owners on 92 Street Southeast to construct sidewalks.
Mr. Walter Martin demonstrated a parking meter and submitted a proposition
l of the City receiving fifty per cent of the income from said meters until such
time as they are paid for, after which time the City shall receive the entire

Upon motion by Williams second by Anderson the matter/was referred to the
Finance Committee, and the Street and Alley Committee.
Alderman Amundsen introduced a resolution accepting the bid and proposal
of the Elk River Concrete Company for the furnishing of approximately 340
lineal feet of 49" reinforced concrete pipe at $4.99 per lineal foot, total
$1693.20, to be used in the 6onstruction by the Highway Department of a new
bridge on Broadway Street North, which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman. Williams introduced a resolution accepting the bid and proposal of
the American Cast.Iron. Pipe Company for the .furnishing of 520 feet of cast iron
pipe at $6.92"per. lineal foot $3599.40, and eight 24" 222o bends at $70.00 each,
$560.00, for use in the construction by the Highway Department of a new bridge
over the Zumbro River on Broadway Street North, which was read.
Upon motion by Mrachek secon d.by Williams that the said resolution be
adopted as read, and all voting in favor thereof., President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution ordering plans for the widening

of/Third Avenue Southwest from Center Street, West to First Street Southwest,
and widening First Street Southwest from Sixth Avenue Southwest to Seventh
Avenue Southwest, which was read.
Upon motion by Amundsen second by Bowers that the said resolution be adopter
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
The City Engineer submitted pland and specifications,fnd estimate .of cost
for the widening of the pavement on the east side of Third Avenue Southwest from
Center Street West to First Street Southwest, and on First Street Southwest from
Sixth Avenue Southwest to Seventh Avenue Southwest.
Alderman Mrachek introduced a resolution adopting the plans and specifica-

Southwest, and First Street Southwest, as above described, ordering a hearing
on the said improvement to be held at 7:30 o'clock P.M., on July 15th,1940, and
ordering bids to be :;received and opened at 7:30 o'clock P.M., on July 15th,1940,
which was read.
Upon motion by Amdedson second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

land estimate of cost for the construction of a water main in Fifteenth Avenue

Upon motion by Moody second by Anderson that the said resolution be
l adopted as read, and all voting' in favor thereof, President Lemmon declared the

The City Engineer submitted Jolans, specifications and estimate of cost for
(the construction of a water main in Fifteenth Avenue Northeast from Third Street
Northeast to Fourth Street Northeast.
Alderman Moody introduced a resolution adopting the plans, and specifica-
tions for the construction of a water maih in Fifteenth Avenue Northeast, as
above described, ordering a hearing on the said improvement to be held at 7:30
o'clock P.M., on July 15th,1940, and ordering advertisement for bids to

Upon motion by Amundsen second by Mrachek that the said resolution be

Alderman Williams introduced a resolution appropriating $269.66 from the
(General Fund, $2.00 from the Street & Alley Fund, and $2571.75 from the Lighting
Fund and ordering payment made to the City of Rochester, Light and Wgter Depart-
Iments for electricity and water furnishedin accordance. with billings of June 25th
1940, which was read.

Alderman Williams introduced a resolution appropriating $5093.56 from the
Street andAlley Fund and ordering payment made to the Roxanda Mines, Inc., for
Estimate #1 for resurfacing.of the North and South Alleys in Blocks 9, 9, 10, 11,
19, 19, 22, 23, 32, 33, 37 and' 46 in Original Plat, Block 20, Moe ana Old's
Addition, and Mill reservation, and the east and west alley in Block 19, Original
Plat, which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be adopter
as read, and all voting in favor thereof, President Lemmon declared the said

Alderman Williams introduced a resolution appropriating $2262.99 from the
Street and Alley Fund, and $5293.90 from the Permanent Improvement Revolving
Fund, and ordering payment made to Harry'l.Earle, for payment of estimate #1
on contract for widening and construction'of curb and gutter on Center Street
West from Broadway to Seventh Avenue, west, which was read.

Alderman Bowers introduced a resolution appropriating $9,991.30 from the
Sewer Fund and ordering payment made to L.M.Feller Company and Wm. C.Fraser &
Son, for changes and additions to contract for construction of a trunk line
storm sewer in Third Avenue Southwest, Center Street West, Second Avenue North-
west, and Fifth Street Northwest and Northeast, which was read.
Upon motion by Amundsen second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof,President Lemmon declaredthe
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $21,253.79 from.the
Sewer Fund and ordering payment made to Wm. C.Fraser & Son and L.M.Peller &
Company, for Estimate No.2, for the construction of a trunk line storm sewer,
which was read.
Upon motion by Bowers second by Mrachek that the said resolution be adppeed
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed .and adopted.
Alderman. B.o.w.er.s .introduced a resolution appropriating $245.00 from the
Fire Protection Fund and orderingpayment made to W.S.Nott Company, for 250 feet
of fire hose, which was read.
Upon motion by Anderson second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $163.99 from the
Park Improvement Fund and $203.95 from the Lighting Fund, and ordering paymaht
made'to the City of Rochester, Light and Water Departments, for electricity
and water furnished at the Mayo Civic Auditarium, in accordance with billings
&f May 25th, 194o, which was read.
Upon motion by Moody second by Anderson.that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $335,00 from the
Park Improvement Fund, and ordering payment made to Hugh Vincent Feehan, for
plans and. specifications fo.r foot bridges and. watering system at Soldier Field,
which was.. read.
Upon motion by Mrachek second -by Amundsen that the.said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared tNie

Band Fund and orde.ring.paymen.t made to Parkhill. Brothers, for public address
system installed for the band shell in Mayo Park, which was read.
Upon motion.by Anderson second by Williaim that the. said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Anderman Andersonintroduced a reso-lution gppnting public dance permit to
the Central Labor Union, for the Woodman Hall, June 29th,1940, and fixing the
fee at $3.00, which was read.
Upon motion by Amundsen second by Anderson that the said resolution bF
adopted as read, and..all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments for
the construction ofa sanitary sewer in Tenth Street Southeast, from
Eighth Avenue Southeas_t..to_.a point 170 feet east, which was read.
Upon.motion by Mrachek second by Williams, that the said resolution be
adopted as read, and all.- voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman -Anderson introduced a resolution levying special assessments for
the construction of a sanitary sewer in 10j Street Southeast, from First Avenue
Southeast to a point 260 feet east, which was read.
Upon motion by Moody second by Amundsen that the said resolution be adopted
as read, and all voting.in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating 4956_.90 from the
General Fund and ordering payment made to Burns & McDonnell for engineering
services incidental to valuation and study of the property and operation of the
Peoples Natural Gas Company in Rochester, which was read.
Upon motion by Anderson second by Bvwers.that the said resolution be adopted
as read, and all voting in f avo.r thereof, President Lemmon declared the said
resolution- duly pas.s.ed and. adopted.
Alderman. Amundsen introduced a resolution appropriating $49.95 from the
General Fund, $319..96 from the Street and Alley Fund, and $66-.45 from the Bridge
Fund and ordering payment made to the Standard Oil Company, for one tank car
UTLX 90519 of road oil, which. was read.
Upon motion by Amundsen second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering a hearing on the construc-
tion of curb and gutter on Seventh Street Southwest from Fourteenth Avenue Southwest
to Lot 106 Belmont, said hearing to be held at- 7:30 oIclock P.M., on July 15th,
1940, which was read.
Upon motion by Mrachek second by Williams, that the said resolution be adopte
as read, and all voting in favor thereof, President Lemmon declared the said

11940, whi ch was read.
Upon motion by Amundsen second.by Bowers that the said resolution be
adopte d as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering a hearing on the
jconstruction of curb and gutter on Center Street East from Eleventh Avenue to
ifteenth Avenue Northeast and Southeast, said hearing to be held at 7:30 o'clock
P.M., on July 15th,1940, which was read.
Upon motion by Moody second by Mrachek that the said resolution be adopted
as read, and all ,vot ing in favor thereof, President Lemmon declared the said

An.ordinance.pr.ohibiting.the parking..of certain trucks and motor vehicles
1I with a trailer attached, on certain streets and avenues in the City of Rochester,
Minnesota, introduced and. given its first -reading on June 3rd,1940, was given
its second reacting.
Upon motion by Moody second by Bowers, and all voting in favor thereof,
Ithe rules were suspended and .the .said ordinance was given its third and final
reading.
Upon motion by Williams second by Amundsen, that the said ordinance be
(adopted as read, and -upon roll call all voting in favor thereof, President,
Lemmon declared the. said ordinance duly passed and.adopted.
Alderman Amundsen introduced an ordinance creating a Sinking Fund and
levying taxes for the payment of principal and interest on $62,•000.00 Surface
Drainage Sewer Bonds of the City of Rochester, Minnesota, dated June lst,194o,
issued under provisions of Chapter 169, Laws of 1927, and repealing Ordinance,
No.576, which was given its first reading.
Upon motion by Williams second by Amundsen, and all voting in favor thereof,
the rule-s were suspended and the said ordinance•'was given its second reading.
Upon motion by•Mrachek second by Bowers, and'all voting in favor thereof,
Ithe rules were suspended and the said ordinance was given its third and fini1
reading.
Upon motion by Amundsen second by Mrachek, that the said- ordinance be adopte
as read, and upon .roll.. call all voting. in. favor thereof, President Lemmon declare
thesaid ordi-nance duly passed and adopted.
Alderman Moody introduced an ordinance pro -riding for the connection of
Lot-14,Block 1, Sub -Division "M", and Lot 24, Block 1, Johnson's Sub -Division,
to the sanitary sewer in Tenth Street Southeast, which was read.
_Upon motioir by Moody second by Williams, and all voting in favor thereof,
the rules were suspended and the said ordinance was given its second reading.,
Upon motion by Mrachek second by Williams, and all voting in favor thereof,
the rules .were suspended and the said ordinance was given its third and
final reading.
Upon motion by Amundsen second by Mrachek, that the -said -ordinance be
adopted as_ read,- and upon roll call all voting in favor thereof, President
Lemmon declared the said resolution duly passed and adopted.
Upon motion by Moody.second by Bowers the matter of purchasing a unit for
the stop and go signals was referred to the Finance Committee and the''Police
Committee with power to act.

A representative of the Junior. Chamber. of_ Commerce appeared before the
Common Council and asked if the .City of Rochester would cooperate with them in
dedicating the Airport by purchasing advertising space in the programs for
the dedication, and upon motion by Williams. second by Amundsen, the matter was
referred to the Public Utility Board, and,record being made that the Council
favored such action by the Utility Board.
Upon motion by Williams second by Amundsen the City'Engineer was instructed
to include in the curb and gutter plans for Seventh Street Southwest from
Fourteenth Avenue Southwest to Lot 106 Belmont Addition, the necessary paving
at the west end of Seventh Street 'Southwest.
Upon motion by Amundsen second by Williams, the City Clerk was authorized
to:return the checks of the unsuccessful bidders for furnishing sewer pipe.
Upon motion by Williams second by Amundsen, the Common Council adjourndd
until 7 :30 o'clock P.M., on July Sth, i:94o.
