OF THE CITY OF ROCHESTER, MINN., July S ,1940 .
Minutes of an adjourned regular meeting of the Common Council of the City 6f
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on July Sth,1940.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek-, Williams. Absent: None.
President Lemmon stated this as being the time and place set for a hearing
on the construction of curb and gutter on Second Street Southeast from Thirteenth
Avenue Southeast to Fifteenth Avenue Southeast, and asked if any one present
wished to be heard concerning.the.said.impro.vement. No one present wished to
be heard.
President Lemmon..s.tated this as being the time and place set for receiving
bids for the construction of curb and gutter on Second Street Southeast from
Thirteenth Avenue Southeast to Fifteenth Avenue Southeast, -and the following_
bid of H.T.Earle was read: 1650 lin ft. curb and gutter @ $.79 per lineal
foot $1303.50, 50 lineal feet of walk @ $.95 per lineal foot $42.50,total
$1346.00. President Lemmon referred the said bid to the Street and Alley
Committee and the City Engineer for recommendation.
President Lemmon stated this as being the time and place set for receiving
bidsforthe resurfacing of Center Street West, from Seventh Avenue, west to
Eleventh Avenue Northwest and Southwest. The following bids were received and
opened at this time: Roxanda Mines, Inc., top dressing $10.60 per ton, $otal
$Cj010.40, leveling course $6.20 per ton $1760.80, total $4771.20; J.H.Ganley
Company, top dressing.$10.8.0 per ton $3092.76, leveling course $6.39 per ton
$lS14.76, total $4907.52. President Lemmon referred the said bids to the
Street and Alley Committee and the City Engineer for tabulation and recommenda-
tion.
President Lemmon. stated this as .being the time set f-or receiving and
opening bids for the furnishing of. a two ton truck for use in the City Engineer's
Department. The following bids were received and opened at this time:
Ellis Motor Company $1365.00 net, International Harvester Company, net $1356.79,
Postier & Eggers Co. net $1500.00, Rochester Nash Co. net $1465.00. President
Lemmon referred the said bids to the City Engineer and Street & Alley Committee
for tabulation and recommendation.
The recommendation by the Street and Alley Committee that a sidewalk be
not constructed on the west side of Eighth Avenue Southeast between Fourth
Street Southeast and the river, due to the expense of excessive excavation and
changing of sewer and water service connections, and recommending that a cross
walk be constructed to connect with the sidewalk on the east side of Eighth

said Committee report was approved and the City Clerk instructed to send a copy
thereof to Mrs. Manion.
A petition asking that a sidewalk be constructed on the north side of Third
Street'Northeast from Eleventh Avenue Northeast to Sixteenth Avenue Northeast,
where needed, was read and Rresident Lemmon referred the same to the Street &
Alley Committee.
A petition asking that Eighth Avenue Northwest from Seventh Street Northwest
to Ninth Street Northwest be oiled, and that Ninth Street Northwest from Eighth
Avenue Northwest to Ninth Avenue Northwest, be oiled, was read and President
Lemmon referred the same to the Street and Alley Committee.
A petition signed by Corwin Stoppel, asking that a tract of land which he
owns in southeast Rochester near the Midland Lumber Company and the Chicago
Great Western Railroad Company tracks, be zoned as industrial instead of
residential, was read, and President Lemmah referred the same to the Zoning Board.
Mrs. Pat Condron objected to the changing of the zoning classification for
the above property, and Mr. Pat Condron presented a remonstrance against the
changing of the zoning Classification, which remonstrance was signed by nine
people. President Lemmon referred the same to the -Zoning Board.
A communication from Burns & McDonnell Engineering Company concerning a
continuation of their services under their agreement, was read, and upon motion
by Mrachek second by Bowers the said Engineering Company were authorized to
continue their inves.tigation, with the total expenditures for services rendered
and to be rendered limited to $2500.00.
A copy of the cooperative agreement executed by the State of Minnesota
Highway Department and the City of Rochester, covering a W.P.A.curb and gutter,
sidewalk and drop inlets, and ornamental guard rail construction project, on
South Broadway between Sixth Street Southwest and Ninth Place Southeast, was
1presented and President Lemmon ordered that the same be placed on file.
Upon motion by Moody second by Amundsen the City Engineer was instructed
to prepare plans and specifications for the extension of the South Broadway
trunk line sanitary sewer from Sixth Street Southwest to the bridge, so that
the trunk line sewer can be extended before the Highway Department make the
above improvements on said street.
A communication from the Secretary of the Firemen's Relief Association
requesting. approval by the Council of the following loans: additional loan of
$500.00 to Dan McLaughlin on his residence at 24 Fourteenth Avenue Northeast;
$2550.00 to Richard McDermott on his residence at 1035 Fourth Avenue Southeast;
$4700.00 to Lee L.Hammond on his residence at 1002 First Street Southwest, and
an additional loan of $400.00 to Frank Springer on iris residence located at
11039 Sixth Avenue.. Southeast, was read, and President Lemmon referred the same to
Ithe Finance Committee.

The recommendation by .the Zoning Board that the reques-t of Anna L.Lawler
for permission..to . con-struct a three room cottage on her lot at 119 Fifth
Avenue Northw.es.t be denied,. was read, and .upon motion by Moody second by
Mrachek the said recommendation was accepted.
The recommendations by the Zoning Board that the request of Harold J.
Underwood for the establishment.of new side lines for his residence ak Lots 13
and 14,Block 3,Cascade Manor, and the request of W.H.Penny for permission to
construct a new residence at 610 Fourth Avenue Southwest, be granted, were each
read and upon motion by Mrachek second by Moody the said recommendations were
accepted.
A certificate of insurance through Jones & Whitlock, Inc., certifying .
that the City of Rochester have been covered for accidents arising out of the
display of fireworks on July 4th,1940, was read and President Lemmon ordered
that the same be placed on file.
A copy of a. communication. from. the State . of Minnesota Industrial Commission
to the Rochester Egg & Poultry Company, was read and President Lemmon ordered
that the same be placed on file.
The.City Enginear's Department trial balance sheet for the month of
June., 194o., was . read.. and .Pres.ident Lemmon ordered that the same be placed on
file.
The report of the Clerk of the Municipal Court.for the week ending
July 9th,194o, showing criminal fines and costs collected $293.00, civil fees
received $7.30, conciliation court fees received $6.75, was read, and having
been previously approved by the. City Attorney, President Lemmon (6rdered that the
same be -placed on file.
Applications signed by Clarence Sattre, Edward H. & Harry A.Deitschman,
for transfer of pool table license #219, and on -sale and off -sale non-intoxicati
malt.liquor licenses to Edward H. and Harry A.Deitschman, were each read, and
upon motion by Amundsen second by Anderson transfers were granted.
Applications signed by R.L.Grundmeyer(2), Phillips Petroleum Company (2),
and the 0.& B.Shoe Store, for permits to place and maintain signs were each read,
and upon motion by Moody second by Bowers, permits were granted.
The application of the Draper Electric Company for -.an electrical contractor'
license, was read, and upon -motion -by Bowers second by Mrachek license was
granted.
The applicat.i-on of Howard C.Draper for a master electrician's license, was
read, a n d upon motion by Williams second by Amundsen, license was granted.
The application of Henry B.Lang fora journeyman electrician-'s license
was read and upon motion by Amundsen second by Bowers license was granted.

The application of Wm. Hagedorn for a plumbers license was read, and upon
motion by Moody second by Mrachek, license was granted.
The application of Joe R.Valsvik for a drivers license was read, and
upon motion by Mrachek second by Moody license was granted.
Applications signed by Traverse W.,Schinke and Edw.H. and Harry A.
Deitschman for soft drink dealers licenses, were each read, and upon -motion by,.
Williams second by Mrachek, licenses were granted.
The license bond of Wm.Hagedorn in the sum of $1, 000.00 with the New
Amsterdam Casualty Company as surety, was read and upon motion by Moody second byl
Amundsen, the said bond was approved,the surety thereon accepted and it was
ordered that the same be placed on file.
Recommendations by the Finance Committee that the proposed loans by the
Firemen's Relief Association to Dan McLaughlin, Richard McDermott, Lee Hammond,
and Frank Springer, be approved, were each read and.upon motion by Moody second
by Amundsen,. the. said .re.commendat.ions .were accepted and the proposed loans
approved.
Desmond Hunt representing the American Legion, asked that the Council grant
a license to the Amerdean Legion for the showing.of the Ringling Brothers &
Barnum & Baihly circus in Rochester on Sunday August 4th,194o. This date being
the day set for the dedication of the Rochester Airport by the Junior Chamber of
Commerce, the Council sought an expression of the wishes of said Junior Chamber
of Commerce in said matter.
A delegation of Junior Chamber members appeared before the Council, the
spokesman for which were Andrew gaehnen, William Schacht, and Richard Towey,
voicing objections to any entertainments of a major character on that day which
lwould detract from the Airport Dedication program.
At the suggestion of the Council, Desmond Hunt and Andrew gaehnen agreed to
have the executive Boards of their respective organizations get to gether for a
discussion of'the matter, and upon motion by Mrachek second by Amundsen, if it
was then agreeable with.the Junior Chamber of Commerce for the American Legion
to sponsor Ringling.Brothers Circus to show in -Rochester, Minnesota on August 4th
the matter.of issuing a license to the circus was left in the hands of the
License Committee with power to act.
The statement of receipts and expenditures in the Park Department at the
end of June,1940, was read, and President Lemmon ordered that the same be placed
on file.
The recommendation by the.City Engineer and the Street and Alley Committee
that the bid of the International Harvester Company for the furnishing of.a two
ton truck for use in the City Engineer's Department for the net aum of $1356.79,
was read and upon motion by Amundsen second by Bowers said recommendation was
accepted.

The recommendation by the Street and Alley Committee and the City Engineer
that the bid of H.T.Earle 3n the sum of $1346.00 for the construction of curb
and gutter on Second.Street Southeast from Thirteenth Avenue Southeast to
Fifteenth Avenue Southeast, be accepted, was read, and upon motion by Moody
second by Williams said recommendation was. approved.
The recommendation of the Street and Alley Committee and the City Engineer
that the bid of the Roxanda Mines, Inc., in the sum of. $4771.20 for the resurfac-
ing.of Center Street West from Seventh Avenue Southwest to Eleventh Avenue
be accepted,
Northwest an d.So.uthwest� was read, and upon motion by Mrachek second by
Amundsen the said recommendation was approved.
Alderman Williams introduced a resolution accepting the bid of H.T.Earle
for the construction of curb and gutter on Second Street Southeast from
Thirteenth Avenue. Southeast to Fifteenth Avenue Southeast, in accordance with
the plans and specifications for same which are on file in the office of the
City Clerk of said City, for the sum of $1346.00, which was read.
Upon motion by Williams second by Amundsen that the said resolution,be
adopted as read, and all voting,in favor thereof, President Lemmon declaredthe
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution accepting the bid of the Roxanda

Avenue Northwest and Southwest for the sum of $4771.20, which was read.
Upon motion by Mrachek.se.d)ond by Bowers that the said resolution be adopted
as read, and all voting -in .favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution accepting the bid of the
International Harvester Company, for the furnishing of a two ton truck for use
of the City Engineer's Department for the net price of $1356.79, which was
read..
Upon,motion by Bowers second by Anderson that the said resolution be adopted
asread, and all .voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Upon motion by Moody second .by Williams the City Clerk was instructed to
return the certified checks of the unsuccessful bidders.
Alderman Amundsen introduced a resolution appropriating $341.05 from the
General Fund and ordering payment made to the Rochester Post -Bulletin, for
official publications and printing during June,1940,which was read.
Upon motion by Moody second by Williams that the said resolution be adppted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and -adopted.

Alderman Anderson -introduced a resolution appropriating $1293.50 from the
General Fund and ordering -payment made to the Street & Alley- Fund, for use of
equipment during June,1940,whi-ch was read.
Upon motion by Williams. second by Amundsenthat the said resolution be adopt
as..read, and all voting in favor thereo-f, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $361065 from the
General Fund and ordering payment made to the Quality Print Shop, for one
counter for municipal court office, which was read.
Upon motion by Mrachek second•by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $500*00 from the
General Fund and ordering payment made to Roy Kingrey for share of the costs of
the fireworks display for July 4th,1940, which was read.
Upon motion by Bowers second by Anderson that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $939.95 from the
Street and Alley Fund and ordering payment made to the Street and Alley Fund, for
!use of equipment for June,1940, which was read.
Upon mo.tio.n.by Amundsen second by.Moody'that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $2343.92 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending June 15th,.1940,which was read.
Upon motion by Mrachek second by An derson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
lsaid.resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $3514.95 from the
Permanent Improvement Revolving Fund and ordering payment made to Martin Paulson
for first and final estimate for the construction of a sanitary sewer in Sixth
Street Southwest from approximately 550 feet east of Fourteenth Avenue Southwest
to approximately 720 feet, and for the laying of a water main in Sixth Street
Southwest from 500 feet east of Pourteenth Avenue Southwest to Tenth Avenue
Southwest, which was read.
Upon motion by Moody second .by Williams that the said resolution be adopted
as read, and all voting in favor thereof-, Presi.dent Lemmon declared the said

Alde.rman-Moody introduced a resolution appropriating $2,000.00 from the
General Fund an.d..o.rdering.payment made to the Park Improvement Fund, for transfer
of funds to make same available for park purposes, which was read.
Upon motion by Amundsen second by Moody that the said resolution be adopted
1as read, and all voting in favor thereof except Alderman Boyers who voted "No",
President Lemmon declared the said resolution duly passed and adopted.
Alderman.Mrachek introduced a resolution granting public dance permit to
Central Labor Union for th-e Woodman Hall, July 6th,1940, and fixing the fee at
1$3.0.0, which was read.
Upon motion by Anderson second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
