Z_ • • .Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on July 29th,1940. .President Lemmon called the meeting to order at 7:30 o1clock P-.M., the following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody, Mrachek, Williams.- Absent: None. Upon motion by Moody second by Amundsen the minutes of the meeting of July 15th, 1940, were approved. President Lemmon stated this as being the time and place set for a hearing on the construction of curb and gutter on Center Street East from Eleventh !Avenue to Fifteenth Avenue Northeast and Southeast, and asked if any one present I wished to be heard concerning this improvement. Walter Heins spoke in favor of th limprovement stating that 37 owners.of property along the improvement were inter- tested and that 23 had signed.the petition asking that curb and,gutter be a instlle I • ;Allen Haggerty presented a petition opposing the improvement. President Lemmon stated this as the time and place set for a hearing on the black top surfacing of Seventh Street Southwest from Tenth Avenue Southwest to Fourteenth Avenue Southwest, and asked if any one present wished to be heard concerning the said improvement. Mr. Spillane stated that the notice of hearing. *tuld indicate that the entire street would be resurfaced and inquired if the surfacing included only the boulevard in the center of the Street. He was told that it was not the intensions of the Common Council to resurface the., entire street. President Lemmon stated this as being the time and place sk for a hearing on the widening of Eleventh Avenue Southwest and Northwest from Second Street Southwest to the bridge on Eleventh Avenue Northwest, and the widening of First Street Southwest from Seventh Avenue Southwest. to Eleventh Avenue Southwest, and asked if any one present wished to be heard concerning this improvement. Joe Kittley appeared before the Council and inquired &t t.o,�why.,E1event}9 Avenue Northwest should be widened. He voiced objections to the improvement and stated that four other residents'were in the audience for the purpose of opposing the widening of Eleventh Avenue. Rev. Bunge opposed the widening of First Street Southwest, also Frank Roth spoke in opposition of the improvement as he thought it would be a damage to the driveways, especially on the south side of the street. Mr. Hammond spoke in favor of the improvement, and James �O'Conner appeared before the Council and requested that Ele-genth Avenue Northwest I be resurfaced if the street is not to be widened. Upon motion by Moody second by Bowers further action on the widening of ;Eleventh Avenue and First Street Southwest as aboge described was abandoned fat this time. RECORD OF OFFICIAL. President Lemmon stated this as being the time and place _set for a hearing on the oiling of Eighth Avenue Northwest from Seventh Street Northwest to Ninth Street; Northwest, and asked if an)[ one present wished to be heard concerning the said improvement. No one present wished to be heard on this improvement. President Lemmon stated this as being the time and place set for receiving bids for the construction of curb and gutter on Center -Street East from Eleventh Avenue to Fifteenth Avenue Northeast and Southeast. The bid of H.T. Earl in the sum of $2172.90 was opened at this time. President Lemmon referred Street and Alley the same to the .::./ Committee and the City Enb.ineer for.recommendation. President Lemmon stated this as being the time and place set for receiving bids for the construction of a •trunk line danitary sewer in Broadway Street South, from Sixth Street Southwest -to the Bridge over the Zumbro River. The following bids were received at this time: Wm.C.Fraser & Son $9620.00; H.H.Frankamp $9996.00. President Lemmon referred the same to the Sewer Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving bids for the construction of a surface drainage sewer in Center Street East from Twelfth Avenue to Fifteenth Avenue Northeast and Southeast. The following bids were opened at this time: Wm.C.Fraser &.Son $1509000, H.H.Frankamp $162g.50, and Martin Paulson $1593.70. President Lemmon referred the same to the Sewer Committee: and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set for receiving bids for the black top surfacing of Seventh Street Southwest from Tenth Avenue Southwest to Fourteenth Avenue Southwest. The City Clerk reported that no bids had been received for this work, and upon motion by Moody second by Williams the City Engineer was instructed to secure the necessary labor and materials and make the said improvement. Royal Nunamaker appeared before the Council, representing the National Guard, and asked that a location be provided for the construction of a garage to house the National Guard 'equipment in Rochester. He asked that the City provide the land only and stated that the State would construct the building. He also suggested that a location be provided within the police patroled district of Rochester. The President of the Council appointed Aldermen Moody, Anderson and Mrachek as a Committee to look into the matter of providing a location. A petition asking that Thirteenth Avenue Northeast be vacated from Second Street Northeast to a point 160 feet north, was read and President Lemmon referred the same to the Street and Alley Committee and the City Engineer. A petition asking that the south half of Third Street Northwest from 82 Avenue Northwest to Ninth Avenue Northwest be vacated was read and President • n U • Lemmon referred the same to the Street & Alley Committee and City Engineer. E, • • • A petition asking that the alley running east and west in Block 3-;-1utaky's [Second Addition be oiled, was read and President.Lemmon referred the same to the Sprinkling Committee. A petition asking that First Street Northeast from Second Avenue Northeast to Third Avenue Northeast be oiled, was read and President Lemmon referred the same to the Sprinkling Committee: The recommendation of.the Sewer and Committee. and City Engineer that a sanitary sewer and water main -'be constructed in Twelfth Avenue Northeast. fm m Tenth Street Northeast to Fourteenth Street Northeast, was read and the City Engineer was instructed to prepare plans specifications and estimate of cost for ,this improvement. A communication from the Secretary of the -Rochester Fire Department Relief Assodiation asking for approval by the Council on additional loans of $600.00 to IRudi Wiese, $400.00 to Charles Shields, and $400.00 to Peter Mackey, on their residences, was read. An oral report was made by the Chairman of the Finance Committee, recommending that these additional loans be approved, and upon motion by Williams second by Anderson the said loans were approved. A communication from Burns & McDonnell Engineering Company was read and President Lemmon ordered that the same be placed on file. A communication from the State of Minnesota Department of Taxation regarding fthe return by the Assessor of the assessments of the City of Rochester, was read hand President Lemmon ordered that the same be placed on file. A communication from the League of Minnesota Municipalities regarding the police training school, which had been previously approved by the Common Council, was read and the return of the second questionaire was authorized. An emergency authorization given by the Mayor to the City Clerk for the purchase of a carload of gasoline was read and upon motion by Mrachek second by Bowers the said action was approved. The reportsof the Clerk of the Municipal Court for the week ending July 22, 1940, showing criminal fines and costs collected $330.00, civil fees received $13.05, and conciliation court feet received $11.50; for the week ending July 29, 1940, showing criminal fines and costs collected $305.00, civil fees received $16.05, conciliation court fees received $9.75; and for the period September 15, 1939 to July 27,1940, showing additional partial payments of criminal fines and costs of $344.91, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The report of the Building and Plumbing Inspector for' the month of June, 1940, showing building permits issued $179.00, plumbing permits $37.75, and the report of the Electrical Inspector for the month of June,1940, showing electrical permits issued $43.25, were each read and President Lemmon referred the same to the Find ce Committee. COUNCIL, July 29,1940._ OF THE CITY OF ROCHESTER, MINN., The recommendation of the Sewer Committee and the City Engineer .that a storm sewer be constructed in Fourteenth Street Northeast from Kris Neilsin's gravel pit to a point 500 feet west, together with the City Engineet's estimate of cost, etc. for same, were each read, and President Lemmon ordered that the same be placed on file, :..The following Committee report was read: "July 29, 194o Hon.Mayor & Common Council Gentlemen: dour Committee recommends that a new warehouse be built this fall in order to give our equipment and surplus materials proper housing, but we are positively opposed to constructing a testing lane in conjunction with the City Warehouse. Manfred Johnson, President of the Safety Council, introduced Mr. Spillane as spokesman for a delegation appearing in support of the establishment of an automobile testing lane, and recommended that the ordinance in effect at the present time requiring cars to be inspected be enforced. James T.Spillane urged that a levy be made to finance the project and later stated that the project would be self supporting when in operation. Alderman Moody stated that the ordinance could not be enforced outside of the City of Rochester and felt that it was imposing a penalty on the residents of Rochester when other cars could enter the town without being required to have their automobiles inspected,. Dr. Montgomery recommended that the building be constructed but stated that it would not be necessary to have the testing lane in connection with the ,warehouse building. Upon motion by Amundsen second by Mrachek the above Committee report on a tes:t.ing lane was accepted and the same committee was retained to make a furthe study -:'of the construction of a safety lane either in connection with the Ciky Warehouse or a separate building. A communication from the Park Board regarding personal injuries to George Laack and Edmond Rohde, employees of the Park Department, was read acid President Lemmon referred the matter to the Public Grounds Committee and the City Engineer. The recommendation of the Zoning,Board that the request of Dr.D.C.Lochead be granted, for a building permit for remodeling his residence,/was read and upon motion • • • L� by Williams second by Amundsen said recommendation was accepted. A petition signed by residents in north Rochester, requesting tLhat a emporary bridge or ford be provided at the site of the installation of :the ew North Broadway Bridge, was read and President Lemmon referred the matter to he Street and Alley Committee and the City Engineer, for consultation with the tat e. Highway Department. A communication from the Board of Park Commissioners requesting authority o enter into contract with the Lyon Gas Appliance Company for furnishigg gas eating equipment at Soldierg Field Swimming Pool.for the sum of $724.95, the oats thereof to be paid by the Board of Education, was, read, and President emmon ordered that_ the same be placed,on file. The appointment by the Mayor of Lauren M.Dale as a member of the Zoning oard, to fill the unexpired term of J.J.Larson, resigned, said term ending on he,second Monday in April 1943, was read and upon motion by Moody second by illiams the said appointment was approved. A communication from the Olmsted County Bank & Trust Company requesting hat they be allowed to qualify for deposits of additional funds of the City of in the sum of $4o,000.00, ochester,/and a communication from the Union National requesting that they be signated as a depository for additional funds in the sum of $50,000.00 were each ead. -0 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., July 29,,1940 The City Engineer submitted an approximate estimate of cost for the purchase of a seven ton roller, said estimate being between $3,0-00.00 and- $3500.00, which was read and President Lemmon ordered that the same be -placed on file. - , The recommendations of the Sewer Committee and the City Engineer, that the contract for construction of a surface drainage sewer in Center Street East - from Eleventh Avenue to Fifteenth Avenue Northeast -and Southeast, be awarded to Wm.-C.Fraser and Son for the sum of $1509.00, and that -the contract for the construction of -a trunk line -sanitary sewer in Broadway Street South, from Sixth Street Southwest to the Zumbro River, be awarded to Wm. C. Fraser & Son for the sum of $9,564.20, wale each read, and upon' motion by Moody second -by Williams, the said recommendations were accepted. The recommendation by the Street -and Alley Committee and the City Engineer that the contract for the construction of curb and rgutter on Center Street East from Eleventh Avenue to Fifteenth Avenue Southeast be awarded to H.T.Earle for -the sum of $2172.90, was read and upon motion by Mrachek second by Amundsen the -said. recommendation was accepted. Harold Crawford; Architect, presinbed five -sections of the proposed new building code and stated that four sections were controversial, and asked that some committee of the Council consider said sections, and upon motion by Moody second-by-Mrachek, Mr. Crawford's request was granted and the matter was referred to a committee -consisting of the Mayor; the members of the Council, the City Attorney, Building Inspector, -Electrical Inspector, Chief of Police, Chief of the Fire Department and the City Clerk. - The official bond of Frank Springer in the sum of $6756.00, with the Maryland Casualty Company as surety; the contract bonds of Harry T.Earle-in the sum of $6950.00, and -$1346.00 with the Standard Aurety & Accident Company as surety; the Elk River Concrete Products Company in the sum of $1693.20,-with the Seaboard Surety Company as surety; the Roxanda Mines, Inc. with the Seaboard Surety Company -as surety in the sum of $4-77•1.20; the International Harvester Company in the sum of $1,356.79, with the United States Guarantee Company as surety; and the license bonds of Philip-Barck in -the sum of $1,000.00 with the Seaboard Surety Company -as- surety an•d -of Martin Paulson in the sum of $1,000.00 with the Fidelity and Casualty Company as surety, were each read, and upon motion by Williams, the said bonds were approved, the sureties thereon accepted, and it was ordered that the same be placed on file. The application of Stephen K.Tjaden for a drivers license was read, and upon motion by Mrachek second by Williams the license was granted. Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution accepting the bid of Wm. C. Fraser & Son in the sum of $1509:00, for the construction of a surface drainage sewer in Center Street East from Twelfth Avenue to Fifteenth Avenue, which was read. Upon motion by Moody second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $772.93 from the General Fund, and ordering payment made to the Public Health & Welfare Fund, for transfer of funds received in the June, 1940; tax settlement for garbage assessments collected, which was. read. Upon motion by Mrachek second by Amundsen that the said resolution be - adopted as read, and all voting in favor thereof, President-Lemmon declaredthe said'r.esolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating-$24.02 fm m the- General- Fund and ordering payment made to the Public Health and Welfare fund, for transfer of funds received in the June,1940,tax settlement for salary and expense of visiting nurse, which was read: Upon motion By Bowers second by -Anderson that the said resolution be adopted as read, and all voting in favor thereof, President_ Lemmon declared the said resolution duly passed' and adopted. - - Alderman Amundsen introduced a r.esolutio.n appropriating $6.,339.90 from the General- Fund and ordering payment made to the Public Health and Welfare Fund, for'. transfer of funds -received in the June, 1940, tax settlement for Health, Department s-alaries and expense-, which was- read. , - Upon motion by Amundsen second by M.rachek that the said resolution be _ adop-ted as read, and all voting in favor thereof, President Lemmon declaredthe said resolution duly passed and adopted. Alderman -Anderson. introduced •a resolution appropriating $318..29 from. the General Fund and ordering payment made t.o'the Statemof Minnesota, Oil Inspection Division for 'state tax and inspection fee on gasoline furnished in car 4936, which was read.. Upon -motion by Mrachek second by Anderson that the said resolution be adopted as read, and' all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a•resolution appropriating $1209.4 6 from the General Fund, -arid $475.-47 .from the Street and Alley. Fund, and ordering payment made to the Standard Oil. Alderman Bowers introduced a resolution appropriating $943.50 from the Street and Alley Fund and $37 46.90 from the Permanent Improvement Revolving Fund, and ordering payment made to Harry T. The Mayor recommended that the zoning ordinance.. -be amended to establish definite set back lines from the street for the locating of buildings to be constructed in commercial zones, and upon motion by Moody second by Williams, the matter was re£drred to the Zoning Board and the City Attorney. The Mayor also recommended that an ordinance be provided for the planting and triming of .trees located in the boulevards of the City, and President Lemmon referred the matter to the Public Grounds Committee, the Mayor, City Attorney and Board of Park Commissioners. Alderman Bowers Chairman of `the Public Grounds Committee st.ated that he had investigated air conditioning for the Council Chambers and that it would cost $1100.00 or $1200.00 to install air conditioning in the Council Cha pbers. Ii was requested that a further investigation be made and plans and specifications be obtained for air conditioning units. Alderman Moody presented a communication 6Pom the Superintendent of the Water Department regarding copper water service connections on Broadway Street North, and upon motion by Williams seconcl'by Amundsen the City Engineer was instructed to prepare plans and specifications for making such water lateral connections on North Broadway preparatory to proposed improvements by the State Highway Department. Alderman Williams brought up the question of left hand turns on the intersections in the business district, and suggested that the streets be painted, to indicate proper turns. The Chief of Police recommended that a painting machine be purchased and that the street lines be painted, and upon motion by Moody second by -�Wt&dsen the matter was referred to the Police Committee and the Chief of Police. Upon motion by Mrachek second by Moody the Purchasing Committee were given power`to purchase bicycle license plates.
