RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY -OF ROCHESTER, MINN., August 12, 1940.
Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, on August 12th, 194o.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams. Absent: None.
President Lemmon stated this as being the time and place set for a hearing.
'on the sprinkling and/or oiling of Eighth Avenue Northwest from Seventh Street
Northwest to Ninth Street Northwest; Ninth Street Northwest from Eighth Avenue.'','.
Northwest to Ninth Avenue Northwest; Fourteenth Street Northwest from the
bridge to Eighth Avenue Northwest; First Street Northeast from Second Avenue'
Northeast to Third Avenue Northeast; and the east and west alley in Block3, '
Kutzky's Second Addition, and asked if any one present wished to be heard concern-
ing said sprinkling and/or oiling. No one present wished to be heard.
President Lemmon stated this as being the time and place set for receiving
bids for the construction of a surface drainage sewer in Fourteenth Street Northe
east from Kris Nielson's gravel pit to a point 500 feet west, The following
Ibids were received and opened at this times Martin Paulson $735.30, Wm- C-
Fraser & Son $791.40. President Lemmon referred the said bids to the City
Engineer End Sewer Committee for tabulation and recommendation.
President Lemmon stated this as being the time and place set for receiving
bids for the resurfacing of Second Street Southwest and Eleventh Avenue Southwest
and Northwest. The following bids were received and opened at this time:
Ashworth -Hawkinson Company $24,929.00, Roxanda Mines, Inc. $23,935.84. Presid§nt
Lemmon referred the said bids to the City Engineer and the Street and Alley
Committee for tabulation and recommendation.
Alpetition asking that all wires, including light, power and telephone on
First Street Southwest between Seventh Avenue and Eleventh Avenue Southwest be
placed underground as soon as possible, was read, and upon motion by Moody
second by Mrachek it was ordered that the same be placed on file for future
reference.
A certificate of classification of forfeited lands as provided by Chapter
386, Laws 1935 as amended, covering lands forfeited to the State of Minnesota,
for non-payment of taxes for the years 1931, 1932 and 1933, was read and
upon motion by Amundsen second by Anderson the'Mayor and the City Clerk were
authorized to execute the said certificate for the City of Rochester. The said
certificate covering the following described property:

The trial balance of the City En-gineer's Department for J uly,1940, was
read and President Lemmon ordered that the same• be placed on file.
The report of the Clerk of the Municipal Court for the week ending August
10th,1940, showing criminal fines and costs collected $426.99, civil fees
received $22.90, conciliation dourt fees $9.50, was read and having been previousl
approved by the City Attorney President Lemmon ordered that the same be placed
Ion file.
A copy of a requisition by the Health Officer upon Saint Mary -Is Hospital
for the isolation of Mrs. LeRoy Tiger, diagnosed to be suffering from Erysepelas
was read and President Lemmon ordered that the same be placed on' file.
Copies of resolutions passed and adopted by the Public Utility Board.
requesting authority to enter into contracts with the John A.Clark Electric
Company and the Clements Chevrolet Company, were each read, and President Lemmon
ljordere.d that the same be placed on file.

The application of Wray Eastlick for a soft drink dealers license, was
jread, and upon motion by Mrachek second by Moody the license was granted.
The applications of the Sanitary Company, and H.Dornack for plumbers
licenses were each read, and upon motion by Anderson second Vy Moody, licenses
ere granted.
The license bonds of the Sanitary Company in the sum of $1,000.00 with the
Aetna Casualty and Surety Company as surety, and of Herman Dornack in the sum of -
$1,000.00 with the American Surety Company of New YOrk as surety, were each
read and upon motion by Moody second by Williams, the said bonds were approved
the sureties thereon accefted and it was ordered that the same be placed on file.
The recommendation of the Sewer Committee and the City Engineer that the
contract for the construction of a surface drainage sewer in - Fourteenth Street
Northeast, from Kris Nielsen's gravel pit to a point 500 feet west be awarded
to Martin Paulson for the sum of $735.30, was read and President Lemmon ordered
that the same be placed on file.
The following claims were read; and upon motion by Williams second by
jAmundsen the same were allowed and the Mayor and City Clerk were authorizedand
directed to draw warrants upon the City Treasurer and make payments accordingly:
From the General Fund: P1F.Donovan $63.D5, Hugo Brumm $2.00, Archie Cray
$15.50, Gust Botke $20.00.
Alderman Williams introduced a resolution granting public dande permit to
the Central Labor Union for the Woodman Hall, August 10th,1940, and fixing the
fee at $3.00, which was read.
Upon motion by Mrachek second by moody that the said resolution be, adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution accepting the bid of Martin
Paulson for the construction of a surface drainage sewer in Fourteenth Street
Northeast from Kris Nielsen's gravel pit to a point 500 feet west, for the sum
of $735.30, which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read., and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution designating additional streets
avenues.and alleys to be sprinkled and/or oiled during the 1940 season,which
was read.
Upon motion by Mrachek second by Bowers that the,said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Bowers introduced a resolution authorizing the Public Utility
Board to enter into contract with the Clements. Chevrolet Company; for the
furnishing of a 12 ton truck, which was read.
Upon motion by aowers second by -Amundsen that the said resolution be
adopted as read, and -all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution authoriming the.Public Utility
Board to, enter into contract -with John A.Clark Electric Company for the furnishin
of 21 transformers, which was read.
Upon motion by Williams second by -Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced the following resolution, which -was read:
"WHEREAS, The Common Council of the City of Rochester, Minnesota, has
entered into a cooperative agreement with the State of Minnesota, Highway
Department for the paving of Broadway Street North from Fourth Street. Northwest
and Northeast to,the bridge over the Zumbro River;
SO THEREFORE, -Be it resolved by the Common Council of the City of Rochester
Minnesota:
That,all water service connections in the above described part of Broadway.
Street North, which are not copper be replaced with copper pipe; and
That aetvice connections for both sewer and water be constructed for all
vacant lots on said street, and. -
That all of said service connections are hereby ordered to be laid from the
in sewer and the water main to the curb line in.said street.
Be it further resolved by the Common Council of said City;
That the City Engineer of said City be, and he is hereby ordered and
directed to make and prepare, plans and specifications for said seiner and water
connections and service pipes and to file the same .in the office of the City
Clerk of said City.
Be it further resolved by said Common Council:
That the City Clerk of said City be and he is hereby ordered and directed
to publish in the official paper of said City for six days, notice to the owners
and occupants of each and every lot or parcel of land abutting upon the streets
and avenues ordered to be paved as herein described requiring said owners and
Decupants to make such connections with sewers, and water mains opposite the
respective lots owned or occupied by them, at their own cost and expense, and
according to the plans and specifications to be .filed in the office of said City
'ilerk, and to do and complete the same within thirty days after the publication
)f said notice and in lase they fail or neglect so to do, the Common Council of
said City will cause such work to be done and will charge and assess the cost and
sxpense thereof to the lots and parcels of land fronting upon such work, as
Drovided by law."
Upon motion by Mrachek second by Anderson that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Upon motion by Bowers second by Amundsen the bids for resurfacing Second
treet Southwest and Eleventh Avenue Southwest and Northwest were rejected, and

resurfacing of Second Street Southwest from Broadway Street South to Elevenhh
Avenue Southwest.
Upon motion by Moody second by Amundsen the Mayor's request for repairs to
is fan in his office was referred to the purchasing Committee.
Upon motion by Moody secondby Williams the City attorney was instructed to
communicate with the proper authorities at. the Rochester Airport regarding the
noise from students.flying in the early morning hours over the City of Rochester.
The -City Attorney submitted a proposed ordinance providing for all tree
planting in the boulevards to be under the direction of the City Engineer, and
a motion by Moody second by Amundsen.carried that action on said ordinance
be -deferred until.August 19th,194p.
Upon motion by Moody second by Bowers the Common Council adjourned until
7:30 o'clock P.M., on August 19th,1940.
