OF THE CITY OF ROCHESTER, MINN., October 14 ,1940.
Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in
said City, on October loth, 194o.
President Lemmon called the meeting to order at 7:30 o'clock P-l— , the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Williams, 1.4rachek. Absent: None.
President Lemmon stated this as being the time and place set for a hearing
on the vacation of 31f Street Southeast from Sleventh Avenue Southeast to a
point 41 feet east of the west line of Lot 2,Block 1, Nei-Tlin's Addition, and
asked if any one present wished to be heard concerning the vacation of said
paf't of 3i Street Southeast. No one present wished to be heard.
A communication f rom the Rochester Chamber of Commerce regarding the
Christmas street lighting, was read and President Lemmon_ referred the matter
to the Street and Alley Committee.
A communication from the Board of Public Health and Welfare, inviting the
Council to inspect the City Farm, was read, and upon motion by Anderson
second by Mrachek the City Clerk was instructed to notify Dr. MaFgath of the
Council's acceptance of said invitation.
A communication from the League of Minnesota Municipalities regarding the
Regional Conference to be held at Faribault on October 23rd.,1940, was read and
President Lemmon ordered that the same be placed on file.
The report of the Commissioners appointed in the condemnation of the
South 33 feet of Lot 92 Auditor's Plat "A", for use as a public street, was
read. In connection with this report, the City Attorney stated that he had
received a lower offer, i.e. $900.00, for a 17 foot strip of land instead of
the said South 33 feet of said Lot 92,Auditor's Plat "Ag.
A motion by Williams second by Moody, carried that the proceedings for
the condemnation of the South 33 feet of said Lot 92,Auditor's Plat "A", be
abandoned and that proceedings be commenced for the condemnation of the
South 17 feet of Lot 92, Auditor's Plat "A", with the benefits and costs thereof
to be assessed against abutting property, all voting in favor thereof except
Alderman Bowers who voted "Nd.
The report of the Clerk of the Municipal Court for the week ending
October 12th,1940, showing criminal fines and costs collected $365.20, civil
fees received $3.75, and conciliation court fees received $7.25, Baas read, and
having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.
The City Engineer submitted specifications for a half ton pick-up truck
and a four door sedan for use in the Engineer's Department.

Applications signed by the Economy Radio Shop and Iver Anderson for permits
to place and maintain signs, were each read, and upon motion by Amundsen second
• by Moody 11ermits were granted.
The application of Velie Ryan, Inc., for an Off Sale non -intoxicating malt
liquor license, was read, and upon motion by Amundsen second by license
,
was granted.
The contract bond of H.T.Earle in the sum of $460.50 with the Standard
fjSurety & Casualty Company of New York as surety, was read, and upon motion by
*uachek second by Bowers, the said bond. was approved, the surety thereon
accepted and it was ordered that the same be placed on file.
Alderman Evachek introduced a resolution appropriating $115.11 from the
and $122.85 from the Lighting Fund,
Park Improvement Fund/and ordering payment made to the City of Rochester, Light

and pater Departments, for electricity and hater furnished at various parks,
• buildings and grounds, which was read.
Upon motion by Williams second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman ',irachek introduced a resolution appropriating $4s3.50 from the
Street and Alley Fund dnd ordering payment made to Gaaony-Vacuum Oil Company,
for one car of asphalt, which was read.
Upon motion by Amundsen second by Bowers, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declaredthe
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $161.75 from the
• Park Improvement Fund, and $69.46 from the Lighting Fund, Md. ordering payment
made to the City of Rochester, Light and Water Departments, for
electricity and water furnished various parks, grounds, etc., which was read.
Upon motion by Anderson second by Williams that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $236.00 from the
Sewer Fund and ordering payment made to the North Star Iron Works Company, for

manhole rings and covers and curb inlets, which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
• said resolution duly passed and adopted.
Alderman Amundsen introduced a -resolution adopting the specificationsfor
!Flourescent lighting fixtures for the City Hall offices, and ordering advertise-
ment for bids to be received and opened at 7:30 o'clock P.M., on October 29th,

Upon motion by Bowers second by Y.Frachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution vacating 32 Street Southeast
from Eleventh Avenue to a point 41 feet east of the west line of Lot 2,Block 11
Ner.lin's Addition, which was read.
Upon motion by Moody second by Amundsen that -bhe said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Resolutions leving special assessments for sprinkling and/or flushing,
and/or oiling during the season of 1940, were introduced, duly adopted,and
ordered placed on file, and made a part hereof, reference to which is hereby
made for more particulars.
Alderman Williams introduced a resolution ordering a hearing on the
assessments levied for sprinkling, and/or flushing, and/or oiling during 1940,
said hearing to be held at :30 o'clock P.M., on October 21,1940, which was:
read.
Upon motion by Williams second by 1rachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Williams introduced a resolution granting public dance permit
,
to dray Eastlick for the Woodman Hall, October 12,19410, and fixing the fee
at $3.00, which was read.
Upon motion by Moody second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted,
Alderman Williams introduced a resolution adopting the specifications Cor

Departiment, and ordering advertisement for bids to be received and opened at
7:30 O'clock P.M--, on October 21,1940, which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read_, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution ado-pting the plans and ordering
bids for construction_ of a sanitary sewer and water main in 3 SStreet Southeast f
from Fifteenth Avenue Southeast to west of Thirteenth Avenue Southeast as far as
necessary and on Fifteenth Avenue Southeast from Fourth Street Southeast to
3[ Street Southeast, said bids to be opened at 7: 30 o'clock P.M., on
October 29th,1940, which was read.

Upon motion by Moody second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
The following claims were read, and upon motion by Williams second by
Amundsen, the same were allowed and the Mayor and City Clerk were authorized
and directed to drag warrants upon the City Treasurer and make payments

release the Foundation -olan of the Power Plant to Lee M-Nelson,Superintenclent.
Upon notion by Amundsen second by Williams, the Common_ Council adjouried
