Minutes of a regular meeting of the Common Council of the City of Rochester,
Minnesota, held in the Council Chambers, in the City Hall, in said City, on
November 4th,1940.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Boners,.Moody,
P.irachek, Williams. Absent: _None.
President Lemmon stated this as being the time and place set for a.hearing
on the construction of a sanitary sewer and water main in 32 Street Southeast
from Fifteenth Avenue Southeast to west.of Thirteenth Avenue Southeast as far
as necessary, and on Fifteenth Avenue Southeast from Fourth Street Southeast to
32h Street Southeast, and asked if any one present wished to be heard concerning
this im-orovement. No one present wished to be heard..
President Lemmon stated this as being the time and place set for aeceiving
and opening bids for the construction of a sanitary sewer and water main in
j-z Street Southeast and Fifteenth Avenue Sout-hea*t, as above described. The
following bids were received and opened: trim. C. Fraser &; Son $2755.62, and
Martin Paulson $2844.95. President Lemmon referred the said bids to.the.City
iEngineer andthe Sewer.Committee,-for..tabulation and recommendation:
Mr. S. J. Cysewski asked permission to :post posters on the lamp posts on
Broadway Street and the streets between First Avenue Northwest and Southwest
and Broadway Str'�,,et Street, and upon motion by Amundsen second b�T Moody
permission w4s granted with the understanding ,that.the Posters be removed after
the date of the Passion Play..
A communication.from the Rochester Public Schools regarding their 1040
tax budget was read and President Lemmon ordered that the same be placed on file.
The budget for the Fire Department was read and President.Lemmon ordered.
that the same be placed on file.
A communication from Ralph LaPlant reque.sting approval of his attendance
at the Assessors' Institute at the University of Minnesota, November. 7th, Sth,
and 9th,1940, and asking that his expenses of approximately $15.00 be reimbursed,
ilwas read and upon Motion by Mrachek second by Amundsen, his request was granted.
Copies of resolutipns passed and adopted by the Public Utility Board,
requesting. authority to enter into contracts with the Sahara Coal Com-pany, the
Walter Bledsoe a.;id Company, The Daunt Corporation,.and •the. General Electric
• Supply Corporation, and requesting authority to acquire Lots 5 and 6 in
Block 50,Original Plat, and Lot 13,Block 1, Kummer's Addition, were each -read,
and President Lemmon ordered that the same be placed on file.
The recommendation of the Zoning Board that Frank J.Harrington be granted
,a bui.lding permit for remodeling his residence into a. duplex, was read and
upon motion by Moody second by Williams said recommendation was accepted.

The recommendation of the Zoning Board regarding the request of

St.John's Church, �,:as read and President Lemmon ordered that the same be

The recommendation of the Committee regarding the exchange of lots
between the City of Rochester and the Rochester Bread Company, was read
and upon motion by Williams sedond by Amundsen the said recommendation was
accept ed.
A petition and statement signed by Anna Larson, requesting a charge of
zoning classification for the east 72 feet of Lot l,in Block SQ, Original
Plat, was read. Mr. James T.Spillane anoeared for the -:petitioner. Upon

motion by Mrachek second by Bowers the matter was referred to the Zoning Board

for an early report.

The report of the City Engineer for the month of October,1940, showing

disbursements from the General Fund for labor $6R9.78, Street and Alley
Fund $1422.23, Sewer Fund, $670.99, and from the Bridge Fund $12.91, was read
and President Lemmon ordered that the same be placed on file.

Mr.C.W.Shepard appeared before the Council regarding his notice of a-preal
A-rom the decision of -the building inspector; and he was informed that no
action would be taken by the Council as the matter was a building code question

and not a zoning matter.
The reports of the Building and Plumbing, and the Electrical Inspectors
for the month of October,19L'-0, showing building permits issued $114.00,

Plumbing permits $33.50, and Electrical permits $01.25, were each read and
President Lemmon referred the same to the Finance Committee.

The report of the Clerk of the Municipal Court for the week ending
November 2nd,1940, showing criminal fines and costs collected $355.60, civil
fees received $7.20, and conciliation court fees.$1.25, wsa read, and having
been previously approved by the City Attorney, President Lemmon ordered that
the same be placed on file.
Applications signed by the Coast to Coast Stores and the Standard Oil
Company for permits to place and maintaAn signs, were each read, and upon
motion by Amundsen second by Bowers permits were granted.
The application of L.S.Anderson for a soft drink dealers license was read,
and upon motion by Moody second by Mrachek, license was granted.
The an-olication of tr_eZumbro Plumbing and heating Company for a plumbers

license was read, and upon motion by Moody second by Amundsen, license was
granted.
The license bond of the Zumbro Plumbing and Heating Company, in the sum of
$1, 000.00 with the Maryland Casualty Company as surety thereon eras read, and

upon motion by Williams second by Mrachek the said bond was approved, the surety
thereon a.cceuted and it was ordered that the same be -placed on file.
The contract -bonds of the Ellis Motor Company in the sum of $596.00 with

the Standard Accident and Insurance Company as surety, and of the Foster Electric
Company in the sum of $459.00 with the Standard Accident Insurance Company as
surety, were each read, and upon motion by Williams second by Mrachek, the said
bonds were ap-Droved, the sureties .thereon accepted and it was ordered that the

same be placed on file.
Applications signed by Dorothy Hodgson and Everett Q,uand_t for transfer of
non -intoxicating malt liquor licenses to Everett Quandt were read, and upon mo-
tion by Mrachek second by Amundsen, transfer was granged.
Peter Bross presented copies of the proposed new buildinb code to the
Council, and President Lemmon ordered that the same be placed on file, and
stated that a meeting will be arranged later after a study has been made of said
.new code.
The following claims were read, and upon motion by Williams second by
Mrachek the same were allowed and the Mayor and City Clerk were instructed to
draw warrants upon the City Treasurer and make payments accordingly:

Alderman Williams introduced a resolution accepting the bid of Wm. C.
Fraser & Son, for the construction of a sanitary sewer and water"main in
3 Street Southeast from west of Thirteenth Avenue to Fifteenth Avenue South-
east, and in Fifteenth Avenue Southeast from Fourth Street Southeast to
32 Street Southeast, for the sum of $2755.62, which was read.
Upon motion by Bowers second by Mrachek that the said -resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution authorizing the Public Utility
Board to enter into contract with the Sahara Coal Company, for furnishing
of 4000 tons coal, in accordance with the resolution request of the Public
Utility Board, which was read.
Upon motion by Amundsen second by Williams, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Mrachek introduced a resolu-tion authorizing the Public Utility
Board. to enter into. contract with the Walter Bledsoe Company, for the
�urnish.ing of 1,000 tons of coal, in accordance with .the resolution request of
said Board, which was read..
Upon motion by Mrachek second by Moody that the said resolution be adopted
as read,.and all voting in favor thereof, P.res.ident Lemmon declared the said
resolution. duly. passed and adopted.

100 fluted shaft,extensions for extending Union Metal costs, for the sum of
$18b0.00, in accordance with the resolution request of said Board, which was
read.
Upon motion by Amundsen second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mraghek introduced a resolution authorizing the Public Utility
Board to enter into a contract with the General Electric Supply Corporation,
for the furnishing of 100 luminaires, in accordance with the resolution request
of said Board, which was read.
Upon motion by Williams second by Anderson that the said resolution be
adopted as read, and all voting,in favor thereof, President Lemmon declared the
said resolution duly passed and adopted..
Alderman goody introduced a resolution authorizing the Public Utility Board
to acquire Lots 5 and 6 6ff Block 50, Original Plat, and Lot 13,Block 1, of
Kummer's Addition, in accordance with the resolution request of.said Board,which
was read.
Upon motion by Moody second by Williams that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmor_ declared the said
resolution duly passed and adopted. V
Alderman Moody introduced a resolution appropriating $1074.60 from the
General Fund and ordering payment made,to the Street and Alley Fund, for use
�of equipment during 0ctober,1040, which was read. '
Upon motion by Mrachek second by Williams that the said resolution_ be
adopted as read, and all voting in favor thereof, PreskdentnLemmon declared the
said resolution duly -passe.d and adopted.
Alderman Moody introduced a res.olutt.ion appropriating $2, 000:00 from the
jGeneral Fund and.ordering payment made to the .park Improvement Fund, for transfer
f of funds to make the same available for park purposes, which was read. .
. Upon motion by Moody second_ by Amundsen that- the said Resolution be adopted

. Alderman t1oody introduced a resolution appropriating $313.65 from th,e
General Fund and ordering payment made to the General. Electric Codpany, for
traffic signal controls, which was read.

Alderman Bowers introduced a resolution appropriating :D707.1�0 from the
Street and Alley Fund and orderirg payment made to the Street and Alley Fund,
for use of equipment during October, 1940, which was read.
Upon motion by Williams second by Moody that the said resolution be adopted
as read,.and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and- adopted.
Alderman Bowers•introduced a resolution appropriating $19.90 from the
General Fund, and $453.04 from the Street and Alley Fund and ardering payment
made -to Morse Brothers, for sand and materials furnished during October,1940,
which was read.
Upon motion by Amundsen second by Mrachek that the said resolution be
adopted as read, and all voting.in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. .
Alderman Bowers introduced a resolution appropriating $5,060.00 from the
Fire Protection Fund and ordering payment made to the City of Rochester,
Water Department, for hydrant rental, which was read.
Upon motion. b-y--Moody second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $223.00 from the
Park Improvement•Fund and ordering payment made to Alvin E.Benike, for repair
work on Williams property, which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed.and adopted.
Alderman Anderson introduced a resolution appropriating $1966.99 from the
Park Imrovement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending October 31,1940, which was
read.
Upon motion by Moody second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly -oassed and adopted.
Alderman Amundsen introduced a resolution appropriating $404.95 from the
Park Improvement Fund and ordering payment made to Woodhouse Brothers, for
furnishing and applying pitch and gravel -to roof at Williams building, which
was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor•thereof, President Lemmon Aeclared the

Alderman Amundsen introduced a resolution adopting specifications for
Christmas street lighting, and:':-,g:rdering advertisement for bids to be received
and opened at 7:30 o'clock P.M., on November 19th,1940,-which was read.
Upon motion by Doody second by Bowers that the�said resolution be adopted
las read, and all voting in favor thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Williams introduced an ordinance amending an ordinance for the
1pu-rpose of _oromoting health, safety, order, convenience and general welfare by
regulating the use of land, the location, size, use.and height of buildings, and
the arrangement of building on lots, and the density of population within the
10ity of Rochester, Minnesota, all in accordance with a comprehensive plan, which
1was given its first reading.
Upon motion by Williams second by Amundsen, and upon roll call all voting
in favor thereof, the rules were suspended and the said ordinance was given its
second reading.
Mayor Grassle spoke in favor of the passage of the amendment to the
e
State Constitution to voted on at the election November 5th,1940.
Mayor. Grassle called the attention of the Council to the Armistice day
Celebration sponsored by the American Legion, and asked that the members of
the Council meet with them on November llth,1940.
Upon motion by Amundsen second by Bowers the City Clerk was instructed to
send a letter by registered mail to Sister Doma.tilla., of St.Mary's Hospital
asking them if they wish the City to take care of the storm and sanitary sewer
facilities in that locality.
The auestion of extra clerks at the General election, was considered and
�Jupon motion by Amundsen second by Williams, the City Clerk was authorized to
'work with the precinct judges where extra clerk help is needed.

liuntil 7: 30 o'clock P. M. , on November 19th, 194o.
