Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City mall, in said City on November 18th,1940. President Lemmon called the meeting to order at 7:30 o'clock P.M., the follol ling members being present: Lemmon, Amundsen, Anderson, Bowers, Moody, Mrachek, lWilliams. Absent: done. President Lemmon stated this as being the time and place set for receiving and opening.bids for the furnishing and installation of Christmas street lighting. The City Clerk stated that no bids had been received. Upon motion by Moody second by Amundsen the.Street and Alley Committee and lthe ElEectrical Inspector were authorized to have the work done with the expense Ito the City not to exceed $729.00. Royal Nuna.maker inquired as to what had been done about land for a garage in connection with the local national,guard armory, and President Lemmon stated that the Common Council had looked over various sites and that the .Committee would report in two or three days. Upon motion by Mrachek second by Bowers Christ Vail was ap_ointed Fire Department Civil Service Commissioner to fill the unexpired term of N. C. Bluhm 1who~resigned. A communication from the Rochester Public Schools regarding a furth.e.r reduction in their 1940 tax budget was read, and President Lemmon ordered that the same be placed on File. Appointments by the Mayor of Martin Kulsrud, Edward Siem, and Stephen Flynn as Snecial Policemen, to serve without pay and to hold. office .until the second Monday in April,19111, unless sooner removed, were each read, and upon motion by Mrachek second by Moody said appointments were approved. A petition signed by Archie M.Ackerman and Minnie Graham Ackerman, asking (for a. change in the zoning classification of Lots 2 and 3, in Block 1, D.P.Ma.dden' Addition, was read., and President L.emmon referred the same to.the Zoning Board. A notice of appeal from the decision of the Building Inspector, signed by John P. Cassidy, was read and President Lemmon referred the matter to the Zoning Board. An emergency order given by the Mayor to the City Clerk for the purchase of a carload of gasoline for the City Bulk station, was read and upon motion by Mrachek second by Bowers the action set forth therein was approved. The City Engineer submitted an estimate of cost and specifications for one Diesel power patrol grader for use of the City Engineer's Department, and President Lemmon ordered that the same be placed on file. 11 s n LJ • RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., November 18 ,19 4 0 . 175 1 • _ U • • A communication from the League of Minnesota Municipalities regarding the Conference on Recreation Planning, to be held at the University of Minnesota, was read and President Lemmon ordered that the same be placed on file. - The City Engineer's trial balance for October,1940, was read and President Lemmon ordered that ithh same be mated on file. A statement of receipts and expenditures in the Park Imrrovement Fund, as of October 31, 1940, was read, and President Lemmon ordered that the same be placed on file. The report of the Clerk of the Municipal Court for the week ending November 9,1940, showing criminal fines and costs collected $277.80, civil fees received $4.25, and conciliation court fees received $41.25, and for the week ending November 16th,1940, •showing Criminal fines and costs collected $240.60, civil fees received $9.00, and conciliation court fees received $3.00, were each read, and having been previously approved by the City Attorney, President Lemmon ordered, that the same be placed on file. The contract bond of Wn,. C. Fraser & Son in the sum of $2755.62 with the United States Guarantee Company as surety, was read and upon motion by Moody second by Williams, the said bond was approved, the surety thereon accepted and it was ordered that the same be placed on file. The recommendation of theBoard of Zoning that the petition of Mrs. Anna Larson be granted, was read, and upon motion by Williams second by Anderson the said recommendation was approved. The request of the Rochester Firemen's Relief Association that the Council approve the transfer of the Sarah Ginther Loan to C.E.Ginther, was read and President Lemmon referred the same to the Finance Committee for report. The application of Esther's Flower Shop for a permit to place and maintain a sign was read, and u-nnon motion by Amundsen second by Anderson permit was granted. Applications signed by R. B. Trainor and_ Caryl Zeller for transfer of non -intoxicating malt liquor licence No.596 to Caryl Zeller, were read, and upon motion by Mrach'ek second by Bowers transfer was granted. The application of Caryl-C. Zeller for a loft drink dealers license was read and upon motion by Anderson second by Bowers license was granted. Franklin D.L.Smith appeared before the Council regarding the drainage of surface water on Fourteenth Street Northeast. Alderman 11oody reported that the Street and Alley Committee have been working with the Township Board and the County Engineer, and County Commissioners, endeavoring to correct the condition and invited Mr. Smith to meet with the said Committee and County officials at their next meeting on said matter. 176 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHEST'ER, MINN., November 18, 1940; President Lemmon declared a twenty five_minute recess for cgnsideration of the 1940 ta.x _levy budgets of various _departments. Upon motion by Mrachek second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution levying special assessments for scavenger service during 191+0, which was read. U-oon motion by Amundsen second by Doody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution levying special assessments for sidewalks constructed and rebuilt in 1940, which was read. - Upon motion by Mrachek second by Williamsthat the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen_ introduced a resolution granting a, public dance permit to the Board of Public Health and Welfare for the Masonic Temple November 16th, 19210, which was read. Upon motion by Amundsen_ second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution granting public dance permit to the Southern bginnesota Broadcasting Company for the Armory, November 16th, 2.3rd, and 30th, 1940, and fixing the fee at $9.00, which was read. Upon motion by Mrachek second by Moody that the said resolution be adopted. as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $1220.99 from the General Fund and ordering payment made to the Permanent Improvement Revolving Fund, for special assessment levied against the State of Minnesota, for a sanitary sewer in Fourth Street Southeast, which was read. MINN,., 179 Alderman_ Bowers introduced a resolution appropriating $2039.59 from the Fund _ Deposits for 'license and permit fees and ordering payment made to the General Fund, for transfer of license and permit fees, which was read. Upon mo'ti'on by Bowers second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $203..30 from the Street and Alley Fund and ordering payment made to the Quarry Products Company for 187 cu. yds. 3/4" crushed rock, and 10 cu.yds. screenings and 24 cu. yds. washed screenings, which was read. Upon motion by Moody second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, Pre sicdent Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $553. 20 from the Street & Alley Fund and ordering payment made to the General Fund, for gasoline furnished Lru the City Filling Station, which was read. _ T Upon motion by Mrachek second by Amundsen that the said resolution be adopted ad read, and all voting in favor thereof, President Lemmon declared the said resolution 'duly passed and adopted. Alderman Moody introduced 'a resolution appropriating $30,8.S5 from the General Fund and ordering payment made to the Rochester Post -Bulletin, for official ;publications and printing which was read.
