OF THE CITY OF ROCHESTER, MINN.,, December 11.1 40 .
Minutes of an adjourned regular meeting of the Commcn Council of the City
of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on December 11, 1040.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams. Absent: None.
Upon motion by Amundsen second by Moody the minutes of the meetings of October
28th, November, 4th, lgth, and 22nd, a.nd December 2nd, 1940, were each approved.
A communication from the Board of Park Commissioners, asking for approval
by the Council of a, 14.P.A.p-roject for construc.tion of a shelter building and
appurtenant and incidental work thereto at Silver Lake Park, was read, a.nd
Arthur E.Reiter, President of the Park Board described the project.
Upon motion by Mrachek second by Bowers the Council approved the proposed
W.P.A.Project for a shelter building at Silver Lake, and the Mayor and City
Clerk were authorized and directed to sign the proposal applications for the
City of Rochester as sponsor of the project.
A communication from rthe State of Minnesota Department of Highways
egardirig revision of the -plans for north Broadway paving, was read and President
Lemmon ordered that the same be placed on file.
A communication from the State of Minnesota, .Department of Highways together
with six copies of an agreement for the inaintenance of trunk highways through
the City of Rochester, during 1941, was read.
A notice of claim for damages signed by Rogelio J. Vega for
persdnal injuries, was read and upon motion by Moody second by Mrachek the
matter was referred to the City Attorney.
The City Engineer's specifications and estimate of cost for the replace-
ment of a chain at the sewage disposal plant, was read, and President Lemmon
ordered that the same be -placed on file.
A communication from the Board of Public Health and Welfare, together with
t1je resignation of Dr. D.C.Lochead as Deputy Health Officer, effective the
second Tuesday in Apri1,1941, were each read; said communication from the Board
of Health reauesting the approval by the Council of the appointment of Dr.
Floyd Ii. Feldma.n as part time Deputy Health Officer at a salary of $197. 50 pe r
month beginning January lst,1941.
Upon motion by Williams second by Mrachek the resignation of Dr. D.C.Lochead
as Deputy Health Officer was accepted.
Upon motion by Mrachek second by Bowers, the a-ppointment by the Board of
Public Health of Dr. Floyd M.Feldman as' part time Deputy Health Officer was
approved.

The trial balance of the City engineer's Department, for the month of
November,1940, was rear' and President Lemmon ordered that the same be placed
on file.
The report of the Building and Plumbing Inspector for the month of November
19110, showing building permits issued $248.00, and plumbing permits issued
$79.50; and the report of the Electrical Inspector for the month of November,
194o-,,,showing electrical permits issued $37.00, were each read, and President
Lemmon referred the same to the Finance Committee.
The report. of the Clerk of the Municipal Court for the week ending
December 7,1911.0, showing criminal fines and costs collected $367.20, civil fees
received $7.99, and conciliation court fees Y7.75, was read, and having been
previously approved by the City Attorney, President'Lemmon ordered that the
same be placed on file.
The application. of Clifford W. Zirirler for a journeyman_ electrician's
license, was read and upon motion by Bower's seco'nd by Amundsen, license was
grant ed..
The applications of the Rochester Electric Company, Olmsted County
Business Men's Association, and the Rochester Police Department for
7.e.rmits to place and maintain signs were each read and upon motion by Amundsen
second by Bowers permits were granted
An application signed by Cora Glasenapp and Wm. J.Moriarity for,.transfer
of On Sale liquor license No.90 to Wm. J. Moriarity, was read, and upon motion
by Mrachek second by Williams transfer was granted.
The license bond of Wm. J. Moriarity in the sum of $1,090.00 with the -
St -Paul Liercury Company as surety and the contract bond of the Wm,. H.Ziegler
Co. Inc., in the sum of $6,127.94, with the Ohio Casualty Insurance Company
as surety, were each read and upon motion by Moody second by Amundsen_, the
said bonds were approved, the sureties thereon accepted, and it: teas, ordered
that the same be placed on file. r'

A statement of receipts and disbursements in the Park Improvement Fund
as of. November 30th, 191F0, was read and President Lemmon ordered that the same
be placed on file.
Alder'ma.n Amundsen introduced a resolution appropriating $472.03 from the
Stre6t"and Allev Fund and ordering payment made to the General Fund, for
which
gasoline furnished from city filling station,/was read.
Upon ;notion by Amundsen secmnd by Anderson that the said resolution be
adopted as read, and all voting in favor thereof; President Lemmon_ declarod
the. -said resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $327.02 from the
Street and Alley fund and ordering payment made to Morse Brothers, for Band and
gravel furnished during'November,1940, which was read.
Upon motion by Pdrachek second by Williams that the said resolution b•e'.,-
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $596.00 from the
Street and Alley Fund and ordering payment made to Ellis Motor Company, for a
1941 DeLuxe Dodge four door sedan purchased under contract, which was read.
Upon motion by Bowers second by Anderson that the said resolution be adopted
as read, and all voting in favor.thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $242.90 from the Sewer
Fund and ordering payment made to Botsford Lumber Company, for Harrisburg coal
furnished during Ngvember,1940, which.was read.
Upon motion by Anderson second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declar ed the
Isa.id resolution duly passed and adopted..
Alderman,Anderson introduced a resolution.appropriating $1703.72 from the
Park Improvement Fuad, and ordering payment made to the Mayo Trust Fund, for
1payroll.s for labor during the half month ending November 30,1940, which was
Iread.
Upon motion by Moody second by Amundsen that the said resolution be adopted
las read, and all voting in favor thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Anderson introduced a resolution granting public dance permit to
lthe Southern Minnesota. Broadcasting Company, for the Armory December 7,1940,
Iand fixing the fee at $3.00, which was read.
Upon motion by Mra.chek second by Moody that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced the following resolution which.i-.as read:
"HEREAS, On November 29,1940, death called our friend and esteemed fellow
citizen,' Julius J. Reiter, and
WHEREAS, During the many years he served the City of Rochester as Alderman
and Mayor, he always had the best interests of the city at heart and gave will-
ingly -and freely of his time and talents and faithfully carried out the duties
of these offices.
NQW THEREFORE, BE IT RESOLVED By the Common Council of the City of Rochester,
Minnesota, that in the death of Julius J. Reiter the community has suffered a
great loss, and that their fullest. praise could add little to the memory of the.
distinguished service for which he was so well known.

BE IT FURTHER.RESOLVED: That this said resolution be entered upon the
books of the City of Rochester and that a certified copy be delivered to
Mrs.. Reiter, his surviving.. wife, and the sympathy of the Mayor and Common
Council of the City of Rochester is hereby expressed to her and other members
of the family in this hour of. sadness. ° _
Upon motion by Amundsen second by Moody that the said resolution be
adopted as read, and all voting in -favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution authorizing the Board of Public
Health...and.Welfare to pay part-time deputy health of-ficer salary, which was
read .
Upon motion by 11rachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor ,thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman_ Moody introduced a resolution adopting the specifications for and
ordering'.bids for furnishing a chain for the Sewage Disposal Plant, said bids
to be received and opened at12.:00 o'clock P.M., on January 6th,104-1, which
was read.
Upon motion by Moody second,by Bowers that the said resolution be adopted
as read, and all ,voting in favor therEcf, .President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $54.93 from the
Street and Allev.Fund, and $151.60 from the Fire Protection Fund,and ordering
payment made to the Dodge Lumber & Fuel Company, for coal furnished during Nov-
ember,1940, which was readl.
Upon motion by Williams second by Moody that the said resolution be
adopted as read, and all voting in favor.thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution acce-oting the agreement -.with the
Minnesota, Highway Department for maintenance of trunk highways +14, 52 and
63, during 1941, which was read.
Upon motion by Mrachek second by Bowers that the said resolution be adopted
as read, and all voting"in favor thereof, President Lemmon declared the
said resolution duly passed and adoptbed.

and directed to draw -warrants upon the City Treasurer and make payments
accordingly:
