RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY OF ROCHESTER, MINN.,. January 2 0 , 19 41
Minutes of an adjourned regular meeting of the Common Council of the City
• of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City on January 20th,1941.
President Lemmon called the meeting -to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams.
Upon motion by Moody second by Amundsen the minutes of the meeting of
January 6th,'1941, were approved.
President Lemmon announced this a"s the time and place set for consideration
of the proposed new building,.code and stated that Bert J.Westover, representing
Insukdtion Board Institute, and Mr. L.P.Keith, representing the National Lumber
Manufacturers Association would like to be heard. Mr. Westover stated that his
• organization would kike more time to study the proposed building code, after
which they would make recommendations and suggestions regarding materials and
various types of construction. Mr. Keith submitted a few recommendations
together with a request for additional time and the privilege of submitting
furthor suggestions. President Lemmon ordered that his communication be placed
on file.
A motion by Mrachek second by, Anderson carried that the Council accept the
propositions as offered by Mr. Westover and Mr. Keith.
Mr. Peter P. Bross, Architect, A.G.Whiting from Botsford Lumber Company,
and Mr. J.G.Lang, were also heard.
The request of the City Engineer for an appropriation of $2,000.00 from the
• Sewer Fund, and $3,000.00 from the Street and Alley fund for use of the Street
and Alley Committee, was read and President Lemmon ordered that the same be
placed on file.
A communication from M. J. Hoffman, Commissioner of Highways, notifying
the City of the discontinuing of the use of the detour for trunk highway 063,
was read, and President Lemmon ordered that the same be placed on file.
A communication from the Salvation Army regarding the issuing of a non -
intoxicating malt liquor license to the Peerldes Inn, was read and President
Lemmon referred the same to the License Committee and the City Attorney.
A notice of claim for damages signed by Dora Strehlow, was read and
President Lemmon referred the.same to the City Attorney.
• A Copy of a resolution passed and adopted by the Commissioners of the Sink-
ing Fund, purchasing $65,000.00 State of Minnesota, 1 3/4% Rural Credit Bonds
from Bigelow Webb Inc., was read, and upon motion by Moody second by Amundsen
the action of the Sinking. Fund Commissioners was approved and it was ordered
that the same be placed on file.

Copies of resolutions passed and adopted by the Public Utility Board
requesting authority to enter into contracts with the Sahara Coal Company,
the Walter Bledsoe Company., and the Burroughs Adding Machine Company, were
each read and President Lemmon ordered that the same be placed on file.
A communication from the Standard Oil Company, together with a statement
of acquiescence, regarding the construction of a new station on the South
80 feet of Lot 2, Elliott's Sub -Division, were each read, and upon motion by
Mrachek second by Bowers the matter was referred to the Zoning Board.
Copies of requisitions by the Health Officer upon Saint Mary's Hospital
for the isolation of Mrs. Martin Fogarty diagnosed to be _suffering from
erysipelas, and for the isolation of Mildred Hollendeck, diagnosed to be
suffering from Poliomyelitis, were each read and President Lemmon ordered that
the same be placed on file.
The report of receipts and expenditures from the Park Improvement Fund
for December,19h0, was read, and President Lemmon ordered that the same be
placed on file.
The reports of the Clerk of the Municipal Court for the week ending -
January llth,1941, showing criminal fines and costs collected $141.20, civil
fees received $4.4-5, and conciliation court fees received .$4.50; and for the
week ending January 18th,1941, sh6wnng criminal fines and costs collected
$110.80, civil fees received $4.75., and conciliation court fees received $5.50,
were each read and having been previously approved by the City Attorney,
President Lemmon ordered.that the same be placed on file.
An application signed by Glenn L.Bowers for a permit to place and maintain
a sign at 1143 Second Street Southwest, was read and upon motion by Amundsen
second by Moody permit was granted.
Applications signed by Lester Lawrence, Ray Benedict, Eugene G.Chapman,
Frank L.Huffman, and Ernest T.Riege, for drivers licenses, were each read, and
upon motion by Amundsen second by Bowers licenses were granted.
The contract bond of the Minnesota Bearing Company, in the sum of $949.92
with the Aetna Casualty and Surety Company as surety, was read, and upon motion 1
Moody second by Mrachek, the said bond was approved, the surety thereon accepted
and it was ordered that the same be placed on file.
The application of Seth Remund for a license to operate a roller skating
rink, in the Woodman Hall, was read, and upon motion by Moody second by
Williams the matter was referred to the License Committee, the Chief of Police
and the Mayor, with power to act.

directed to draw warrants upon the City Treasurer and make payments accordingly;

Alderman Williams introduced a resolution appropriating $364.95 from the
Pafk Improvement Fund and ordering payment made to the City of Rochester, Steam
Department, for steam heat f urnished'at the Mayo Civic Auditorium, which was
read. '
Upon'motion by Willkams second by Amundsen that the said resolution be
adopted as read, and all voting- in favor thereof, President Lemmon declared the
said resolution duly'passed'and adopted.
Alderman Williams introduced a resolution appropriating $271.57 from the
Park Improvement Fund and ordering. payment made to the Coca Cola Bottling Comp
for soft drinks furnished at the Auditorium during-December,1§40,which was read.
Upon motion by Mrachek second by Bowers that the said resolution be
adopted as read'and all voting,in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $479.70 from the
Park Improvement Fund and ordering payment made to Leitzen Concrete Products
for T38 yds. of black dirt, which was read.
Upon motion by Moody'second by Amundsen that th.e said resolution be adopted
as read, 'and all voting, in favor thereof, President Lemmon declared the said
resolution duly'passed and adopted .
Alderman Mrachek introduced a resolution appropriating $290.00 from the
Park Improvement Fund and'ordering,payment made to J.E.Burke Company, for two
tobogan slides; which was read.
Upon motion by Amundsen second by Anderson that the said resolution be
adopted as read, and all voting,.in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution authorizing the Public Utility
Board to enter'inio contract with .the Burroughs Adding Machine Company, for the
furnishing of a billing machine for'the sum of $2,72.6.10, which was read.
Upon motion'by Bowers second by Mrachek that the said resolution be adopted
as read,'and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution authorizing. the Public Utility
Board to enter into contracts with the Sahara Coal Company for the furnishing
of 2500 to 5060 tons coal screenings, and with Walter Bledsoe and Company
for the furnishing of 2500 tons to 5000 tons coal screenings, which was read.

Upon motion by Amundsen second by. Anderson :;that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. - -
Alderman Mrachek introduced -a resolution appropriating-$2,.000.00 from the
Sewer Fund, and $3, 000.-00 from the -Street and Alley Fund, for use of the Street
and Alley Committee, which was read. -
Upon motion by Williams second by Anderson that the -said -resolution be
adopted as read, and all voting- in favor thereof, President-Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced -a resolution requesting -an examination of the
books and records of the Gity__ of -Rochester for the fiscal year -ending March 31,
1941, by the -State Comptroller, which was read.
Upon motion by Amundsen second by,Mr-achek that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and -adopted.
Alderman -Moody introduced a resolution fixing..the_distribution of the
10% Public Utility Income payments fo'r 1941, `which was read. -
Upon motion -by Moody second by Williams that the said resolution be adopted
las read, and all voting in favor thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Moody introduced a resolution appointing election judges for the
Ci ty Primary -and -Charter Elections to be -Held February 25th, and -March 11*, 1941,
which was read.
•Upon motion by Mrachek second by Amundsen that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
isaid-resolution duly passed and adopted.
Alderman Moody introduced a resolution granting public dance permit to the
l Board of Public -Health and Welfare for the Masonic Temple, January 18th,1941,
and fixing the fee, at $3.00, which was read.
Upon motion by Moody second by Anderson that the said -resolution be adopted
i as •read, and all voting in favor thereof, -President Lemmon declared .the said
(resolution duly passed and adopted. -
Alderman Bowers introduced a resolutiongranting public dance permit to the
(Southern Minnesota Broadcasting Company, for the -National Guard Armory, January
18th,1941, and fixing the -fee at $3.00, -which was read. -
- Upon motion by Bowers second -by Amundsen that the said -resolution be adopted
l as -read, and all voting in -favor thereof, President Lemmon declared the -said

Alderman, -Bowers introduced a resolution appropriating $400.00 from the
General Fund and ordering payment made to the Rochester Chamber of Commerce
for 3/4 cost of purchase and distribution of 6400 Rochester Minnesota booklets,
which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $215.b4 from the
Park Improvement Fund, and $143.10 from the Lighting -Fund and ordering payment
made to the City of Rochester, Light Department, for electricity and water
furnished at the Mayo Civic Auditorium, which was read.
Upon motion by Moody second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $1300.05 from the
Park Improvement FudU and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending January 16,1941, which was read.
Upon motion by Mrachek second by Moody that the said resolution be adopted
as read, and all voting -in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Mr. Arthur Reiter, Dr. Brunsting and James 01Conner appeared regarding
liability insurance at Auditorium, and upon motion by Williams second by
Amundsen the matter was referred to the Insurance- Committee with power to act.
The Chief of the Fire Department inquired regarding the replacing of men
who are ill with those on the eligible list, and upon motion by Mrachek second
by Amundsen the matter was referred to the Fire Committee with power to act.
Upon motion by Williams second by Amundsen the City Engineer was
instructed to prepare plans and specifications for the repaving of north
Broadway.
The matter of paying Frank Adair for extra time worked in reinstallation
and hooking up fire alarm system, was left in the hands of the Fire Committee
with power to act.
Upon motion by Williams second by Moody the Common Council adjourned.
