Minutes of a regular meeting of the Common Council of the City of Rochester,]
Minnesota, held in the.Council Chambers, in the City Hall,.in said City, on
February 3,1941.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams. Absent: None. ,
Upon motion by Amundsen second by Bowers the minutes of the meeting of
January 20th,1941, were approved.
Mr. Peter Bross requested that a committee be appointed to go.over the
proposed new building code step by step during the next two weeks, and President
Lemmon referred,this matter to the Council as a committee of the whole.
Febr-4ary 6th,1941, at 7:30 o'clock P.M., was. -set as the -time for an informal
meeting of said Committee for consideration of the said proposed.building code
and all persons interested in said building code were invited to attend said
meeting.
Mr. Flanders complained that out of town labor was employed on.the
snow shoveling work, and President Iemmon referred the matter to the Street and
Alley Committee,.the City Engineer and the Mayor, for investigation.
A communication from the Western Surety Company withdrawing their -notice
of cancellation of the surety bond of Tim Daly, was read, and President Lemmon
ordered that the same be placed on file.
The mayor's emergency order given to the City Clerk for the purdhase of
a carload of gasoline, was read.and upon motion by Mrachek second by Williams,.
the action set forth therein was -approved.
A communication from the Public Examiner acknowledging receipt of a
copy of the resolution requesting an'examination of the books and -records -of the
City of Rochester, for the fiscal year ending March 31,1941, was read and
President Lemmon ordered that the same be placed on file.
A, communication from the United Brotherhood of Carpenters &. Joiners of
America regarding the scale of wages after April 1,1941, was read.
The recommendation of the Zoning Board that the request of the. Standard
Oil: pompany for permission to construct a new filling station.at the corner of
Y be granted,
Second Street Southwest and.Eleventh Avenue Southwest,/was read, and upon motion
by Moody second by Williams the said recommendation was accepted and the
• 11 Building Inspector authorized to issue a.building permit to the Standard Oil
Company.
A copy of a resolution passed, and adopted by the Public Utility Board
requesting authority to sell 5,000_..pounds of junk,.to Sam Reznick for the sum
of $729.50,.was read, and President Lemmon ordered that the same be placed on
file.

A communication from the Chicago & Northwestern Railway Company, and a
letter from the Department of Highways to the Chicago & Northwestern Railway
Company, regarding the improvement.of the grade crossing on Broadway Street
North, were each read, and upon motion by Moody second by Mrachek the City
Engineer was instructed to notify the said Railway Company_to widen said
crossing to a width of 70 feet .
An invitation from the Junior Chamber of Commerce to a banquet February
lgth,1941, at Pine Room of the Carleton Hotel, was read, and.President Lemmon
requested the City Clerk to notify the Junior Chamber of Commerce of the
Council's acceptance and appreciation for this invitation.
The report of the City Engineer for the month of January,1941, showing
expenditures from the Street and Alley Fund, for labor, in the sum of $2045•95,
Sewer Fund $966.10, was read, and upon motion by Amundsen second by Moody the
said report was ordered.placed on file.
The report of the Clerk of the Municipal Court for the week ending
January 25th, 1941, showing cr.iminal:.fines-_and costs collected $337.75, civil
fees received $2.00, conciliation court fees received $10.50, and for the
week ending February 1,1941, showing criminal fines and costs collected $66.40,
civil fees received $13.75, conciliation court fees received $8.50,'-'were each
read, and having been previously approved by the City Attorney, President
Lemmon ordered that the same be placed on file.
A certificate of insurance, issued by the Fidelity and Casualty Company
of New York! covering Martin Paulson the assured, was read and President Lemmon
ordered that the same be placed on file.
The applications of Francis Christopherson and Maass & McAndrew Company
for licenses to connect to sewers and drains, were each read, and upon motion
by Moody second by Williams, licenses were granted.
The applications of•Arthur A.Brown for an electrical contractors license,
and of Arthur A.Brown, for a master electrician's license, were each read, and
upon motion by.Williams second by Amundsen, licenses were granted.
The application of Harold Richards for a journeyman electrici-an's license
was read; and upon motion by Moody second by Bowers license was granted.
The application of Mrs. Lucille Hargesheimer for -transfer of Off -Sale
non -intoxicating malt liquor license #609, was read and upon motion by Mrachek
second by Amundsen transfer was granted.
Applications signed by Mrs. Lucille Hargesheimer and Olson-Defosse,.for
soft drink dealers licenses.were each read, and upon motion by Moody second by
Bowers, licenses were granted.
Applications signed by Frank Salley, Homer Strangeway, Arnold L.Brown,
Richard Lehman, Clifford J. Carson, Gerald A.Cooke, Walter Wilke, Edward Campion,

Marvin W. Matthiesen, Frank A.MeLaughlin, Julius Feind, Joe R.Valsvik, and
Alfred H. Hollo, for drivers licenses were each read, and upon motion by
Amundsen second by Anderson, licenses were granted.
The applicationsof J.A.Peterson for an electrical contractors license,
and a master electrician's -license, were each read, and upon motion by Bowers
second by Anderson, licenses were granted.
An application signed by Sam DeFosse, and Olsen-Defosse Corporation, for
transfer of non -intoxicating malt liquor licenses, 334 and 569, to the Olsen -De
iFosse Corporation, was read, and upon motion.by Mrachek second by Amundsen,
transfer was granted.
The application of the Rochester Electric Company for an electrical
contractors license, was read, and upon motion by'Mrachek second by Moody,
License was granted.
Applications for master electrician licenses signed by Ed. M. Raetz; and
Lyle W.Edgerton, and applications for journeman electrician licenses signed
by Arthur L. Seaman, Herbert Fordham,. Wm. Hines, Alton Rittenhouse, Edw."D.
,
Holst, Earl J. Squires, Walter Il Alker, Spencer H. Holloway, John E. Hines,
Clifford Boutelle and Fred Raetz, were each read, and upon motion by
Williams second by Amundsen, licenses were granted.
The license bonds of Maass & McAndrew Company, in the sum of $1,000,00
with the National Surety Company as surety, and of Frances Christopherson
in the sum of $1,000.00 with the Fidelity & Casualty Company as surety, were
each read, and upon motion by Mrachek second by Moody thacA the said bonds,_were
approved, the sureties thereon accepted and it was ordered that the same be
placed on file.
The surety bond of J.A.Peterson in the sum of $1,000.00 with the New
Amsterdam Casualty Company as surety was read and upon motion by Moody second
by Bowers the said bond was approved the surety thereon -accepted and it was
,ordered that the same be placed on file.
The following claims were read and upon motion by Williams second by Bowers
the same were allowed and the Mayor and City Clerk were authorized and directed
to draw warrants upon the City Treasurer and make payments accordingly:

Alderman Williams introduced a resolution authorizing the Public Utility
Board to enter into contract with Sam Resnick, for the sale of 8,000# junk for
the sum of $728- 50, which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all"voting in favor thereof, President Lemmon declared the
said resolution duly passed ana adopted.
Alderman Williams introduced'a resolution granting public dance permit to
the Board of Public Health & Welfare Board for the Masonic Temple, February 1,
1941, and fixing the fee at $j.00, whichaas read.
Upon'motion.'by Amundsen secona by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, Pr,e,sident Lemmon declared the
said resolution duly -passed and adopted.

Alderman Mrachek introduced a resolution granting public dance permit to
the Co -Operative Oil Credit Union, for the Mayo Civic Auditorium February 13,
1941, and fixing the fee at $3.00, which was read.
Upon motion by Moody second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution granting public dance permit to
t7ge Southern Minnesota Broadcasting Company for the Armory Fanuary 25th, and
February 1st, Sth, 15th, and 22nd,1941, and fixing the fee at $15.00, which
was read.
Upon motion by Amundsen second by Williams that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $1442.30 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending January 31,1941, which was
read.
Upon motion by Moody second by Amundsen that the said resolution be adopted,
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $295.20 from the Gen-
eral Fund and ordering payment made to the City of Rochester, Public Utilities,
for steam heat furnished at ,the City Hall, in accordance with billing dated
January 28th,1941, which was read.
Upon motion by Bowers second by Anderson that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $553.30 from the
Park Improvement Fund and ordering payment made to A.D.Reynolds, Collector of
Internal Revenue, for amusement tax at the Mayo Civic Auditorium, which was
read.
Upon motion by Williams second by Mrachek that,We said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $33.00 from the
General Fund, $7.20 from the Street and Alley Fund, and $4,910.59 from the
Lighting Fund and ordering payment made to the City of Rochester, Public
Utilities, for electricity fornished for lighting public streets and buildings,
which was read.

Upon motion by Moody second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $750.99 from the
General Fund and ordering payment made to James H.Starkey, for liability
insurance for the Mayo Civic Auditorium, expiring September 1, 1944, which
was read.
Upon motion by Mrachek second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted..
Alderman Anderson introduced w=resolution appropriating $596.05 from the
Street and Alley Fund and ordering payment made to the Street and Allay Fund,
for equipment use during January,1941, which was read.
Upon motion by Bowers second by Williams that the said resolution be
adopted as read, and all voting in favor thereof,_ President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering a hearing on the
widening and resurfacing of Broadway Street North, from Fourth Street Northeast
and Northwest to the new bridge over the Zumbro River, said hearing to be held
at 7:30 o'clock P.M., on February 26th,1941, which was read.
Upon motion by Amundsen second by Moody that the said resolution be adopted
as read, and all voting in favor thereof,
resolution duly passed and adopted.
President Lemmon declared the said
31p6n motion by Amundsen second by Bowers the City Clerk was instructed to
request the heads of the various departments to furnish inventories of supplies
and equipment as of February 28th,1941.
Mayor Grassle called the attention of the Council to the nuisance:;of the
box -elder trees and suggested that an education program along this line be
carried on and that the matter be referred to the Board of Public Health and
Welfare, and upon motion by Williams second by Amundsen the matter of trees and
tree planting was referred to the Public Health and Welfare Board and the
Park Board for further study.
Upon motion by Moody second by Williams the City Attorney was instructed
to prepare an amendment to the hand bill and card ordinance requiring that
distributors of such cards be licensed.
Mayor Grassle read a letter regarding the Conference of Mayors to be held
at St.Louis, Missouri on February 20th, and 21st,1941, and upon motion by
Mrachek second by Amundsen, the Mayor was authorized to attend said conference
at the expense of the City of Rochester.

at Winona, Minnesota.

Upon motion by Moody second by Williams, the Council went on record as
opposing the State legislative measure on tax on natural gas consumed in the
State, and the Mayor and City Clerk were instructed to notify the Senator and
Representative accordingly. y
Upon motion by Amundsen second by Mrachek the City Engineer and the
Assistant City Engineer were authorized to attend the Convention of Engineers
to be held at St.Paul, Minnesota.
A deed from Joe Mackey for land donated for street purposes, was presented
and upon motion by Mrachek second by Williams, the City Clerk was instructed
to have the same recorded.
Upon motion by Williams second by Mrachek the Chief of Police was
authorized to continue the use of a Ford Car for the Police Department on
a rental basis.
Upon motion by Williams second by Bowers the Common Council adjourned
until 7:30 o'clock P.M., on February 26th,1941..
