RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY OF ROCHESTER, MINN., February 26, 1941.
Minutes of an adjourned regular meeting of the Common Council held
JIFebruary 26,1941, in the Council Chambers, in the City Hall, in said City of
IlRochester, Minnesota.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams.•
Upon motion by Amundsen, second by Moody the minutes of the meetings of
IIFebruary 3rd, and February 19th,1941, were each approved.
President Lemmon announced this as the time and place set for a.hearing on
the widening of the pavement, resurfacing and construction of new curb and gutter
on Broadway Street North from Fourth Street Northeast and Northwest to the south
end of the new bridge over the Zumbro River, and asked if any one present wished
Ito be heard concerning this improvement.
Mr. -Fitting stated that if an assessment of $1.00 per foot was to be made
for these improvements, he wished to protest the same, and he was informed
that no amount was determined up to the present time.
A copy of a requisition by the Health Officer upon Saint Mary's Hospital
for the isolation of Mary Ferber, diagnosed to be suffering from whooping cough,
and a copy of a requisition for the isolation of Dr. Leo Crumpacker, diagnosed
Ito be suffering from typhoid_fever, were each read, and President Lemmon
ordered that the same be placed on file.
A communication from Henrik Shipstead regarding the approval by the Works
Projects Administration of Project No.50293 for Silver Lake Park was read
and President Lemmon ordered that the same be placed on file.
A communication from the Rochester Hotel Association regarding endorsement
of an ordinance requiring a license for distribution of advertising on the
public streets, wa.s read and President Lemmon ordered that the same be placed
on file.
A communication from the Board of Park Commissioners regarding asphalting
of all park driveways, was read and President Lemmon ordered that the same be
1 placed on file.
A copy of a resolution passed and adopted by the Sinking Fund Commission
1 purchasing $200.0.00 City of Rochester 41% Improvement Bonds, from Agnes Hoffman,
was -read, and upon motion by Moody second by Amundsen, -.the action -set forth .
therein was approved and it was ordered that the same be placed on file:
A copy of a resolution regarding certain salaries, passed by the Board of
Park Commissioners, was read, and President Lemmon referred the same to the
Finance Committee.
A petition for permission to change one four room apartment located at
22 Eleventh Avenue Northeast, to a two room apartment, was read, and upon motion
by Amundsen second by Bowers, it was referred to the Zoning Board.

A petition asking that a sanitary sewer be constructed in Fourth Street
Northeast from the State Hospital sewer to Lot 56 School,'Section 36, was' read,
and President Lemmon referred the same to the Sewer Committee.
A petition asking that Eighth Street Southwest be graded to the established
grade from Fifth Avenue Southwest to 159 feet, west, and oiled in the same
location was read, and President/`referred the same to the Street and Alley
Committee.
The request of the Union National Bank to substitute $40,000.00 U.Z.Treasuryl
(notes 1 1/9% due June 15,1943, and $10,000.00 State of Minnesota 2% bonds due
July 30,1942, for $50,000.00 U.S.Treasury Notes 1 2% due 3/15/41, was read and
President Lemmon ordered that the same be placed on file.
A petition asking for the vacation of a portion of Third Street Southeast,
was read and President Lemmon referred the matter to the Street and Alley
Committee and the City Engineer.
The report of the Board of Trustees of the WaltertHurlbii:t Book Fund, for
the year 1940, was read, and President Lemmon ordered that the same be placed
on file.
The City Engineer's Trial Balance for the month of January,1941, was read,
and President Lemmon ordered that the same be placed on file.
The reports of the Building and Plumbing Inspector for the month of
January,1941, showing building permits issued $132.00, and plumbing permits
issued $19.00, and .the report of the Electrical Inspector for the month of
January,1941, showing electrical permits issued $20.90, were each read, and
President Lemmon referred the same to the Finance Committee.
The statement of receipts and disbursements from the Park Improvement
Fund, as of January 31,1941, was read and President Lemmon ordered that the
same be placed on file.
T The reports of the Clerk of the Municipal Court for the week ending
February gth,1941, showing criminal fines and costs collected $179.90, civil
fees received $6.20, and conciliation court fees $2.75; for the week ending
February 15th,1941, showing criminal fines and costs collected $543.60, civil
-fees received $7.50, and conciliation court fees $5.00; and for the week
ending February 22nd,1941, showing criminal fines and costs collected $227.40,
civil fees received $17.30, conciliation court fees $6.00, were each read, and
having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.
Applications signed by the Hollywood Bar and Lewis Implement Company for
permits to place and maintain signs, were each read, and upon motion by
Amundsen second by Mrachek permits were granted.

An application signed by James Hubbard.for a drivers license, was read,

The applications of O.S.Cummens, and Frederick A.Roepke for master
lelectrician's licenses, were each read, and upon motion by Moody second by
jAmundsen, licenses were granted.
The applications of Leonard Giere, L.C.Fordham, and John Harrison for
Journeyman electrician's licenses, were each read, and upon motion by Mrachek
second by Williams, licenses were granted.
The application of J.W.Leiferman for transfer of his_non-intoxicating malt
liquor license to 417 Third Avenue Southeast, was read, and upon motion by
Williams second by Anderson transfer was granted.
The application of Leo Huey fora temporary transfer of his Off.Sale Liquor
license to a new location, was read, and up6n.motion by Anderson second by
Amundsen, transfer teas granted.
The license bonds.of Elmer C.Johnson in the sum of $1,000.00 with the
Aetna Casualty Company as surety; O.S.Cummens in the sum -of $1,000.00 with the
United States Fidelity.& Guarantee Company of -Baltimore as surety; Frederick
ARoepke in the sum of $1,000.00 with the National Surety Corporation as surety;
E.M.Rae,ts in the sum of $1,000.00 with the United States -Fidelity and Guarantee
Company as surety,and the continuation certificate -of the Western Surety Company
extending Arthur A.Brown's surety Bond #139289 to February 22nd,1942, were
each read,, and upon motion by Moody second by. Bowers, the said bonds were approved
the sureties thereon -accepted and it was ordered that the same be placed on
file. - -
The following claims were -read, and upon motion by Williams second by
Amundsen, the same were allowed and the Mayor and City Clerk were authorized
and directed to draw warrants upon the City Treasurer and make payments
accordingly:

Alderman Amundsen introduced a resolution ordering a hearing on the widen-
ing of the pavement on Broadway Street North from the south rail of the Chicago
Northwestern Railway tracks to Fourth Street Northeast and Northwest, said
hearing to be held at 7:30 o'clock P.M., on March 12th,lg4l, which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution authorizing the City Treasurer
to release securities deposited as collateral and accepting replacements,
ifo*r the Union National Bank, which was read.
Upon motion by Mrachek second by Bowers, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution granting public dance permit
to the Southern Minnesota Broadcasting Company for the Armory, March 1st,.
Sth, 15th, 22nd, 29t]., -1941, and .fixing the fee at $15.00, which was- read.
Upon motion by Amundsen second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof,. President Lemmon declared
the said resolution duly passed and adopted. -
Alderman Anderson introduced a resolution granting public dance permit
to the Board of Public Health and Welfare, for the Masonic Temple, 8ebrhary
22nd, 1941, and fixing the fee at $3.00, which was read.
Upon motion by Moody second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Anderson introduced a resolution granting public dance permit
to G.L.Fellows and L..A.Fellows for the Mayo Civic Auditorium, February 22nd,
and March 17th,1941, and fixing the fee at $6.00, which was read.
Upon motion by Mrachek second by Moody that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $263.70 from, the
General Fund and ordering payment made to the City of Rochester, Public
Utilities, for steam heat for the City Hall, which was read.
Upon motion by Anderson second by Amundsen that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.

Alderman Bowers introduced a resolution appropriating $548.13 from the
General Fund and ordering payment made to the Co -Operative Oil Company, for
a tank car of gasoline, ASIX 178, which was read.
Upon motion by Moody second by Anderson that .the -said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $263.12 from the
General Fund and ordering payment made to the Chicago Great Western Railroad
Company, for freight on tank car of gasoline, ASIX 178, which was read.
Upon motion by Bowers second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $27.00 from the General
Fund, $3.b0 from the Street & Alley Fund, and $4,464.24 from the Lighting
Fund and ordering payment made to the City of Rochester Public Utilities,
for ItgIgting various streets and public grounds, which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the'said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $290.73 from the
Street and Alley Fund and ordering payment made to the General Fund, for gaso-
line from the City Filling Station, which was read.
Upon motion by Moody second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Moody introduced a resolution.appropriating $63.52 from the
Street and Alley Fund, $35.75 from the Fire Protection Fund, and $112.95 from
the Sewer Fund and ordering payment made to Dodge Lumber & Fuel Company, for
fuel furnished as per billing for Jan.1941, which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $932.93 from the
Sewage Disposal Plant Fund and ordering payment made to'the Minnesota
Bearing Company for 4 strands of #720 Promal chain, which was read.
Upon motion by Anderson second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $370.80 from the
Park Improvement Fund and ordering payment made to City of Rochester Steam
Department, for steam heat furnished at the Mayo Civic Auditorium, which was
read.
Upon motion by Moody second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $1373.96 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending February 15,1941, which was
r ead.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $897.75 from the
Park Improvement Fund and ordering payment made to the Recreation Equipment
Company for slides, swings, see -saws, ladders, etc. for parks, which was
Iread.
Upon motion by Williamssecond by Moody that the said resolution be adopted
jas read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $2,000.00 from the
lGeneral Fund and ordering payment made to the Park Improvement Fund, for transfer
!of`funds to make same available for park purposes, which was read.
Upon motion by Amundsen second by Mrachek that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $315.72 from the

/Department, for electricity, water and power furnished at the Mayo Civic Audi-
Itorium, which was read.
Upon motion by Moody second by Bowers, that the said resolution be adopted

The Common Council canvassed the returns from the Primary Election held
on February 25th,1941.
Alderman Williams introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the following is a tabulated statement of the number of votes cast for
each person at the Primary Election held on the 25th day of February,A.D.1941,

Be it further resolved by the Common Council:
That Ralph I.LaPlant and Knute Olson are hereby declared to be candidates
for City Assessor of the City of Rochester at the Charter Election to be held
March llth,1941;
That George W. Goetting and Harry V.Hanson are hereby declared to be
candidates for Alderman of the First Ward of the City of Rochester. Minnesota,
at the Charter'Election to be held March llth,1941;
That Tom Moody and J.A.Yaeger are hereby declared to be candidates for
Alderman of the Second Ward, for the City of Rochester,. Minnesota, at the
Charter Election to be held March llth,1941;
The City Clerk of said City is hereby instructed to cause the names of the
said persons to be printed as candidates for the respective offices upon the
official ballots at the coming Charter Election to be held March llth,1941.'1
Upon motion by Moody second by Williams, that the said Resolution be
adopted as read, and all voting in favor thereof, President. Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Williams second by Moody the City Clerk was authorized to
make transfers on taxicab licenses after all requirements have been met.
The Mayor suggested that some thought be'given to what plans and public
improvements would be made by the Engineering Department and the Street and
Alley Committee.
Xr. R.A.Hammond, of th'e Hammond Box Company, submitted a proposed
contract with the City of Rochester for the installation of waste disposal
boxes on the streets and in the parks, and upon motion by Williams second by
Amundsen the matter was referred to the Street & Alley Committee & City Attorney,

Alderman Amundsen introduced an ordinance prohibiting the placing on or
throwing in or on any public street, alley or sidewalk, or in any motor
vehicle in the City of Rochester, Minnesota, except with the consent of the
owner or person in charge of said vehicle of any card, placard, handbill,
pamphlet, booklet, manuscript, or any advertising matter of any kind or
description, which was given its first reading.
Upon motion,by Williams second by Bowers the ;:Common Council adjourned.
