OF THE CITY OF ROCHESTER, MINN., March 3 ,19 41
Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on March 3rd, 1941.
President Lemmon called the meeting -to order at 2:00 o'clock P.M., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
Mrachek, Williams. Absent: None.
A communication from the Olm§ted County Bank and Trust Company, requesting
a substitution in collateral deposited in lieu of a depository bond, was read
and President Lemmon ordered that the same be placed on file,
An invitation to all interested persons to attend the twenty-fifth annual
meeting of the Minnesota Tax Conference in St.Paul,Minnesota, March 7th and
Sth,1941, was read and upon motion by Amundsen second by Moody all those who
were able to were authorized to attend said meeting. "
The recommendation of the Sewer Committee and the City Engineer, that
a sanitary sewer be constructed in Fourth Street Northeast from the State
Hospital sewer to Lot 56,School Section 36, was read and ttpon motioii�by:Mrachek
second by Williams, the said recommendation was approved and it was
ordered that the same be placed on file.
A report by the Zoning Board on the petit&on of C.E.Paterson to change one
four room apartment into two apartments , was read, and upon motion by Amundsen
second by Mrachek the matter was referred back to the Zoning Board to give the
opponents of the petition a chance to be heard.
The reports of the Building and Plumbing Inspector for the month of
February,1941, showing building permits issued $59.00, plumbing permits $54.25,
and the report of the Electrical Inspector for the month of February,1941,
showing electrical permits issued $99.75, were each read, and President Lemmon
referred the same to the Finance Committee.
The report of the City Engineer for the month of February, 1941, showing
expenditures from the General Fund for labor $15.20, Street and Alley Fund
$1097.25, and the Sewer Fund $1519.10, was read and upon motion by Mrachek
second by Moody the said report was approved.
The report of the Clerk of the Municipal Court for the we:ekihending
March 1,1941, showing criminal fines and costs collected $361.95, civil fees
received $17.05, and conciliation court fees received $12.50, was read and
having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.
The annual report of the City Engineer was read, and upon motion by Moody
second by Amundsen, the said report was accepted, and it was ordered that the
same be placed on file.
The application of the Kling Music Company for a permit to place and

was granted.
The official bond of Mae C. Nelson,in the sum of $1,000.00 with the
Fidelity & Casualty Company of New York as surety, was read, and upon motion by
Mrachek second by Moody, the said bond was approved, the surety thereon accepted
and it was ordered that bhe same be placed on file.
The application of Art Borpicksen for a journeyman electrician's license
was read, and upon motion by Bowers second by Mrache�( license was granted.
The application of Don E. Postier, and the application of -John Morrison
for master electrician's licenses, were each read, and upon motion by Williams
second by Amundsen, licenses were granted.
Applications signed by Donald Taylor, Lyle R.Voth, and Marcel Drake,
for drivers licenses were each read, and upon motion by Moody second by Bowers
licenses were granted.
The license bond of John R.Morrison in the sum of $1,000.00 with the
Employers Liability Assurance Corporation, Limited, as surety, was read, and
upon motion by Moody second by Williams, the said 'pond was approved, the surety
thereon accepted and it was ordered that the same be placed on file.
Retailers
Applications for/Off Sale Liquor licens, signed by Leo A. Huey, R.M.Graen,
Joe Wallace, and Andrew C. Chafoulias, each with a surety bond in the sum of
$1,000.00 with the Western Surety Company as surety; the applications signed
by Christ Margellos and Don Emmerson, and Emanuel Kostakes, each with a surety
bond in the sum of $1,000.00 with the Western Casualty & Surety Company as
surety; the application of Hazel V.Kitzman, together. with a surety bond in the
sum of $1,000.00 with the Fidelity & Deposit Company of Maryland as surety;
and the application of Robert P. Kennedy, together with a surety bond in the
sum of $1,000.00 with the Standard Accident Insurance Company as surety,were
each read, and upon motion by Mrachek second by Williams, the said licenses
were granted, the bonds approved, the sureties thereon accepted and it was
ordered that the same be placed on file.
The following claims were read, and upon motion by Williams second by.
Amundsen, the same were allowed and the Mayor and City Clerk were authorized
and directed to straw warrants upon the City Treasurer and make payments
acitordingly:

Alderman Williams introduced a resolution appropriating $2,000.00 from the
General Fund and ordering payment made to the Park Improvement Fund, for
transfer of funds to make same available for park purposes, which was read.
Upon motion by Moody second by Mrachek that the said resolution be -adopted
as read, and -all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $277.25 from the
Street and Alley Fund and ordering payment made to the Street and Alley Fund,,
for equipment use .during February,1941,which was read.
Upon motion by Bowers second by Moody that the'said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $240.75 from the
Sewer. Fund and ordering payment made to the Street and Alley Fund,-for,use of
equipment during February,1941,which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adppted as read, and all voting in favor - thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $1429.00 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending February 28th,1941,-which was
•rea•d.
Upon -motio-n by Mrachek second by Anderson that the said resolution be
adopted av read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and -adopted.

Alderman Anderson introduced a resulution authorizing the City Treasurer to
release securities deposited as collateral in lieu of a depository bond by the
Olmsted Councy Bank and Trust Company, and accepting securities to replace those
released, which was read.
Upon motion by Amundsen second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution ordering a hearing on the
construction of a sanitary sewer in Fourth Street Northeast, from the State
Hospital Sewer to Lot 5b, School Section 36, said hearing to be held at 2:00
o'clock P.M., on April 7h,1941, which was read.
Upon motion by Bowers second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $425.00 from the
(Fire Protection Fund and ordering payment made to the Gamewell Company, for
lone time stamp, which was read..
Upon motion by Amundsen second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Anderson presented two statements and claims for extra time worked
by Frank Adiir on the Fire alarm system, amounting to $194.00, and upon motion
by Williams second by Mrachek the said claims were allowed and the Mayor and
City Clerk authorized to draw a warrant upon the City Treasurer for payment of
(said extraordinary services and extra time.
The Chief of Police reported to the Council that Mr. Hughs of the Universal
lMotors had -notified him that the rental contract the City of Rochester has with
Ithe.Universal Motor Company could not be continued at the present rate, and
that new terms would have to be ifeents per mile.
Upon motion by Williams second by Mrachek the City Clerk was instructed
to advertise for bids for the furnishing of two police automobiles, the cost not
to exceed $1200.00, with a trade in of the police car which the City owns, said
bids to be received and opened at 7:30 o'clock P.M., on March 24th,1941.
The Chief of Police requested that reloading equipment be purchased for
reloading shells, and upon motion by Williams second by Moody the matter was
referred to the Police Committee and the Chief of Police with power to act.
An ordinance prohibiting the placing on or throwing in or on any public
street, alley or'sidewalk, or in any motor vehicle in the City of -Rochester,
Minnesota, except with the consent of the owner or person in charge of said

vehicle of any card, placard, handbill, pamphlet, booklet, manuscript, or any
advertising matter of any kind or description, introduced and given its first
reading on February 26th,1941, was given its second reading.
Upon motion by Bowers second by Moody the Common Council adjourned until
7:30 o'clock P.M., on March 12th,1941.
