HomeMy WebLinkAbout03-12-1941RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., March 12, 1941 237 .• LJ • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on March 12, 1941. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody, Mrachek, Williams. Absent: None. Upon motion by Amundsen second by Anderson the minutes of the meetings of February 26th and March 3rd, were each approved. President Lemmon stated this as being the time and place set for a hearing on the widening of the pavembnt of Broadway Street North from the South rail of of the Chicago Northwestern Railway Company tracks to the South line of Fourth Street Northwest and Northeast to,a width of 70 feet. There was no one present wishing to be heard. A communication announcing the First Minnesota Traffic Engineering Confer- ence Conference to be held March 25th to 28th, 1941 was read and President Lemmon ordered the same to be placed on file. A communication from the League of Minnesota Municipalities announcing Short Courses to be given at the University for Water Works operators, Plumbing Inspectors, Sewage Disposal Operators, and Traffic<_. Engineers:was read. Upon motion by Mrachek second by Anderson, representatives from the Depar ments interested were authorized to attend the Short Courses to be held at the University at City expense. A communication from Ellis Holloway offering to purchase from the City of Rochester, for the sum of $100, the North 100feet of the South!- 2 of the North 963.07 feet of Outlot Number 5, East of the road, Northern Addition was read, and on motion by Williams, second by Mrachek, the City Attorney was instructed to draw a deed and the Mayor and City Clerk were authorized to sign same. A communication from Mr. H. S. Patterson requesting that a permit be issued for remodeling a building at 924 Second Street Southwest, and also a statement of acquiescence from the residents in that locality was read. On motion by Bowers, second by Amundsen, Mr. Patterson's communication was referred to the Zoning Board. The petition presented by Mr. C. W. Shepard requesting that the 400 Block' on the south side of Fourth Street Southwest be changed from a residential zone to a multiple -dwelling zone was read. Upon motion by Amundsen, second by Mrachek the petition was referred to the Board of Zoning. A copy of the resolution passed and adopted by the Public Utility Board re- questing authority to enter into a contract with the American Cast Iron Company for purchase of cast iron pipe was read, and President Lemmon ordered that same be placed on file. 238 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., March 12, 1941 The City Engineer's -Trial Balance for the month_of February, 1941 was read., and President Lemmon ordered same be placed on file. The report of the Clerk of the Munici.pal Court for ,the week ended March 9, 1941, showing criminal. fines and ,costs. collected $451.90, civil fees received $9.95, and conciliation court fees $6.00, was; read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The license bond of J. P. Huyber in the sum of $1,000.00 with the Aetna Casualty and Surety Company was read, and upon motion by Mrachek, second by Bowers, the said bond was approved and the surety thereon accepted, and it was ordered that the same be placed on file. The City Engineer's approximate estimate of cost of road oil and bituminous material in the amount of $5,350 for the year of 1941 was read,. and President. Lemmon ordered same•to be placed on file. A list of streets, avenues,.and alleys that are be sprinkled, flushed, or oiled during the year 1941 was submitted be the City-Engineer.and.read. Presi- dent Lemmon ordered same•be placed on file. The applications of Wesley J. Williams, Ray L. Niles, and Harold Sheppard for licenses to sell Soft Drinks were each read and upon.motion by Amundsen, second by Williams, the licenseswere granted. An application of 0. S. Cummens for an Electrical Contractor's license was read, and upon motion by.Bowers, second by Amundsen, the license was granted. The applications signed by Leo Neitz, Paul.Plantz, and Harold Belke for a--. Journeyman Electrician's license were each read, and upon motion by Amundsen, second by Anderson the licenses were issued. Harold A. McGoon's application for a Driver's license ;was read, and upon motion by Mrachek, second by Amundsen the license was granted. The City Attorney presented three opinions: As to when a policeman is en- titled to compensation under the Workmen's Compensation Act; The matter of the claim of Chester Fellows against the City of Rochester; and the possibility of. - a claim by Captain Thomas Slatterly against'the City of Rochester. Mrs. Edith Rommel appeared before the Council and presented a petition re- questing that no license for selling beer be issued to the Gingham Inn. Two petitions signed by sixty-four residents of North Broadway protesting any re -paving or new paving that will cause any assessment to be levied against realm, estate abbutting on said North Broadway were presented by Fred J. Heidinger. Alderman Bowers stated that Mr. Guy Barnes had done considerable work on the construction of the radio tower, police Gamewell system, and radio for which he had received no compensation. Mr. Barnes was also present and stated his case. The matter was then referred to the Police Committee. Upon motion by Mrachek second by Amundsen that the said resolution be adopted as read, and all voting .in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced.a resolution authorizing the Publiq Utility • n Board to enter into contract in the sum of$6,515.56 for the purchase of cast iron pipe from the American Cast Iron Pipe Company,.which was read. Upon motion by Amundsen second by Williams that the said resolution be adopted as read,, and all voting in favor thereof, President Lemmon declared the said resolution passed and adopted. Alderman Mrachek introduced a resolution appropriating $319.06 from the Park Improvement Fund and $173.48 from the Lighting Fund and ordering payment to which the City of,Rochester Public Utilities/, was read. Upon motion by Mrachek second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $378.00 from the Park Improvement Fund and ordering payment made to the City of Rochester Steam which Department for steam heat at the Auditorium,/was read. Upon motion by Anderson second by Bowers that the said resolution be adopted as read, andtall voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $5,060.00 from the Fire Protection Fund and ordering payment_ made to the City of Rochester Water which Department for hydrant rental, was read. Upon motion by Amundsen second by Williams that the said resolution be (adopted as read, and all voting in favor thereof, President Lemmon declared the V (said resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering -.a:' -hearing on March 24th at 7:30 o'clock on the levying of special assessments for sanitary sewer and which water main in 3-21 Street and 15th Avenue Southeast%was read. Upon motion by Mrachek second by Bowers that the said resolution be adopter jas read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. d Alderman Amundsen introduced a resolution designating streets, avenues, which and alleys to be sprinkled, flushed and oiled during the year 1941V was read. Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Upon motion by Williams second by Mrachek the City Attorney was instructed Ito draft an ordinance regulating the use of heavy trucks making deliveries on certain streets and alleys in the City of Rochester.
