Minutes of an adjourned regular rueeting of the Common Council held March 24,
1941, in the Council Chambers, in the City Hall, in said C,ity,of Rochester,
Minnesota.
President Lemmon called the meeting to order at 7:30to'clock P.M.,
the
following members being present: Lemmon, Amundsen, Aderson, Moody, Mrachek,
Williams. Absent: Bowers, absence due to illness..
Upon motion by Moody, second by Amundsen the minutes of the meeting of March
12th;:1'941 ;wexe approved.
President Lemmon announced this as the time and place set for a'hearing'on
the sprinkling, flushing, or treating with oil the public streets and avenues of
the City, and asked if any o'ne- present wished to be heard concerning this improve-
ment.
Mr. Steve Woodward appeared before the Council and protested the sprinkling
or oiling of Ninth' Street Southeast from Eighth Avenue to Ninth Avenues Southeast,
for the reason that there are no -residences located o'n that part of ninth Street
Southeast.
Mr. Leo Cavanaugh appeared before the Council and stated that they didnot
wish to have Sixteenth Avenue between Second and Fourth Street Southeast sprinkled
or oiled until that part of the street was graded. President Lemmon referred the
matter to the Sprinkling Committee.
President Lemmon announced this as the time and place .set for a hearing on
the levying of special assessments for construction of a sanitary sewer and water
main in part of 32 Street Southeast and on part of 15th Avenue Southeast. There
was no one present wishing to be heard.
President Lemmon stated this a s being the time and the place for the re-
ceiving of bids for the purchase:of.two police cars. The following bids were
received: Universal Motors $1073.00; Clement's Chevrolet Company $997.00; and
Ellis Motor Company $1409.00. President Lemmon referred the said bids to the
Police Committee and the Chief of Police for tabulation and recommendation.
A copy of the resolution passed and adopted by the Public Utility Board re-
questing authority to enter 'into a contract with the Power Service Corporation
for the furnishing and installing of equipment in the sum of $16,256.00 for Power
Plant, was read, and President Lemmon ordered that same be placed on file.
A copy of the resolution passed and adopted by the Public Utility Board re -
(questing authority to enter into contract with Gust Nelson and Son for the fur-
Inishing of labor, materials, tools, and equipment for drilling a water well on
JLot 13 Block 1 in Kummers First Addition was read, and President Lemmon ordered
(that same be placed on file.

A communication from the League of Minnesota Municipalities announcing the
(Minnesota Safety Council annual award dinner was read, and President Lemmon or—
dered the same to be placed on file.
The City Engineer.'s request for $2,000.00 to be appropriated from the Sewer
Fund for use of the Street & Alley Committee was read, and President Lemmon or-
dered the same to be placed on file.
The notice of a claim of Lulu Brogan in the sum of $1050; the notice of
claim of Francis Brogan in the sum of $750.00; and the .summons in the $3000.00
claim of Mrs. Dora. Strehlow, were each separately read, and upon motion by Moody
second by Williams the cases were referred to the City Attorney with instructions
to employ legal assisstance if he deemed it necessary.
The petition of Paul E. Gatewood for a building permit to construct a two
Ifoot addition on the north side of his filling station, located at the corner of
Eleventh Avenue Southeast and Fourth Street Southeast, was read. Upon motion by
Williams second by Moody, Mr. Gatewood was granted permission to make the
,improvement.
The petition for bituminous treatment of the alley running east and west
Iin Block 3, Cascade Manor was read` and President Lemmon referred the same to
(the Street & Alley Committee.

.The petition of the Rochester Airport to vacate f part of Fourteenth Street
Southeast lying easterly of the East line of Fourth Avenue Southeast, an all
that part of Eleventh Avenue Southeast lying southerly of the South line. of
Thirteenth Street Southeast, was read and President Lemmon ordered the same to be
iplaced on file.
The report of the Clerk of the Municipal Court for the week ended March 15,
11941, showing criminal fines and costs collected $466.60, civil fees received
$3.35, and conciliation court fees $3.00, was read, and having been previ.ously
approved by the City,Attorney, President Lemmon ordered that the same be placed

The report of the Clerk of the Municipal Court for the week ended March 22,
1941, showing crim�na.l fines and costs collected $323.30, civil fees received
$9.35, and conciliation court fees $9.25, was read, and having been previously
approved by the City Attorney, President Lemmon ordered that the same be placed:
on f ile.
The statement of receipts and expenditures from the Pare Improvement Fund,
Ifrom April 1, 1940 to February 28, 1941, was read, and President Lemmon ordered
that the same be placed on file.
The application of 1V. J. Bell for a Master Electrician's License was read,
and upon motion by Amundsen second by Williams the license was granted.

was read, and. upon motion by Mrachek second b�T Anderson, the said bond was approve
and. the wurety thereon accepted, and it was ordered that the same be placed on
file.
An -agreement between the State of Minnesota dnd the City of Rochester re-
garding the construction and improvement of a portion of Tuunk Highway No. 63 on
North Broadway Street, which would permit the Highway Department to proceed with
improvements oncertain parts of the said street from time to.time as the same
is made available was read,and President Lemmon ordered that same be placed on
file.

On motion by Amundsen/the recommendation of the Police Committee and the
Chief of Police for the purchase of two automobiles from the Universal Motors
was approved.
The recommendation of the Board of Zoni'ng that the petition of Mr. C. E.
Patterson to make alterations in his apartment building be denied was read, 'and
upon motion by Amundsen, second by Anderson, the said recommendation was approved.
The recommendation of the Board of Zoning that the petition of Mr. H. S.
Patterson to make certain improvements on.a building located at 924, Second Street
Southwest be granted was read, and upon motion Joy Moody, second by Amundsen, the
said recommendation was approved and the Building -Inspector was instructed to
issue a building permit for said improvements. Aldermen Amundsen, Moody, Mrachek;
and Williams voting in favor thereof, and Alderman Anderson voting no.
The recommendation of the Board of Zoning that the petition of C. W. Shepard
and Block 5 of Original Plat
Ito have Block j of Head.?& McMahons Addition/to the City of Rochester changed
from Residential Zone to Multiple Dwelling Zone was read, and upon motion by
Mrachek, second by Amundsen, the action of.the Zoning Board was approved.
The communication of Mr. L. W. Reents protesting the proposed -amendment to
Ithe Handbill Ordinance was read,.and President Lemmon ordered that same be placed

Alderman Amundsen introduced a resolution accepting the'bid of Universal
Motors for purchase of two four door sedans for use of Police Bepartment, which -
was read.
Upon motion by Williams, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution authorizing the Public Utility

Alderman Williams introduced a resolution authorizing the.Public Utility
(Board to enter into contract with Gust.Nelson and Son for them to furnish labor,
materials, tools, and equipment for drilling a water well on Lot 13,Block 1, -in
Kummers'First Addition, which was read.
Upon motion by Anderson, second by Amundsen that the said resolution be
adolbted as read, and all voting in favor thereof; President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution_ levying special assessments for the
construction of a sanitary sewer and watermain in part of 321 Street Southeast.and
part of 15th Avenue Southeast, which was read.
Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Mrachek,-introduced a resolution appropriating $2,000.00 from the
(Sewer Fund for use of the Street and Alley Committee.
Upon motion by Moody, second by Anderson that the said resolution be adopted
las read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution consenting to and authorizing the
Mayor and City Clerk to execute the agreement between the State of Minnesota and
the City of Rochester, regarding the improvement to be made upon North -Broadway
Street, which was read.
Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President.Lemmon.declared the
said resolution duly passed and adopted.
Alderman Moody introduced a. resolution ordering bids for road oil, tarvia,
nd asphalt forthe season of 1941, which was read.
Upon motion by Williams, second by Amundsen, that the said resolution -be
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.

Alderman Moody introduced a resolution ordering a hearing on vacating/part
of Fourteenth Street Southeast lying easterly of the East line of Fourth Avenue

Alderman Moody introduced a resolution ordering a hearing on the vacating of

South fine of Third Street Southeast lying 159.5 feet east of the east line of
South Broadway Street, and lying west of the Zumbro River, which was read.
Upon motion by. Moody, second by Williams that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared -the said reso-
Ilution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $1,205.09 from the
Park Improvement Fund and ordering payment made to Mayo Trust Fund for salaries,
(which was read.
Upon motion by Amundsen, second by Mrachek that the said resolution be adopt
as read, and all voting in favor thereof, President Lemmon declared the said reso-
Ilu.tion duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $240.95 from the
General Fund and ordering payment made to the State of Minnesota Department of
ITaxatian for tax and inspection fee, which was read.
Upon motion by Williams, second by Amundsen that the said -resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Mrachek, second by Williams, the City.Clerk was instructed to
return the certified checks of the unsuccessful bidders for Police cars.
The following claims were read, and upon motion by Williams second by Amundse
the same were allowed and the Mayor and City Clerk were authorized and directed tc
draw warrants upon the City Treasurer and make payments accordingly:

Alderman Amundsen introduced and ordinance prohibiting the parking, loading,
nd unloading of any and all motor vehicle trucks exceeding eighteen feet in

length and the parking of any and all motor vehicles with a. trailer attached
upon certain streets, avenues and alleys in the City of Rochester, Minnesota.,

;and prescribing penalty therefore,/was given its first reading.
Mr. A. C. Leonard, County Engineer, appeared before the Council and stated
that the County and State Highway Departments were having considerable trouble
with people dumping rubbish along the highways. He asked for the City to cooperat(
with the Highway Departments by extending the hours at the Dumping Ground.
President Lemmon referred the matter to the Public Grounds Committee.
The Police Committee recommended that the bill for extra work on the Police
radio and Gamewell Systems presented by Mr. Guy Barnes be not allowed, and. upon
motion by Williams, second by Mrachek, the report of the Committee was accepted.
Upon motion by Williams second by Mrachek the .Common Council adjourned.
