Minutes of a regular meeting of the Common Council of the City of
• Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City on April 7, 1941.
President Lemmon called the meeting to order at•2:00 o'clock P.M., the
following members being present: President Lemmon, Alderman Anderson, Bowers,
Hanson,•Mrachek, Williams, Yaegerq Absent: None.
Upon motion by Williams, second by Anderson, the minutes of the adjourne
regular ,meeting of March 24th, 1941, . were approved.
President J. T. Lemmon addressed the Common Council and those present.
and expressed his appreciation of the work doen by the members of the council
who had served during the past year and also welcomed the new members who were
entering upon their duties as aldermen. Mr. Lemmon then introduced Mayor Paul A.
Grassle who responded by reading a paper in which he made the following recommenda
tions: That parking meters be installed; That the city charter should be amended
to meet the needs of a growing city; That replacement of the city building and
electrical inspectors be*made; That provisions be made for employees of the street
and alley, parks, and public utility departments to have city insignias on work
be
clothes; That action/continued for an extensive street improvement program; That
a uniform wage scale be established if possible; and that the department comply
with the recommendat.ions made by the state public -examiners in order to avoid
Briticisms in their reports. I,:,.: Mayor•,Grassle.made the announcement
of his appointment of the foll.owing persons to the various Boards of .the City of
Rochester, Minnesota: Dr. F.M. Feldman, Dr. Magath, and Mrs. Percy Smith as mem-
• Ibers, of the Board of Public Health & Welfare for a period of three, one and two
years.respectivly; James O'Conner as Park Commissioner at Large and Lester
.Fawcett as Commissioner from the Second Ward; A. J. Osman as a member of the
Police Civil Service Commission; Theordore H. Johansen as a member of the Public
(Utility Board; Mark Anderson., Mr. Laufenberge.r, and Bert Ballot as membbbs of the
Music and Band Committee; CG.Xai-1 'be reappointed from. the Third Ward as a member
,of the Firemen's Civil Service Commission.
Upon motion by.Anderson, second by Williams, the Mayor's appointment of
�T. H. Johansen to the Public Utility Board for a period of three years, was
approved. Each member of the present Council declined to serve as a membeL- of
said board.
• Upon motion by Mrachek, second by Bowers, the Mayor's appointment of
James O'Bonner as Park Commissioner at Large was approved.
Upon motion by Mrachek, second by Williams, the Mayor's re -appointment
of Lester Fawcett as Park Commissioner from the Second Ward for a period - of two
,years, was approved.
Upon motion by Williams, second by Bowers, the Mayor's appointment of

T. B. Magath. as a member of the Public Health & Welfare Board for a period of
lone year, was approved.
Upon motion by Mrachek, second by Anderson, the Mayor's appointement of
jMrs. Percy Smith as a member of the Public Health & Welfare -Board for a period of
two years, was approved.
Upon motion by Williams, second by Hanson, the Mayor's appointment of Dr.
F. M. Feldman as Health Officer ,for a period of ,three years, was approved.
Upon motion by Mrachek, second by Hanson, the Mayor's appointment of Dr.
(Mark Anderson, Henry C. Laufenberger, each to serv6 three years, and E. B. Ballot
'to fill out the unexpired term of one year of James Matheson, was approved.

Upon motion by Hanson, second by Mrachek, the Mayor's appointment of A.J.
Osman as a member of the Police Civil Service Commission for a period of three
years, was approved. All voting.in favor thereof except Alderman Bowers who
voted "No".
Upon motion by Bowers, second by'Mrachek, the Mayor's appointment of
C. G. Vale as a member of the Firemen's Civil Service Sommission from the Third
Ward, for a period of three years, was approved.
President Lemmon appointed the following Committees of the Common Council
for the ensuing official year:

Alderman Williams introduced the following resolution, which was read:

That the said Robert's Rules of Order be adopted by this Common Council
as rules of order for the conduct of its business."

Upon motion by Mrachek, second by_ Williams that the said resolution be adopted
s read, and all voting in favor thereof, President Lemmon declared the said reso-II
Lution duly passed and adopted.
Alderman Anderso.n introduced the following resolution, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesota:
That the said Common Council.of the City of Rochester, Minnesota hereby
idopts the following rules and regulations for the order of business of said
common Council: _
1.. Roll Call. The roll call of the Common Council shall be had and taken
Ln its alphabetical order according to the names of the members, except that the
same of the President of the Common Council shall b.e called only at the first
roll call of each meeting and then after that, at that meeting, only in case of a
tie vote when his name shall be called and vote taken after the expression of each
)f the other members of said Common Council, or when a 5/7 vote is required.
2. Reading and approval of the minutes of the minutes of the preceeding
meeting.
j. At first meeting, the appointment of officers and committees.
4. Public hearings.
5. Reading of petitions and communications.
6. Report of committees All reports of committees shall hereafter be made!,

Upon motion by Williams, second by Mrackeh, that'the said resolution be
idopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
The application of F.R.Finch for reappointment as City Clerk was read, and
pon motion by Mrachek second by Williams, F.R.Finch.was appointed City Clerk

The applications of Arle'igh C. Smith and Walter C. Hogenson for appointment
s City Engineer were each read, and upon motion by Hason, second by Williams,
rleigh C. Smith was reappointed -City Engineer for the ensuing official year. All
oting in favor thereof except Aldermen Anderson and Bowers who voted "No".
- The application of Desmond Hunt for appointment to the office..o.f City
ttorney was read, and upon motion by Bowers, second by Mrachek, Desmond Hunt was
ppointed City Attorney. All voting in favor thereof except Alderman Williams who
oted "No".
The applications of Edward E. Zuehlke, E.R.Emerson, Garnet Spring, Harold
. Dunnette and R. J. Thompson for appointment as Building and Plumbing Inspector
ere each read, and upon motion by Anderson, second by Williams, Garnet Spring
as appointed Building and Plumbing Inspector. All voting in favor thereof except

The application of George E. Rink for the office of Electrical Inspector was
ead, and upon motion by Bowers, second by Hanson, George E. Rink was appointed as
Electrical Inspector.

The applications of Henry C. Lindberg, Ernest T. Riege, and Joseph J.
Schuster as Assistant Custodianswere each read, and upon motion by Williams,
second by Anderson, Henry C. Lindberg and Joseph J. Schuster were reappointed as
jAssistant Custodians.
The applications of Peter D. Claude as First Assistant of the Dumping Grounc
Paul Dornack and Cecil J. Foster, as Second Assitants, and Charles Fritsch,

{Alvin Mackey, Ross E. Phillips as Assitants, and Edward Fallon as Assisstant at
lthe Dumping Grounds or any other city work, were each read. Upon motion by
Bowers, second by Hanson, Peter D. Claude was reappointed as First Assistant of
the Dumping Grounds.
Upon motion by Mrachek, second by Williams, Paul Dornack was reappointed as
,Second Assistant at the Dumping Grounds.
The application of Flora C. Anderson for reappointment as stenographer for
the Chief of Police, Juvenile Officer, and City Att.orney of the City of Rochester.(
Iwas read, and upon motion by Bowers, second by Hanson, Flora C. Anderson was
Ireappointed.as Stenographer.
The application of Grayce Lee for appointment as Stenographer in the office
lof the Building, Electrical and Plumbing Inspector, was read,and upon motion by

The application of Janice Ellringer for reappointment as Stenographer in
Ithe offices of the Municipal Court and City Clerk was read, and upon motion by.
IWilliams, second by Anderson, Janicd Ellringer was reappointed as Stenographer in
(the offices of the Municipal Court and City Clerk.
The application of Mark E. Blanchard for reappointment as City Painter was
Iread, and upon motion by Anderson, second by Bowers, Mark E. Blanchard was re-
jappoi:nted as City Painter for the ensuing official year.
The application of C.E.Ginther as Fire Warden was read, and upon motion by
IMrachek, second by Anderson, C.E.Ginther was appointed Fire Warden for the en -
(suing official year.
President Lemmon announced this as being the time and place fixed for a
hearing on.the construction of a sanitary sewer in Fourth Street Northeast from
the State Hospital Sewer to Lot 56, School Section 36, and asked if any one
present wished to be heared concerning the said improvement. No one present
1wished to be heard.
The petition for the construction of a curb and gutter on Fifth Street
Northeast ffom Ninth Avenue Northeast to Tenth Avenue Hortheas,t was read, and
(President Lemmon ordered same be placed on file.

The petition for the construction of a sanitary sewer and watermain in
(Nine and one-half Street Southeast from Ninth Avenue Southeast to 4291 East or as
If ar,as practical, was read, and President Lemmon ordered that same be placed on
Ifile.
Mrs. Edith Rommel appeared before the Council and presented a list of
ladditional signers to a petition which had previously been presented.t.o the Commo
lCouncil,protesting the granting of a license for selling 3.2 beer at what is
1known as the Gingham Inn on Sixth Street Southwest.
Mr. Traverse Schinke also appeared before the Council with.a petition con-
ltaining a list of names of persons who didnot object to the sale of 3.2 beer at
Ithe Gingham Inn on Sixth Street Southwest.
The petition of C.E. Patterson to have property zoned as Multiple dwelling
Ion East Center Street And<<:Eleventh Avenue Northeast was read, and upon motion by
Williams, second by Bowers the same was referred to the Board of Zoning.
A communication from the Chicago and Northwestern Railway Company notifying
lthe City that they wish to pay the special assessment for the widening, paving ,
land gutter work on North Broadway Street as soon as the project is,completed, was
tread, and President Lemmon ordered that same be placed on file.
The City Engineer's estimate of cost for .a five to eight ton --Tandem Roller
Iwas read, and President Lemmon ordered that same be placed on file.
The.City Engineerls estimate of cost for a sanitary sewer in Nine and one-
[half Street Southeast from Ninth Avenue Southeast to 5001 East was read, and.
(President Lemmon ordered that same be placed.on file.
The City Engineer's estimate of cost of a sanitary sewer in Fourth Street
(Northeast from State Hospital sewer to Lot 56, School Section 36, was read,.and
Iresident Lemmon ordered that same be placed on file.
An appeal from the decision of the Building Inspector by Mr. C.W. Oesterreic
in regard to constructing a new residence at the corner of Tenth Street Southwest
and Eighth Avenue Southwest, 5161, from the North line of the lot, was read, and
upon motion by Hanson, second to Mrachek the same was referred.to the Board of
Zoning.
The report of the Clerk of th.e Municipal Court for the week ending March
129th,1941, wh6wing criminal fines and costs collected $272.95, civil fees receives
$13.30, and conciliation court fees $4.25, was read, and having been previously

approved by the City Attorney, President Lemmon ordered flat same be placed onfile.
The report of the Clerk of the Municipal Court for the week ending April
5,1941, showing criminal fines and costs collected $595.90, civil, fees received,
$12.25, and conciliation court fees $7.25, was read, and having been previously
approved by the City Attorney, President Lemmon ordered that same be placed on
file.

Isell "Off and One Sale" non -intoxicating malt liquors was seconded by Alderman
(Anderson, and upon roll call Aldermen Anderson and Yaeger voted "Aye" and Alderman
lBowers, Hanson, Mrachek, and Williams voted "No".
The Applications. of the Yellow Cab Company for eighteen taxicab licenses,
J.C. Adams for six taxicab licenses, and Harold McGoon for one taxicab license,
were each read, together with the insurance policy of the Hartford Accident &
Indemnity Company for the Yellow Cab Compan3ij, and upon motion by Bowers, second

by Hanson, the licenses ,were granted,/the.insurance policy accepted and ordered

the City Engineer is hereby authorized to emply 21 men regularly on a monthly
bases at a salary not to exceed $125.90 each per'month.
Be it further resolved by the tsaid Common Council:
That in the event the above..number of employees shall not be sufficient to
adequately carry on the work of the said -.department the said City Engineer, with
the approval of the Street and Alley,,Gommittee and the Common Council may employ
not to exceed an additional men o.n.;,the''hourly basis.
Be it further resolved by the Common Council of said City:
That in case of extreme emergency the -City Engineer of said City is hereby 11
authorized to employ such additional help as may be necessary during said emergenciy"*

Provided that all firemen appointed who have not had previous experience
as firemen shall receive a salary and compensation in the sum of $120.00 for the
first six months; WO.00 for the next Twelve months & $140.00 maximum.
Said salary and compensation shall be paid from the Fire Protection Fund,
semi-monthly; one half of the monthly salary and compensation being payable on the
16th day aifd the balance thereof on the last day of each calendar month during the
ensuing official year."
Upon motion by Williams second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof except Aldermen Bowers and
(Hanson who voted "No", President Lemmon declared said resolution duly passed and
jadopted.
Alderman Yaeger introduced the following resolution, which was read:
"WHEREAS, Section 7 of Ordinance No.. 415 provides that the Common Council
of the City of Rochester, Minnesota, on the first Monday in April in each year,,
shall establish a minimum wage scale for all public works for the ensuing official
year:
SO THEREFORE, Be it resolved by the -Common Council of the City of Rochest6z
Minnesota:
That for and during the official year following the passage and adoption
of this resolution all contracts hereinafter entered into for the purpose of per-
forming any work for the City of Rochester, involving either new construction
work or repair on any roads, bridges, sewers, alleys, parkways, buildings, street:
or any other public work involving the improvement of public property, shall be
made upon the basis that the wages paid skilled and unskilled labor shall not be
less than the following:

hours of employment for a week shall be fixed at a miximum of fourty-four hours,
except Bricklayers, and Plasters whose week shall be forty hours."

Alderman �aeger introduced a resolution fixing the salary of the painter
for the City of Rochester at $1690.00 per year for the ensuing official year,
which was read.
Upon motion by Williams, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly -passed and adopted.
Alderman Williams introduced a resolution granting public dance permit to
the Rochester Junior -Chamber of Commerce for the Mayo Civic Auditorium April 26th,
1941, and fixing the•fee at $3.00, which was read.
Upon motion by Anderson, second by Mrachek that the said resolution be
jadopted as read, and•all voting in favor thereof, President Lemmon declared the
(said resolution duly -passed and adopted.
Alderman Williams introduced a resolution granting publi-c'iiance-permit to
Ithe Southern Minnesota Broadcasting Company for the Armory, April'5th,12th,19th,
land 26th, 1941, and fixing the fee at $3.00 each, which was read.

Alderman Bowers introduced a resolution adopting plans, specificiations,
and estimate of cost for the construction of a sanitary sewer in Fourth Street
Northeast from the State Hospital Sewer to Lot 56 School Section 36, and ordering
hearing on said improvement to be held at 7:30 o'clock P.M. -on April 21st,1941,

Alderman Williams introduced a resolution ordering advertisement:, for bids

The appointment of the City Assessor of Bruce Gilles as Deputy Assessor
was read, and upon motion by Mrachek, second by Williams the said appointment was
approved.
Alderman Hanson introduced a resolution levying special assessments for a
(sanitary sewer and water main in part of Three and one-half Street Southeast and
)Fifteenth Avenue Southeast, which was read.
Upon motion by Williams, second by Hanson that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
On motion by Bowers, second by Hanson it was moved that the Council go on
record as not favoring employees of the City of Rochester who are working on a
monthly basis being employed for extra work and being paid for extra ordinary
(services. All voted in favor thereof except Aldermen Williams and Yaeger who vot

After further discussion a.motion was made by Bowers, second by Hanson to
reconsider the action.
On motion.by Bowers, second by Williams, the former motion was repealed.
Upon motion by Bowers, second by Mrachek the matter was.to be taken under
advisement.
Upon motion by Williams, second by Hanson it was moved that -the District
Court appoint three men as trustees for the George Healy Trust Fund.
Upon motion by Williams, second by Mrachek, the Common Council adjourned
until 7:30 o'clock P.M., on April-14th, 1941.
