Minutes of an adjourned regular meeting.of the Common Council of the City
of Rochester, Minnesota, held in the,Council Chambers, in the City Hall, in said
City, on April loth, 1941.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Anderson, Bowers, Hanson; Mrachek,
Williams, and Yaeger. Absent: None.
President Lemmon announced this,as being the time and place set for re -
and opening
ceiving/bids for the furnishing of road oil, asphalt, and tar. The following bids
were received and opened at this time:
Standard Oil Company: 60,000 Gal. S.C. 3 Road Oil delivered F.O.B. Rochester
$0.0530 per gallon and 10,000 Gal. M.C. 3 Cutback Asphalt delivered F.Q.B.
Rochester, $0.0640;
The Barrett Company: 10,000 Gal. T.C. 3 Tar delivered F.O.B. Rochester,
$0.0905;
The Ohio Oil Company: 60,000 Gal. SC-3 Road Oil delivered F.O.B. Rochester.
$0.0532, and 10,000 Gal. MC-3 Cutback Asphalt delivered F.O.B. Rochester, $0.0632;
Bitucote Products Company: 10,000 Gal. Emulsified Asphalt delivered F.O.B.
cheater, Minnesota AE 1 or 2 $0.0715 and Minnesota ADS+ $0.0745;
Col-tex Refining Company: 10,000 Gal. Emulsified Asphalt, T.C. 1 delivered
F.O.B. Rochester $0.0670; and
Socony-Vacuum Oil Company: 60,000 Gal. S.C. 3 Road oil delivered F.O.B.
cheater $0.0535 and 10,000 Gal. M.C. 3 Cutback Asphalt delivered F.O.B.
cheater $0.0630.
President Lemmon referred the above bids to the Street & Alley Committee
d.City Engineer for tabulation and recommendation.
Mayor Grassle announced his appointment of Reverend W. M. Grabowski as Park
Commissioner for the unexpired term in the Third Ward. On motion by Williams
and second by Yaeger, the Mayorls.appointment was approved.
Mr.'William Schacht appeared before the Council and requested that $140.00
e appropriated to the Junior Chamber of Commerce for the purpose of furnishing
usic at the Gypsy Frolic on April 26th, 1941, which is sponsored for the members
f the 4-H Club by the Junior Chamber of Commerce.
Upon motion by Mrachek, second by Williams, the sum of $l40.Oo was appro-
riated from the Banff Fund to the Junior Chamber of Commerce.
Upon motion by Mrachek, second by Yaeger, the following bids for furnishing
oad oil, asphalt, and tar were accepted after recommendation by the Street &
ley Committee and the City Engineer:
The Standard Oil Company,. The Barrett Company, The Col-tex Refining Company
nd The Socony-Vacuum Oil Company.
Upon motion by Anderson and second by Hanson, the City Clerk was instructed
o return the certified checks of the,unsuccessful bidders for the furnishing of

A communication from Ralph I. LaRlant in regard to certain auxiliary per-

An opinion of the City Attorney, dated April 10, 1941, with reference to

The petition to vacate the alley in Block 1, W. A. Johnson Subdivision was
ead and referred to the Street & Alley Committee and the City Attorney for report
nd recommendation on April 21st, 1941.
A communication from Mr. J. Norman Peterson, State Liquor e Control Commis-
ioner, advising that the "Off -Sale" Liquor licenses of Joe Wallace, Emanuel
ostakes Robert P. Kennedy,, and Leo A. Huey had been approved by his department,
as read, and the same was ordered placed on file.
The City Engineers estimate of the cost of constructing a curb and gutter
in Fifth Street Northeast from Ninth Avenue Northeast to Tenth Avenue Northeast
was read, and President Lemmon ordered that same be.pl,aced on file.
The Mayor's emergency order given to the -City -Clerk for the purchase of a
(iarload of gasoline was read, and upon motion by Bowers, second by/Hanson, the
action set forth therein was approved.
• A report from' the Board of Zoning, recommending that Mr. C. W. Oesterreich
Abe granted a permit to construct a new residence five feet six inches from the
orth line of his property located at the corner of Tenth Street Southwest and

A communication from Mr. A. C. Fratzke, withdrawing his name from a petitic
ated March 21, 1941 and presented by Mr. C. E. Patterson, was read,•and President
emmon ordered that same be placed on file.
A report from the Board of Zoning recommending that the petition dated
arch 21, 1941, presented by Mr. C. E. Patterson requesting that the property from

The annual report of the Public Utility Board was read, and upon motion

The report of the Building and Plumbing Inspector for the month of March,
941, showing building permits issued $127.00;.and plumbing permits $32.25, was
ead, and President Lemmon referred same to the Finance Committee.
The report of the Electrical Inspector for the month of March, 1941,
howing electrical permits issued $13.00 was read, and President Lemmon ordered
ame referred to the Finance Committee.
The report of the City Weighmaster for the month of March, 1941, showing
361 private loads weighed, and receipts of•$36.10, was read, and President Lemmon
eferred same to the Finance Committee.e
The report of the Clerk of the Municipal Court for the week ending April
12, 1941, showing criminal fines and costs collected $472.50, civil fees received
$6.50, and conciliation court fees $3.50, w as read, and having been previously
'approved by the City Attorney, President Lemmon ordered that the same be placed
on file.
The applications of The Schmidt Printing Co., Huey's Cigar Store, Ray Lifto
I0. E. Mosing, Firestone Service Stores; C. R. Hutchinson, Piggley Wiggly Store,
Iver Iverson, M. J. Donahue, City. Service Oil Company (two), and the Board- of Park
Commissioners, for permits to place and maintain a sign, were read, and upon motio;
by Williams, second by Bowers, the permits were granted.
The applications of J. K. Williams, Carl W.Meinen, Don Arenz, and Henri
jBakker for licenses to sell Soft Drinks were read, and upon mation'by Bowers,
;second by Hanson, the licenses were granted.
The applications of H. J. Wernecke and - Henri Bakker for "Off Sale" licenses
o sell non-intox�ca.ting malt liquors were read, and upon motion by Mrachek;
econd by Bowers, the licenses were granted.
The applications, of Arthur Glasenapp and Henri Bakker for "On Sale" license;
o sell non -intoxicating malt liquors were read, and upon motion by Williams,

The applications of George Wiltgen for licenses to sell "Off and On" Sale
ion -intoxicating malt liquors were read, and upon motion -by Bowers, second -by
Hanson, the granting of the licenses was: deferred until April 21st, pending an
opinion of the City Attorney.
The application of the Rochester Bus Line, Inc. to operate nine buses on the
(streets of Rochester was read, and upon motion by Mrachek, second by Williams, the
,license was granted.
Upon motion by Hanson, second by Bowers, the application of David Nichols
or a license to connect sewers and drains was granted.
The petitions that bituminous treatment be applied to and that a curb and
fitter be constructed in Seventh Street Southwest from Lot 106, Belmont Addition
est to Fourteenth Avenue Southwest were referred to the Street and Alley Committee
The petition that Nbirth and South, East and West.alleys in Block 10 of Head
nd McMahon's Addition be graded and oiled was referred to the Street and Alley
ommittee and the Sprinkling Committee.
The official bonds of Desmond B. Hunt, Arleigh C. Smith, Chester A. Cotting-

am, Paul F. Dornack,/Henry C. Lindberg each in the.sum of $500.00 and with the
merican Surety Company of New York as surety; the offical bond Peter D. Claude,

1,000.00 each with the Fidelity & Casualty Company of New York as surety, were

The contract bond of Universal Motors in the sum of $1054.00 with the
festern Surety Company as surety, and the license bond of David Nichols in the
um of $1,000.00 with the United States Fidelity & Guarentee Company as surety
e.re each read, and upon motion by Williams, second by Yaeger, said bonds were
pproved, the sureties thereon accepted and it was ordered that same be placed on

Alderman Anderson introduced a resolution fixing the.salary of the Building
& Plumbing Inspector at $1,920.00 per year for the ensuing official year, which
was read.
Upon motion by Williams,second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resoltuion.duly passed and adopted.
Alderman Anderson introduced a resolution fixing the salary of the Electri-
cal Inspector at $2100.00 per year for the ensuing official year, which was read.
Upon motion by Bowers, second by Hanson that the said resoltuionbe adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
/ Alderman Anderson introduced a resolution approving the salaries fixed by
the Public Health & Welfare Department for employees in said department during
the ensuing official year, which was read.
Upon;;motion by Mrachek, second by Bowers that the said resolution be adopted
as -read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Adnerson introduced a resolution fixing fees to be charged by the
City Scavenger during the ensuing official year, which was read.
Upon motion by Williams, second by Hanson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Street & Alley Fund, $6.95 from the Sewer Fund, and $36.67 from the Fire Protectio?
d and ordering payment made to the National Bushing & Parts, which was read.
Upon motion by Bowers, second by Hanson that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $5.40 from the
eneral Fund, $30.13 from the Street & Alley Fund, $77.53 from the Fire Protection
d, and $132.02 from the Sewer Fund and,ordering payment made to Dodge Lumber
Fuel Company, which was read.
Upon motion by Mrachek, second by Williams that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $39.04 from the
Street & Alley Fund and $353.74 from the Bridge Fund and ordering payment made to
the Lyle Culvert & Pipe Company, which was read.
Upon motion by Williams, second by Anderson that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.

blic Utility Department for employees in said department during the ensuing
fficial year, which was read.
Upon motion by Mrachek, second by Yaeger that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Bowers introduced a resolution approving and fixing the salaries
f the Park Department employees during the ensuing official year, which was read.
Upon motion by Williams, second by Mrachek that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly -passed and adopted.
Mayor Grassle stated that a hearing on a tax to be levied against gas used
would"be held at the State Capitol in the very near future and suggested that the
City Attorney and members of the Council attend this hearing if possible. Mr.
ant, City Attorney, stated that he had already made plans to attend the hearing.
The matter of purchasing two boats for use by the Fire Department was
eferred to the Fire Committee and the Purchasing Committee with power to act.
Upon motion. by Williams, second by Hanson the Common Council adjourned un-
