Minutes of an adjourned regular-meeting,of the Common Council of the City
lof Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
city on April 21st, 1941.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present: President Lemmon, Aldermen Anderson, Bowers,
Hanson, Mrachek; Williams, and Yaeger.
President Lemmon•stated this as being the time and place set for a hearing
on the construction of a sanitary sewer in Nine and one-half Street Southeast
from Ninth Avenue Southeast to 500' East, and asked if any one present wished to
be heard concerning this improvement. No one present wished to be heard.
President Lemmon stated this as being.the time and place s'et for a hearing

(Avenue Northeast to Tenth Avenue Northeast, and asked if any one present wiahed t

President Lemmon stated this as being the time and place set for a hearing
Ion the construction of a sanitary sewer in Fourth Street Northeast from the State
(Hospital Sewer to Lot 56, School -Section 36, and asked if any one present wished
Ito -be heard concerning this improvement. No one present wished to be heard.
President Lemmon stated this as being the time and place set for receiving
land opening bids for the construction of a sanitary sewer in Fourth Street North-
east -.from the State Hospital Sewer to Lot 56, Sdhool Section 36. The following
(bids were received and opened at this time: William:,C. Fraser & Son $649.20 and
(Martin Paulson $739.00.
President Lemmon referred the above bids to the City Engineer and the
Sewert @ommittee for tabulation and recommendation.
President Lemmon stated this as.being the time and place set for receiving
and opening bids for the furnishing of a new tandem roller for' use of the City
Engineer's Department. The following bids were received and opened at this time:
George T.-Ryan Co. $2949.00 and A-W Company Inc. $3199.00, and Thorman W. Rosholt
Company, $2900.00
President Lemmon referred the above bids to the City Engineer and the
Street and Alley Committee for tabulation and recommendation.
The Rochester Post -Bulletin's proposal for itoing the'official printing and
advertising for the City of Rochester, Minnesota was read, and President Lemmon
ordered that same be placed on file.
The following proposals for being designated as depositories for funds of
the -City of Rochester, Minnesota, were each read: Union National Bank, $150,000.0
The
Olmsted County Bank & Trust Fund $45,000.00 and/First National Bank, $200,000.00,
and President Lemmon ordered that same be placed on file.
A representative from the Hammond Bex Company of Minneapolis appeared befor
the Council and outlined a proposition for placing rubbish boxes at various loca-

Itions in the business district of Rochester. These boxes were to be furnished at
Ino cost to the city but were to carry certain advertising. -
A motion was made by Mrachek, second by Williams not to accept the proposi-I
ition of the Hammond Box Company.

The report of the Street & Alley Committee and the City Engineer recommending

Upon motion by Mrachek, second by Hanson the report was accepted and

Upon motion by Bowers, second by Mrachek, the City Clerk was -instructed to
iretur.n the certified checks of the unsuccessful bidders..
Upon motion by Mrachek, second by Williams, the Mayor's appointment of
!George.F. Strifert as Wbbd Inspector for the ensuing official year was approved.
A communication from the Minnesota Department of Highways and an agreement
'between the State of Minnesota Department of Highways and the City of Rochester
!regarding the reconstruction of a portion of Highway #63 on North Broadway Street
were each r`bad. and President Lemmon ordered same to be placed on file.
A communication from the Central Labor Union recommending that Mr. Harold
Wood be appointed to the office of Labor Inspector was read. Mayor Grassle stated
that the recommendation was agreeable to him, and on motion by Anderson, second by
Yaeger, the appointment of Mr. Harold Wood was approved for the balance of the
jensuing fiscal year.
Mayor Grassle then verbally appointed Harold Wood as a special policeman,
he to serve without pay until the Second Monday in April,-1942, unless sooner re-
(moved, and his appointment to be effective only while making inspections. On
Imotion by Mrachek, second by Williams, the appointment of Harold Wood as Special
loliceman was approved.
A recommendation of the Water & Sprinkling Committee in regard to the layix
Iof a water main in Nine and one -half -Street Southeast from Ninth Avenue Southeast
Ito 500 feet East was read.
Upon motion by Williams, second by Hanson, the said recommendation was re-
Iferred to the Public Utility Board for proper action.
The assignmentcof securities by the Olmsted County Bank & Trust Company,
The Union National Bank, and the First National Bank of Rochester, Minnesota, kere
leach read, and President Lemmon ordered same -be placed on file.

A communication from the Board of Park Commissioners requesting that $2,000I!00
be transferred each month.during the fiscal year 1941-1942 was read. Upon motion
by Williams, second by Hanson the communication was referred to the Finance Com-
mittee for a report at the meeting of May 5th, 1941.
A communication from the Board of Park Commissioners requesting treatment
of the drives around Silver Lake and through Soldiers Field was read, and upon
motion by Williams, second by Hanson, the communication was referred to the
Street & Alley Committee.
A petition for the construction of a curb and gutter on Twelfth Avenue
Northwest from Center Street West to First Street Northwest was referred to the
Street and Alley Committee for consideration.
A petition and statement of acquiescence signed by eighteen petitioners
requesting a change in the zoning were read and referred to the Board'of Zoning.
Upon motion by Williams, second by Anderson the Mayor's appointment of
James M. O'Conner, Louis A.,Brunsting, Lester N. Fawcett, Wal'ter.M. Grabowski,
Ralph B. Compton, James Ralph Kelly, Herbert P: Thienell, and George E. Laack as
special policemen.in.the Parks of the City of Rochester, Minnesota, they.to serve
without pay until the Second Mondy in April, 1942, was approved.
The report.of the Clerk of the Municipal Court for the week ended April
19th, 1941, showing criminal fines and costs collected $335.60, civil fees re-
ceived, $3.95. and conciliation court fees $8.75, was read, and having been pre-
viously approved by the City Attorney, President Lemmon ordered that the same be
laced on file.
The applications of George Wiltgen for licenses to sell non -intoxicating
(malt liquors, both "Off and On Sale", were read, and on motion by Bowers, second
lby Hanson the licenses were granted.
The applications of the Cities Service Oil Company and the Shell Betroleum
(Company for Permit to Place and Maintain a sign, were read, and on motion by
Hanson, second by Yaeger, the permits were granted.
The applications of S.A. Arthur West and.Howard E. Hill for license to sell
soft drinks were read,.and on motion by Bowers,.second by Anderson the licenses
were granted.
The applications of -the Minneapolis Brewing Company and S.W. Arthur West.
"Off Sale"
for license to sell non -intoxicating malt liquors were each read, and on motion,by
Anderson, second by Mrachek the licenses were granted.
The application of George E. Fordham for a Journeyman Electrician's License
was read,,and on motion by Mrachek, second by Hanson the license was granted.
The application of L.A. Fellows for an auctioneer's license was read, and
Ion motion by Mrachek, second by Anderson the license.was granted.

The application of Douglas Hansen for a driver's license was read and on
tion by Bowers, second by Yaeger, the license was granted.
The official bonds of the Rochester Post -Bulletin. in the sum of $1,000.00
with the Fidelity & Casualty Company as surety; George E. Rink in the -sum of
$1,000.00 with the Fidelity & Casualty Company as - surety; and F.R: Finch in the
sum,of $500.00 with the Great American Indemnity Company of New York as surety,,
and the license bond of Leonard A. Fellows in the amount of $1,000.00 with the
National Surety Corporation of New York as surety, were each read, and on motion
by Williams, second by Mrachek, said bonds -were approved, the sureties thereon
accepted, and it was ordered that same be placed on file.
The following claims were read; and upon motion by Williams, second by,
(Mrachek, the same were allowed and the Mayor and City Clerk instructed to draw
warrants upon the City Treasurer and make payments accordingly:

Alderman Anderson introduced a resolution appropriating $299.16 from the
Park Improvement Fund and $163.35 from the Lighting Fund and ordering payment made)
to the City of Rochester Public Utility Department for electricity, water,.a.nd
ower used during March at the Auditorium.
Upon motion by Bowers, second by Hanson,that the said resolution be adouted
as read, and all voting in favor the President Lemmon declared the said reso-
lution duly passed and adopted.
Alderman Anderson introduceda resolution appropriating $333.00 from the
Bark Improvement Fund and ordering payment made to City of Rochester Public
Utilities for steam heat used at the Auditorium for March, 1941.
Upon motion by Hanson, second by Mrachek that the said resolution be adopte!
as read, and all voting in favor thereof, President Lemmon declared the said reso-1
lution culy passed and adopted.
Alderman Anderson introduced a resolution appropriating $259,40 from the -
Sewer Fund and ordering payment made to The Dorr Company, Inc.
Upon motion by Mrachek, second by Williams, that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution granting two public dance permits
Ito L.A.Fellows and G.L.Fellows for the Mayo Civic Auditorium April 19th and May
�3rd, 1941, and fixing the fee at $3.00 each, which was read.
Upon motion by Williams, Second by Anderson that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Hanson introduced.a resolution accepting the bid of Wm.C.Fraser &
Son for the construction of a sanitary sewer in Fourth Street Northeast from the
State Hospital Sewer to Lot 56, School Section 36, which was read.

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Bowers introduced a resolution adopting plans, specifications, an
estimate of cost for the construction of a sanitary sewer in Nine and one-half
Street Southeast from Ninth Avenue Southeast to 500 feet East, +1,

Alderman Bowers introduced a resolution adopting plans, profiles, specifi-
cations and esitmate of cost for the construction of a sanitary sewer in Nine and
one-half Street Southeast from Ninth Avenue Southeast to 500 feet East, and -order-
ing a hearing on said improvement to be held at 2:00 o'clock P.M.,.on May 5th,

1941, and ordering advertisement forbids to be received and opened at 2:00 o'clocl
?. M. on May 5th, 1941, which was read.
Upon motion byWilliams, second by Anderson that the said -resolution be
dopted as read, and all voting in favor thereof, President.Lemmon declared the

Alderman Bowers introduced a resolution adopting plans, etc. for the con-

Upon motion by Bowers, second by Hanson that the said resolution be adopted

Alderman Mrachek introduced a resolution accepting the assignment of col-
lateral of the First National Bank in lieuofa depository bond, which was read.
Upon motion by Hanson, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Yaeger introduced a resolution appropriating $450000 from the
General Fund.and ordering payment made to Holt & Glabe for the City Treasurer's
Bond, which was read.
Upon motion by Williams, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $1,970.00 from the
(Park Improvement Fund and ordering payment made to the Mayo Trust Fund for paymen
lof salaries for first half. of April, 1941, which was read.
Upon motion by Mrachek, second by Anderson that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution making transfers to take up over -
(drafts in Codes 2 & j of the Street & Alley Fund and Codes j & 4 of the Bank Fund
land to transfer budget balances to the main code in the various funds where such
lbalances occur, which was read.
Upon motion by Williams, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced an Ordinance amending an Ordinance entitled,

"An Ordinance to provide for registration of dogs and for the distruction of dogs

Hsame being Ordinance No. 563, which was given its first reading.
On -motion by Williams, second by Anderson, and all voting in favor thereof,
the rules were suspended and the Ordinance was given its second reading.
Upon motion by Bowers, second by Hanson the sum of $199.00 was appropriated
t7o9 the Mayor's Contingent Fund.
Mayor Paul Grassle recommended that the Council meet with the Street &
Alley Committee to make an inspection of the streets r- President Lemmo��

The City Engineer's estimate of cost for a sanitary sewer/from Second StreJ11t

Upon motion by Williams, second by.Hanson the report of the Sewer Committee
'recommending that St.Maxys'> Hospital pay.the full cost of the sanitary sewer and
one-half of the storm sewer was accepted.
The recommendation of the Sewer Committee that the bookaccount against
Hospital authori-ties ed
St.Marys-; Hospital be cancelled providing St.Marys=3/release any claim/rights in
the Sewage Dispoal Plant in the City of Rochester, was read, and on motion by
Williams, -second by Hanson the recommendation of the Sewer Committee was accepted,
and the City Attorney was instructed to notify the proper authorities of St.Mary.'€
Hospital
The question of annexing the property owned by St.Mary's Hospital within
the city limits, which has not been annexed to the city, was discussed, and actior
was deferred until the regular meeting on May 5th, 1941.
The matter of charging St.Mary'.7 Hospitala fee of $3,600.00 per year as
their contribution toward the maintenance of the Sewage Disposal Plant was also
deferred until the meeting of May 5th, 1941.
Mayor Grassle stated that it was believed that there were violations of
certain ordinances regulating *'.e r certain devices and games within the
City of Rochester, and on motion by Williams, second by Hanson the Council went
on record as being in favor of prosecuting, anyone -found-' ::d violating the said
ordinance.
Alderman Hanson, Chairman of the Fire Committee,recommended that two flat

bottom steel boats fifteen and sixteen feet long, and one two oieel trailor for
transporting the boats be purchased,at an estimated cost of $116.50, for the Fire
Department by the Purchasing Committee, which had previously been given power to
act. He also recommened that the boats be kept at the Central Fire Station and
used only for drowning emergency calls, and that the boats be numbered I and 2
and a record of same be kept in the office. of the City Clerk.
