COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., May 12, 1941 3 n •- n LJ Minutes of an adjourned regular meeting of the Common Council of'the City of Rochester, Minnesota, held -in the Council Chambers, in the City Hall, -in said City on May 12th, 1941. - President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon, Aldermen Anderson, Bowers, Hansen, Mrachek,•Williams, and Yaeger. On mo.tion by Bowers, second by Hansen -the minutes of the adjourned regular meeting of April 21st, 1941,-and the special meeting of -May 1st, 1941, were approved. - President Lemmon stated this'as-being the time and place set for a hearing Ion the widening of Second Avenue -Southwest from Fourth Street Southwest -to -Fifth (Street Southwest, and asked if any one present wished to be heard concerning this improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hearing Ion the widening of Second Avenue Southwest from Fifth Street Southwest to Sixth Street Southwest, and asked if any one present wished to be heard concerning this improvement. No-one present wished to be heard. ;President Lemmon stated this as being the time and place set for a hearing lon the widening of Third Street Southwest from Third Avenue Southwest to Sixth Avenue Southwest, and asked if any one present wished to be.heard concerning this limprovement. A petition against the -widening of the street, signed by Sadie B. Barber, Isabella P. Gooding, Ella B. Eaton, John H. Towey & Sons, and G. A. Roan, for the First Presbyterian Church, until the zoning of the abutting property be changed from residential and multiple dwelling zoning to commercial zoning, was read. President Lemmon ordered that same be placed on file. Mr. Thomas Fraser, representing Mrs. George Granger, appeared before the (Council and stated that Mrs. Granger was apposed to the widening of Third Street If rom Fifth Avenue to Sixth Avenue, Southwest, unless -the abutting property was lincluded in the commercial zone. Mr. Oscar Kernan spoke in favor of widening Third Street Southwest, provide the abutting property be changed to commercial zoning. President Lemmon stated this as being the time and place set for a hearing on the widening of Fourth Street, Southwest from Second Avenue Southwest to Tenth Avenue, Southwest, and asked if any one present wished to be heard concerning this limprovement. . Dr. H. .S. Williams, respresenting a group of residents on Fourth Street, (Southwest, presented a petition with thirteen signers, protesting the widening of (Fourth Street. President Lemmon-ordered that same be placed on file. A communication from the Rochester Bus Line, Inc., requesting permission to extend its bus routes within the City of Rochester, as follows, was read: Southwest-- On 9th Street Southwest from 7th Avenue Southwest, west to Stli Avenue Southwest; On 9th Avenue Southwest, south to loth Street Southwest; On loth -Street Southwest, east to 7th Avenue Southwest; and on 7th Avenue Southwest, north -to 9th Street Southwest. Northwest-- On 2nd S.treet Northwest, west from 12th Avenue Northwest to 13th-Avenv Northwest; and on 13th Avenue Northwest, south from 2nd Street Northwest to 2nd Street Southwest. I • sion Upon motion by Williams, second by Bowers, the permiq� was granted. A.communication from the Rochester Fire Department Relief Association, re- al questing an additio4 loan to Frank W. Everett in the sum of $500.00, was read. On motion by Williams, second by Bowers the request was approved. The City Engineer's approximate estimate of cost per assessable foot for ti following contemplated street improvements, was read: Third Street Southwest widening from 3rd Avenue to 6th Avenue Southwes $2.10 per assessable foot. Fourth Street Southwest widening from 2nd Avenue to loth Avenue South- west,. $2.10 per assessable foot. Second Avenue Southwest from 4th Street to 5th Street _Southwest, widen ing, $2.20 per assessable foot. Second Avenue Southwest from 5th.Street to 6th Street' Southwest, for brick widening, $2.65 per assessable foot. For Skidno widening, $2.25 per assessable foot. President Lemmon ordered same to be placed on file. A request of Glenn L. Bowers to have two installments of a sanitary sewer and watermain assessment changed so as to be assessed against the North 175, of the. West 395' of Lot 49, Section 36, Township 107, Range 14, Lands in the City of Rochester, less the West 1931.of the. North 1751 thereof, was read. Upon motion by Williams, second by Hansen the matter was referred to the RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF' ROCHESTER, MINN., May 12, 1941 • Sewer Committee and the City Attorney with power -to act. The recommendation of the Board of Zoning of the City of Rochester, that Mr. C. B. Morgan, be granted permission to construct an addition to his -residence, was read. The recommendation of the Board of Zoning recommending that -Dr. H. M. Helmholz be granted permission to,construct a one story addition to the southwest corner of his residence, was read. On motion by Mrachek, second by Bowers the above recommendations of the Board of -Zoning were approved. A communication from the Rochester Automobile Club, requesting that the Common Council do not pass an ordinance revoking Ordinance No. 513, was read, and President Lemmon.ordered that same be placed on file. A copy of the letter written by Chief H. N. Tompkins, to the City of Madison, Wisconsin, requesting information in regard to parking meters, and-&:kj the reply v to his letter from Madison, Wisconsin,werre,read, and President Lemmon ordered same be placed on file. Mr. Clarence Knowlton, representing a committee of business men from the Chamber of Commerce, stated that they had voted 100% against the installation of the Common Council parking meters in the City of Rochester, and recommended that/ zx�, i�xzcazr=a�x (purchase property to provide for parking space. Mr. John Lobb spoke in favor of the Council installing meters on a trial basis. Mr. C.. Darerin, City Clerk from Kokoma, Indiana, a city of 30,000 p:opulaarion stated that th-ey--had -used, parking meters for some time, and that the businessmen • in that city had now petitioned the Council to install additional meters as the ones in use had proved very satisfactory. Mr. Erwin Briese, secretary of the Chamber of Commerce, presented a remon- strance, requesting the Common Council to refuse any and all proposed installation of parking meters in the City of Rochester, and that the Common Council endeavor to establish municipal parking areas within and adjacent to the business district. This remonstrance was signed by fifty-six representatives from the business secti of Rochester. A communication from the City Electric Department in regard to the installs tion of certain street lights, was read, and Bresident Lemmon ordered same to be • placed on file. petition to vacate a part of Dan Street xorthwest, was read, and same was referred_to.the Street and Alley Committee. Mr. Joe.Plemling,represehting the property owners in Block 1 of W. A. Johnson's Sub -division, appeared before the Council and stated that all the pro- perty owners in the said block had agreed to grant easements for light poles in RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., May 12. 1941 the alley, which the said property owners wished to have vacated. A motion was made by Bowers, second by Williams that the north and south alley in Block 1, W. A. Johnson's Sub -division be not vacated. Aldermen Anderson and Mrachek voted "no". A notice of an appeal from the decision of the Building Inspector in not granting a permit to construct a garage on the west side of the residence to be constructed on the Northwest corner of the inter -section of First Street and Eleventh Avenue Northwest, was read. On motion by Williams, second by Bowers, the matter was referred to the Board of Zoning. The Health Officer's Lockup Inspection Report of May 6th, 1941, was read, and President Lemmon ordered that same be placed on file. The report of the Clerk of the Municipal Court for the week ending May loth 1941, showing criminal fines and costs collected $279.80, civil fees received, $5.70, and conciliation court fees $4.00, was read, and having been previously approved by the City Attorney, President Lemmon ordered that same be placed on file. The report of the License Committee, recommending that the application of Alden A. Fuerstnau for a Journeyman Electricians License be.granted, was read. A motion was made by Mrachek, second by Williams, that the report be approv and the license be granted. The report of the License Committee, recommending that the application of C.C. Courture for a Master Electricians license, the application of Lionel R. 'Anderson for a Master Electricians license, and the application of Merrill E. Johnson for a Journeyman Electricians license be not granted, was read. A motion was made by Anderson, second by Mrachek that the report of the Committee be approved. The applications of Clyde Bloom, Gene Bloom, R.S. Plzak, Mrs. Thomas Donov and Frances A. Meyers for licenses to sell soft drinks, were each read, and on motion by Bowers, second by Williams the licenses were granted. for a motor car license The application of the Rochester Bus Line/to operate a new bus, was read, and on motion by Hansen, second by Mrachek the license was granted. The application of Mrs. Thomas Donovan for an "Off -Sale" 3.2 license to sell non -intoxicating malt liquors, was read. On motion by Hansen, second by Williams the application was referred to the License Committee with power to act. -d f The application of Leo A. Huey for transfer of his "Off -Sale" liquor license was read, and on motion by Hansen, second by Yaeger, the transfer was granted. Upon motion by Mrachek, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution ordering plant, specifications, land estimate of cost for the construction of curb and gutter in Twelfth Avenue !Northwest from West Center to First Street.Northwest, which was read. Upon motion.by Bowers, second by Hanson, that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced.a resolution granting a public dance permit to Grant L. Fellows, for the.Mayo Ciyic Auditorium , May 10th, 1941, and fixing the fee at $3.00, which was read. Upon motion.by Mrachek,.second by Williams that the said resolution be dopted as read, and all voting in -.favor thereof, President Lemmon declared the said resolution duly passed and adopted.. Alderman Yaeger introduced a resolution appropriating $933.4.0 from the General Fund and ordering payment. made to the. C.O. Brown -Agency for insurance remiums , which was read. Upon motion.by Mrachekt,second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said reso— lution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $294- 57 from the General Fund and ordering payment.made to Herbert G. Knopp, Agent, -which was read. Upon motion by Hansen, second by Bowers that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $251..30 from the General Fund and ordering payment made to Spencer M. Knapp, which was read. Upon motion by Anderson, second by Yaeger that the said resolution be - adopted as read,' 'and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $719.15 from the General Fund and ordering payment made to the Street & Alley Fund, for use of equipment.during April, which was read. Upon motion by Williams, second by Hansen that the said resolution be opted as read, and all voting in favor thereof, President Lemmon:declared the aid resolution duly passed and adopted. . Alderman Williams introduced a resolution appropriating $97.6g from the eneral Fund, $2.00 from the Sewer Fund, and $3,355.54 from the.Lighting Fund and rderiag payment made to the City of Rochester Public Utilities, which was read. Alderman Mrachek introduced a resolution appropriating $437.04 from the (Street and Alley Fund and ordering payment made to the General Fund, Code'29, for (gasoline used from the city pump, which=was read. Upon motion by Bowers, second by Hanson, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed •and adopted. Alderman Mrachek introduced a resolution appropriating $949.10 from the Code 1 Street & Alley Fund/and ordering payment made to•the Street & Alley Fund, Code 18, for use of equipment during April, which was read. Upon motion by Hanson, second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resoluti.on duly passed and adopted.
