OF THE CITY OF ROCHESTER, MINN., M����� thy, Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on May 26 th, President Lemmon celled the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon, Aldermen Anderson,,Bowers, Hanson, Williams, Yaeger. Absent: Mrachek. Upon motion by Bowers, second by Hanson the minutes of the regular meeting of May 5th, 1941 and the adjourned regular meeting of May 12th, 1941, were approvei President Lemmon stated this as being the time and place set for receiving and opening bids for the construction of a curb and gutter on Fifth Street North- east, from Ninth Avenue Northeast to Tenth Avenue Northeast. The following bids were received and opened at this time: H. T. Earle, $565.50 and C. M. Boutelle, $714. 00. • and Alley* President Lemmon referred the above bids to the Streett-DOmmittee for tabula- tion and recommendation. Mr. Christie Ferguson appeared,before the Common Council and submitted a ,protest against the widening of North Broadway Street. President Lemmon ordered that same be -placed on file. Mr. Kennedy -`appeared before the Common Council and requested permission for the Christian Businees Mens' Association to hold services on the corner of Broadway and'First Street Northeast. On motion by Bowers, second by Yaeger the ,permission was granted. Alderman Anderson, Chairman of the Street and Alley Committee, recommended • that the sidewalk on Fifth Avenue Southwest, between Seventh and Eighth Street, Southwest, be constructed three feet closer to the curb than the present sidewalk line. On motion by Williams, second by -Bowers the recommendation was approved. A petition for the construction of a sanitary sewer and watermain on Seventl Avenue Northwest, from Tenth Street Northwest to Fourteenth Street Northwest, and on Seventh Avenue Northwest to approximately 250 feet west of the west line of Ninth Avenue Northwest, was read. President Lemmon referred same to the Sewer and Water Committee for a repor', lat the meeting of June 2nd, 1941. A communication from the Board of Park Commissioners asking permission to . enter into a five-year contract with the Community Oil Company for the lease of the property at 312-314-First Avenue Southwest, was read. President Lemmon ordered " that same be placed on file. The recommendation of the Board of Zoning that Mr. H. B. A communication from the Board of Public Health & Welfare correcting errors in setting certain salaries for the current fiscal year was read, and upon motion Iby Bowers, second by Anderson the same was approved•and,ordered placed on file. A report of theaction taken by the Chamber of Commerce in regard to the establishing of daylight saving time was read, and President Lemmon ordered that (same be placed on file. The report of the Clerk of the Municipal Court -for the week ending May 17thi 1941, showing criminal fines and costs collected $269.90, civil fees received �5.20,'and conciliation court fees $6.50, was read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file. The applications of the Rochester Eat Shop and The Lunch Box for permits tol glace and maintain a sign were each read, and upon motion by Bowers, second by Yaeger the permits were granted. The applications of Clarence Ryan, Mrs. George'Henke,,Inez Bonsack, and Marie Stortz for licenses to sell soft drinks were each read, and upon motion by Bowers, second by Hanson the licenses were granted. Mr. Harry Manion again requested -that a sidewalk be constructed on the west] side of Eighth Avenue Southeast north from the creek to Fourth Street Southeast. Mr. Zimmerman appeared before the Council for the purpose of apposing the constru Ition of the above mentioned sidewalk. The license bond of L.A. Kepp doing business as L.A.Kepp Contracting Co., it the sum of $1,000.00 with the Fidelity and Casualty Company of New York as surety; the official bond of Dr. D. C. Lochead in the sum of $500.00 with the Standard Accident Insurance Company as surety; and the contract bond of the Standard Oil Company in the sum of $3,190.00, with the Seaboard Surety Company,as surety, were each read, and upon motion by Williams, second by Bowers the said bonds were appro the surety thereon accepted and it was ordered that the same be placed on file. Upon motion by Anderson, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said reso- lution duly passed and adopted. Alderman Williams introduced a resolution appropriating $'_$4,77g.75 from the Interest Fund and ordering payment made to the First National Bank of Rochester, for maturity of interest -on City of Rochester bonds, which was read. Upon motion by Hanson, second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $2,259.01 from the Park Improvement Fund and drdering payment made to the Mayo Trust Fund for salarie) for first half of May, 1941, which was read. Upon motion by Williams, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution accepting the bid of H.T. Earle for the construction of curb and gutter in Fifth Street Northeast, which was read. Alderman Bowers introduced a resolution adopting plans, ordering second hearing, and bids for the widening of the pavement on Second Avenue Southwest from Fourth Street to Sixth Street Southwest, which was read. Alderman Bowers introduced a resolution adopting plans, ordering bids, and (second bearing for the construction of curb and gutter and paving Seventh Street Southwest from Lot 106 Belmont Addition west to Fourteenth,Avenue Southwest, which (was read. Alderman Williams introduced a resolution ordering a hearing on the constru tion of curb and gutter in Twelfth Avenue Northwest from First Street Northwest o Second Street Northwest, which was. read. Alderman Williams introduced a resolution appropriating $242.09 from the :eneral Fund and ordering payment made to the State of Minnesota Department of 'axation, which was read. Alderman Williams introduced a resolution appropriating $530.05 from the general Fund•and ordering payment made to Standard Oil Company, which was read. Upon motion by Anderson, second by Bowers that the said resolution be adopted as:'_read, and - all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $271.02 from the General Fund, $3.24 from the Street and Alley Fund, $5.95 from the Fire Protec- tion Fund, and $3,059.49 from the Lighting Fund and ordering payment made to the City of Rochester Public Utilities, which was read. Upon motion by Hanson, second by Anderson that the resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resc lution duly passed and adopted. Mayor Paul Grassle read several communications from various towns statin their experiences after parking meters had been installed, and on motion by Williams, second by Anderson, a public hearing concerning parking meters was set for 7:30 o1clock P.M., on June 9th, 1941. On motion by Bowers, second by Williams, the City Attorney was instructed Marys to begin the proceedings to restrain Stio/Hospital from using city sewers for dis- posal of waste from the new addition and to employ legal help if he finds it necessary. Alderman Boviers introduced a resolution appropriating $251.10 from the General Fund and ordering payment made to Guy Barnes for installing the police radio and maintenance thereon and maintenance of the stop and go signals, which was read. Upon motion by Bowers, second by Yaeger that the resolution be adopted and as read,/all voting in.favor thereof, except Aldermen Williams and Anderson, who voted "No", o /President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resol#tion ordering bids for the constructio of a transmitter house on the water tower in St. Marys Park, which was read. Upon motion by Williams, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. On motion by Yaeger, second by Anderson, the City Engineer was instructed) to furnish the necessary materials for a barrier to be placed at the end of First)' Street Northeast, where it intersects Elbventh Avenue Northeast.
