OF THE CITY OF ROCHESTER, MINN., Jun e 2 n d , 1941 323 • n .• Minutes of a regular meeting of the Common Council of the City of Rochester Minnesota, held in the Council Chambers, in the City Hall, in said City.Hall, in•said City, on June 2nd, 1941. President Lemmon Called the meeting to order at 2:oo o'clock P.M., the following members being present: President Lemmon, A•ldemen Anderson, Bowers, Hanson, Mrachek, Williams, Yaeger. ,President Lemmon stated this as being the time and place set for a hearing on the construction of a curb and gutter in Twlefth Avenue Northwest, from First Street Northwest; to Second Street Northwest, and asked if any one present wished to be heard concerning this improvement. No one present wished to be heard. Reverend W.W. Bunge appeared at the Council meeting -and stated that resi— dents on the south side of First Street Southwest, for a short distance east of Eleventh Avenue Southwest, were borthered with surface water from Second Street Southwest, running down on their property, also considerable debris washed ontd i their places during heavy rain storms. He further stated that the residents in that locality thought that if a storm sewer were constructed in Second Street Southwest, it would remedy the trouble. Mrs. Mary -Craddock and Mr. Jenson also voiced a protest against the flooding of their property. Alderman Anderson said he had inspected the location but had no solution as. yet. President Lemmon referred the,matter to the Street & Alley Committe -for further study and report at the,meeting of June 9th,.if•poasible. An invitation from the Mayor of Winona, Minnesota, for all of the City Officials to attend the convention of the League of Minnesota Municipalities Convention.to be held on June 16, 17, and lSth, was read, and President Lemmon ordered that same be placed -on file. The City Engineer's•request that,$2,000.00 be appropriated from the Genera and $1,000.00 from the Sewer Fund Fund/was read, and upon motion by Mraghek, second by Williams the repor_t,t was• &adept'edand ordered.placed on file. ti The report of expenditures from the City Engineer's payroll for the month of.May, 1941, was•read „ and President Lemmon ordered that -same -be placed on.file. The report of the Clerk.of,the Municipal Court for tRe week ending May•31st 1941, showing criminal fines and costs collected.$334.30, civil fees received $7.35, and conciliation court fees, $2.00, was read, and having been previously approved by the City Attorney, President Lemmon ordered that the same be -placed on file. The reports of the Building and,Plumbing, and the Electrical Inspectors for fees received for the month of May, 1941, showing/`building permits issued $330.00, Plumbing permits $99.00, and electrical permits $33.50, were each read, and President Lemmon referred the same to the Financial Committee. 32 4 OFFICIAL PROCEEDINGS RECORD OF OF R EEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, , MINN, su n e 2 n d 1 The application of B. G. Maydu fora permit to place and maintain a sign was read. Upon motion.by Bowers, second -by Mrachek the permit was granted. The application of Bernar G. Mayou for a license_ to sell soft drinks was read. Upon.motion by Bowers, second by Hanson the license .was granted. The application of William H. Hagadorn for a plumber's license was read, and upon motion by Williams, second by Anderson -the license was granted. The application of Howard W. Michealson for a journeyman electrician's license wa.s.read, and upon motion by Bowers, second by Hanson the license was granted. , The application for. transfer of "0£f-Sale" and "On -Sale" 3.2 non-intoxicati malt liquor licenses #'s 643 and 399 respectively from Alvin -Drake ito William, P. Zrasselt was read. Upon motion by Bowers, second by Williams the transfer was granted. Mr. Peter Bross, architect, submitted a plan for a new City Warehouse to the Common Council for -their consideration. No action was taken at this time. The following claims were read, and upon motion by Williams, second by - Hanson, the same were allowed and the Mayor and City Clerk instructed to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: Drs. Power & Gore, $2.00; Weber & Judd Co., $0.49; Gus Bottke, $20.00; Peerless Chemical Co., $49.50; Henry C. Lindberg, $20.00; J.J. Schuster, $200-00; Geo. F. Strifert, $56.00; F.R. Finch, City Clerk, $74.04; J.S. Morrison, $25.00; H. A. Schende1, $25.00; J.S. Beatty, $25.00; Register of Deeds, $16.25; Chicago & Northeestern Railroad Co., $5.00; City of Rochester, Public Utilities, $32.40; Miller -Davis Co., $1.35- From the Street and Alley Fund: -Thorman W. Rosholt Co., $43.00;Parkhill Bros., $0.09; C.M. Boutelle, $42.50; From the Fire Protection Fund: C.E. Ginther, $5.00; R.C. Drips Grocer Co., $4.75; City of Rochester; Public Utilities, $43.53; Janesville Apparel Co., $44.2 From the Park Improvement Fund: Rochester Bottling C,o., $30.00; Golf Tee Co., $27.50; Vogel Garage, $0.75; National Cash Register Co., $2.75; Northern .Water Treating Co., $6.22; American Playground Device Co.; $50.00; Barrett Co., $19.2.4; City of Rochester Public Utilities, $79.60. From the Lighting Fund: City of Rochester Public Utilities, $46.95. A communication from the Anchor Casualty Co., and an endorsement for,added coverage on a 1941 Yellow.Transit Coach -motor number AR 3171144, was read, and upon motion by Mrachek, second by'Anderson the additional coverage was accepted. A petition for the construction of a sanitary sewer on Sixth Street North- east, from the manhole on First Avenue Northeast, west to Lot 16, Block 37, North- ern Addition, was read, and President Lemmon referred same to the Sewer Committee.1 The petition of Harley J. Miller to have the zoning of his property at 627-Fourth Street Northwest, changed from Residential zoning to an Industrial area was read,. Upon motion by Williams, second by Mrachek the petition was re- ferred back to the maker for his signature. The veto by the Mayor on a resolution passed by.the Common Council, May 26th, 1941, appropriating $251.10 from the General Fund and ordering payment made to Guy Barnes for overtime claimed by him, was read, and upon motion by Bowers, second by Yaeger that the resolution be -adopted as read, and upon roll calll, Aldermen Bowers, Hanson, and Yaeger voting in favor thereof, and Aldermen Anderson Mrachek, Williams, and Lemmon voting "No", President Lemmon declared the resolu- tion.lost for lack of a 5/7 vote in favor thereof. Upon motion by Hanson, second by Yaeger, Chief. C.E. Ginther and three men were given permission to attend the Firemen's Convention -to be held in Alexandria, Minnesota, on June 9th, loth, and llth, 1941, their expenses to be paid be the City. Upon motion by Yaeger, second by Mrachek, Chief Harry N. Tompkins was authorized.to attend the Police Convention to be held at Faribault, Minnesota, Ion June 9t4, 10th, and llth, at City expense. Upon motion by Williams, second by Hanson, the.City Attorney was instructed to notify St. Marys Hospital attorneys that the Council would meet.with them at 2:00 o'clock P.M., June 9th, 1941, in connection with the proposed sewers to be Icons tructed. City Attorney, D.B. Hunt, stated that the jury had allowed damages in the sum of $250.00 uto Mrs. Dora Streahlow for injuries received from a fall on a side- walk. Upon motion by Williams, second by Bowers, he was instructed to settle with JMrs. Streahlow for -the above mentioned sum. Alderman Anderson introduced a resolution appropriating $572.95 from the (General Fund and ordering payment made to the Rochester Post Bulletin, which was Ir ead. _Upon motion by Hanson, second by -Bowers, that the said resolution be adopted as read, and all voting in favor thereof,.Pre6idnet Lemmon declared the (said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $533.50 from the (General Fund and ordering payment made to the Standard Oil Co.,which was read. Upon motion by Williams, second by Anderson that the said -resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the 2 6 RECORD OF OFFICIAL. Alderman Mrachek introduced a resolution appropriating $579.43 from the 'Permanent Improvement Revolving Fund -and ordering payment made to Martin Paulson, which was read. Upon motion by Mrachek, second by Hanson, that the said resolution be - jadopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $2,311.67 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll for last. half of May, 1941, which was read. Upon motion by Bowers, second by Hanson that.the said resolution.be adopted las read, and all voting in favor thereof, President Lemmon declared the said Iresolution duly, passed and adopted. Alderman Hanson introduced a resolution appropriating $2,000.00 from the (General Fund and $1,000.00 from the Sewer Fund and ordering payment made to the IStre.et and Alley Fund for use of,the Street & Alley Committee, which was read. Upon motion by Hanson, -second by Williams that.the said resolution be 14dopted as read, and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adopted. Alderman Yaeger introduced a resolution adopting plans, ordering bids, and second hearing on the construction of curb and gutter in Twelfth Avenue Northwest, jfrom First Street Northwest, to Second Street Northwest, which was read. Upon motion by Bowers, second by Hanson, that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adopted. Alderman Anderson introduced a resolution ordering a hearing on.the {widening of Fifth Street Southwest, from First Avenue Southwest, to Second Avenue lSouthwest, which was read. Upon motion by Bowers, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers reported that he had investigated the possibility of con- structing a watermain on Fourteenth Street Northwest, and stated that it would be impossible at this time to construct the watermain until the property abutting on lFourteenth Street had been plated, and the City Clerk was instructed to notify the 1petitioners of this affect. Alderman Anderson, Chairman of the Street and Alley Committee, stated that lit would be necessary to remove certain trees on North Broadway Street where it is snow being widened. Upon motion by Mrachek, second by Williams the City Engineer new was notified to replace the trees.with/ones of substantial size.,. o OFFICIAL 327 RECORD OF OF CIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., June 2, 1941 An ordinance relating to and providing for the licensing and regulation of any machine or device vending soft drinks or confections, the operation of which depends upon the insertion of a coin, was given its third and final reading. Upon motion by Williams, second by Bowers the ordinance.was adopted as read An ordinance providing for the licensing and regulation of car4,board, box,''. table, stand, cabinet, or similar device used -in games or amusement where a charge is made for the use thereof and subscribing penalty for violation thereof, was given its second reading. The matter of constructing a sidewalk on the west side of Eighth Avenue Southeast between the creek and Fourth Street Southeast was brought up, and a motion was made by Williams second by Bowers that no action be taken at -this time on the construction of the above mentioned sidewalk. Upon motion by Williams, second by Yaeger the Common Council adjourned. City Clerk
