RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON, COUNCIL
OF THE CITY OF ROCHESTER, MINN., June 16 th , 1941
-Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota, held in the Council Chambers in the -City Hall, in said
City, on June 16th, 1941.
President Lemmon called the meeting -to order at 7:30 o'clock P.M., the
following members being present:. President•Lemmon,•Aldermen Anderson,Bowers,,
Hanson, Mrachek, Williams, Yaeger. Absent: None.
Upon motion by Hanson, second by Mrachek, the minutes of -the adjourned
regular meeting of Junel-lth, 1941, were approved.
The appointment by the President -of the Common Council of Leo. C. Anderson.
ID.L. Williams, and Glenn L. Bowers as members of the Board of Equalization was
(read, and same was ordered placed on file.
The report of the Police Committee, recommending to the Common Council

that four addition policemen be employed on the'Department was read; and upon
motion by -Bowers, -second by Hanson the report was approved.
A motion was made by Bowers, second by Mrachek that the Police Civi�SPrYr�P
Commission be notified to select four patrolmen from the eligible list.
The report of the Police Committee, recommending -to the Common Council
that one automobile, with ambulance equipment be purchased for use of the Police
-Department was read9
Upon motion by Bowers, second by Hanson the report was accepted and the
-City Clerk was instructed to advertise for one automobile,for use of the Police
(D9partment, equipped with stretcher, and the cost not to exceed $1,200.00 F.O.B.
(Roches=ter, Minnesota. The bids will be received July 7th,1941.
The resignation of Edmund L. -Schweppe as Justice of the Peace of the First
Ward of -the City of Rochester, Minnesota, was read, and upon motion by Mrachek,
second by Williams, the same was accepted and ordered placed on file.
The petition of Mrs. Marie Stortz to change the property known as Lot 3 in
Block Z, Irelands Addition from -residential zoning to coigmercial zoning and a
(statement of acquiescence from property owners within-1001 of said property were
leadh read, and upon motion by Mrachek, second by Bowers the petition was referred
Ito the Board of Zoning.
The City Engineer's plans, specifications, and estimate of cost for the
widening of Fifth Street Southwest, from First Avenue Southwest, to Second Avenue
Southwest,was read, and President Lemmon ordered that same be placed on file.
The City Engineer's Trial Balance for the month of May, 1041,- w�-:s read,
land President Lemmo'n ordered that same be placed on file.
The report of the Clerk of the. Municipal Court for the week ending June
I14th,1941, showing criminal fines and costs collected $375.55, civil fees received
I$3.00, and conciliation court fees $4.00, was read, and having been previously

lapproved'by•the City Attorney, President Lemmon ordered that the same be placed -I
on •file.
The application of Lillian Neumann and Traverse W. Schinke for transfer'of
3.2 "Off" and "On" Sale non -intoxicating malt liquor licenses numbered 699 and
1369 respectively, -was read.
Upon motion by Bowers, second by Hanson the same was referred .to'the
(License Committee for a report on June 23rd, ig4i,
The contract bond of Harry T.-Ea.rle in the sum of $565.50'with *the Western
(Surety Company of Sioux Falls, South Dakota, as surety, was read.
Upon motion by Mrachek, second by Hanson the said bond was approved, the
Isurety'thereon acoepted and it was ordered that the same be placed on file.
A communication from Alois F.-Aufenthie notifying the City of Rochester
of the terms of the -deed for Fifty Feet of -the South 259.66, of the North z and
the South-2- of Lot 13, .Auditor's Plat "Al', given to the City of 'Rochester for the
purpose of -constructing a street was now cancelled due to the fact that the pro-
prosed street had not been graded and oiled by June 1st, according•to the* terms
of the deed-, which stated -that the land -would revert to Alois F.' Aufenthie and
Bernice L.' Aufenthie, after that date, was read.
President Lemraon referred the matter to the Street & Alley Committee, the
City Bngineer, and the City Attorney.
The following claims- were read, and upon motion by Willi•ams,• •second by
1,Mrachek the same were al -lowed- and the Mayor and City Clerk instructed to draw

Upon motion by Williams, second by Hanson the City Clerk was instructed to

Alderman Anderson.introduced a resolution ordering a hearing on the widening
Iof Fourth Street Southwest, from Ninth Avenue Southwest., to Tenth Avenue South-
1west, which was read.
Upon motion by Hanson, second by Bowers.that the said resolution be adopted
Las read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and. adopted.
Alderman Anderson introduced a resolution designating additional avenues,
(streets, and alleys,to be flushed and/or oiled during 1941 season, which was read.

Up Upon motion by Bowers, second by Hanson that the said resolution be adopter
as read; and all voting in favor thereof, President Lemmon declared the said reso-
lution duly passed and adopted.
Alderman -Bowers introduced a resolution appropriating $524.48 from the
General Fund and ordering Payment made to L. L. Coryell & Son, which was .read.
Upon motion by Hans"on, second by Mrachek that the said resolution be adopte
las read, and all voting in favor thereof, President Lemmon declared the said reso-
Ilution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $1092.74 from the
General Fund and $10.38 from the Street & Alley Fund and ordering payment made to
the Standard Oil Company, which was -read.
Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting -in favor thereof, President Lemm-on declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $207.50 from -•.the -
General Fund and ordering payment made to the Chicago Great Western Ry Co.,which
I eras' read.
Upon motion by Mrachek, second,by Yaeger -that the said resolution be
ladopted as read, and all.voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution ordering plans,. specifications,
land estimate of cost for the widening of Fifth Street Southwest, from First
IAvnue Southwest, to Second Avenue Southwest, which was read.
Upon motion by Bowers, second by.Hanson that the said resolution be adopted
las read, and all voting in.favor thereof, President Lemmon-declared the said -
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution adopting plans and ordering bids
lfor the widening.of Fifth Street Southwest from First Avenue Southwest, to Second
Avenue Southwest, which was read.
Upon motion by.Williams,-second by Hanson that the said resolution be y
ladopted as read, and all voting in favor thereof, President Lemmon declared the -
lsaid resolution duly passed and adopted.. _
An -ordinance regulating the Police Department of -the City of Rochester,,
Minnesota, was given its first read.
Upon motion by Williams, second by Yaeger, and all voting in favor thereof,
lthe rules were suspended and the said ordinance given its second reading.
Upon motion by Bowers,, second by Mrachek, and all voting in favor thereof,
lthe rules were suspended and the said ordinance given its third and final reading.
Upon moti.on by Williams, second by Hanson that the said ordinance be adopte

as read., and upon roll call all voting in favor thereof, President Lemmon declared
the said ordinance duly passed and.adopte.d. ,
The proposed contract between the Academy of -Our Lady of Lourdes and the
City of Rochester, Minnesota, was considered by the Common Council. After dis-
cussing the various offers as set forth.i-n the proposed contract it was determined
that the proposalfor the construction of a sanitary sewer was acceptable, and it
was agreeable to the Council that the Academy pay fifty per cent of the cost of
the construction of the storm sewer. It was further proposed that all sewage from
�St. Marys Hospital be metered through a meter to be installed in the Twelfth Avenu
sewer --line, the meter and installation of same to be paid for - by the Academy -of
O.ur Lady of Lourdes. It was proposed that St. Marys Hospital be billed with a
minimum charge of $100.00 per month f,or sewage treatment, plus any amount over
and above the minimum charge,to be determined by the metering of sewage from the
Hospital. The rate of the charge for sewage treatment is to be based on the cost
of the operation of the Sewage Disposal Plant at Rochester, Minnesota, for the
fiscal year, prior to that in which the billings are made.
A motion was made by.Bowers, second by Hanson, and carried, that a•minimum
charge be made to St. Marys Hospital for sewage treatment of $100.00 per month,
plus any additional amount as determined by the metering of sewage, and that St.
Marys Hospital pay the sum of $200.00 per month for Fire Protection,: -Police Pro-
tection, and certain other municipal. services, and that all prvious billings for
sewage treatment be cancelled, provided the Academy of Our Lady of Lourdes relin-
quish any claimed interest in the Sewage-Dis-co.sal Plant.
Upon motion by Williams, seconded by Hanson, the meeting was adjourned
antil 7:30 P.M., June 23rd, 1941.
