President Lemmon called the meeting to order at 7:30 o1clock P..M., the ollowing members being present: President Lemmon, Alderman Anderson, Bowers, anson, Mrachek, Williams, Yaeger. Absent: None. Upon motion by Mrachek, second by Hanson the minutes of the adjourned egular meeting of June 16th,1941, were approved. President Lemmon stated this as being the.time and place set -for the hearin, n the construction o-f a curb and gutter on Twelfth Avenue, Northwest, from First treet, Northwest, to Second Street, Northwest, and asked if anyone present wishedl to be heard concerning this improvement. No one present wished to be heard. President Lemmon stated this as being the time and place set for the hearin, • on the widening of Fourth Street Southwest; from Ninth Avenue Southwest, to Tenth Avenue Southwest, and asked if anyone present wished to be -heard concerning this mprovement. Miss Emily Willson and Judge Bunn T. Willson apposed the widening of the street. Dr. H.H. Bowing stated that he owned one hundred feet abutting on Fourth Street Southwest, and while he was not apposed to the widening of the street he asked that the Council do the work with as little expense to the property owner ,s possible. President Lemmon stated this as being the time and place set for the heari n the widening of Fourth Street Southwest, from Second Avenue Southwest, to Ninth !Avenue Southwest, and.asked if anyo#e present wished to be heard concerning this. !improvement. Dr. H.L. Williams, Mr. Ed. Cappell, Dr. and Mrs. B.T. Horton, Mrs. J.A. Bargen, and Mrs. Madge B. Knowlton appeared before the Council and apposed the widening of Fourth Street Southwest,,at this time. Mr. Clarence Thompson and A.M. Bach urged that the street b.e widened. Mr. Horace C. Doty, appeared before the Council in behalf of his father, George B. Doty, and asked that the Council experiment by making a"one way"street of Fourth Street Southwest from First Avenue Southwest, to Tenth Avenue Southwest. Dr. J.A. Bargen proposed that a, trial be made o.f parking on one side of the street. Chief of Police, H.N. Tompkins stated that it would not be practical to make Fourth Street a "one way" street unless • (lanother street was made "one tray" for return of traffic. Mayor Grassl.e stated that he was in favor of widening Fourth Street, and felt that a forty foot street would be adaquate to take are of the traffic on the said street. President Lemmon stated this as being the time and place set for the hearin; :)n the petition for vacation of the alleys in Block 23, Head & YlcMahon's Addition to the City of Rochester, After discussing the matter, a motion was made by Hanson, sec--nd by Bowers, that the hearing be adjourned, and continued until 2:00o'clock P.14., on July 7th, 1941. President Lemmon stated this as being the time and place set for the re- ceiving and opening of bids for the construction of curb and gutter on Twelfth Avenue, Northwest, from First Street, Northwest, to Second Street, Northwest. The following bid was received and opened at this time: H.T. Earle $552.00. President Lemmon referred the above bid to the Street & Alley Committee and the City Engineer for tabulation and recommendation. President Lemmon stated this as being the time and place set -for the re- ceiving,and opening of bids for the ptrchasing of one, three ton truck for use' iij the Street and Alley Department. The following bids were received and opened at this time: Stolp & Bowers & Company $2354.60, Ellis Motor Company $2740.00, International Harvester Company $2510.15, and Poster and Eggers $2999.62. President Lemmon referred the above bids to the Street & Alley Committee and the City Engineer for tabulation and recommendation. The report of the Street & Alley Committee and the City Engineer that the contract for the construction of curb and gutter on Twelfth Avenue, Northwest, e awarded to H.T. Earle, was read. The report of the Street & Alley Committee and the City Engineer that the ontract for the purchasing one three ton truck be awarded to the Ellis Motor Company, was read. The Mayor's apppintments of Paul F. Schmidt and George Schmelzer as special policemen at the Public Schools and Playgrounds, and in the Public Parks, respec= unless sooncrremoved tively, they to serve without pay until the second Monday in A-_oril,1942,/were read and President Lemmon ordered that same be placed on file. A report of the State Highway Department in regard to the parking condition in the City of Rochester was presented by J.E.P. Darrell, Executive Traffic Engine of Minnesota State Highway Department, ind also a report prepared by the Traffic Committee of the Rochester Chamber of Commerce was presented by L.K. Edstrand. Both of these reports indicated that off- -urb parking is necessary in the City of Rochester. Mr. W.F. A motion was made by Williams, second by Hanson that the -communication from) the Rochester Chamber of Commerce be accepted and placed on -file, and that the City. Clerk write a letter of appreciation to the Chamber for their cooperation in trying•to.solve the parking problems in the business districts of the City. A protest against the widening of Fourth Street, Southwest, in addition to the one -oreviously presented was read, and -President Lemmon ordered that same be )laced on file. The recommeddation of the Sewer Committee and the City Engineer recommendin€ that a sanitary se-er be constructed in Elev:nth Avenue, Northeast, from Tenth Street to Fourteenth Street, Northeast, was read, and President Lemmon ordered that same be placed on file. The recommendation of the Board of Zoning that the petition of Mrs. Marie >tortz be denied, was read, and upon motion by Anderson, second by Hanson, the fiction of the Board of Zoning was approved. The recommendation of the Board of Zoning that the petition of Harley J. Biller be not granted, was read, and upon motion by Williams, second by Hanson she action of the Board of Zoning was approved. The report of the Clerk of the Municipal Court for the week ending June ?lst,1941, showing criminal fines and costs collected $571.80, civil fees received' 07.50, and conciliation court fees $2.50-, was read,a-nd having been previously ipproved by the City Attorney, President Lemmon ordered that the same be placed )n_ f ile. The applications df M.E. Johnson, L.L. Egleston, and Ben Zimdars for a Tourneyman Electrician's License, were each read, and upon motion by Bowers, seconA oy Mrachek the licenses were granted. The a-Nplication of Befriel Brothers for permit to place and maintain a sign ,ias read, and upon motion by Williams, second by Anderson the permit was granted. The application of William P. Krasselt for a license to sell soft drinks vas read, and upon motion by Mrachek, second by Bowers the license was granted. The application of Wm. C. Fraser & Son for a license to connect ?-pith sewers 7•nd drains was read, and upon motion_ by Hanson, second by Bowers the license was ;ranted. The application of Robert A. Peck for a, driver's license was read, and upon) notion by Mrachek, second by Williams the license was granted. The applications of the Town Taxi for transfer of licenses #19 and 20, were aach read, and upon motion by Williams, second by Hanson the transfers were granted The license bond of Wm. C. Fraser & Son in the sum of $1,000.00 with the Vec•. A certificate from the Hartford Accident and Indemnity Company certifying that a policy for Public Liability, No. OLT 48901 has been issued to the United States Fireworks Company, covering fireworks exibitions in the State of Minnesota, was read, and upon motion by Mrachek, second by Hanson, the coverage was approved and ordered placed on file. The report of the License Committee and the Chief of Police that the tras- er of "on -sale" and "off -sale" 3.2 non -intoxicating; malt liquor licenses #is 369 and698, respectively, from Traverse Schinke to Lillian Neumann be granted, was read. Upon motion by Mrachek, second by Hanson the recommendation was approved. Mr. James Coon, representing the Central Labof Union, requested that Ordinance 4415 be amended to include the following rates: "Boilermaker Foreman- $1.75 per hourp Boilermaker-$1.50 per hour; Boilermaker helper-$1.37 ; Iron Workers Foreman-$1.75 per hour; and Iron worker-$1'.50- per hour.." Upon motion by Bowers, second by Anderson the City Attorney was instructed to prepare an amendment to Ordinance -"415. Mr. Raymond Smith -presented a proposed plat of certain property on the nort] side of Fourteenth Street, Northwest, which had been approved -by the Public Utilit; Board-,& fipon motion.by Williams, second by Hanson the same was referred to the Street & Alley Committee and City Engineer for a report. A petition that the City of Rochester remove from its present location the Iso-dalled "City Dump", was read. President Lemmon referred the same to the Public ounds Committee. Alderman Anderson introduced a resolution accepting the bid of Harry T. arle for the construction of curb and gutter on Twelfth Avenue Northwest, from which irst Street Northwest, to Second Street Northwest,/was read. Upon.motion by Williams, second -by Yaeger that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the aid resolution duly passed and adopted. Alderman Yaeger introduced a resolution accepting the bid of the Ellis otor Company for the purchase of one, three ton truck for use of th-e Street and lley Department, which was.read. Alderman Bowers introduced a resolution adopting plans, specifications, and estimate of cost, ordering hearing and setting date for receiving bids, for widening Fourth Street, Southwest, from Ninth Avenue, Southwest, to Tenth Avenue, Southwest, which was read. Upon motion by Hanson, second by Williams that the said_ resolution be adopt, as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed a.nd adopted. . Alderman Bowers introduced a resolution ordering plans, specifications, and -estimate of cost for the construction o.f a sanitary sewer in Sixth Street,. North- east, in front of the west 42.5' of Lots 13 and 14 and Lots 15 and 16 in Block 31 Northern Addition, which was read. Upon motion by Bowers, second by Mrachek that the said resolution be adoptec as read, and all voting in favor thexeof, President Lemmon declared the said reso. lution duly passed and adopted. Alderman Hanson introduced a resolution adopting plans, specifications, and estimate of cost of constructing a sanitary sewer in .Sixth Street, Northeast, in front of the west. 42..51 of Lots 13 and 14 and Lots 15 and 16 in Block 31, Northern Addition, which was -read. Upon motion by Hanson, second by Yaeger that the said resolution be ado-ot-ed as read, and all voting in favor thereof, President Lemmon declared the said•reso lution duly passed and adopted. Alderman Anderson introduced a resolution ordering bids for the widening of Fourth Street, Southwest, from Second Avenue Southwest, to Tenth Avenue, Southwest which was read. Upon motion by Yaeger, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating535.30 from the General Fund and ordering payment made to the Standard Oil Company, which was reac Upan motion by Mrachek, second by Williams that the.said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resol-dtion duly passed and adopted. Alderman Williams introduced a resolution appropriating $580.11 from the Permanent Improvement Revolving Fund and $51.66 from the Street and Alley Fund arrd ordering payment ma�de to H.T. Earle, which was read. Upon motion by Williams, second by Hanson that the said resolution be SO I adopted as read, and all voting in favor thereof, President Lemmon declared the RECORD OF OFFICIAL, PROCEEDINGS OF THE COMMON COUNCIL, OF THE CITY OF ROCHESTER, MINN., June 23, 1941 aid resolution duly passed and adopted.. Alderman Williams introduced a resolution appropriating $2572.99 from the ark Improvement Fund and ordering payment. made to the Mayo Trust Fund for the ayroll for first half of June, 1941, which was read. Upon motion by Hanson, second by Bowers that the said resolution be adopte s read, and all voting in favor thereof, President Lemmon declared the said reso- ution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $526.31 from the treet and Alley Fund and ordering payment made to the General Fund, Code 28 for 877 gallons of gasoline used, which was read. Upon motion by Bowers, second by Hanson that the said resolution be ado -ate s read, and all voting in favor thereof, President Lemmon declared the said r.eso- cation duly passed ar_d_adopted. Upon motion by Mrachek, second by Williams, Kenneth Rohde was appointed .as eco_rd clerk in,the Police Department for a period not -to exceed three months, and e to be paid at th,e rate_ of $75.00 per month. Mayor Grassle presented the resignation of Dr.-T.B. Magath from the Board f Public Health and Welfare, and upon motion by Mrachek, second by Hanson the esignation was accepted. Mayor Grassle then announced the appointment of Dr.. J.S. Lundy to frill the aca.ncy in the Board of Public Health and Welfare caused by the resignationf-of. T.B. Magath. Upon motion by Anderson, second by Williams the appointment of r. J.S. Lundy was approved. Upon motion by Mrachek, second by Williams,.Raleigh Zuehlke of 1209 Fourth venue, Southeast was appointed Justice of the Pease of the First W?.rd to fill the nexpired term of Edmond Schweppe. Alderman Anderson suggested that the City Engineer make a preliminary chec' "and estimate of the expense of constructing a bridge from Mayo, Park across the iZumbro River to Third Avenue Southeast,, The Chamber of Commerce made the fo-llowing recommendations for improving the general traffic conditions: "To extend Sixth Street, Southea9.t, from Third Avenue Southeast, to Broadway, with new bridge across the River and supervised Railroad grade crossing. Install "stop and go" light at Broadway, and to make Fourth Avenue West a "Thru Stop Street" frorii Soldier's Field to Fourteenth Street, Northwest, with a bridge across Cascade Creek near Fourteenth Street, Northwest. Install "stop and go" lights at Fourth Avenue and Second Street, Southwest." Alderman Bowers recommended that a surface drainage sewer be constructed ir. Eleventh Avenue, Northeast from Ninth Street, Northeast, to Tenth Street, North- east. President Lemmon referred same to Sewer Committee and City Engineer. Upon motion by Williams, second by Bowers, the meeting was adjourned until 2:00 o'clock P.M., on July 7th,1941. City Clerk
