OF THE COMMON COUNCIL OF THE CITY OF .ROCHESTER, MINN., Sent. 2. 1941 401 • . • Minutes of a regular meeting of the Common Council of the City of Roch- ester, Minnesota, held in the Council Chambers, in the.City Hall, in said City on September 2, 1941. President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: President Lemmon,.Aldermen Anderson, Bowers, Hanson, IvIrachek, Williams and Yaeger. -Absent: none. Upon motion by Mrachek, second by Hanson the minutes of the adjourned regular meetings of August loth and August 25th, 1941 were approved. President Lemmon stated this as being the time and place set -for recei ing and opening bids for furnishing sand, gravel and crushed rock for the use of the City of Rochester, Minnesota, for the balance of the present fiscal year. Th bids of Leitzen Concrete Products in the sum of $1472.25, for• Pi't-Run, Gravel and Washed Sand; Halvorson Bros., and Quarry Products Co. in the sum of $2109.90 for Pit -Run Gravel, Washed Sand and Crushed Rock; and Morse Bros. in the sum of $1992!$5 for Pit -Run Gravel, Washed Sand and Crushed Rock, were received and opened. Presi- dent Lemmon referred the same to the Street and Alley Committee and City Engineer for tabulation and recommendation. The recommendationsof the Street and Alley Committee and the City Engin" eer that the bids of Morse Bros. in the sum of $1356.60 for Washed Sand and Pit -Run Gravel, and Halvorson Bros. and Quarry Products Co. in the sum of $I+06.25 for II Crushed Rock, be accented, were read and upon motion by Mrachek, second by Yaeger the said Committee recommendations were anproved. Upon motion by Anderson, second by Williams the City Clerk was instruct( to return the certified check of the Leitzen Concrete Products Company. A communication regarding the sidewalk on the South side of Sixth Stree- Southwest between -Fourteenth and Fifteenth Avenues Southwest -was read, and upon motion by Hanson, second by Bowers, the matter was referred back to the Street a Alley Committee and the City Engineer for further investigation and report. A communication from K. J. Hoffman, Commissioner of Highways of the State of Minnesota, notifying the City that such streets as were temporarily used as a detour for Highway No. 63, in the -City of Rochester, were released by Order INo. 14162, was read and President Lemmon ordered that same be placed on file. A communication from the Christy Obrecht Show requesting a reduction in the fee for a license to show one week in Rochester was read, and upon motion by Williams, second by Mrachek the City Clerk was instructed to notify the Christy • 11 Obrecht Company of the fees as required for a Class C Show by City Ordinance #349, A commu.nicatio.n and copies of letters written by the Firemen's Civil Service Commission, were read and same were ordered placed on file. A Citation of non-payment of Personal Property Tax on personal property at the City Hog Farm was read and same was referred to the City Attorney. d 402 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON.COUNCIL OF THE CITY OF ROCHESTER, MINN., Sept. 2, 1941 A petition for a watermain in Third Avenue Northwest from the Kepp Cor- i I {ner about 500 feet North of the Asbury Corner, to serviceouar.t of Outlots 5 and 6, llNorthern Addition was read, and same was referred to the Water Cbmmittee. A summons in the case of Lula Brogan vs the City of Rochester and also i the complaint of Lula Brogan was read and the same was referred to the City Attornfey. The report of the Clerk of the Municipal Court for the ,reek_ ending Aug- ust 30, 1941, showing criminal fines and costs collected $350.25, civil fees re- ceived $12.20,-and conciliation court fees $3.00 was read, and having been prev- iously approved by the City Attorney, President Lemmon ordered that same be place Ion file. The report of the Building and Plumbing Inspector for the month of Aug- ust, 1941, showing fees for building permits issued $234.00, and fees for plumb - ling permits issued $67.00, s.nd the report of the Electrical Inspector for the mon I -of August, 1941, shouring fees for electrical permits issued $19.25, were each read and President Lemmon referred the same to the Finance Committee'. The applications of the Sam Hanson Oil Company for permits to Place and Maintain two signs were read, and upon motion by Bowers, second by Hanson the per-1 Imits were granted. The application for' transfer of 'Off Sal'en Liquor License No. 11 from Chris Ma.rge'llos and Don Emerson to Chris Margellos was 'read, and upon motion by IMrachek, second by Yaeger the transfer was' granted. The applications of Russell Regan, Leo Gifford, Harold Reiter and Leo J.1 Struiff for drivers licenses were read, and upon motion by Hanson, second by Ander; son the licenses were granted. The official bond of Frank Springer in the sum of $74 00.00 with the Mar land Casualty Co. as surety and the Contract bonds of H. T. Earle in the sum of $2260.00 and $6194.00 with the Western Surety Co. as surety, were read, and upon motion -by Williams, second by Hanson the said bonds were approved, the surety thereon accepted and it was ordered that the same be placed on file. A combination automobile policy issued by the Anchor Casualty Co. to the ochester Bus Line, Inc. -and the City of Rochester, Minnesota was read, and upon notion. by Mrachek, second by Bowers, the policy was accepted and ordered placed or. File. The following claims were read, and upon motion by Williams, second by aeger, the same were allowed and the Mayor and City Clerk instructed to draw arrants upon the City Treasurer and make payments accordingly: From the General Fund: Woodhouse Bros., $55.00; Schmidt Printing Co., $4.25; Leonard -Myrow, $0.25; Henry Lindberg, $13.00; Joseph J. Alderman Anderson introduced a resolution appropriating $539•81 from thi General Fund and ordering payment made to the Standard Oil Company for one Tank Car Road Oil, which was read. Upon motion by Hanson, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $2560.77 from ;e, F 9 404 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., Se-pt. 2. 1941 the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for the Payroll for the last half of August, 1941, which was read. Upon motion by Mrachek, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the Isaid resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $9619.15 from the Sewer Fund and ordering payment made to Wm. C. Fraser &: Son for the construction a Storm Sewer in Thirteenth Avenue Northwest and Southwest and in Second Street Southwest, which was read. Upon motion by Bowers, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $2000.00 from the General Fund and ordering payment made to the Park Improvement Fund for monthly transfer, which was read. Upon motion by Mrachek, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said r.esolution duly passed and adopted. Alderman Bowers introduced a resolution accepting the bid of Morse Bros., for furnishing sand and gravel for use of the City of Rochester in the sum of $1356.6o, which was read. Upon motion by Hanson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $3009.96 from the Policemen's Relief Fund and ordering payment made to Theo. H. Tollefson, Trea: of the Policemen's Relief Association for transfer of funds received from tax settlement, which was read. Upon motion by Yaeger, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $1446.61 from the Firemen's Relief Fund and ordering payment made to Frank Springer, Treasurer of the Firemen's Relief Association for transfer of funds received from tax settlE ment, which was read. Upon motion by Williams, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced"a resolution appropriating $9219.92 from z the Permanent Improvement Revolving Fund and ordering payment made to H. T. Earlel RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., s ezp t - 2, 1941 405 for widening Fourth Street Southwest from Second Avenue to Tenth Avenue Southwest, which was read. - Upon motion by Botnrers, second by Mrachek that the said resolution be adopted as read, and all voting in -favor thereof-, President Lemmon-declared the said resolution 'duly passed and adopted: Alderman Mrachek introduced a resolution levying special assessments foz (curb and gutter in Twelfth Avenue -Northwest from First Street Northwest to Second Street Northwest, which was read. - - - Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the - said resolution duly passed and adopted. - .Alderman Mrachek introduced a resolution levying special -assessments f03 (curb and gutter in Twelfth Avenue Northwest and Southwest from Second Street South- west•to First Street Northwest, which was read. Upon motion by Williams, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. - Alderman Mrachek introduced a resolution appropriating $2544.90 from the Lighting Fund, $294.46 from the General -Fund, $2.00 from -the Street & Alley Fund and $15.75 from the Fire Protection Fund and orderiing payment made to City of Rochester, Public Utilities, for electricity and water used, which was read-. Upon motion by Hanson, second by Anderso*n that the said resolution be adopted as read, and -all voting in favor -thereof, President Lemmon declared the said resolution duly passed and adopted. Alderm•an-Hanson introduced a resolution appropriating $200.00 from the Park•Improvement Fund and ordering payment made to Don Devlin for one Pop Corn machine to be used in the Auditorium building, which was read. Upon motion by Mrachek, second by Yaeger that the.said resolution be adopted as read, and all voting in favor thereof, P-resid$et Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating $574- 39 from the - Park Improvement Fund and $143.10 from the Lighting Fund and ordering -payment made to City of -Rochester, Public Utilities,for light and water used, which was -read. Upon motion by Bowers, second by Anderson that the said resolution be jadopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating $263.39 from the Park Improvement -Fund and ordering payment made to The Vilter Mfg. Co., which was I read. Upon motion by Mrachek, second by Hanson that the said reso'lution be 406 - RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., Sept . 2, 19.E+1 4 adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution accepting the bid of Halvor- son Bros. and Quarry Products Co., for the furnishing of crushed rock for use of the City of Rochester in the sum of $406.25, which was read. Upon motion by Mrachek, second by Bowers that the said resolution be adoptedes read, and all voting in favor thereof, President Lemmon declared the said'resolution duly passed and adopted. Alderman Bowers stated that there were various types cf signs which were obstructing the sidewalks and boulevards, and the Chief of Police was -in- structed to notify the owners of the said.signs to make application for a sign permit. Alderman Bowers, Chairman of the Public Grounds Committee, made a ver- bal report recommending that a well and pump be installed at the residence of thel Dog Catcher. Upon motion by Williams, second by Hanson the recommendation was approvl and the Public Grounds _Committee was instructed to have the above mentioned well and.pump installed. Alderman Hanson, Chairman of the Water Commit.tee, reported on the in- stallation of two drinking fountains on Second Street Southwest in the vicinity of St. Mary's Hospital. He stated that the cost would be $59.00 and $65.00 plus the expense of installing same. A.motion was made by Williams, second by Mrachek that one fountain be installed on the north side of Second Street Southwest between Eleventh and Twelf Avenues Southwest, and that the Water Committee have power to act. Alderman Williams stated that it had been brought to his attention that) various rubbish fires were causing a smoke nuisance in the residential part of the City, which was contrary to City ordinance. The City Clerk was. instructed to notify the Fire Chief of same. The matter of installing street lights at the corners of Sixteenth Avenue Southwest on Second and Third.Streets Southwest was brought up by Alder- man Yaeger, Chairman of the Lighting Committee, and he was instructed to notify the Public Utility Board to install the above mentioned street lights. Union motion by Williams, second by Hanson the Street and Alley Committee and the Assistant City Engineer were instructed to employ extra help during the absence of the City Engineer if such were found necessary. Chief of Police, H.N.Tompkins, stated that Mr. Kenneth Rohde who had been employed in his office as a clerk during the summer months, was now leaving to attend school, and he requested permission to employ another young man to -fill the vacancy. 16d lb _ RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., Sent. 2, 1941 40 Upon motion by Hanson, second by Williams, the matter was referred to the Police Committee with power to act, all voting in favor thereof except Alder- man Bowers who voted 1IN011. The proposal of the Charles L. Pillsbury Co. to furnish preliminary plans, specifications and estimate of cost for remodeling of the present Sewage Disposal Plant was read, and upon motion by Mrachek, second by Williams, the Mayo) and City Clerk were authorized to sign the agreement as presented. The City Attorney stated that Mr. James Spillane, representing Gertrude Toomey in the matter of an assessment for a Sanitary Sewer, had requested that the City of Rochester cancel the said assessment. Upon motion by Bowers, second'by Mrachek, the City Attorney was in- structed to notify Mr. Spillane that the assessment will stand as originally assessed. was Upon motion by Hanson, second by Yaeger the meeting/adjourned until September 8, 1941 at 7:30 o1clock P.M.
