PROCEEDINGS OF .TIDE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., o c to b er 13- 1941 Minutes of an adjourned regular meeting of the Common `Council of the City of Rochester, Minnesota, hel-ii in the Council Chambers,` in the City Hall, in said City on October 13, 1041 ' President Lemmon called the meeting to order at 7:30 o'clock P.M., the (following member's being present: President Lemmon, Aldermen Anderson, Borers, Ha son-, Mrachek, Williams and Yaeger. Absent: -none. Upon motion by Anderson, second by Bowers, the' minutes of the meeting of October 6th, 1941, were approved. President Lemmon stated this' as' being the time and place set for a hear- ing. on the extension of 32 Street Southeast over and upon the North 50- feet' of` th South 269.66 feet of Lot 13, Auditor's Plat -"A°, i n the City of Ro che's ter. No on present wished to be heard. The recommendation of the Board of Zoning that the petition 'of Alvin W; Hein and Edwina PR. Hein requesting permission to construct a 12' by 141 addition to their combined residence and store building be granted and that no change be made in the zoning of Lot 1, Block 1, Johnson's Sub -division was read, and upon motion by Mrachek, second by Ranson the recommendation was approved. A communication f-rom the, Rochester and Olmsted County Public Safety Council recommending to the Common Council that a traffic aivi.sion be s'et up with. in the Police Department with one man in charge and responsible to the Chief of Police was read, and upon motion by Williams-, second by Mrachek the matter was referred to the Police Civil Commission for their recommendation. The Mayor's appointment of Max Graham as a special policeman for duty at the Armory in the City of Rochester,` he to serve without pay until the second Monday in April 1942, unless sooner removed, was read and upon motion by Anderson) second by Williams, the Mayor's appointment was approved. A petition for a sidewalk to be constructed on the South side of Eleven Street Southeast from 92 Avenue Southeast to Ninth Avenue Southeast and on the East side of Ninth Avenue Southeast from Eleventh Street Southeast to Tenth Stree Southeast where the sidwalk has not already been constructed, was read, and the matter was referred to the Street & Alley Committee and tree . City Engineer. A copy of a resolution passed by the Public Utility Board requesting approval by the Common Council of a contract between the City of Rochester and the People's Cooperative Power Association of Olmsted County, was read and ordere -placed on file. The recommendation of the Sewer Committee,and the City Engineer that a Sanitary Sewer and watermain be constructed in Fifteenth Avenue Southeast from 32 Street Southeast to Second Street Southeast was read, and upon motion by Mrach second by Williams the recommendation was approved. n U • • RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF. ROCHESTER, MINN., October 13, 19 41- 429 A.report of the Finance Committee was read recommending that .a loan be made to 11. L., Norgaarden by the Firemen's_Relief Association, not to Pxceed $3000.00 for the purchase and repairs of a residence located at 321-Seventh Street North- west. The report of the Clerk of'theMunicipal Court for the.week ending October 11, 1941, showing criminal fines and costs collected $194.00,.civil foes received, $2.55, and conciliation court fees received $5.50, was read, and having been previously approved by the City Attorney, President Lemmon Qrdered that same be placed on file. A petition signed by 136 residents of the City of Rochester, requesting that the Common Council grant the ap_�lications of William Riege for "Off" and "On" Sale License to sell non -intoxicating malt beverages, was read and President Lemmon ordered that same be placed on file. The applications of. T.. J., Daly and the_ Hankee Heating Company for Plumber's License were read, and upon motion by Bowers, second by Williams the Licenses were granted. The application of the.Mills Automatic Merchandise Corporation for a license to operate three vending machines_operated by a coin less than five cents in denomination was read, and upon motion by Hanson, second by Bowers the license was granted. The applications of William Riege for 3.2 beer "Off".and "On" Sale Licenses were read and a motion was made by Bowers that the licenses be granted. President Lemmon declared the motion lost for want of a second. Upon motion by Williams, second,by Yaeger that the licenses for 3.2 beer j "Off" and "On" Sale applications by William Riege be not granted, was carried by all voting in favor thereof except Alderman Bowers who voted "No". 3 The following claims were read,,and upon motion by Williams, second by t Yaeger, the same were allowed and the Mayor and City Clerk instructed to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: R. Alderman Anderson introduced a resolution appropriating $1165.15 from the General Fund�and ordering payment ma.de to the Street and Alley Fund for use of equipment during September 1941, which was read. Upon motion by Bowers, second by Anderson that the said resolution be j adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers- introduced a resolution appropriating $769.25 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund for us.e of equipment during September, 1941, which was read. Upon motion by Bowers, secon'by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the. said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $622.97 from the Street and Alley Fund and ordering payment made to the Permanent Improvement Re- volving Fund for city's hhare-of cost for widening Fifth Street Southwest from Fir.st to Second Avenue .Southwest, which was read. • Upon motion by Williams, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the Isa.id resolution duly passed and adopted. Alderman Yaeger introduced a resolution a.prropriating $2307.67 from the I Permanent Improvement Revolving Fund and ordering payment made to H. T. Earle for curb and gutter in Ninth Street and Eighth Avenue Southwest, -which was read. - Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the r ' said resolution duly passed and adopted. Alderman Yaeger introduced a, resolution ap-propriating $334.79 from the Sewer Fund and ordering payment made to the Street and Alley Fund for stock used r during September, 1941, which was' read. Alderman Williams introduced a resolution ordering a hearing on the r levying of special assessments for sprinkling, flushing and/or oiling of streets =said hearing to be at 7:30 o1clockP.M. October 20, 19411, in the City of Rochester for the season of 1941; which was read. Upon motion by Williams, second by Mrachek that the said resolution be • adopted as read, and all voting in favor thereof, President Lemmon declared the said -resolution duly passed and adopted. - Alderman Williams introduced a resolution ordering a hearing on the levying of special assessments for a sanitary sewer and watermain in Seventh Avenue Northwest from Tenth Street 'to Fourteenth Street Northwest, and in Fourteenth Stre1et Northwest from Seventh Avenue Northwest to 250 feet ,rest of Ninth Avenue Nor thwes I�, said hearing to be held at 7: 30 0' clock P.M. Alderman Williams introduced a resolution ordering a hearing on the levying of special assessments for a sanitary sewer in Sixth Street Northeast, in front of the West 42.5 feet of Lots 13 and 14 and Lots 15 and 16 in Block 31, Northern Addition, said hearing to be held at 7:30 o'clock P.M. on October 27th, 1941,. which was read. Upon motion by Bowers, second by Hanson that, the said resolution be Iadopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , Alderman Mrachek introduced a resolution ordering a hearing on the levy• ing of special assessments for the widening of Fifth Street Southwest from First Avenue Southwest to Second Avenue Southwest, said hearing to be held at 7:30 o'clock P;M. October 27th, 1941, which was read. Upon motion by Hanson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Resolutions levying special assessments for s-prinkling and �or flushing, and/or oiling during the season of 1941, were introduced, duly adopted and orderer placed on file, and made a part hereof, reference to which is hereby made for Amore particulars. Alderman Mrachek introduced a resolution ordering a hearing on the con- struction of a Sanitary Sewer in Fifteenth Avenue Southeast from 321 Street South- east to Second Street Southeast, said hearing to be held at 7:30 o'clock P.M. (October 20, 1941, which was read. Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution ordering bids for 500 feet of fire hose to be received and opened at a meeting to be held at 7:30 o'clock P.M. jOctober 27, 1941, which was read. Upon motion by Hanson, second by Yaeger that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon declared the Isaid resolution duly passed and adopted. Alderman Manson introduced a resolution ordering bids for a 1000 gallon (Pumper and Hose Car to be received and opened at a meeting to be held at 2:00 o' clock P.M. November 3, 1941 , which was read. Upon motion by Mrachek, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., October 13, 1941 433 0 • • a 11 Alderman Yaeger introduced a resolution ordering/hearing on the construe- tion of a watermain in Third Avenue Northwest, from the North line of Outlot 2, (Northern Addition to a point,approximately 94 feet North of the South line of Out lot 5, Northern Addition to the City of Rochester, a distance of approximately 750 feet, said hearing to be held at 7:30 o'clock P.M. October 20, 1941, which wa: read. " Unon motion by Hanson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemr-non declared the (said resolution duly passed and adopted. Upon motion by Williams, second by Hanson the City Engineer and City Clerk were instructed to omit from the sprinkling resolutions such descri-otions as did not receive service during the 1941 sprinkling season. An Ordinance providing for and regulating the collection of garbage in (the City of Rochester, Minnesota, the disposal thereof, and providing for assess- ments against property benefited thereby, was given its first reading. The matter of resurfacing paving on certain streets which are in need o such repairs at the present time, before the Roxanda Mines, Inc. moves its plant Ifrom the City of Rochester, was discussed and same was referred to the Council as la committee of the whole and the City Engineer, to determine which streets should be resurfaced at this time. Upon motion by Yaeger, second by Williams the Council went on record as favoring the issuing of an emergency order by the Mayor for such resurfacing work as was deemed necessary at this time. Mr. Norman E. Schmidt, Mr. I. E.Rosa, Superintendent of Schools, app earec at the Council meeting and made recommendations as to traffic regulations on cer- tain streets for the protection of children going to and from school. The matter was referred to the Police Committee, Chief of Police and Norman Schmidt, Member of the Board of Education. The matter of filling the vacancy in the Electrical Inspector's Office Iwas brought up and a motion was made by Alderman Williams that Mr. William Kimmel (be appointed Electrical Inspector. This motion was declared out of order as ' jMr. Kimmel has not established a residence in the City of Rochester. A motion was made by Bowers, second by Hanson that Mr. Alton Rittenhouse The appointed Electrical Inspector for the balance of the fiscal year. Aldermen • II Bowers, Anderson and Hanson voted "Yes", Aldermen Mrachek, Williams, Yaeger and President Lemmon voted "No".
