President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon. Aldermen Anderson, Bowers, Hansan, Williams and Yaeger. Absent:•Alderran Mrachek. Upon motion by Hanson, second by Bowers the minutes of the meeting of October 13th, 1941 were approved.' President Lemmon stated this as being the time and place set for a hear- ing on the levying of special assessments for.,the cost and expense of sprinkling, flushing and oiling streets for the season of 1941, No one present wished to be heard.. President Lemmon stated this a•s being the time and place set for a hearif ing on the construction of a sewer and watermain in Fifteenth Avenue Southeast from Second Street Sout,ieast to 32 Stree,t Southeast. No one present wished to be heard. President Lemmon stated this as being the time and place set for a hear- ing on the construction of a watermain in Third Avenue Northwest, from the north line of Outlot 2, Northern Addition, to a point approximately 94 feet north of the south line of Outlot 5, Northern Addition'to the City of Rochester, Minnesota. No on.e--oresent wished to be heard. The City Engineer reported that the City did not have cast iron pipe oni hand for these projects and same could not be purchased in•tirie to lay the mains this year, George C. Mr./Henke appeared before the Council to protest the licensing of mach- ines used for vending soft drinks and confections, President Lemmon ,informed Mr. Henke that the matter had already been referred to the City Attorney for fur- ther study and suggested that the owners of machines appoint a Committee to study the matter with the City Attorney. Mr.. Carl Tynes appeared at the Council meeting and complained that the sidewalk constructed in front of his property a.t 901 Sixth Avenue Southwest, was too low, and President Lemmon referred the matter to the Street and -Alley Committe land Alderman Hanson. Mr. A. H. Clemens appeared before the Council and -requested that the Common Council make a refundment for the cost •of a certain part of the sewer con- Istructed in front of property belonging .to Mr. Toomey. The matter was referred to (Ithe Sewer Committee, the City Engineer, the City Attorney and the C-ity Clerk. A communication from the Rochester Chamber of Commerce suggesting to the IlCommon Council that they advertise for. bids for the erection of Christmas street 4 3-6 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., October 20, 1941 7 IlLighting was read, and the matter was referred to the Lighting Committee- with the Ilrecommendation that they look into the condition of the equipment used last year llbefore requesting bids for this year's Christmas Street Lighting. A notice of injury to Mark Blanchard which occured on October 16, 1941 (while painting areaway grates a.t the City Hall building was read, and the same 11was referred to the Public Grounds Committee. A notice of claim against the City of Rochester, Minnesota in the a.moun of $5,000..00, signed by Stuart Hargesheimer, for injury to Richard Miles on Sept- ember 15, 1941, was read and same was referred to the Public Utility Board and the City Attorney. A letter from Alton Rittenhouse stating that lie would not be interested (lin accepting the office as Electrical Inspector for less than $200.00 a, month was I read, a.nd same was ordered placed on file. The Mayor's emergency order for the purchase of one 9000 gallon car loa (of gasoline given to the City ,Clerk was read, and upon motion by Bowers, second b ,Hanson the Mayor's action in issuing the emergency order was approved. _ An acknowledgement of receipt of the agreement for sewage facilities fox the State of Minnesota Highway Department Buildings at. Rochester, Minnesota was read, and President Lemmon ordered that same be -placed on file. A copy of a resolution passed.by the Commissioners of the Sinking'Fund appropriating $7263.51 for the purchase of seven Anoka Councy, Minnesota 2% S.D. #2 School Building Bonds was -read, and upon motion by Anderson, second.by Yaeger the action was approved. The City Engineer's estimate of cost of construction• of a sani-tary sewer and watermain in Fifteenth Avenue Southeast from Second Street Southeast to 312 (Street Southeast was read, and upon motion by Yaeger, second by Anderson construct lion of same was deferred until such time as cast iron pipe would be available. _ A notice of hearing on the petition of the executrix of the will of Burt W. Eaton, deceased, for the appointment of .an administrator in the estate of (George Healy, deceased, was read and same was ordered placed.on file._ A petition for the construction of a curb and gutter on the north side lof Seventh Street Southwest from Fifth Avenue Southwest to Sixth Avenue So:athwest' was read, and upon motion by Williams, second by Hanson the construction of same was deferred until Text spring. The application of Paul T, Pla.ntz for the office of Electrical Inspec- for was read, and upon motio.n by Anderson, second by Williams same was ordered placed on file. A petition to grade and fill Fifteenth Avenue Northeast between Fourth , (land Fifth Streets Northeast was read, and President Lemmon referred same to the 43'7 RECORD OF OFFICIAL PROCEEDINGS .OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., October 20, 1941 a r • Street and Alley Committee and the City Engineer and requested that a drain be installed for.the purpose of draining the surface water temporarily, if possible, until more permanent improvement could be made. The report'of the Clerk of the Municipal Court for the week ending Oct- ober 19, 1941 showing criminal fines and costs collected $413.60, civil fees re- ceived $14.95, and conciliation court fees $5.25, was read, and having been prev- iously approved by the City Attorney, President Lemmon ordered that same be placed on file. Alderman Anderson introduced a resolution appropriating $497.79 from th Street and Alley Fund and ordering payment made to H. T. Earle for .construction of (sidewalks, which was' read. Upon motion by Williams, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $2064.07 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for'payrol7 for the first half of October, 1941, which was read. Upon motion By Hanson, second -by 1�illiams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $2413.94 from the Permanent Improvement "Revolving 'Fund 'and ordering payment made to Wm. *0.' Fraser & Son for laying watermain in Tenth and Eleventh Avenue Southeast, which was read. -Upon motion by Anderson, second by Bowers that the said resolution be adopted as read, and all• voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $974.33 from the Permanent Improvement Revolving Fund and ordering payment made to Roxanda Mines, Inc for -resurfacing Third Street Southwest from Third to Sixth Avenue Southwest, which was react. Upon motion by Williams, s'ecorid by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said reso-lutio'n duly passed and adopted. Alderman Williams introduced -a resolution appro-priating $708.94 from the Permanent Improverent Revolving Fund and 'ordering payment made to Roxanda Mines, Inc. for resurfacing Second Avenue Southwest from Fourth to Sixth Street Southwest which was read. Upon motion 'by Hanson, second by Bowers that the said resolution be adopted as'read, and all voting in favor thereof, President' Lemmon declared the said resolution duly passed -and adopted Alderman Williams int'rod'uced a resolution appropriating $4399.75 from the Permanent Improvement Revolving Fund and ordering payment made to Roxanda Ming1s, Inc. for resurfacing Fourth Street Southwest from First to Tenth Avenue Southwest, which was read. Upon motion by Bowers, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the RECORD OF OFFICIAL' PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF, ROCHESTER, MINN., October 20, 1941 said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $2975.70 from th Permanent Improvement Revolving Fund and orderingpayment made to Roxanda Mines, Inc. for resurfacing of Eleventh Avenue Southwest from Center to Second Street Southwest, which was read. Upon motion by Anderson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed.and adopted. Alderman Bowers introduced a resolution appropriating $204- 57 from the Sewer Fund and $5.50 from the Lighting Fund and ordering payment made to City of Rochester, Public Utilities for electricity and Crater used, which was read. Upon motion by Yaeger, second by Williams that the said -resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. ' Alderman Bowers introduced a resolution confirming the sprinkling, flusk ing and oiling assessments for the season of the year 1941,'which was read. Upon motion by Hanson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution ordering a hearing on the levy- ing of special assessments for widening Second Avenue Southwest from Fourth Street to Sixth Street Southwest, said hearing to be held at 2i00 O'clock P.M. November 1941, which was read. Upon motion by Anderson, second by Yaeger that the said resolution be adopted as read; and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. klderman Hanson introduced a resolution ordering a hearing on the levy- ing of special assessments for widening Fourth Street South�,iest from Second Avenue Southwest to Tenth Avenue Southwest, said hearing to be held at'2:00 o'clock P.M. November 3, 1941, which was read. Upon motion by Hanson, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President'Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution ordering a hearing on the levy- ing of special assessments for widening First Street Southwest from Seventh Avenue Southwest to Eleventh Avenue Southwest and Eleventh Avenue Southwest from Center Street West to Second Street Southwest, said hearing -to be held at 2:00 o'clock P.M. November 3, which was read. Upon motion by Anderson, second by Williams that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the 2' Js j. Alderman Ranson introduced a resolution ordering a hearing on the levy- ing of special assessments for the widening of Third Street Southwest from Third Avenue Southwest to Sixth Avenue Southwest, said hearing to be held at 2:00 o'cloc P.M. November 3, 1941, which was read. Upon motion by Manson, second by Bowers,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Ranson introduced a resolution authorizing the Public Utility Board to enter into contract with the People's Co-operative Power Association of Olmsted County, which was read. Upon motion by Williams, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted, Mayor Grassle stated that there would be a meeting of the American Municipal Association of Mayorsand Councilmen held in Chicago, Illinois on the 23rd, 24th and 25th of October, 1941, and recommended that representatives be sent (from the City of Rochester. A motion was made by Williams, second by Anderson that the Mayor and (President of the Common Council be authorized to attend the said meeting at the lexpense of' the City. Upon motion by Anderson, second by Bowers the City Clerk was instructed Ito notify the County Board that the City is ready to proceed with their share of Ithe drainage work on Fourteenth Street Northeast as previously planned. Alderman Bowers presented a communication from the Northrop Parent - Teacher's Association requesting that crossings be marked at Seventh, Eighth, Ninth and Tenth Streets on North Broadway, that one-way traffic be designated jaround Cascade Park, that there be no trucks allowed on the West side of the Park, that crossing provisions be made on Fourth Avenue Northwest, Seventh Street North- west and Second Avenue Northwest, and that "Slow" or "School" signs be provided laround the School. President Lemmon referred the matter to the Police Committee and the I Chief of Police. Upon motion by Williams, second by Anderson the meeting was adjourned until 7: 30 o'clock P.M.
