RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY OF ROCHESTER, MINN.,_ December 9, 1941
Minutes of an adjourned regular meeting of the Common Council of the
!City of Rochester, Minnesota, held in the Council -Chambers -in the City Hall, in
isal d City on December S, 1941.
President Lemmon called the meeting to order at 7:30 o'clock,P.M., the
Ifollowing-members being present: President -Lemmon, Aldermen Anderson, Hanson,
IMrachek, Williams and Yaeger. Absent: Alderman -Bowers, due to illness.
Upon -motion by Williams, second by Yaeger, the minutes of the meeting
of December 1, 1941, were approved. -
President-Lemmon stated this as being the time and place set for a hear -
ling on the grading of Fifteenth Avenue Northeast from Fourth Street Vo-Fifth Street
+Northeast. Mr. Edward Vonch and Mr. Alvin B. Mattison were each heard in regard
Ito the improvement.
Upon motion by Hanson, second by Anderson the -City Engineer was instructed
Ito grade Fifteenth Avenue Northeast from Fourth'Street to Fifth Street Northeast
Ito the proper grade.
The City Engineer's estimate of cost of the construction of a sanitary
Newer and watermain in Fifteenth Avenue Southeast from Second Street to 32 Street
(Southeast was read; and_President Leramon ordered same placed on file.
A communication from the Board of Park'Commissioners requesting that the
sum of $47.50 be appropriated from the General Fund for rental of the Mayo Civic
Auditorium Concert Theatre for a Symphony Concert on December 22, 1941, was read,
land upon motion by Mrachek, second by Anderson the above mentioned amount was
!appropriated for rental of the Theatre.
The report of the City Weighmaster for the month of November, 1941,
Ishowing 359 private loads weighed, and receipts of $35.90 was read, and President
ILemmon referred same to the Finance Committee.
The reports of the Clerk of the Municipal Court for the week ending
November 29, 1941, showing criminal fines and costs collected $563.05,-civil fees
received $7.35, and conciliation court fees $9.25, and for the week ending Decem-
ber 6, 1941, showing criminal fines and costs -collected $173.30, civil fees re-
ceived $10.75, and conciliation court fees $6.25, were each read, and having been
previously approved by the City Attorney, President Lemmon ordered that same be
!placed on file.
Thereport of expenditures from the City Engineer's Payroll for,the
(month of November, 1941, was read and ordered placed on file.
The City Engineers' Trkil Balance sheet for the month of November 1941,
was read and President Lemmon ordered that same be placed on file.
The statement of receipts and disbursements from the Park Improvement
Fund for the month of November, 1941, was read and ordered placed on file.

The ap.plicatio,n of Edward L. Haffma.n for License to .sell Cigarettes at
Iretail was read, and upon motion by Hanson, second by Anderson the License was
granted.
The application of Walter F., Hansen for a .license to operate a vending
(machine was read, and upon motion by Mrachek, second by Yaeger the license was
1granted.
The following claims were read, and upon motion by Williams,, second by
(Yaeger, the same were allowed and the MayQr and City Clerk were authorized and
Idirected to draw warrants upon the City Treasurer and make payments accordingly:

Alderman Anderson introduced a resolution appropriating $220.50 from the
General Fund and ordering payment made to the Street and Alley Fund for use of
equipment during November, 194i, which was read.
Upon motion by Williams, second by Hanson that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
- Alderman Anderson introduced a resolution appropriating $324.42 from the
IGeneral Fund•and ordering payment made to•the Commissioner of Taxation, Petroleum
IDivision-for, tax on Tank .Car of gasoline, which was read.
Upon ,motion by Hanson, second by Yaeger .that the -said nesolut,ion be
adopted as read, and all voting in favor thereof, President Lemmon declared•the
said resolution duly passed .and adopted.
Alderman Yaeger introduced a resolution appropriating $361.95 from the
(Street and Alley Fund and ordering payment made to Morse Bros., for sand and gra
jel, which was read.
Upon motion by Yaeger, second by Williams.that the said resolution be
ladopted a, read, .and all voting in favor thereof, President Lemmon declared the
(said resolution•duly,passed and adopted. .
Alderman Yaeger introduced a resolution appropriating $491.75 from the
(Street and Alley Fund and ordering payment made to the Street -and Alley Fund for
Luse of equipment during November, 1941, which was read.
Upon motion by Hanson, second by Mrachek that the said resolution•be
adopted as read, and.all voting in favor thereof, President Lemmon declared the

Alderman Williams introduced a -resolution appropriating $302.60 from the
Park Improvement Fund and.ordering payment made to the Rochester Plumbing and
(Heating Co.,.,for parts and supplies purchased, which was read.
Upon motion by Mrachek, second -by Anderson that the•said resolution be
adopted as -rea:d, and all voting in favor thereof, President Lemmon declared the
said resolution,duly, passed and adopted.•
Alderman Williams introduced a resolution appropriating $191-7.89 from
the Park Improvement.Fund and ordering payment made to the Mayo• Trust Fund for
pay -roll for las,t half of November, 1941, which was read.

adopted as react, and all voting in favor thereof, President Lemmon declared the
.said resolution duly passed and adopted:

Alderman Mrachek introduced -a resolution appropriating $251.10 from the
Park Improvement Fund and ordering payment made to the City of Rochester, Public
Utilities for steam.heat.for Auditorium, which was read.
Upon motion by Yaeger, second by Anderson that the said resolution be
adopted as read, 'and all voting in favor thereof, President Lemmon declared the.
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $297.17.from the
Park Improvement Fund and ordering payment made to Simon Stensrud for share of ne
income on F.E.Williams Estate Building, which was read.
Upon motion by Mrachek, second by Hanson -that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $331.20 from the
Park Improvement Fund and $122.85-from the Lighting Fund and ordering payment.made
to the City -of Rochester; Public Utilities, for light -and water used, which was re

Alderman Hanson introduced a resolution granting Public Dance Permit to
Ithe Southern Minnesota Broadcasting Co, which was read.
Upon motion by Mrachek, second, by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the -
said resolution duly passed and adopted.
-Alderman Anderson introduced a resolution ordering plans, specification:
land estimate -of cost for the construction of a sanitary sewer and watermain in
(Fifteenth Avenue Southeast from Second Street to 3� Street -Southeast, which was

Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution -duly passed and adopted. -
Alderman Anderson introduced a resolution adopting plans, specificatio
(land estimate of cost for the construction of a sanitary sewer m d watermain in
Fifteenth Avenue Southeast from Second Street to 32 Street Southeast, ordering a
hearing to be held at 7:30 o'clock P.M. December 19, 1941, and ordering advertis
went for bids -to be received and opened at 7:30 o'clock P.M. -December 1.9,, 1941,

adopted as read, and all voting -in favor thereof, President-Lemmon declared the

Alderman Anderson reported on the request of the Park Board for per-
mission to erect signs on First Street Southwest and Second Street Southwest, ad-
vertising the various activities at the Mayo Civic Auditorium, and upon motion b5
Mrachek, second by Hanson the matter -was left in the hands of the Street and All(
Committee with power to act.
Alderman Mrachek stated -that a portion of the roof at the Sewage Dis-
posal Plant was badly in need of insulation for the purpose of conserving heat
in the Plant, and upon motion by Williams, second by Yaeger the matter of insul-
ating the above mentioned roof was referred to the Sewer Committee.
A complaint by I.J.Renning against the -Oasis Beer Parlor stating that
liquor was being mixed with soft.drinks in the said establishment,and was being
drunk by minors, was read,and also a verbal complaint that liquor was being sold
by Morey's Bar & Cafe after closing hours was made to the Common Council by Chief
H. N. Tompkins.
Upon motion by Williams, second by Hanson the City Clerk was instructed
!to notify M.P.Maloney, proprietor of the Oasis Beer Parlor, and Morey Kitzman,
proprietor of Morey's Bar & Cafe, to appear before the Common Council at their
next adjourned meeting to be held on December 19, 1941 at 7:30 o'clock P.M., and
show cause why their licenses should not be revoked.
Upon motion by Williams,_ second by Mrachek the meeting was adjourned
until 7:30 o'clock P.M. December 19, 1941.
