OF THE CITY OF ROCHESTER, MINN., December 19, 1941
Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota,.held in the Council Chambers in the City Hall in sai
City on December 19, 1941.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
fo]lowing members being present: President Lemmon. Aldermen Anderson, Bowers,
Hanson, Mrachek, Williams and Yaeger. Absent: none.
Upon motion by -Hanson, second by Bowers the minutes of the meeting of
ecember S, 1941 were approved.
President Lemmon stated this -as being the time and place set for a hear-
ing on.the.construction of a watermain in Eighth Avenue Northwest from Tenth Stree
to -.Eleventh Street Northwest. There was no one present wishing to b:e heard.
Preed dent Lemmon stated this as being the time and place set for a hear-1
ing on the construction of a sanitary sewer and wat.ermaLn in Fifteenth Avenue
Southeast from Second Street to 32 Street Southeast. There was no one present
ishing to be heard.
President Lemmon`,stated this as being the time and place set for receiv-
ing and opening bids for the construction of a watermain in Eighth Avenue Northwest
rom Tenth Street to Eleventh Street Northwest. The bids of Martin Paulson in the
Alm of $733.65 and Wm C. Fraser & Son in the sum of $944.00 were received and
pened. President Lemmon referred the same to the Water Committee and the City
gineer for tabulation and recommendation.
President Lemmon stated this,as being the time and place set for•receiv-)

Upon motion by Williams, second by Anderson, the recommendations of the
ater and Sewer Committees and the Assistant City Engineer that the contracts for
,he construction of a watermain in Eighth Avenue Northwest from Tenth to Eleventh
street Northwest, and for the construction of a sanitary sewer and watermain in
ifteenth Avenue Southeast from Second to 32 Street Southeast be awaxded to Martin
aulson, were accepted.
Upon motion.by Williams, second by Anderson, the City Clerk was instruct'
o return the checks of the unsuccessful bidder.
Upon motion by Mrachek, second by Yaeger, the matter of hearing M.P.
aloney and Morey Katzman in regard t'o alleged violations in operating their place

A communication from the -League of Minnesota Municipalities regarding
he distribution of orders issued by the Office of Production.Management and an

Upon motion by Mrachek, second by Bowers, the Mayoris emergency order

A communication from Mr. and.Mrs. Paul Rubow protesting the- constructions

A letter from the.Seagrave Corporation requesting that a defense rating

he matter was left in .the hands of the Mayor and the Chief of the Fire Department
. Upon motion by Mrachek, second by..Williams, the Mayors appointment of
r. Martin Kulsrud as a special policeman for duty at the.Hol-mes School was approvjed.
A certificate of issuance of Workmen's Compensation and Public Liabilit
nsurance. policies No. C. 6729370 and No. 239742 to the Foster Electric Company

A summons notifying the- City_ of Rochester and Fred R. Finch to answer
the complaint.of S.P.Nelson, Loretta Nelson and Martha Drewelow was read, and upor
notion by Williams, second by Yaeger .the same was referred to the City Attorney.
A.summons notifying the City of Rochester, Minnesota -to -answer to the
complaint of the Rochester.Dairy Company was read, and upon motion by Mrachek, ,
second by Bowers the.same was.referred to the City Attorney.
A notice of hearing on the filing of a petition for the admissiontto
probate the last Will and Testament and three codicils of George Healy, deceased,
as read and upon motion by Williams, second by Mrachek, same was referred to the
City Attorney.
Upon motion by Mrachek, second by Hanson, the following -copies of reso-
utions passed and adopted by the Commissioners of the Sinking Fund were approved:
ppropriating $3111.95 from the Sinking Fund and ordering payment made to the
Interest Fund to make.same available for payment of January 1, 1942 interest on
City of Rochester Light and Water Bonds; appropriating $19.,000.00 from the Sinking
Fund, Code 5 to Code 13 to make same available for payment of January 1, 1942

ight Bond Maturities; appropriating $19,000.00 from the Sinking Fund and ordering
ayment made to the First National Bank for maturities of $13,000.00 City of Roch-
ster Electric Light Bonds and $5,000.00 City of Rochester Water Bonds; and approp
iating $5,190.00 for the purchase of seven United States Savings Bonds, Defense

Attorney Samuel P. Allen appeared before the Council in behalf of Mr.
,oyd C. Galpin and protested the levying of assessment against Lot 92, Auditor's
lat "A", for the expense of opening 92 Street Southeast.
The report of the Clerk of the Municipal Court for the week ending
ecember 13, 1941, showing criminal fines and costs collected $369.8O, civil .fees
eceived $2.50, and conciliation court fees $3.25, was read and having been.prev-
ously approved by the City Attorney, President Lemmon ordered that same be placed
n file.
The application of Carl L. Dionysius for a Driver's License was read, an

Alderman Ydeger introduced a resolution appropriating $149.41 from the
General Fund and $522.60 from the Street and Alley Fund and ordering payment made
to the Col -'Tex Refining Company for 10,015 gallons of emulsified asphalt, which

Upon motion by Hanson, second by -Bowers that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
, ..Alderman Anderson introduced a resolution appropriating $1900.54 from t
ark Improvement Fund and ordering,payment made to the Mayo Trust Fund for payrolll,
or the first half of December, 1941, which was read.
Upon motion by Hanson, second by:,Williams that the said resolution be
opted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $223.49 from the
treet and Alley Fund and ordering payment made to Arthur A. Brown for wiring of
rehouse, which was read.
Upon motion by Yaeger, second by Mrachek that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $7535.00 from t
ermanent Improvement.Revolving Fund and ordering payment made to the First Natio
1 Bank of Rochester, Minnesota for the January 1st, 1942 maturity of City of -
ochester P.I.R. Fund Bonds and interest, which was read. .I
Upon motion by Williams, second by Yaeger that the said resolution be
dopted as read,, and all voting in favor thereof, President Lemmon.declared the
aid resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $4,950.00 from th
nterest Fund and ordering payment -made to the First National Bank of Rochester,
i4nesota for the January 1st, 1942 maturity of interest on City -of Rochester Ligh
nd Water Bonds, which was read.
. Upon motion by Bowers, second by Anderson that the said resolution -be
dopted as read, and all voting in favor thereof., President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Mrachek introduced a, resolution providing for the sale of
10,000.00 Permanent Improvement Revolving Fund Bonds, -which was read._
Upon motion by Mrachek, second by Williams that the said resolution be
dopted as read, and'all voting in favor thereof; President Lemmon declared the
aid resolution duly passed and adopted. _
Alderman Bowers introduced a resolution accepting the bid.of•Martin
aulson for the construction of a watermain in Eighth Avenue Northwest from'Tenth
treet.to Eleventh Street.Northwest, in the sum of $733.65, which was read.
Upon motion by Hanson,- second by Mrachek that. the said resolution be

Alderman Bowers introduqed a resolution accepting the.bid of Martin
aulson for the.construction of a sanitary.sewer and watermain in Fifteenth Avenu,
outheast �rom.Second Street to 32 Street Southeast, in the sum of $1437•.90,. whit]

Upon motion by Williams, second.by Yaeger that the said resolution be
dopted as read, and all voting in favor thereof, President Lemmon declared the
aid resolution duly passed and adopted.
Mr. Erwin Briese requested that the Common Council pay part of the ex-
ense of publishing a booklet of the City of Rochester, published by the Chamber
f.Commeree, and upon motion by Mrachek, second by Hanson the matter was referred
o the Purchasing Committee with power to act.
Mr..Erwin Briese, Secretary of the Chamber of Commerce, appeared before
the Council and presented a request from the State of Minnesota Department of
ilitary and Naval Affairs in regard to acquiring property for the erection of a
vehicle storage addition in the City of Rochester.,
Upon motion by Williams, second by Hanson the Mayor was,instructed to
jlook up an available location for the proposed building and also havea plat of
jsame prepared for the use.of the Department.
Alderman Anderson introduced an Ordinance entitled, "An Ordinance
Establishing Fire Limits; and Providing for all Matters, Regulating the Construc-
tion, Maintenance, Alteration, Demolition and Removal of Buildings and Other
Structures Erected or to. be Erected Within the City of Rochester, Minnesota,"
which was given its first reading.
Mr. E.V.H. Brown, Engineer from the Minnesota State Highway Department,
submitted a proposed agreement for improvements, including curb and, gutter, storm
(sewer, bituminous widening of the pavement and construction of a sidewalk, on
Twelfth Street Southeast from Third Avenue Southeast to the intersection of Elev-
tenth Avenue Southeast.
Upon motion by Williams, second by Yaeger the matter was referred to the
Street and Alley Committee and the City Clerk was instructed to notify the,owners
)f abutting property that the proposed street improvement would again be taken up
at the meeting of January 5, 1942.
Upon motion by Williams, second �y Anderson, the City Clerk was in -
strutted to dispose of all obsolete metal badges, dog tags and license number
lates.
Upon motion by Williams, second by Bqwers the City Clerk was instructed
to prepare a resolution transferring the balance in the Permanent Improvement
d for the construction of a new warehouse, to the Sinking Fund for investment

by the Sinking Fund Commissioners.
Upon motion by Williams, second by Anderson the meeting was adjourned.
