HomeMy WebLinkAbout01-05-1942486 RECORD OF OFFICIAL, PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., January 5, 1942 Minutes of a regular meeting of the Common Council of the City of Roch- 11' ester, Minnesota, held in the Council Chambers in the City Hall, in said City,_on January 5, 19112. President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present. President Lemmon, Aldermen Anderson, Bowers, Hanson, Mrachek, Williams, Yaeger. Absent: none. President 'Lemmon stated this as being the time and place set for receiv- ing and opening bids for'the purchase of $10,000.60 City of Rochester, Minnesota, Permanent Improvement Revolving Fund Bonds. The bids of Kalman & Company in the sum of $10,077.50,, and the Sinking'Fund Commission i,n the sum of $10,123.00 were received and opened. President Lemmon referred the same to the Finance Committee. The matter of the proposed improvements to be made by the Minnesota State Highway Department on Twelfth Street Southeast from Third Avenue Southeast to Eleventh Avenue Southeast, a part of the expense of which is to be paid by the City of Rochester, was discussed with seventeen owners of property abutting on the said street. The City Attorney was instructed to draft an agreement specifying the amount of`assessment to be paid by those owning property along the south side of Twelfth Street Southeast, the same to be submitted for the said property owners)!' signatures. A communication from the City Engineer requesting that the Common Counc appropriate $5000.00 from the Street and Alley Fund for use of the Street and All Committee and $1600.0.0 from the Sewer Fund for use of'the Sewer Committee was rea and President Lemmon ordered that same be placed on file. A communication from the People's Natural Gas Company of Omaha, Nebraska filing schedule of new Gas rates and notifying the City of Rochester that it was their desire to withdraw their proposal of August 27, 1940, agreeing to the in- corporation of certain terms and conditions in a new franchise covering the sale of natural gas in the City of Rochester was read, and President Lemmon ordered that same be placed on file. The reports of the Public Examiner on the financial affairs of the City of Rochester and the Rochester Fire Department Relief Association, were presented to the Common Council, and President Lemmon ordered same placed on file. A communication from the Olmsted County Bank and Trust Company request- ing permission to withdraw all of the securities now pledged with the City Treas er and offering to replace same,with $35,000.00 United States Treasury Bonds was read, and upon motion by Williams, second by Mrachek the matter was referred to the City Attorney, City Clerk and City Treasurer with power to act. r. RECORD OF- OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., January 5, 1942 4S7 A copy of a resolution passed by the Sinking Fund Commission purchasing six United States Savings -Bonds, Defense -Series F (issue price $7,400.00 each) and seven United States Savings Bonds, Defense Series F (issue price $740.00 each) for Sinking Fund investments was read, and President Lemmon ordered that same be place on file: -The recommendation of the Water Committee that the construction of a watermain in Third Avenue Northwest be abandoned because of priorities and alloca- tion of material, as the material on hand has to be retained for emergency cases, was read, and upon motion by Bowers, second by Mrachek the recommendation was anvroved. - The reports of the Clerk of the Municipal -Court for the week ending December 20, 1941, showing criminal fines and costs collected $507.00, civil fees received $10.6.0, and conciliation court fees- $5.75, for the week ending December 27, 1941, showing criminal fines and costs collected $265.60, civil fees received $2.70, and conciliation court fees $1.50, and for the week ending January 3, 1942; showing criminal fines and costs collected $277.40, civil fees received $1.60, and conciliation court fees $5.25, were each read, and having been previously approved by the City Attorney, -President Lemmon ordered that same be placed on file. The report of the Building, Plumbing and Electrical Inspector for the month of December, 1941, showing fees for building permits issued $31.00, fees for plumbing permits issued $21.25, and fees for electrical permits issued $9.25, were each read and President Lemmon referred the same to the Finance Committee. The applications for license to sell cigarettes at retail of H.J.Wer- necke, Joe Angelici, Alvin W. Hein, Red Owl Store, C. R. Brown, Tuttle House, Claudets Standard Service, A.F. Spiess, Sr., and Lester Anderson were each read and upon motion by Hanson, second by Bowers the -licenses were granted. The applications for license to sell Soft Drinks of John Sageotis and St. Mary'-s Haspital were each read and upon motion by Mrachek, second by Williams the licenses were•granted. The official bond of Frank Springer in the sum of $1970.00 with the Maryland Casualty Co. as surety and the contract bonds of Martin Paulson in the sum of $733.65 and $1437.90 with the Fidelity & Casualty Company of New York as surety were each read and upon motion by Mrachek, second by Anderson, the bonds were approved, the surety thereon accepted and it was ordered that same be placed n file. Alderman Anderson introduced a resolution appropriating $2,000.00 from the General Fund and ordering payment made -to the Park Improvement Fund for monthl transfer, which was read. Alderman Anderson introduced a resolution appropriating $932.33 from the General Fund and ordering payment made to the Public Health & Welfare Fund for transfer of garbage assessment, which was read. Alderman Yaeger introduced a resolution appropriating $6,471.01 from thell- eneral Fund and ordering payment made to the Public Health & Welfare -Fund for transfer of tax levy, which was read. Upon motion by Hanson, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $0.20 from the General Fund, $44.14 from the Street and Alley Fund and $190.95 from the Sewer nd and.ordering payment made to Dodge Lumber & Fuel Company for purchases made in December, 1941, which was read. Upon motion by Mrachek, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $750.99 from the General Fund, Code 18, and ordering payment made to the General Fund, -Code. 31, fox Liability insurance at the -Mayo Civic Auditorium, which was read. Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $327.32.from the F General Fund and ordering payment made to the Commissioner of Taxation, Petroleum Division for tax and inspection fee on Tank Car.RPX 146, which was read. Upon motion by Williams, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof; President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $219.60 from the General Fund and ordering payment made to City of'Rochester, Public Utilities for isteam heat for City Hall, _ which was read. Upon motion by Hanson, second by Bowers that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the !said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $911.03 from the (General Fund and ordering payment made to the'Shell Oil Company for Tank Car of Igasolirie, which was read. Upon motion by Williams, second by'Arderson that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon declared the isaid resolution duly passed and adopted. 490 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., January 5., 1942 Alderman Bowers introduced a resolution appropriating $75.47 from the General Fund, $3.,24 from the Street & Alley Fund, and $4025.19 from the Lighting Fund and ordering payment made to City of Rochester, Public Utility Dept., which was read. Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $475.50 from the Street and Alley Fund and ordering payment made to Lyon Gas Appliance Co., for t unit heaters installed,.which was read. Upon motion by Williams, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $1850.51 from the Park Improvement Fund and ordering; payment made to the Mayo Trust Fund for payroll for last half of December, 1941, which was read. Upon motion by Bowers, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $695.00 from the ark Improvement Fund and ordering payment made to Rochester Plumbing and Heating Co., for plumbing at Silver Lake Shelter House, which was read. Upon motion by Mrachek, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $1006.96 from the Firemen's Relief Fund and ordering payment made to Frank Springer, Treasurer, for transfer of fund, which was read. Upon motion by Anderson, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating $2121.94 from tl Policemen's Relief Fund and ordering payment made to Theo. H. Tollefson, Treasurei for transfer of fund, which was read. Upon motion by Mrachek, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution granting Public Dance Permit to the Southern Minnesota. Broadcasting Company, which was read. Alderman Hanson introduced a resolution appropriating $5000.00 from the Street and Alley Fund and $1000.00 from the Sewer Fund for use of the Street and Alley Committee and the Sewer Committee respectively, which was read. Upon motion by Bowers, second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating $19,341.99 from th Permanent Improvement Fund and ordering payment made to the Sinking Fund, to make Warehouse funds available for investment, which was read. Upon motion by Williams, second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution accepting the bid of the City of Rochester,. Minnesota for the purchase of $10,000.00 Permanent Improvement Revolving Fund Bonds, which was read. Upon motion by Mrachek, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. An Ordinance entitled, "An Ordinance Establishing Fire Limits, And Pro- viding For All Matters, Regulating The Construction, Maintenance, Alteration, Demolition And Removal Of Buildings And Other Structures Erected Or To Be Erected Within The City Of Rochester, Minnesota," was given its second reading. The appropriation of $400.00 to the Chamber of Commerce for the printi f Rochester Booklets was held up pending a ruling by the City Attorney as to hether or not such an appropriation can be made by the Common Council, and also that no request be made that the Chamber of Commerce readvertize for the printing of said booklets until the Attorney's ruling has been received. Upon motion by Bowers, second by Hanson, Mr. Paul Plantz was appointed Electrical Inspector for the balance of the fiscal year, the appointment to be effective when Mr. Plantz qualifies for the position, and to receive the same salary as was previously paid the Electrical Inspector. The Fire Committee reported that they had discussed the matter of in- stalling underground wires,for the Fire Alarm System with the Public Utility Depa3 nerit and the Public Utility Board had agreed to have their construction department ooperate with the Fire Department when extensions are made to the present Fire larm System. The Public Utility'Department requested that a blueprint of the 4 9: RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., January 5, 1942 present underground Alarm System be provided for their information, and the City Clerk was requested to notify the' Chief of the Fire Department to have such a blueprint prepared. It was further recommended that the Superintendent of the Fire Alarm System continue to have charge of the maintenance of the said alarm system.
