President Lemmon called the meeting to order at 7:30 o'clock P.M. the following members being present: President Lemmon, Aldermen Anderson, Bowers, i Hanson,, Mrachek, Williams,. and Yaeger._ Absent: none. Upon motion by Mrachek, second by Bowers, the minutes of the meeting of. l February 2, 1942 were, approved. President Lemmon stated this as being the time and place set f-or a hear• ling on the levying of special assessments. for the construction of a watermain in +Eighth Avenue Northwest from Tenth Street to Eleventh Street Northwest. There l wa.s no one present .wishing to be heard. President Lemmon.stat_ed this as being the time and place set for re- ced ving.and opening bids for the Burnishing of Road Oil for the 1942 season, and th.at ine, bid had been received, for tar. • Upon motion by Williams,.. second by Anderson the bid from The Barrett (Division, Allied Chemical & Dye Corporation for road tar, was opened. _ Upon motion by Williams, second by Anderson, the City Clerk was in- Ist.ructed to return the bids for Asphalt, and re -advertise for bids on road oil, lasphalt, and emulsified asphalt,, on March 2, 1942. The notice of claim of George B. Eusterman, M.D., agai.,nst the City of Rochester, for.damage to his automobile which occurred on January 30, 1942, was read, and upon motion by Anderson, second by Bowers,. the same was referred to the Public Utility Board._ The recommendation of the Street and Alley Committee and the City Engineer that the contract for the purchase of one Car of Tar be awarded to The lBarrett Division, Allied Chemical & Dye Corporation, was read, and upon motion by Bowers, second.by Hanson, the recommendation was accepted. The report of the City Weighmaster for the month of January, 1942, sho ing 297 private loads weighed, and receipts of $29.70 was read, and President Lemmon referred same to the Finance Committee. The City Engineer's Trial Balance sheet and the expenditures from the City Engineer's payroll for the month of January, 1942, were read and President Lemmon ordered that same be placed on file. The statement of receipts and expenditures from the Park Improvement Fund for the month of January, 1942, was read, and President Lemmon-ordered that same be placed on file. The report of the Clerk of the Municipal Court for the week ending February 7, 1942, showing criminal fines and costs collected,$202.80, civil fees RECORD OF OFFICIAL PROCEEDINGS OF THE .COMMON COUNCIL OF THE CITY OF, ROCHESTER, MINN., February 9, 1942 511 received $16.40, and conciliation court fees $9.50, was -read, -and having been previously approved by the City Attorney, President Lemmon ordered that same be placed on file. The applications of'Lyle Edgerton, John P. Huyber, and E. M. Raetz for Master Electrician's License, were each read, and upon motion by Mrachek, second by Ranson*the licenses were granted. The application of the H & H Electric Company for an Electrical Con- tractors License was read,`and upon motion by Bowers, second by Anderson, the license was granted. The applications of'James Hubbard and Leonard Marsh for Driver's Licens' were each read, and upon motion by Hanson, second by Yaeger, the licenses were granted. The applications of Mrs. J.M.Brand, Worrall'Hospital, and Michael P. Maloney for license to sell cigarettes at retail were each read, and upon motion `by.Anderson, second by Mrachek, the licenses were granted. ` The apj�licatioii of'Paul Plantz for a Journeyman Electrician's License was 'read, and upon motion by Bowers, second by Hanson the license was granted. The applications of Michael P. Maloney and the M. Brodie Company (three)for license to operate vending machines were each read,'and upon motion by Mrachek, second by'Bowers, the licenses were granted. The license bond of E. M. Raetz in the sum of $1000.00 with the Stand- ard'Surety Company as surety,`was road, and upon motion by Mrachek, second by Yaeger, the said bond was approved, the surety thereon accepted and it was ordered that same be placed on file. II Alderman Bowers reported that the Mayor, City Attorney and the License Committee had met and asked for. more time to consider the present Ordinance for licensing of vending machines. Alderman Anderson introduced a resolution granting four Public Dance lPermits to the Southern Minnesota Broadcasting Company, which was read. Upon motion by Mrachet, second by Williams that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $554.74 from the Street and Alley Fund and ordering payment made to the Street and Alley Fund for use of equipment during January, 1942, which was read. Upon motion by Hanson, second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $230.20 from the General Fund and ordering payment made to the Universal Motors for parts and re- p airs to police cars, which was read. 5."l RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY. OF ROCHESTER, MINN., February 9, 1942 Upon motion by Bowers, second by Mrachek that the said resolution be adopted as read, and all voting in favor.thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution levying special assessments for the cost and expense of constructing a watermain in Eighth Avenue Northwest from Tenth Street to Eleventh Street Northwest, which was read. ;Upon motion by Williams, second by Hanson that the said resolution be adopted as read, and all vo.ting in favor thereof, President L.emmon declared ,the said resolution duly. passed and adopted, and the City Clerk was instructed to. notify the Public Utility Board and the owners of property abutting on Eighth Avenue Northwest, that refunds for the covert and expense of installing the water - mains would be made on a fifty foot frontage only. Alderman Bowers introduced a-rem)lution designating the polling places for 1942, which was read. Upon motion by Mrachek, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers introduced a resolution appropriating $5230.00 from the (Fire Protection Fund and ordering payment made to City of Rochdster, Public Util- lities for hydrant rental, which was read. Upon motion by Anderson,,second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $41.65 from the Street and Alley Fund, $38.30 from the Fire Protection Fund, and $210.54 from the (Sewer Fund and ordering payment made to Dodge Lumber & Fuel Co., which was read. Upon motion by Hanson, second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed -and adopted. Alderman Mrachek introduced a resolution appropriating $597.50 from the (Fire Protection Fund and ordering payment made to the American LaFrance Foamite ICorporation-for one Kerotest Portable Cutting outfit and one 1500 watt. Alfcilite (Generator,. which was read. Upon motion by Mrachek, second by Yaeger that -the said resolution .be adopted as read, and all voting in favor thereof., President Lemmon declared the said resolution duly passed and adopted. I Upon motion by Yaeger, 'second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. An Ordinance amending an Ordinance entitled IlAn Ordinance For The Pur- pose Of Promoting Health, Safety, Order, Convenience And General Welfare By.Regu- lating The Use Of Land, The' Location, Size, Use 'And Heig1th Of Buildings, And The Arrangement Of Buildings On Lots'And The Density Of Population Within The City Of Rochester, Minnesota, All In Accordance With A Comprehensive Plan As Amended By Ordinance No. 56011, was given its first reading. Upon motion by Mrachek, second, by Williams, and all voting in favor thereof, the rules were suspended and the Ordinance was given its second reading. Mayor Grassle stated that he had received notice from Governor Stassen that a Defense Meeting would be held in St. Paul, Minnesota on February 11, 1942, and upon motion by Mrachek, second by Williams, the Mayor, President of the Coun- cil, Fire Chief and Chief of Police: were authorized to attend at City expense. Upon motion by Mrachek, second by Yaeger the meeting was adjourned until 7: 30 dl clo ck P.M. February 25, 1942. City Clerk ,
