Minutes of an adjourned regular meeting of,the Common Council of the
City of Rochester, Minne.sota, held in the Council Chambers, in the City Hall; in
said City on February 25, 1942.
President Lemmon called the meeting to order at 7:30 O'clock. P.M., the
following members being present: President Lemmon, Aldermen Anderson, Hanson,,
Alderman
Mrach.ek, Williams and Yaeger. Absent: Bowers.
Upon motion by.Hanson, second by Mrachek, the minutes..of the meeting
of February 9, 1942, were approved.
President Lemmon stated this as being the time and place set for a hear-
ing on the construction of a storm sewer, sidewalk and bituminous street widening
on Twelfth Street Southeast from Third Avenue Southeast to Eleventh Avenue South-
east. There was no one present wishing t'o be heard.
A communication from Joseph T. Langlais, Public Examiner, acknowledging
request for an audit of the financial affairs of the .City of Rochester covering
the fiscal year ending April 1, 1942, was read, and President Lemmon ordered that
same be placed on file.
The request of the Board of Park Commissioners that the sum of $59.56
be paid to the Park Improvement Fund,for the cost of opening.and operating the
North Hall.at the Mayo Civic Auditorium for five Red Cross meetings, was read.
Upon motion by Williams, second by Anderson, the said bill was grdered
paid.
A .copy of a resolution adopted by the Board of Park Commissioners petit-
ioning the Common Council to ammend the Zoning Ordinance of the City of Rochester,
to include a provision which would protect Park Property from any damage which
might result from sand pit operations, was read, and President Lemmon referred
the same to the City Attorney.
The report of the inspection made by the Minnesota Department of Health
of the plumbing system in the.new Shelter Building at Silver Lake Park was read,
and President Lemmon ordered that same be placed on file.
A report of the Minnesota Department of Health, Division of Sanitation,
covering the examination of plans on.a sewage lift station for the new Shelter
Building at Silver Lake Park, was read,.and President Lemmon ordered that,same.be
(placed on file.
A notice of claim, dated February.23, 1942, by Clifford.Huey in the,sum
of $106.11 for damage _to his automobile was read,, and President Lemmon referred
same to the City Attorney and the .Street and Alley Committee.
The•6pecifications for one heavy duty .truck equipped with a five yard
dump box, for use in the City Engineer's Department, were read and President
Lemmon ordered that same be placed on file.

Upon motion by Williams, second by Anderson, the`report of the Finance
Committee recommending -that the action of -the Rochester Fire -Department Relief
lAssociation be approved, was accepted.
• • The reports -of the Clerk of the Municipal Court for the week ending
February 14; 1942, showing criminal fines and costs collected $250.10, civil fees,
received $2.05, and conciliation c6urt fees $5.75, and for the week ending Feb-
Iruary 21; 1942; showing criminal fines and costs collected $193.g0, civil fees
Ireceived $5.80, and conciliation court fees $3:50, were each read and having been
1previously approved by the City Attorney, President Lemmon ordered that same be
1placed on file.
The application of R. L. Plzak for a license to operate a vending mach-
ine was read, and upon motion'by Hanson, second by Mrachek, the license was grants
The application of the Jefferson Transportation Company for a •license
to sell cigarettes at retail was read, and upon motion by Mrachek, second by
(Williams, the license was granted.,
The applications of the Rochester Electric Company and 0. S. Cummens
for Electrical Contractors Licenses, O.S. Cummens for a Master Electrician's
License, Leonard Giere and Edward D. Holst for Journeyman Electrician's license,
were each read, and upon motion by Yaeger, second by Hanson, the licenses were
granted.
The license bonds of Lyle W. Edgerton in the sum of $1000 with the'
Fidelity and Casualty Company of New York as surety, Bemel Brothers, in the sum
of $1000 with the Maryland Casualty Company as surety, and O.S. Cummens, in the
sum of $1000 with the United States Fidelity and Guarantee Company of Baltimore
Ica surety, were each read, and upon motion by Hanson, second by Yaeger, the said
bonds -were approved,•the surety thereon accepted a$d it was ordered that same be
1placed on file.
The following claims were read, and upon motion by Williams, second by
Anderson, the same were allowed and the Mayor and City Clerk were authorized to
draw warrants upon the City Treasurer and make payments accordingly:

Alderman Anderson introduced the following resolution canvassing the.
returns of the Primary.Election of February 24th, 1942, which was read:
"Be it resolved by the Common Council of the City of Rochester, Minnesot.-
.That the following is a tabulated statement of.the number of votes cast
for each person at the Primary Election held on the 24th day of February, A.D.
1942, in the City of-Rochester,.Minnesota, as determined by.said Common Council.
on the canvass of the returns of the said Primary Election made this 25th day -of

Be it further resolved by the said Common Council:
That Glenn.L. Bowers and Martin W. Nass are hereby declared to be can-
didates for Alderman of the.Third Ward of the City of Rochester, Minnesota, at
the Charter Election to be held March 10, 1942.
. The City Clerk of said City is hereby instructed to cause the names of
said persons to be printed as candidates for the respective offices upon the
official ballots at the coming Charter Election to be held March 10, 1942..11
Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $222.70 from thi
General Fund and $33.96 from the Street & Alley Fund and ordering payment made to
Amundsen's Paint Store, for paint and painting supplies, which was read.
Upon motion by Williams, second by Yaeger that the saidr'esolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $570.93 from the
Street & Alley Fund and ordering payment made to the General Fund, Code 31, which
was read. .
.Upon motion by Yaeger, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. .
Alderman Yaeger introduced a resolution appropriating $392.66 from the
Street & Alley Fund and ordering payment made to Wm. H. Ziegler Co., Inc., for
snow plow, less parts returned, which was read.

S adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $371.50 from the
. Street & Alley Fund and ordering
payment made to the A-4V Company Inc., for parts
for' -Patrol Sweeper; which was read.
' Upon motion by Mrachek, second by Williams that the said'resolAtion be
: adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating from the
` Sewer Fund and.ordering payment made to the General Fund, Code 31, for insurance,
which was read.
Upon Motion by Williams, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $436.50 from the
Park Improvement Fund and ordering payment made to City of Rochester, Public
Utilities for steam heat at the Mayo Civic Auditorium, which was read.
Upon motion by Yaeger, second by Anderson that the said resolution be
4' adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $261.00 from the
Park Improvement Fund and ordering payment made to the Recreation ?Fund,'Board of

• Park Commissioners, for expenditures for Children under 15 years of age, which wa:

Alderman Mrachek introduced a resolution appropriating $1363.29 from thi
Park Improvement Fund and ordering payment made to the Mayo Trust Fund for payroll
for first half of February, 1942, which was read.
Upon motion by Hanson, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Mrachek introduced a resolution appropriating $253.99 from the
Park Improvement Fund and $153.23 from the Lighting Fund and ordering payment made
to City of Rochester, Public Utilities, for electricity and water used, which was
read.

Upon motion by Anderson, second by Mrachek that the said resolution be
adopted as read., and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson.introduced a resolution ordering a hearing on the levy-
ing of special assessments for grading Fifteenth Avenue Northeast from Fourth
Street to Fifth Street Northeast, said hearing to be held at 7:30 o'clock P.M. on
(March 11, 1942, which was read.
Upon motion by Hanson, second by Yaeger that the said reolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution adopting specifications and or-
dering bids for the purchase of one heavy duty truck for use in the City Engineerf
Department, said bids to be received and opened at 7:30 o'clock P.M, on March 11,l
1942, which was read.
Upon motion by Anderson, second by Hanson tha.t the said resolution be
adopted as read, and.all voting in favor thereof, President Lemmon declared the=
said resolution duly passed and adopted.
Alderman Williams introduced a resolution rescinding the resolution
passed by the Common 6ouncil at the meeting of February 9, 1942, accepting the
Ibid of the Barrett Division, Allied Chemical & Dye Corporation, for one car of
JTar, which was read.
Upon motion by Williams, second by Mrachek that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Williams, second by Yaeger, the City Engineer was antho
lized to purchase one car of Road Tar in the open market,. and the Mayor and City
'Clerk were authorized to execute a contract covering said purchase.
