RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL
OF THE CITY. OF. ROCHESTER, MINN., -March 2, 1942
Minutes of a regular meeting of the Common Council of the City of Roch-
ester, Minnesota, held in the Council Chambers, in the City Hall, in said City,
on March 2, 1942.
President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: President Lemmon, Aldermen Anderson, Hanson,
Mrachek, Williams, and Yaeger. Absent: Alderman Bowers.
Upon motion by Hanson, second by Yaeger, the minutes of the meeting of
February 25, 1942, were approved.
President Lemmon stated this a.s being the time and place set for recei
ing and opening bids for the furnishing of fourteen (14) cars of Road. 0il, one (1)
car of Asphalt, and one (1) car of Emulsified Asphalt. The following bids were
received and opened: The Col -Tex Refining Company, $.072 per gallon for Asphalt
and $.0675 per gallon for Emulsified Asphalt; Union Asphalts & Roadoils, •Inc.,
per gallon
$.0549 per gallon for Road Oil,' $.0667/for MC 2, 3,4 Cutback Asphalt, $.0692 per
gallon for,RC 2,3,4 Cutback Asphalt, and $.0762 per gallon for Emulsified Asphalt;
The Standard Oil Company, $.0555 per gallon for Road Oil, $.0648 per ,gallon' for
MC . 2, 3, 4 Cutback Asphalt, and $.0673 per gallon for RC 2, 3, 4 Cutback Asphalt; The
L. N. ' Sickels & Co., $:07'90 per gallon for. Emulsif ied Asphalt; The Empire State Oil
Company, $.0638 per gallon for Road Oil; The North States Asphalt Company, $.0577
per gallon for Road Oil, $.0713 per gallon for MC 2,3,4 Cutback Asphalt, and for
R'C 2,3,4 Cutback Asphalt, $.0728 per gallon; and the Scotch Oil Co., $ 0567 per
gallon for Road Oil, $.0798 per gallon for MC 2, 3,4 Cutback Asphalt, and $.0828
per gallon for RC 2,3,4 Cutback Asphalt. President Lemmon referred the bids to
the Street and Alley Committee and the City Engineer for tabulation and recommen-
dation. "
Upon motion 'by Mrachek, s'econd by Hanson, the recommendations of the
Street and Alley Committee and. the 'City Engineer that the contract for one car of
Emulsified Asphalt be awarded. to Col -Tex Refining Co., at the price of $.Ob75 per
gallon and that the contract for one car of Asphalt'be awarded to the Standard Oil
Company of Indiana at the price of'$.0648 per gallon for M6 2,3,4 Asphalt and' '
$.0673 per gallon for RC 2,3,4 Asphalt, were accepted.
Upon motion by Anderson, second by Mrachek, the bid of.the..Union.'Asph

A letter from the Warren S. Holmes Company regarding appraisal of build-
C ilingsbelonging 'to the City of.Rochester for insurance purposes was read, and
resident Lemmon referred 'same to the Insurance Committee.

A petition by.Edward J. Johnston to install Potato Chip manufacturing
equipment at No. 1602 Third Street Northeast, the legal description of the prop-
erty being Lot 1, Block 1, Boutelle's First Addition to the City of -Rochester,
was read and upon motion by Williams, second by Mrachek, the -same was referred to
the Board of Zoning.
The Mayor's emergency order for the purchase of one 9000 gallon car loa
of gasoline given to the City Clerk was read, and upon motion by Mrachek., second
by Williams the Mayor's action in issuing the emergency order was approved.
An announcement by the League -of Minnesota Municipalities, of sanitatior
short courses for Water Works Operators, Plumbing Inspectors, and Sewage Plant
(Operators to be held at the University of Minnesota during the week beginning,
March 16th, 19?2, was read, and upon motion by Mrachek,-second by Anderson, the
Building Inspector, Chief Operator at.the Sewage Disposal Plant and the City
Engineer were authorized to attend at City expense.
The Public Library Statistical report for the calendar.year ended.Decem
ber 31, 1941, was read and President Lemmon ordered that same be placed on file.
The report of the Building and Plumbing Inspector for the month of Feb-
ruary, 1942, showing fees for building permits issued $63.00, and fees for plumb-
tng permits issued $21.75, were read and President Lemmon referred same to the
Finance Committee.
The report of the Electrical Inspector for the month of February, 1942,
showing fees for electrical.permits issued $5.25, was read and President Lemmon
referred same to the Finance Committee.
The report of -the Clerk of the Municipal Court for the week ending
February 29, 1942, showing criminal fines and costs collected $639.65, civil fees
received, none, -and conciliation court fees $5.25, was road, and having been prevT
iously approved by the City Attorney, President Lemmon ordered that same be placed
on file.
The applications of John Miller for a Master Electrician's License and
H. F. Beilke and John Harrison for Journeyman E1"ectrician's Licenses were each
read, and upon motion by Anderson, second by Yaeger the licenses were granted.
The application of Albert Angelici for a license to sell cigarettes at
retail was read, and ullon motion by Hanson, second by Mrachek the license was
(granted.
The application of Elmer C. Johnson for a Plumber's License was read,
and upon motion by Mrachek, second by Williams the license was granted.
The applications for Driver's License of Clifford Carson, Gerald A. Cook
Leo Gifford, Homer Strangeway, Richard Lehman, Arnold L. Brown, Julius Feind, Joe
R. Valsvik, Leo J. Struif, Frank A. McLaughlin, Edward Campion and Francis Merry

were each read, and upon motion by Hanson,.second by Yaeger, the Licenses were
granted.
The application of Francis Christopherson for license to connect with
sewers and drains was.read, and upon motion by Mrachek, second by, Anderson, the
(license -was granted.
The License Bond of Francis Christopherson in the sum of ,$1000.00 with
the Fidelity & Casualty Company of New York as surety, was read; and upon motion
by Mrachek, second by Williams, the said bond was approved, the surety thereon
accepted and it was ordered that same be placed on file.
.The following claims were read, and upon motion by Williams, second by
Yaeger, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City.Treasurer and make payments accordingly:

Alderman Anderson introduced a resolution, appropriating $270.00 from the
General Fund and ordering payment made to City of .Rochester, Public Utilities, for
Isteam heat for the -City Hall, which was read.
Upon motion by Anderson, second by Hanson that the said resolution be

adopted as read, and all voting in favor thereof, President Lemmon declared the
�jsaid resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $21.00 from the
General Fund, $3.60 from the Street & A lley Fund, and $4560.96 from the Lighting
Fund and ordering payment made to City of Rochester, Public Utilities, for light
(and water used, which was read.
Upon motion by Mrachek, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
jsaid resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $1511.50 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for
payroll for last half of February, 1942, which was read.
Upon motion by -Hanson, second'by Mrachek that the said resolution be
ad,opted as read, and" al.l voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution accepting th-e bid of the Stan-
jdard Oil Co. 'of -Indiana for furnishing approximately 10,000 gallons of -Cutback
jAsphalt, which was read.
Upon motion by-Mrachek, -second by Hanson that the said resolution be
jadopted as read, and al•l voting in favor t-hereof-, President Lemmon declared •the-
jsaid resolution duly passed and adopted. .
Alderman Ainder•son introduced a resolution accepting the bid of the
(Col -Tex •Ref-ining• -Company for furnishing appr-oximat-ely 10,000• gallons• of Emulsified
jAsphal-t, which was read..
Upon motion by Williams, :s•econd by Yaeger that the -said resolution be
adop-ted as read, and- all -voting in favor thereof, President Lemmon decl-ared the
said resolution duly passed and adopt-ed.
Alderman Mrachek introduced a resolution -appropriating $420.26 from the
jPark Improvement Fund and ordering payment made to the Leitzen Concrete Products
jfor black dirt and labor, which was read.
Upon moti-on by Williams, second by Anderson that the said resolution be
jadop"ted- as read, and all voting in favor thereof, President Lemmon-declared the
(said re'solution duly passed and adopted.
Alderman Hanson introduced a•resolution appropriating .$269.19 from -the
jPark Impr-ove-rent Xund and ordering payment made to Alfred P-ekkala for two fan -co
Itrols complete, which was read.
Upon motion by Hanson, second by Yaeger that.the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
jsaid resolution duly passed and adopted.

_ An Ordinance amending an Ordinance entitled "An Ordinance For The Purpo
Of Promoting Health, Safety, Order, Convenience And General Welfare By Regulating
The Use Of Land, The Locat-ion, Size, Use And Heigth Of Buildings, And The Arrange
ment Of Buildings On.Lots And The Density Of Population Within The City Of Roches-
ter, Minnesota, All In Accordance With A Compyehensive Plan, As Amended Byr,Ordin
ante No. 560, Same Being,Ordinance No. 558,!1 was given its third and final read-
i ng.
Upon motion by Mrachek, second by Williams, -and all voting in favor
thereof, the Ordinance was adopted as read.
Upon motion by Williams., second by Mrachek, the City Clerk was instruct(
to return the certified checks of the unsuccessful bidders for Road Oil, Asphalt
and Emulsified Asphalt except those of the Standard Oil Co., and Union} Asphalt
Road Oil Company.
Mr. John Young appeared at the Council meeting.and stated that he and
members of the School faculty had investigated the school warning signs which have
been installed on North Broadway by the Police Department, and recommended that

the sameysigns be used in various parts of the town at crossings most used by the
children on the way to and from school. President Lemmon referred the matter
to the Police Committee, the Mayor and the Chief of P olice.
Mayor Grassle explained that the Civilian Defense Program had increased
its activities considerably and that there were some _necessary expenses connected
with the operation of their office, and asked that the Common Council make an
appropriation to cover same.
Upon mo.tion by Mrachek, second by.Anderson, the amount of $199.00 was
appropriated from the General Fund for the use of the Civilian Defense Council.
Upon motion by Williams, second by Hanson, the amount of $199.00 was
appropriated from the General Fund for the Mayor's Contingent Fund. e
Upon motion by Williams, second by Anderson the meeting was adjourned
until 7: 30 o'clock P.M. March 11, 1942.
