Minutes of an adjourned regular meeting of the Common Council of the Cit!
)f Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
ity, on March 11, 1942..
President Lemmon called the meeting to order at 7:30 o'clock P.M,, the
ollowing members being present. President Lemmon, Aldermen Anderson, Hanson,
rachek,- Williams and Yaeger. Absent:- Alderman Bowers.
Upon motion by Hanson, second by Williams, the minutes of the meetings oil
arch 2nd and March 9th, 1942, were approved.
President Lemmon stated this as being the time and place set for a hear-
ng on the levying of special assessments for the grading of Fifteenth Avenue.

President Lemmon stated this as being the time and place set for receiv-
ing and opening bids for one heavy duty truck for use in the City Engineer's De-
partment. The following bids were received: Stolp & Bowers in the amount of
$3196.92; Universal Motors in the amount of $2697.23; Northwestern Terminal Co.,
in the amount of $2919.37; and Postier & Eggers in the amount of $2972.19. Pres-
ident Lemmon referred the bids to the Street and Alley Department and the City
Engineer for tabulation and recommendation.
Upon motion by Mrachek, second by Anderson, the recommendation of the
Street and Alley Committee and the City Engineer that the contract for the pur-
chase of a heavy duty truck for use in the City Engineer's Department, be awarded
to Universal Motors for the -amount of $2697.23, was approved.
Mr. John J. Kerr presented a proposed plat of land located on Third
Avenue Northwest between Fourteenth Street Northwest and., the City Limits, and Pre
ident Lemmon referred the matter to the Street and Alley Committee and the City
JEngineer.
A communication from the City Engineer submitting a list of streets,
avenues and alleys in the City of Rochester, to be flushed or treated with oil
during the season .o.f 1942; was read, and same was referred to the City Engineer
for correction.
A request from the Board of Park Commissioners that the sum of $25.62
be appropriated.from•_the General Fund to cover the rental of the North Hall in th
Mayo Civic Auditorium for the evenings of February 19th and 26th, 1942 and,the
South Hall for the evening of March 4, 1942 was read, and upon motion by Yaeger,
(second by Mrachek, the same was allowed.
The recommendation of the Street and Alley Committee and the City Engin-
eer regarding the purchase of Road Oil was read and ordered placed on file.

The report of,the City Weighmaster-for the -month of February, 1942,
sshowing 262 private -loads weighed, and receipts of $26.20 was read, and President)
ILemmoir. referred same to the Finance Committee. -
The report of expenditures from the City Engineer's Payroll for the;
month of February, 1942, was read -and ordered placed on file.
`the City Engineers trial baiance for the month of February
11942, was read, and President Lemmon ordered that same be placed on file.
Upon motion by Williams, second by Anderson, the annual report of the
Rochester Bus Line, Inc., for the -year ended December 31, 1941, was approved., and
same was ordered placed on file.
The report of the Clerk of the Minicipal-Court-for the week ending
March 7, 1942, showing criminal fines and costs collected $414.80; civil fees
received $8.05, afid conciliation, court fees $5.25, was read, and having been prev-
iously approved by the City Attorney, President Lemmon ordered that same be placed
on -file.
- The applications for Drivers License -of Leon Hatch and Marvin W. Mathi
Isen were each read and upon motion by Mrachek, second by Yaeger the licenses were
(granted. - -
The applications for License to sell cigarettes at Retail of-D.-G.
ITwentyman, Bernard G. Mayou, Hotel Rochester, Mayo Civic Auditorium, Ross Phill,
(Gerald Ryan; Thurber's Cafe, C.R.Hutchinson, Newton E. Holland, Elks Club.and
IA.C.Evans, were each read and'upon motion by -Yaeger; second by Hanson, the licens
Iwere granted. - -
The application of John B. Morrison for Master Electrician's License
)was,read,-and upon motion by Williams, -second by=Anderson, the license was granted
The application of M. Brodie Co. for a license to operate a vending -
machine was read, and upon motion by Anderson, second by Mrachek the license was
1granted.- -
The license bond of John R. Morrison in the sum of $1000.00 with the
IEmpl•oyer's Liability Assurance Corporation, Limited, as surety, was read, and upor
motion by Mrachek, second by Williams,'the bond was approved, the surety thereon
jaccepted and it was ordered that same be placed on file.
Upon motion by Williams, second by Anderson, the City Clerk was instructed
Ito return the cbrtified checks of the unsuccessful bidders for the heavy duty
Itruck.
The following claims were read, and upon motion by Williams, second by
Yaeger, the same were allowed and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make -payments accordingly;

."-Be it resolved• by, the Common Council of the City of Rochester, Minnesota:
That the following is a tabulated statement and -list -of the number of
votes cas-t for each person at the Charter Election held March 10, 1942, in the City
of Rochester, Minnesota, as determined by said Common Council, on the canvass of
the returns of said election made the llth day of March, 1942; the said statement

SO THEREFORE, Be it resolved by the Common Council of the City of
Rochester, Minnesota: _
That J. T. Lemmon is hereby declared to be elected to the office of
Alderman at Large of said City, at the Charter Election held March loth, 1942', to
hold office for two years and until his successor is elected and qualified;
That Theo.H. Tollefson is hereby declared to be elected to the office of
City Treasurer of said City, at the Charter Election held March 10, 1942, to hold
loffice for one year and until his successor is elected and qualified;
That Burt Elliott Eaton is hereby declared to be elected to the office c
Municipal Judge of said City, at the Charter Election held March 10, 1942, to hold
office for four years and until his successor is elected and qualified;
That Wm. S. LaPlante is hereby declared to be elected to the office of
Special Municipal Judge of said City, at the Charter Election held March 10, 1942,
to hold office for four years and until his successor is elected and qualified;
That Frank Roth is hereby declared to be elected to the office of Justic
of the Peace, styled "City Justice", at the Charter Election held March 10, 1942';

Alderman of the First Ward, at the Charter Election held March 10, 1942, to hold
office for two years and until his successor is elected and qualified;
That H.D. Meyer is hereby declared to be elected to the office of Justic
of the Peace of the First Ward, of said City, at the Charter Election held March
100 1942, to hold office for two years and until his successor is elected and
qualified;
That D. L. Williams is hereby declared to be elected to the office of
Alderman of the Second Ward of said City, at the Charter Election held March 10,
1942,-to hold office for two years and until his successor is elected and qualif9

That there is hereby declared to be a tie vote for Justice of Peace of
the Second Ward;
That Owen E. McCoy is hereby declared to be elected to the office of
Constable of'the Second Ward, of said City, at the Charter Election held March 10,

That Martin W. Nass is hereby declared to be elected to the office of
Alderman of the Third Ward, of said City, at the Charter Election held March 10,

of Justice of the Peace of the Third Ward, of said City, at the Charter Election

Upon - motion by Mrachek, ' second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lefnmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a- resolution appropriating $214.70 from th
General Fund and ordering payment made to the Rochester Post Bulletin, for print
ing and publishing, which was read.
Upon motion by Anderson, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $299.20 from the
Street & Alley Fund and ordering payment made to the Street and Alley Fund for
use of eauipment during February, 1942,.which was read.
Upon motion by Williams, second by Yaeger that the said resolution•be'
adopted as read, and all voting in'favor thereof, President Lemmon declared'tht
said resolution duly passed and adopted.
Alderman Williams introduced a resolution granting four dance permits
I1to the Southern Minnesota Broadcasting Company, which was read.

Upon motion by Mrachek, second by Williams that the said resolution be
dopted as read, and all voting,in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution levying special assessments
or the grading of Fifteenth Avenue Northeast from Fourth Street Northeast to
Fifth Street Northeast, which was read.
Upon motion by Hanson, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced'a resolution accepting the bid of Universal
Motors for furnishing one heavy duty truck for use in the Street & Alley Depart-
ment, which was read.
Upon motion by Williams, second by Hanson that the said resolution be
adopted as read, and all voting -in favor. thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution accepting toe bid of Union
sphalts & Roadoils, Inc., for furnishing approximately 140,000 gallons of Road
Oil, which was read.
Upon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution appropriating $49.26 from the
General Fund, $130.99 from the Street and Alley Fund, and $25.75 from the Fire
Protection Fund and ordering payment made.to National Bushing & Parts Company for
repairs and supplies used, which was read.
Upon motion by Yaeger, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution dulynpassed and adopted.
A letter from the Board of Park Commissioners addressed. to the Mayor and
the Common Council requesting that appraisers be appointed to make an appraisal of
Race
certain lands in Silver Lake Mill/Reservation area, which the Board of Park Com-
nissioners consider desirable for development as an industrial site, was read.
Jpon motion by Williams, second by Hanson,,the following appraisers were appointed
!fir. F. L. Josselyn from the First Ward, Mr. Amiel Glabe from the Second Ward, and
.4r. E. E. Woodhouse from the Third Ward.
Mayor'Grassle requested permission to move his office to the Carlton
otel.as his office in the City Hall was now being used for the various activities)
of the Defense Program, and upon motion by Williams, second by Mrachek, the Mayor''
