Minutes of an adjourned regular meeting of the Common Council of the
City of, Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City, on March •23, 1942.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
following members being present. President Lemmon, Alderman Anderson, Bowers,
Hanson, Mrachek, Williams and Yaeger. Absent:'none.
Upon motion by Mrachek, second by Bowers, the minutes of the meeting of
March 11, 1942 were approved. '
A communication from the Rochester Firemen's Relief Association request;
ling authority to purchase $5920.00 in United States Defense Bonds was read, and
(President Lemmon ordered same placed on file.
The recommendation of the Finance Committee that the action of the Fir
men's Relief Association in appropriating $5920.00 for the -purchase of United States
Defense Bonds be approved, was read, and upon motion by Anderson, second by Hansor.
the Finance Committee recommendation was accepted.
The following resolutionspassed and adopted at a meeting of 'the Sinking
Fund Commission were each r.ead:
"That the sum of -$.1.18 be appropriated from Code 24 of the Sinking Fund,
$0.49 from Code 26, and $0.12 from Code 30, and ordered paid to the
City Clerk's petty cash account to reimburse same for payment of
additional accrued interest on $15,000.00 State of Minnesota Rural
Credit Deficiency Fund 1.6% Certificates of Indebtedness, -_ourcha'sed
from Kalman and Company, January 29th, 1942."
"That the sum of $119.25 be and the said sum is hereby appropriated
from Code 11 of th-e Sinking Fund and ordered paid to Code 25 of the
Sinking Fund to transfer accrued interest on City Hall Investments
to Interest on Investments, Water Depreciation Reserve."
Upon motion by Xrdehek, second by Bowers, the action of the Commissioner
lof tine Sinking Fund was approved.
A request by G. H. Glinke to move his "On Sale" Liquor place of business
from No. 12 Second Street Southeast to No. 316 South Broadway was read, and upon
Imotion by Yaeger, second by Williams, same was referred to the License Committee
land the Chief of Police.
The recommendation of the Board of Zoning that Edward J. Johnston be
Ipe-rmitted to construct a double garage on Lot 1, Block 1 of Boutelle's Addition
land u-se same for a potato chip factory, but that no change'be made in the zoning
lof the above described property, was read, and upon motion by Mrachek, second by
Yaeger the said recommendation was approved.
A specification of a bookkeeping machine for use in the City Clerk's
loffice, and ettima-te of cost of same, submitted by the City Clerk was read, and
JPresident Lemmon ordered that'same be placed on -file.
Chief of Police, H.N.Tompkins, reported that he had made a check on the

number of school signs necessary, and recommended that approximately 12 "Crossing
signs were needed to take dare of all the schools at a cost of $11.00 each, and
that 12 "Caution" signs be purchased at a price of $2.60 each.
Upon motion ..by Hanson, second by Bowers the report of. the Chief of Poli
was referred to the Police Committee with power to act.
A communication from F.M. Feldman, M.D. , City Health efficer, recommendi
that the house.at the City Dump Grounds be fumigated and redecorated before the
new appointee moves in on April 13, 1942, was read.
Upon motion by Mrachek, second by Anderson, the matter was referred to
the Public Health & Welfare Board.
The statement of receipts and disbursements from the Park Improvement
Fund for the month of February, 1942, was read, and President Lemmon ordered that
same be placed on file.
The reports of the Clerk of the Municipal Court for the ,reek ending
March 14, 1942, showing criminal fines and costs collected $239.90, civil fees
received $4.05, and conciliation court fees $3.25; and for the week ending March
21, 1942, ahowing criminal fines and costs collected $342.90, civil fees r.eceived
$9.75, and conciliation. court fees, $9.50, were each read, and having been prev-
iously approved by the City Attorney, President Lemmon ordered that same be placed
on file.
The application of the Foster Electric Company for an Electrical Con-
tractor's License was read, and upon motion by Bowers, second by Anderson, the
license was granted.
The application of Lillian B. Campbell for license to sell Soft Drinks
was read, and upon motion by Hanson, second by Bowers the license was granted.
The application of Walter Wilke for a, Driver's license was read, and
upon motion by Anderson, second by Yaeger the license was granted.
The applications of Ilia Arthur Stretch, Zumbro Hotel, Kahler Hotel and
Henry G. Smith for license to sell cigarettes at retail were each read, and upon
motion by Mrachek, second by Yaeger the licenses were granted.
The, application for transfer of "On Sale" Liquor license #104 from Wm.
J. Moriarty to Julius 0. Dalsbo was read, and upon motion .by Bowers, second by
Anderson the application was referred to the License Committee and the Chief of
Police with power to act.
The application for transfer of 3.2 Beer "Off Sale" license #649 from
Roland-E. Hardt.to Henry G. Smith was read, and upon motion by Williams, second
by Yaeger, same was referred to the License Committee and the Chief of Police with
power to act.

The application of Lawrence Lysne to move a one story house over the
following streets was read: From 209 Fifteenth Avenue'Southwez-t to Second Street
Southwest, then West to the Belt*Line and South to South Broadway;'then'North to
Sixth Street Southwest, then West to First Avenue Southwest, then North to Second
Street Northwest, then East to North Broadway, then North to the City Limits.'
Upon motion by Mrachek, second by Bowers the permit was granted, the
moving of the building to be under the supervision of the City Engineer and the
Building Inspector.
The license bond of J.O.Dalsbo in the sum of $3000.00 with the Western
Surety.Company as surety was read, and upon motion by Bowers, second by Anderson
the said bond was approved, the surety thereon accepted, subject to the granting
of the license, and it was ordered that same be placed on file.
The following claims were read, and upon motion by Williams, second"by
Hanson, the same were allowed and the Mayor and Ci'ty Clerk were authorized and
directed to draw warrants upon th`e City Treasurer and make payment's accordingly:

Alderman Anderson introduced a resolution ordering advertisement for
proposals for being designated as City Depositories, and ordering that sealed pro-
osals shall be received and opened at 2:00 o'clock P.M. April 6, 1942, which was
rread.
Upon motion by Bowers, second by Mrachek that the said resolution be
adopted as read, and all. voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution ordering advertisement for
bids for the official printing and.publications during the fiscal year of 1942 and
1943, and ordering that sealed.proposals shall be received and opened at 2:00
o'clock P.M. April 6, 1942, which was read.
Upon motion by Mrachek, second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution adopting specifications and
estimate of cost and ordering bids for an Accounting machine to be used in the
City Clerk's office, said bids to be received and opened at 7:30 o'clock P.M.,
April 6, 194 2,_which was read.
Upon motion by Bowers, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted..
A lderman Hanson introduced a resolution appropriating.$2000.00 from the
General Fund, Code 19, and ordering payment made to the Park Improvement Fund for
transfer of funds, which was read.
Upon motion by Mrachek, second.by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President-Lemmon declared, the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution,appropriating $4999.07 from the
Code 18 .
General Fund/and ordering payment made to the General Fund, Code 20, for City's
share of 1941 sprinkling, which was read.

Upon motion by Anderson, second by Borers that the said resolution be
jadopted as read, and all voting in favor thereof, President Lemmon declared the
Isaid resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $240.92 from the
(General Fund and ordering payment made to the Public Health & Welfare.Fund for
transfer of taxes received, which was'received.
Upon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in -favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $10,503.45 from
the Sewer Fund and ordering payment made to the Sewer Fund for the purpose of
taking up overdrafts in Codes 5 and 19 and transferring balances accumulated from
back taxes.in Codes 21, 22 and 23, which was read.
Upon motion by Yaeger, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lerdmon declared the
Isaid resolution duly passed -and adopted.,
Alderman Yaeger introduced a resolution appropriating $1348.06 from -thee
Park Improvement Fund and ordering payment made to the Mayo'Trust Fund for payroll,
or the first half of March., 1942,E which was read.
Upon motion by Yaeger, second by_Williams that the said resolution be
ladopted as read, ,and all voting in favor thereof, President Lemmon declared_ the
Isaid resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $495.00 from
the Park Improvement Fund and ordering payment made_to.the City of Rochester, Pu
lic Utilities for steam heat for Auditorium, which was read.
_ Upon motion by Hanson, second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon_•declared the
said resolution duly passed and adopted!
Alderman Bowers introduced a resolution appropriating $293..40 from the
Park .Improvement Fund and $143.10 from the Lighting9 Fund and ordering payment made
to the City of Rochester, Public Utilities, for light and water used at Auditor-
lium, which was read.
Upon motion by Mrachek, second by Anderson thatthe said resolution be
adopted as read, and all voting in favor thereof, President Lemmon dedlared the
said resolution duly .passed and adopted.
Alderman Hanson introduced a resolution appropriating $321.72 from the
`Lighting Fund, Code_16 and ordering payment made to the .Lighting Fund, Code 9,

Upon motion by Yaeger, second by Williams that the said resolution be
(adopted as read, and all voting in favor thereof, President Lemmon declared the
jsaid resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $576.00 from the
JDeposits for Licenses and Permits Fund and ordering payment made to the General
Fund, Code 19, for transfer of funds, which was read.
Upon motion by Williams, second by Mrachek that the said resolution be
jadopted.a.s read, and all.voting in favor thereof, President Lemmon declared the
jsaid resolution duly passed and adopted.
.Upon} motion by Williams, second by Bowers, an Ordinance entitled "An
10rdinance Establishing Fire Limits, AndProviding For All Matters, Regulating The
lConttruction, Maintenance, Alteration, Demolition And Removal Of Buildings And
10ther Structures Erected Or -To Be Erected Within The City Of Rochester, Minnesota)
(was given its third and final reading.
A • : motion was made by Anderson, second by Hanson that,the Ordinance
be not adopted, and all voting in favor thereof, President Lemmon declared the
said Ordinance not adopted.
Alderman Anderson introduced
/A revised edition of the Building Code Ordinance entitled, "An Ordi-
nance Establishing Fire Limits,_And Providing Fqr All,Matters, Regulating The Con-
struction, Maintenance, Alteration, Demolition And Removal Of Buildings And Other.
Structures Erected Or To Be Erected Within The City Of Rochester, Minnesota, And
which
Providing A Penalty For Violation Thereof,."/was given its first reading.
Upon mo.tion by Williams, second by Mrachek, and all voting in favor
thereof, the rules were suspended and the Ordinance was given its second reading.
A motion waq made by Mrachek, second by Williams that the rules be
suspended and the Ordinance -be given its third and final reading. Alderman Bow1p
lers voted "No".

Alderman Hanson stated that it had been brogght to his attention that
persons liviag outside of the City Limits were dumping rubbish at the City Dump
Grounds. -
Upon motion by Hanson, second by Bowers the matter was referred to the
Public Health & Welfare Board and the -City Attorney, to draft -an Ordinance pro-
viding that persons living outside of the City L}mits pay a fee for dumping in
the City Dump Grounds, and providing -for a penalty for violation of same.
Alderman Hanson stated that the.tank�on one of the City flushers had
been welded so many times that it was now practically -beyond repair, also the
power engine was badly worn and so obsolete that new parts could not be purchased

Upon -motion by Williams., second by Mrachek, the 'City Engineer was in-
• stru,cted to -prepare specifications -for a new tank and power engine for this par-
ticular flusher and submit same to the .Common Council at its next meeting.
Alderman Mrachek suggested enlarging the sludge beds or 1iits_at the �
Sewage Disposal Plant, which should effect a substantial saving in the operation 3
of the Plant. Mr. A.C.Smith, City Engineer, then explained that the sludge beds
could be extended to the north -and east at very little expense to the City. This
chance would eliminate the expense of hauling sludge from the present beds.

Upon motion -by Williams, second by Hanson, the matter was referred to
the Sewer Committee and the City Engineer with power to act.
Upon motion by Bowers, second by Yaeger the meeting was adjourned until
i 7t30 o'clock P.M. March 30, 1942.
