Council Chambers in the City Hall, in said City on April 6, 1942. President-Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: TLemmon, Fryer, Hanson, Mrachek, Nass, Yaeger. .Absent:" Williams, due to illness. ` Upon notion by Hanson, second -by Yaeger, the minutes of the meetings of Mar6h 30th and 31st, 1942, were approved. President Lemmon addressed the Council and those present and introduced) Mayor Paul.A. Grassle who res-oonded-with a short address which included the announcement of his appointment of the following persons to the various"Boards of the City of Rochester, Minnesota: Carl Oestarreich as a member of the Public (Utility Board; Dr. Louis A. Brunsting as Park Commissioner of the First Ward; Rev. W. M. Grabowski as Park Commissioner of the Third Ward; Dr. A.E. Brown, Mrs. � H. F. Helmholz and Dr. J. S. Lundy as members of the. Board of Public Health and T Welfare; E.E. Harkness and Oscar Hargesheimer as members of the Zoning Board;j E. B. Ballou as a member of the Music and Band Committee;and J. J. Adamson to the PQlice Civil Ser-vice Commission. Upon motion by-Mrachek, second by Hanson, and all voting in favor thereof, the Ma.yor!s appointments were approved. PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTM MINN., Ap r i 1 6. 1942 An Ordinance entitled "An Ordinance Establishing Fire Limits, And Pro- �viding•For All Matters, Regulating The Construction, Maintenance, Alteration, 1Demolition And Removal Of Buildings And Other Structures Erected ,Or To. Be Erected 'Within_The City Of Rochester, Minnesota, And Providing A Penalty For Violation I Thereof," was given its -third and final reading, and upon roll call, all voting in favor thereof, President Lemmon declared the Ordinance duly passed and adopted Alderman Hanson introduced a resolution.adopting Robert's Rules of COrder (revised) of the 1915 Copyright, as rules of order for the.conduct of the 1jbusiness.of the Common Council, which was read. Upon motion by Fryer, second by Hanson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly, passed. and adopted. Alderman Fryer introduced the following resolution which was read: I 113e.it resolved by the Common Council of the City of Rochester; ;Minnesota: That the said Common Council of the City of Rochester, Minnesota, hereby adopts the following Pules and regulations for the 'order of business of !said Common Council: 1. Roll Call. The Roll Call of t-he Common Council shall be had and taken_in its alphabetical order according to the names of the members, except that the name of the President of the Common Council shall be called only at the first roll call of each meeting and then after that, at that meeting, only in case of a tie vote, when his name shall be called and vote taken after the expression of each of the other members of said Common Council, or when a 5/7 vote is required. 2. Reading and approval of the minutes of the preceding meeting. j. At first meeting, the appointment of officers and committees. 4. Public hearings. 5. Reading of petitions and communications. i _ 6. Reoorts of committees. All resorts of committees shall here- after be made in writing,,unless ordered otherwise by said.Common ` Council. 7. Unfinished business. 8. Resolutions and Ordinances., 9. Upon motion by Mrachek, second by Nass that the said resolution be i 'adopted as,read, and all voting in favor.thereof, President Lemmon declared the I ;said resolution duly passed and adopted. The application of F.R.Finch for reappointment to the office of City Clerk was read, and upon motion by Fryer, second by Yaeger, F.R.Finch was appoint, City Clerk for the ensuing official year. The application of Desmond B. Hunt for reappointment as City Attorney was read, and upon motion by Hanson, second by Mrachek, Desmond B. The application of Arleigh C. Smith for reappointment as City Engineer was read, and upon motion by Mrachek, second by Fryer, action on the appointment of a City Engineer was deferred at the present time.. The application of Garnet L. Spring for reappointment as Building and Plumbing Inspector was read, and -upon motion by Nass, second by Mrachek, Garnet L. Spring was appointed Building and Plumbing Inspector for the ensuing official year. The application of Paul T. Plantz for reappointment as Electrical In- spector -was -read, and upon motion by Hanson, second by Fryer, action on the appointment of an Electrical Inspector was deferred at the present time. The applications of C.A. Cottingham and Fred W. Yochem for appointment as City Weighmast-er were read, and upon motion by Mrachek, second by Nass, C.A. Cot-tin•gham was appointed City Weighmaster for the ensuing official- year. The applica:tio-n of C.E.Ginther for reappointment to the office of Fire Warden was- r-ead, and upon motion by Hanson, second by Fryer, C.E. Ginther was appointed Fire Warden for the ensuing official year. Th.e` application of Flora C. Anderson for reappointment as -Stenographer for the Chief of Police, Juvenile Officer and City Attorney of -th-e C-ity of Roch- ester, was read, and upon motion by Fryer, second by Yaeger, Flora C. Anderson was appointed Stenographer for the ensuing official year. The application of G-rayce Lee for reappointment as Stenographer in the ,office of the Building and Plumbing Inspector and the Electrical Inspector, was ,read, and uppn motion by Hanson, second by Nass,-Grayce Lee was appointed Steno- Igrapher for the ensuing official year. The applications of Henry C. Lindberg and Joseph J. Schuster for re- appointment as Assistant Custodians of -the City Hall -were read, and upon motion by Fryer, second by Yaeger, Henry C. Lindberg and. Joseph J. S-chuster were appoints Assistant Custodians of the City Hall for the -en -suing official year. j The application of Mark Blanchard for reappointment -as Painter for the City of Rochester was read, and upon -motion by Hanson, second -by Fryer, Mark Blan- chard was appointed Painter for the ensuing official year. Thp application of P-eter D. Claude -for reappointment as first assistant of the City Dumping Grounds was read, and upo-n motion by Fryer, second by Mrachek, (Peter D. Claude was appointed first assistant of the City Dumping Grounds for the ensuing official year. The appointment of Mae French Nelson as Clerk of the Municipal Court of the City of Rochester for the ensuing year by Burt Elliott Eaton, Municipal Judge, was read, and upon motion by Fryer, second by Yaeger, the appointment was approves The appointment of Janice Ellrir_ger as Deputy Clerk of Court and steno- grapher to the Municipal Court of the City of Rochester for the ensuing year, by Burt Elliott Eaton, Municipal Judge, was read, and upon motion by Hanson, second by Fryer, the appointment was approved. The following recommendation of the Public Health and Welfare Depart- ment was read: j°Common Council City of Roches t.er Rochester, Minnesota Gentlemen: At the last, regular meeting of the Board of Public Health & Welfare, the following appointments .were made for the year begin- ning April 13, 1942. The Board recommends that the Council approve the appointments with the salaries indicated. HEALTH DEPARTMENT: , Dr. F.M. Feldman - Health Officer $4500.00 (Plus use of Health Officer's car) Dr. D.C. Lochead - Sanitary Inspector 1620.00 (to be paid entirely by the City Farm) Richard L. The Rochester Post -Bulletin's proposal for ding the official printing and advertising for the City of Rochester, Minnesota, for the ensuing official year was read, and upon motion by. Fryer, second by Hanson, the proposal of the. Rochester Post -Bulletin was accepted and same was ordered placed o.n filel'_ The following proposals for being designated as depositories for funds of the City of Rochester, Minnesota, were each read: The First National Bank, $200,000.00;- Union National Bank, $150,000.00;and the Olmsted County Bank and Trust,Company', $40,000.00; and President Lemmon ordered that._same,oe placed on file. A.petition by the.Rochester "On Sale" non -intoxicating malt beverages license holders that the license fee of $75.00 pqr year be payable in. -two install, ments; that the fee for selling bottle beer only "On Sale",be• $25.00 per year payable in .two installments.; that there be a limit on ,the ."On Sale" -licenses issued in the residential district; and that the holder of an "O.ff Sale" license,, who does not also. hold an "On Sale" license,. shall.not.cool or.sell any cooled beer; was read and upon motion by Yaeger, second by Fryer the matter was referred' to the License Committee to be reported on in the afternoon session. A-questionai.re from the League -of Minnesota Municipalities requesting the League membersi to express their opinions and plans regarding the annual Leagu' Convention, now set to be held in Ely, Minnesota on June 15, 16, and 17, 191L2 was', read, and upon motion by Mrachek, second by Hanson the Council went on record as being in favor of. holding the 1942 Conventi.on at Ely, Minnesota. Upon motion by Fryer, second by Hanson, the amount of $1.00, was appropriated for payment of,the fee for renewal of Petroleum „distributor's lic- ense for 1942. The City Engineer's request that $2000.00 be appropriated from the General Fund for use of the Street and Alley Committee, was read, and President Lemmon ordered that same be placed on file. A petition by the grocers in the City of Rochester requesting that the Common Council make no change in the Ordinance governing the.sale of .3.2, Beer "Off Sale" was read, and President Lemmon referred same to the License Committee for .action o.n this date. A petition by the On Sale Liquor Dealers Association that the On Sale Liquor stores be permitted to remain open until 1:00 o'clock A.M. as provided by the Laws adopted by the State of Minnesota, was read, and upon motion by Fryer, second by Hans.on,. the City Attorney was instructed -to draw an Amendment to the 556 RECORD OF OFFICIAL. M. The Annual Report.of the City, Engineer covering the period beginning April 1, 1941 and ending April 1, 1942 was read, and President Lemmon ordered san placed o�n file. The City Engineer's Trial Balance for the month of March, 1942 was read and -President Lemmon ordered same placed on file. The report of expenditures from the City Engineer's payroll far the month of March, 1942, was read, and President Lemmon ordered same placed on file. A statement of expenditures and receipts in the Park Improvement Fund for the month of March 1942 was read, and upon motion by Fryer, second by Hanson, same was ordered placed on file. The r.eport of the Rochester Fire Department Relief Association fdr the period beginning January 1, 1941 and ended January 31,.1942, was read, and upon .mo.tion by Yaeger, second by Hanson, same -was accepted and ordered placed on file.f The annual report of the City Health Department was read and President Lemmon ordered that same be placed on file. The statement of business by the -People's Natural Gas Company as re- quired by Ordinance No: 320 for the year ended December 31,' 1941 was read, and upon motion by Hanson, second by Fryer, same was accepted and ordered placed on file. The report of the Clerk of the Municipal Court for the week ending April 4, 1942, showing criminal fines and posts collected $259.4 0, civil fees received $1.05, and conciliation court fees $6.00,• was read, and having been prev lously approved by the City Attorney, President Lemmon ordered that same be place on file. The Annual Report by t-he Board of Park Commissioner was read, and upon motion by Mrache.k, second,by Fryer, same was approved and ordered placed on file. The applications for "On Sale" Liquor licenses of the Eagles Club, Harry Dros6s, Jerry J. Reichert, Joe Daly, M.J.Donahue, Carl Mogen, Frances A. Meyer, G. .H. The following applications for license to operate a Pool Hall were each read: Roy C. Emerson (7 tables), Ben Sternberg (6 tables), Claude G. Darst (5 tables), Fred W. Oesterreich (9 tables), Harry Belmont (6 tables), and Harry Deitschman (5 tables). Upon motion by Fryer, second by Nass the licenses were granted. The applications of Lynn C: Chamberlain for license to operate a pop- corn and peanut wagon at the intersection of Broadway and Second Street Southeast and of Leonard V. Gilday for license to operate a popcorn vending wagon at the intersection of Third Street Southeast and Broadway, were each read, and upon motion by Hanson, second by Yaeger, the licenses were granted. The application of H. Dornack for license to connect with sewers and. drains was read, and upon motion by Mrachek, second by Nass, the license was granted. Upon motion by Hanson, second by Vass that the said resolution be adopted.as read, and all voting in favor thereof,.President Lemmon declared the said resolution duly passed and adopted. Mayor Grassle stated that during the year he appointed special police- men to serve in various locations in the City of Rochester. Heretofore. special policemen had not been required to furnish a surety bond, and the Mayor recommend( that each person appointed as a special policeman furnish a surety bond in the sum of $1000.00.Upon.motion by Mrachek, second by Hanson, the Mayor's recommenda- tion was approved. Mayor Grassle also stated that in the past Soft Drink Licenses had been lissued without the payment of any fee, and he recommended that a fee of at least lone dollar be charged for a license to sell Soft Drinks. Upon motion by Hanson, second by Fryer, the City Attorney was instructed Ito draw an amendment to the Soft Drink License Ordinance which would provide for. (the payment of a fee, the amount of which would be decided on by the.Common Coun- cil at the time the Ordinance was considered-. Mr. Hiram H. Joslyn, Manager of the Rochester Egg & Poultry Company,, appeared at the Council„meeting and stated that he had been notified by the Public Health & Welfare Department that he would have to discontinue dumping feathers in the City Dump Grounds. He stated that he had paid a fee to the Scavenger for e digging a trench and burying such feathers, and now was at a loss to know how to dispose of feathers in the future. President Lemmon reauested the Public Grounds Committee to take the matter up.with the Public Health -and Welfare Board and determine how the feathers could be disposed of.
