HomeMy WebLinkAbout04-13-1942572 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., Ap r i 1 13, 1942 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, -in the City Hall; in said City, on April 13, 1942. President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being Present: Lemmon,-Fryer, Hanson, Mrachek, Nass, Yaeger. lAbsent: Williams, due to illness. President Lemmon stated this as being the time and place set for re Iceiving and opening bids for the furnishing of a flusher tank and motor to replac the tank and motor now in use on the White Flusher. The bids of the Minneapolis Equipment Company in the sum of $2751.30, and Charles Olson & Song, Inc. in the sum of $3213.00 were received and opened. President Lemmon referred the -same to the City Engineer and the Common Council -as a Committee of the whole, for recommei, Idation. Mr. William Schacht, representing the Junior Chamber of Commerce, appeared before the Common Council and requested that an appropriation be made to the Junioa Chamber of Commerce for the furnishing of instrumental music on the streets of Rochester and at the Mayo Civic Auditorium during -the days of.the Gypsey Frolic, and upon motion by Hanson, second by Fryer, the sum of $150.00 was appropriated to the Junior Chamber of Commerce. - - I The appointment by the City Clerk of Wilbur R. Miller as City .Clerk's Stenographer and Clerk'of Registration, and Dagna Nordby as -City C1erk's.Second (Stenographer and Clerk of Registration, was read and upon motion by Mrachek, second by Fryer, the appointments were approved. The City Engineers appointment of Gerald Hutchins as Assistant City Engineer, Soren Olsen as First Assistant to the City Engineer, Anna M. Drews as Bookkeeper and Private Secretary, -and Herman P. Free as Mechanic; also John J. Cook as Chief Operator of the Sewage Disposal Plant and Edward Ranfranz and_ 'H.M.Persons as Assistant Operators at the Sewage'Dispos'al Plant, was read, and Jupon motion by Fryer, second by Yaeger, the appointments were approved. The recommendation of the City Engineer that each of the 19 mend authorized to be hired by him, work 2172 hours per year, with ten (10) days sick leave per year which shall be accumulative from year to year, was read, and upon motion by Fryer, second by Hanson, the recommendation was approved. A copy of a communication from A. C. Smith, City Engineer to Mr. J. G. Sullivan, Project Engineer for the Minnesota State Highway Department, requesting (the following changes in the Twelfth Street Southeast project was read: 1. Change width of cross -street openings from 32 feet to 36 feet, which was also requested and approved by the Common Council. RECORD OF OFFICIAL. Ap r i 1 13, 1942 573 2- Change curb plan from a battered face to a semi -straight face, same as was built on the South Broadway project. This will make it better for flushing and cleaning. 3. The special curbs to be placed between side- walks and gasoline service stations were not shown on the plans but were referred to in the agreement. -Refer to Section 3 (Part D) in Co-operative Agreement C 292. President Lemmon ordered the above mentioned communication placed on f ile. A communication from the C ity Engineer notifying the Council of the expiration of the Cit7's sand and gravel contract on March 31, 1942, was read and President Lemmon ordered same placed on file. The City Engineer's specifications for sand, gravel and crushed rock was read, and President Lemmon ordered same placed on file. A communication from the Board of Park Commissioners requesting that the Common Council appropriate funds for the payment o,f rental for the North Hall of the Mayo Civic Auditorium was read, and upon motion by Mrachek, second by Hanson, an amount covering the cost of opening the said North Hall was appropriat'I A letter from the War Production Board, Washington D.C. suggesting that requests, for preference rating be made before any contract, agreement, or pur- chase order is advertised, was read, and President Lemmon ordered that same be placed oh file. A report by'the Chief of Police that the Crawley & O'Neill Garage at 911 Seventh Avenue Southwest, had been closing at 10:00 o'clock P.M. was read, and upon motion by Mrachek, second by Fryer, the report was accepted and ordered placed on file. The collateral assignment of the Union National Bank was read, and President Lemmon ordered that same be placed on file. A letter from J. Norman Peterson, State Liquor Control Commissioner, stating that all "Off Sale" Liquor.li•censes had been approved, was read, and President Lemmon ordered same.placed on file. Beatrice Prather to construct a•private garage on the Southeast corner of the property at 1117 First Avenue. -Northeast, be not granted, but that she be given permission to construct a private garage building north -of her residence and within eighteen inches of the West line of the lot, was approved. Upon motion by Mrachek, second by Nass, the resignation of F.M.Feldman, M.D. as a member of the Board of Public Health & Welfare, was accepted. A petition by thirteen residents of Fourteenth Avenue Southwest, that additional street lighting be installed on the said avenue between Second Street (Southwest and Fourth Street Southwest, was read, and President Lemmon referred the matter to the Lighting Committee for report at the meeting of April 27, 1942. A petition bigned by fourteen residents of Fourteenth Avenue Southwest that the City post 020 M.P.H;" speed signs on the said Avenue between Second Strei Southwest and Sixth Street Southwest and that the thoroughfare be patrolled for the enforcement of the speed limit, was read, and upon motion by Mrachek, second by Hanson, the matter was referred to the Police Committee and the Chief of Polico Ifor recommendation at the meeting of April 27, 1942. A motion was made by Fryer, second by Hanson, that no action be taken on the construction of sidewalks in Krolow's Addiition,until the matter could be investigated by the Street .and Alley Committee and the City Engineer. Upon motion,by Hanson, second by Nass, the report of the Street and Alley Committee and, the City Engineer that the sidewalk on the West side of Sev- enth Avenue Southwest, between Fifth and Sixth Streets Southwest, will be re - (paired in the near future, was accepted and same was ordered place& on file. A petition by Electrical Contbactors of the City of Rochester urging that an Electrical Inspector be appointed for the ensuing year and that Paul T. Plantz be appointed to fill the position, was read, and same was ordered placed on file. A motion was made by Mrachek, second by Fryer, that no action be taken on the purchase of the flusher tank and motor until it is determined as to whethe: or not a priority rating for the purchase of same can be obtained. The reports of the Building and Plumbing Inspector for the month of March 1942 showing fees for building permits issued $21.00, and fees for plumbing permits issued $119.00, and of the Electrical Inspector for the month of March, 1942, showing fees for electrical permits issued $3.00, were read'and President temmon' referred same to the Finance Committee. The report of the Clerk of the Municipal Court for the week ending April 11, 1942 showing criminal fines and costs collected $97.40, civil fees received $13.65, and conciliation court fees $3.50, was read, and having been previously approved by the City Attorney, President Lemmon ordered that same be placed on file. The report of the Public Grounds Committee regarding the disposal of feathers was read, and upon motion by Mrachek, second by Fryer, same was accepted and ordered placed on file. The report of the Purchasing -Committee regarding the purchase of an Accounting Machine for use in the City Clerk's office was read, and upon motion by Mrachek, second by Yaeger the report was accepted and the purchase authorized. Upon motion by Yaeger, second by Nass, the recommendation of the Purchasing Committee that 1000 City Government Booklets be purchased from the Whiting Press, was approved. The applications of Phillips Petroleum Company for permits to place land maintain four signs and of Roy's• Grocery for permit to place and maintain one sign were -each read, and upon motion by Fryer, second by Yaeger, the permits were granted. " The applications for license to sell non -intoxicating Malt Liquors "Off Sale" of Albert Spiess, H. J. Wernecke, R. S.Plzak, E.W.Judd, and Donald Twenty - man were each read, and upon motion by Mrachek, second by Nass, the licenses•were granted. The application for license to sell non -intoxicating MaltLiquors "On Sale" of Donald Twentyman, was read, and upon motion by Hanson, second 'by Fryer, the license wasrgranted. The applications of Motbr Sales & Service and the Campbell Hotel for license to sell cigarettes at retail, were each read, and upon motion•by Yaeger, second by Nass, the licenses were granted. The applications of Eddie Johnson for license to operate one vending machine and John Hoffman to operate five vending machines were each read, and upon motion by Mrachek, second by Hanson, the licenses were granted. The application'of John H.' Engel for a Master Electrician's License was read, and upon motioh by Fryer, second by Yaeger,•same was referred to the License -Committee. Upon motion by Yaeger, second by Mrachek, the City Clerk was instructed to return the deposits of the applicants who were not granted a liquor license. Alderman Fryer introduced a resolution granting public dance permit to the Rochester Junior Chamber of Commerce, which was read. Upon motion by Fryer, second by'Nass that the said resolution be adopte as read, and all voting -in favor thereof, President Lemmon declared the said reso lution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $724.42 from the Street & Alley Fund and ordering payment made to the Street and Alley Fund for use of equipment during March, 1942, which was read. Upon motion by Hanson, second by Fryer that the said resolution be adopted as read, and all voting in favor -thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $441.00 from the Fire Protection Fund and ordering payment made to the Quaker Rubber Corporation for 500 feet fire hose, which was read. ` Upon motion by Yaeger, second by Hanson that the said resoltttion-be adopted as read,'and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adoptedl' Alderman Hanson introduced a resolution' accepting the City Engineer's specifications for sand, gravel and crushed rock and' ordering sealed bids for Isame to be received and opened at1 the meeting of April 27, 1942, at 7:30 o'clock d 1P.M., which was read. 580, RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY, OF ROCHESTER, MINN., April 13, 1942 Upon motion by Nass, second by Fryer that the said resolution be.adopted as read, and all voting in favor thereof, President Lemmon declared the said reso lution duly passed and adopted. Alderman Hanson introduced a resolution accepting the assignment of collateral of the Union National Bank and authorizing the City Treasurer to.execu the proper papers accepting the collateral, which was read. Upon motion by Mrachek, second by Yaeger that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $345.45 from the Fire Protection Fund and ordering payment made to the American LaFrance Foamite Corporation for floodlights and cable, which was read. Upon motion by Mrachek, second by Nass that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution approving the salaries to.be paid by the Public Utility Department for the year ending April 1, 1943, whi.ch was r ead. . Upon motion by Fryer, second by Zaager that the said resolution be opted as read, and all voting in favor thereof, President Lemmon declared the aid resolution duly passed and adopted. Alderman Mrachek introduced a resolution approving the appointments and alaxies -of the - employees of the Park Board, for the fiscal year of 1942, which as read. Upon motion by Fryer, second by Yaeger that the said resolution be dopted as read, and all voting in favor thereof, President Lemmon declared the aid resolution duly passed and adopted. Alderman Nass introduced a resolution fixing the salaries and approving ppointments of employees in the Public Health & Welfare Department for the fiscal ear of 1942, which was read. Upon motion by Hanson, second by Nass that the said resolution be adopted s read, and all voting in favor thereof, President Lemmon declared the said reso- ution duly passed and adopted. Alderman Nass introduced a resolution appropriating $455.00 from the Park. mprovement Fund and ordering payment made` to the Rochester Plumbing & Heating Co.. or contract work at Silver Lake, which was read. Upon motion by Yaeger, second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. An Ordinance amending an Ordinance entitled "An Ordinance regulating the sale of intoxicating liquor within the City of Rochester, providing for such sale) by duly licensed persons, establishing regulations for the operation of places where such intoxicating liquor is sold, providing regulations for the granting ofl such licenses, setting license fees, providing penalties for the violation thereo: and repealing all inconsistent ordinances. This is an emergency Ordinance ren- dered necessary for the preservation of the public peace, health and safety." was given its first reading. Upon motion by Mrachek, second by Hanson, and all voting in favor therei the rules were suspended and the Ordinance was given its second reading. Upon motion by Mrachek, second by Nass, and all voting in favor thereof, the rules were suspended and the.Ordinance was given its third and final reading.' Upon motion by Mrachek, second by Nass, and all voting in favor thereof, the Ordinance was adopted as read. An Ordinance amending an Ordinance entitled "An Ordinance relating to and providing for the licensing and regulation of the sale and disposal of soft drinks, near beers and other non -intoxicating liquors and beverages in the City of Rochester," was given its first reading. Upon motion.by Mrachek, second by Yaeger, and all voting in favor there- of, the rules were suspended and the Ordinance was given its second reading. Upon motion by Mrachek, second by Nags, and all voting in favor thereof, the rules were suspended and the Ordinance was given its third and final reading. Upon motion by Yaeger, second by Nass, and all voting in favor thereof, the Ordinance was adopted as read. Mayor Grassle recommended an inspection of all sidewalks at this time and that repairs and replacements be made where necessary. He also recommended that an Ordinance be drafted covering the replacement of paving or street re- surfacing where same had been torn up for the purpose of making connections to buildings. This matter was referred to the City Attorney, Mayor Grassle recommended that some provision be made to provide music lat the time when groups of.draftees are leaving for service. Upon motion by Mrachek, second by Fryer, the matter of repairing and iecorating the house at the City Dump Grounds, which was brought to the attention Df the Council by Alderman Hanson, was left in the hands of the Public grounds Committee with power to act. Upon motion by Hanson, second by Fryer, the City Attorney was instruc.te to draw a lease between Darrell Sanford, the dog catcher and scavenger, and the Welfare Board covering -the period of his term in office.
