Common Council of the_ City of Roch- jester, Minnesota, held in the Council Chambers, in the -City Hall, in said City, on j May 4, 1942. President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: Lemmon, Fryer, Hanson, Mrachek, Nass, Yaeger. jAbsent: Alderman Williams, due to illness. Upon notion by Fryer,. second by Yaeger, the minutes of the meeting of - (April 27th, 1942, were approved. Mrs. Louis.Reentz; representing the Women's Auxiliary of. the American Legion, and Mrs. John Lawler, representing.the Women's Auxiliary of the Veterans" - (of Foreign Wars, appeared before the Common Council and asked for permission to sell poppies on the streets -of Rochester o,n Saturday May 23, 1942, and -upon motio:r. by Fryer, second by Hanson, they were granted permission to sell poppies-asre- quested. Mrs. Lorraine Wentworth, owner of a vacant lot on the corner of Fourth Avenue and Eleventh Street Southeast, appeared before the Common Council and pro- tested the construction of a sidewalk in front of her property. President Lemmon referred the matt.er back to the Street and Alley Committee for report at the (meeting of May 19, 1942. A communication from the War Production Board notifying the Street and lAlley Department that their application for a preference rating •covering a new !tank and motor for the Mack Flusher, was disallowed, was read and President Lemmor jordered same placed on file. The Mayor's emergency order given to the City Clerk for the purchase of lone car load of gasoline was read, and upon motion by Fryer-, second by Mrachek, (the, said action was approved. _The report of the City Weighmaster.for.the month.of April, 1942, whowi 1306 private loads weighed and receipts of $30.60, was read and President Lemmon referred same to the Finance Committee. The reports of the Building and Plumbing Inspector for the.month.of (April, 192' , showing fees for building permits issued $126.00, and fees for plumb - ling permits issued $58.00, and of the Electrical Inspector for the month of April 11942, showing fees•£or-electrical permits issued.$18.50, were each read and Pres- lident Lemmon referred same to the Finance Committee. The report of expenditures from the City Engineer's payroll for the . lmonth of April, 1942, was read, and President Lemmon ordered same placed=on file. The report of the Police Committee and the. Chief of . Police that the speed limit,,in the City is set by State haw and cannot be reduced without permis- Ision from -the -State Highway Department, and that .they.are now attempting .to have 'the City speed limit changed from 30 miles per hour to a lower spp;ed, was read, and upon motion by Mrachek, second by Nass, the report was accepted and ordered 1placed on file. The report of the Finance Committee that they"have examined the reports of the Building -and Plumbing Inspector, the Electrical Inspector and the City Wei_ghmaster for the, month of March 1942;` and have found same to be correct, was read, and President Lemmon ordered same placed on file. recommendation The/xX?Emg:k of th.e Publiq Grounds Committee that Donald.G. Twentyman be granted a 20 foot driveway,on the.East line of the City Hog Farm, .South of the Highway, for as long'as the City Hog Farm is operated.by.the City of. The report of the Street and Alley Committee and the City Engineer that (the grading of boulevards on Second Street Southwest has been completed, was read (and President Lemmon ordered same placed on file. Th.e recommendation of the Street and Alley Committee and the City Engin eer,that an.Eaton Axle,be purchased for the Ford 'IV-S".at the approximate cost of $215.00 installed, was read, and upon motion by Na'ss, second by Hanson,, the (recommendation was accepted and -the matter referred to the Street and Alley Commis Itee..and the City Engineer with power .to act. The report of the Street and Alley Committee and the City Engineer that the matter regarding the hole next to the sidewalk by the. Norton Hotel on Second Street Southeast, has been referred to the Park Board, was read and President Lemmon.ordered same placed on file. The report of the Street and Alley Committee and the City Engineer that :Ilthe railing on the South Broadway Bridge had been investigated and the matter Ireferred to the State. Highway Department, was read, and upon motion by Mrachek, Isecond by Fryer,.the report was accepted and same was ordered placed on file. The recommendation of the Street and Alley Committee and the City Engi .e,er that.the,sidewalk on the South side of Third Street Southeast from Broadwayt East to the alley be paved with bituminous material, was read, and upon motion by Hanson, second by Nass the same was,.. -accepted and ordered placed on file, and the City Engineer was instructed to make the improvement and charge same to the prop- Ilerty owners. 5,9 2 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., May 4. 1942 The recommendation of the'Street And Alley Committee, City Attorney and the City Engineer that the claim of Russell Keefe in the amount of $29.45-for idamage to tires, be paid, was read and upon motion by Hanson, second by Mrachek, jthe recommendation was accepted.and 'same was ordered placed on file. The recommendation of the License Committee that Ordinance 4309 regard- ing Popcorn and Peanut Vending Wagons b,e amended to make the license transferrabl Ifor a fee of $5.00; was read and, upon motion by Mrachek, second by Yaeger, the 1recommendation was approved and;�the matter was referred to the City Attorney -to (draft said amendment. The recommendation of the Street and Alley Committee and the City Engin leer that all street openings shall be repaired by the City, and the contractors who have made these street openings be charged at the following prices, effectivel May 15, 1942, minimum fee to be paid at the time of issuance of permit was read:!, Oil Surfaced .25 cents per sq. ft.- or $3. 50 minimum. Asphalt .30 cents per sq. ft. or 4.00 u Concrete .45 cents per sq. ft. or 6. 50 Concrete Base -Asphalt .60 cents per sq. ft. or 9.00 Concrete Base -Brick .60:cents per sq. ft. or 9.00 Upon motion by Nass, second by Hanson, the above recommendation was approved and President Lemmon ordered same placed on file. - -A ruling submitted by Desmond B. Hunt, City Attorney, that the cost of the repairs to that certain space between the sidewalk and the curbing proper may be levied against the property or may be paid from the Street and Alley Fund, whatever the practice of the City has been in the past, was read; and upon motion by Mrachek,• second by Fryer, said ruling was accepted and ordered placed on file. The report of the Clerk of the Municipal Court for the week ending May 2, 1942, showing criminal fines and costs collected $210.35, civil fees re- ceived $7.40,.and conciliation court fees $3.25, was read, and having been prev- iously approved by the Ci-ty Attorney, President Lemmon ordered that same be place on file. The following claims were read, and upon motion by Yaeger, second by Fryer, the same were allowed and the Mayor and City Clerk were authorized and directed to draw warrants against the City Treasurer and make payments accordinglyj: From+the General Fund: Gust Bottke, $20.00; Jas. Alderman Fryer introduced a resolution granting a public dance permit Ito the Southern Minnesota Broadcasting Company, which was read. Upon motion by Fryer, second by Hanson that the.said resolution be. adoptedas read, and all voting in favor thereof, President Lemmo-n declared the said resolution duly passed and adopted. , Alderman Fryer introduced a resolution appropriating $259.25 from the (.General Fund and ordering payment made to H. H. Crawford and Peter P. Upon motion by Hanson, second by'Fryer that the said resolution be jadopted as read, and all voting in favor thereof, President Lemmon declared'the (said resolution duly passed and adopted. Alderman Mrachek introduced•a resolution appropriating $999.90 from the IGeneral Fund, $937.13 from the -Street & Alley Fund, and $150.50 from the Sewer (Fund and ordering payment made to the Street and Alley Fund f6r rise of -equipment Ifor April, 1942, which was read. • Upon motion by Mrachek, second by Yaeger that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adopted. - Alderman Nass introduced a resolution appropriating $646:25 from the Police Relief Fund and ordering payment made to Theo.H.Tollefson,.Treasurer, for transfer of funds,.which was read. Upon motion by -Fryer, second by Nass that the said resolution be adopted, as.read, and all voting in favor thereof, President Lemmon declared the -said reso- lution duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $395.00 from the (Licenses & Permits'Fund and ordering payment made to Fred W. Oesterreich for re - (fund of fee with application for On Sale -Liquor and On Sale 3.2 licenses, which Iwas.read. Upon motion -by Nass, second by -Fryer that the said resolution be ` jadopted as read, and all voting in favor thereof, President Lemmon+declared the said resolution duly passed and adopted. Alderman Hanson introduced a resolution appropriating.$500.09 from the Street and Alley Fund and $217.60 from the Sewer Fund and ordering -payment made Ito Morse Buos., for sand and gravel, which was read. Upon motion by Yaeger, second by Hanson that the said resolution be adopted as read, and'all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted.. ' Alderman Hanson introduced a resolution appropriating $2433.67 from the Park Improvement Fund and ordering payment made -to the Mayo Trust Fund for payroll for the last half of April, 1942, which was read. Upon motion by Hanson, second by Mrachek.that the said resolution be jadopted as read, and all voting in favor thereof, President Lemmon declared the Isaid•resolution duly passed and adopted. Upon motion by Fryer, second by Hanson, the payment of a sum not to exceed $500.00•was approved for Fire Works, upon receipt of an invoice for same. O'Connor, Louis A. Brunsting, Lester N. Fawcett, Walter M. Grabowski, Ralph B. Compton, Charles Baldwin, Herbert P. Thienell, and George E. Laack as special (policemen in the Parks of the City of Rochester, Minnesota, they to'serve without pay until the second'Monday in April, 1943, was approved. Mayor Grassle announced the appointment of P.F.Donovan as Weed Inspector for the ensuing year, and upon motion by Hanson, second by Nass, the Mayor's appoi ment was approved,'the Weed Inspector to work under the direction of the Board of Public Health and Welfare. Alderman Hanson, Chairman of the Fire Committee, recommended that the 1936 Chevrolet Pickup Truck now used by the Fire Department be exchanged for a 1937 Chevrolet Panel truck, and'a motion was made by Hanson, second by Mrachek, that the Fire Committee and the Fire Chief be authorized to make the exchange at la cost of $300.00. It was suggested that the doors at the City Warehouse, which now open across the sidewalk,'be changed to overhead doors, and the matter was ref.erred'to the Public Grounds Committee and the City Engineer for investigation and report. The matter of finishing the outside walls df the City Warehouse with stucco was brought to the attention of the Council. The City Engineer stated that he had received a quotation of $150.00 for the work. Upon motion by Fryer, second by Mrachek, the matter was referred to the Public Grounds Committee with power to act. Alderman Na'ss inquired as to whether or not it was advisable to employ a man at the Dump Grounder in Northeast Rochester, as most of the dumping at the present time is done on private property. A motion was made by Hanson, second by Yaeger, and all voting in favor thereof, that the services of Mr. Gust Bottke be discontinued on May 6, 1942, and the dumping of rubbish at this location be under the supervision of the Board of Public Health and Welfare from date of May-6,1942. The matter pertaining to the dumping of rubbish southeast of Tauer's Store between Fourth and Fifth Streets Southeast was discussed, and upon motion by Fryer, second by Hanson, same was referred to the Board of Public Health & Welfare Upon motion by Fryer, second by Hanson, the meeting was adjourned until 7: 30 o'clock P.M.
